5. Welcome to the 10th NASP Annual Conference. Since 2005,
NASP has hosted ten conferences in fi ve different cities. These
conferences add up to over one hundred different speaker
presentations, over 1,500 attendees and the publishing of
thousands of pages of educational material. We certainly have
come a long way over these ten conferences, and it’s a good
time to look back.
In typical NASP fashion, the fi rst conference came about
from a casual discussion among members. We recognized
that many of the new entrants to our industry did not know
the history of settlement purchasing and the genesis of
state and federal regulation. Our members knew that a
conference could bridge that gap in knowledge. With more enthusiasm than skill, NASP
quickly arranged for the fi rst meeting in Hollywood, Florida without realizing the folly
of hosting a conference in South Florida during the height of hurricane season.
Upon arriving at that fi rst conference, members were handed a binder weighing roughly
ten pounds that included all conference materials. NASP had no conference sponsors,
no CLE credits available, and only NASP members companies and their lawyers were
permitted to attend. Our fi rst attendees listened to discussions on the history of the
industry, issues in court approval, and the future of the marketplace. With the specter
of Hurricane Wilma bearing down on Broward County, Florida, many attendees elected
to cut their visit short. Despite the hurricane, everyone acknowledged that our fl edgling
conference was a success.
In looking back at that fi rst conference, we have come a long way. We enjoy a diverse
group of conference sponsors whose contributions have allowed us to raise the level of
conference experience for all attendees. We have electronic registration and materials,
CLE credits in many states, and we opened attendance to non-NASP members. While we
have improved the overall conference experience, we have retained what made that very
fi rst conference such a smashing success.
As I reviewed our 2005 materials, I noted that we had eleven speakers at that conference,
and eight of those speakers are presenting again this year. If you think that you know
the eight speakers who spoke in 2005 and 2014, make a point of searching me out this
year to let me know who they are.

John A. (Jack) Kelly is a partner in the McPherson Group LLP. He has extensive legislative and public policy experience
in structured fi nance and tax-related issues. He was the federal lobbyist for the legislative clarifi cation of tax issues
related to the transfer of structured settlements. In addition to federal advocacy, he coordinates the McPherson Group’s
state and local practice. A political aide to Presidents Reagan and George H.W. Bush, he previously served as a legislative
assistant to Rep. Charles B. Rangel (D-NY) and held staff positions in both the New York and federal courts. For 28 years
until his retirement, Kelly served in active and reserve components of the United States Army, including command of a
Special Forces unit. His awards and decorations include the Legion of Merit. He presently serves as chairman of the US
Advisory Committee on National Cemeteries and Memorials.

He formerly was general counsel for the Settlement Capital Corporation and a partner in Jackson Walker, LLP in Dallas,
Texas. Nesbitt takes a central role in NASP’s lobbying efforts, notably in the enactment of federal legislation governing

Peter Arnold founded Arnold Consulting Group in 1998 after more than 15 years of lobbying, White House and Capitol
Hill experience. Since then, he has served as executive director and spokesman for several major industry coalitions,
compiling a successful record in media advocacy and lobbying.
From 1995 to 2014, Peter was a consultant to the National Structured Settlements Trade Association, most recently
serving three years as NSSTA’s Deputy Executive Director. He was responsible for NSSTA’s media efforts and designed
its successful outreach to disability rights leaders and consumer advocates, enlisting their support to win passage of
favorable legislation for the structured settlement industry.
As executive director for a telecommunications industry coalition (2006-10), he managed a successful federal and
12-state lobbying and public relations campaign against broadband “neutrality” regulation.
He was also spokesman for a high-tech coalition’s successful effort to pass a federal Internet tax moratorium (1997-
99) and executive director for a cable television coalition that successfully opposed state and federal “open access”
broadband regulations (1999-2002).
In each capacity, he testifi ed before government legislatures and frequently appeared on television and radio.
Since 2008, Peter has been the Director of Media Services for Dawson & Associates, the nation’s premier Federal
environmental lobbying fi rm. Working with more than a dozen retired Generals from the U.S. Army Corps of
Engineers, Peter oversees the fi rm’s offerings in environmental crisis communication and grassroots advocacy.
A former White House speechwriter and Congressional press secretary, Peter ran his fi rst national media campaign from
1993 to 1995 as director of public affairs for UN-50 in New York, which organized the United Nations’ 50th anniversary.

