представители группы пострадавших от действий Аэрофлот в
период предновогоднего авиаколлапса,
объединившей почти 1000 сторонников в интернете,
подадут претензии пассажиров к авиакомпании
17 февраля представители пассажиров, пострадавших во время
предновогодних задержек рейсов авиакомпании Аэрофлот, юрист Сергей
Литвинцев и адвокат Кристина Каменева, подают копии коллективных
претензий в компанию Аэрофлот в 17.00 в главном офисе авиакомпании.
Оригиналы претензий предварительно рассылались по почте каждым
пострадавшим: копии подаются единым «пакетом» с целью помочь
авиакомпании рассмотреть все претензии инициативной группы
коллективно и оперативно.
17 февраля будет передано не менее 600 копий претензий (6000
страниц). Претензии подаются от имени граждан России, ближнего и
дальнего зарубежья, пассажиров десятков рейсов ОАО «Аэрофлот»,
которые были задержаны в период с 25 по 31 декабря 2010 года.
Группа «Иск граждан против Аэрофлота» возникла в интернете – в
социальных сетях Facebook, ВКонтакте и блоге в Живом Журнале. Для того,
чтобы принять участие в группе, нужно заполнить он лайн анкету. По
состоянию на 16.02 к группе присоединились 960 человек.
Цели группы
- главная цель - подать коллективный иск в суд с едиными требованиями:
о компенсации морального вреда, о выплате 3% неустойки,
предусмотренной по Закону о защите прав потребителей, и о возмещении
понесенных (реальных) материальных убытков;
- привлечь внимание общественности к вреду, который причинила
компания ОАО «Аэрофлот» в период предновогодних задержек рейсов
своим пассажирам -- потребителям услуг, клиентам авиакомпании;
- оказать меры воздействия на авиакомпанию со стороны общественных и
государственных организаций, специализирующихся на защите прав
потребителей;

2. - проанализировать произошедшее и предложить авиакомпании набор
конструктивных стратегических и тактических рекомендаций по
разрешению кризисных ситуаций подобных коллапсу, произошедшему в
терминалах F и D в «Шереметьево» в 2010 году;
- предложить законодательные изменения в области повышения
ответственности авиаперевозчика перед пассажирами (сближение с
законодательством ЕС и международными конвенционными нормами).
Претензии и будущий коллективный иск сфокусированы
преимущественно на требовании компенсации морального вреда.
Это кажется наиболее важным требованием группы по следующим
причинам:
1. сотрудники Аэрофлота не делали обоснованных прогнозов
относительно времени возможного вылета с 25 по 30 января.
Многие рейсы переносились на 1-2-3-4 часа каждые 1-2-3-4
часа. Такое поведение авиаперевозчика заставило тысячи
пассажиров находиться в терминале по несколько суток: люди
надеялись на то, что вылет состоится в ближайшее время и по
этой причине не могли покинуть терминал, восстановить силы,
были вынужденны находиться в стрессовых условиях.
2. Аэрофлот не предоставлял информацию о причинах задержки
вылетов, не держал пассажиров в курсе происходящего.
Из-за долгого отсутствия диалога пассажиры теряли доверие к
перевозчику. По этой причине произошли столкновения
пассажиров с сотрудниками авиакомпании, давка, взятки
отдельных пассажиров с целью улететь «вне очереди», хаос.
3. Аэрофлот не предоставил условия, необходимые для долгого
пребывания в терминалах Шереметьево: условия для сна и
отдыха, питание для грудных детей и другие условия,
предусмотренные законом.
4. Все три причины выше едины и объединяют ситуации тысяч
пострадавших.
