Aggrieved by the order dated 28.08.2019 of Patna High Court in Cr.WJC No. 1238/2019 (Token
no.45078/2019) Pe oner has approached Supreme Court of India on 27.11.2019 with
M.A.D.NO.42652/2019 in W.P. (Crl) 136 of 2016 for direc on for Cons tu on Bench to decide the
cons tu onal validity of Ar cle 227 as Patna High Court has refused to register and admit the Cr.WJC
No. 1238/2019 (Token no.45078/2019 without adding Ar cle 227 while writ of cer orari is original
jurisdic on of High Court under Ar cle 226.
A er the se lement of the ma er by High Court of Delhi in 2013 the pe oners have approached
Supreme Court of India in the same ma er under Ar cle 32 of Cons tu on of India through W.P. (Crl)
136/2016 en tled Om Prakash and another VS State of Bihar and others to impeach the criminal
proceedings under 498A with N.B.W u/s 83 Cr .Pc. con nuing secretly under the judicature of Patna
High Court.
W.P (Crl) 136/2016 and R.P. (Crl) 825/2016 have been dismissed by Supreme Court of India with a
liberty to approach High Court. Cura ve pe on (Crl) D.NO. 41026/2016 has also been dismissed as
withdrawn. However, applica on for Cons tu on Bench Crl. M.P.D.NO.77878/2016 in W.P (Crl)
136/2016 has not been registered by Supreme Court of India ll date.
Pe oner no.02 Widow Srmt. Asha Rani Devi has succumbed to suspicious death on 11.11.2017
Pe oner has approached with a prayer to decide the cons tu onal validity of Ar cle 227 pointed out
by the registry of Patna High Court for registra on and admission of Cr. WJC No.1238 of 2019(Token
No.45078/2019) whereas Patna High Court has no jurisdic on to create a property dispute or to dilute
this ma er a er the se lement of the ma er by High Court of Delhi on 23.07.2013 in MAT.APPL.
7/2012 with NO COST and for quashing of 498A with N.B.W dated 08.09.2011 u/s 83 Cr.Pc in Criminal
Case Complaint (P) 5591/2013 at Begusarai court under the judicature of Patna High Court.
Prayer for direc on to the DGP Bihar to register F.I.R against state sponsored mob lynching of pe oner
Pe oner has persuaded the urgent processing of M.A.D.NO.42652/2019 over telephone dated
02.12.19, 09.12.19, 12.12.19 and through email dated 09.12.19, 10.12.19 with Registrar, Addi onal
Registrar, Assistant Registrar and Branch Officer of Supreme Court of India but did not receive any
sa sfactory reply.
Since 17 days have been lapsed from the date of filing of the case and the court will be closed for
winter break from 18.12.19 and pe oner is wai ng in hotel therefore pe oner is seeking
informa on from Registrar under RTI Act 2005
1. When the defects will be no fied in M.A. D.NO. 42652/2019 to the pe oner
2. When the M.A. D.NO. 42652/2019 in W.P. (Criminal) 136/2016 will be registered and listed before
the Honble the Chief Jus ce of India court for hearing