Patrick Hindert is an attorney, author, educator and online journalist who resides in Warren County, Ohio and
specializes in structured settlements and personal injury settlement planning. Hindert is a member of the Ohio Bar
Association and the National Academy of Elder Law Attorneys (NAELA). He is a graduate of Harvard University and the
University of Michigan Law School.
Prior to entering the structured settlement industry in 1977, Hindert taught French and coached varsity tennis at
Cranbrook Academy in Bloomfi eld Hills, Michigan and practiced trust and estate law in Michigan and Ohio. In 1995,
Hindert served as Chairman of the Board of Directors of R.A. Jones, Inc., an international packaging machinery
company headquartered in Northern Kentucky. Hindert previously served as Managing Director of the Settlement
Services Group from 2009 to 2013 and currently is Managing Director for S2KM Limited.
Hindert has been a leader within the United States structured settlement industry since its inception. He co-founded
Benefi t Designs, Inc. in 1977 and developed it into a national structured settlement intermediary before selling the
company in 1998. Hindert has previously served as President of the National Structured Settlement Trade Association
(NSSTA) and Executive Director of the Society of Settlement Planners (SSP). The National Association of Settlement
Purchasers (NASP) honored Hindert as the 2012 recipient of its Alexander Hamilton award.
Hindert co-authors “Structured Settlements and Periodic Payment Judgments,” a legal treatise published in 1986 by Law
Journal Press and updated semi-annually. Both NSSTA and SSP feature “Structured Settlements and Periodic Payment
Judgments” in their certifi cation programs. Hindert also authors S2KM’s blog “Beyond Structured Settlements” and S2KM’s
public wikis including the “structured settlement wiki” and the “web 2.0 for lawyers wiki.”
Hindert appears frequently as a featured speaker at national conferences sponsored by professional associations
including: NSSTA, SSP, NASP, NAELA, the Academy of Special Needs Planners (ASNP), and the National Association of
Medicare Set-Aside Professionals (NAMSAP). Hindert was the keynote speaker at the fi rst national structured settlement
conference in Australia in 1994. Hindert has also provided expert testimony concerning structured settlements before
federal and state legislative committees including the United States House Ways and Means Committee.

promoting the expansion of the structured settlement industry into the nonqualifi ed assignment marketplace.
In 2002, Dan moved on to Allstate Life Structured Settlements. In addition to marketing all structured settlement
products, Dan focused on the development of new markets for their nonqualifi ed assignment product. He is
experienced in the use of nonqualifi ed assignment products for attorney fees, employment cases, property sales and
many other taxable transactions. In 2009, Dan also became the Senior Manager responsible for Operations with a
primary focus on the New Business unit that issued all annuity contracts and funding agreements for the Structured
Settlement Distribution channel. Additionally, Dan interacted weekly with the Product unit to develop prices that met
Allstate’s profi t margin and return goals.
Dan is a Past President (2009-2010) of the National Structured Settlements Trade Association (NSSTA). Prior to joining
the NSSTA Board of Directors in 2008, Dan co-chaired the NSSTA Marketing/PR Committee, working with other NSSTA
members and the Board on strategies to promote our industry’s products.

Mr. Hillman was a pioneer in the secondary market for structured settlements. He was instrumental in bringing to the
capital markets the fi rst fi nancing (securitization) of structured settlement payment streams and advising companies
entering into the advance funding markets de novo. Mr. Hillman was a primary negotiator of the compromise
between the National Structured Settlement Trade Association (“NSSTA”) and the National Association of Settlement
Purchasers (“NASP”) that resulted in federal and state legislation to foster the orderly and consumer protective transfer
of structured settlement payments. He was a partner in a large Philadelphia based AV rated law fi rm and a general
counsel at NASP member compsnies and banks, and specialized in corporate and fi nancing transactions and fi nancial
institution regulatory compliance issues (consumer and commercial). Mr. Hillman has a Bachelor of Arts Degree from
The American University, Washington. D.C. and a Juris Doctorate from Temple University School of Law, Philadelphia,
Pennsylvania. He is a member of the Pennsylavania Bar and is a FL Authorized House Counsel. He is a frequent lecturer

Michael Fasano began his career in 1972 at the White House Offi ce of Management and Budget, where he served
as Senior Budget Examiner until 1976. From 1976 until 1983, Mr. Fasano served as Investment Advisor to General
Investment Funds, a pension management group with $2 billion in assets under management. In 1983 Mr. Fasano was
appointed Executive Vice President of Trans-General Life Insurance Company, and in 1986 he was named President. Mr.
Fasano served as President and CEO of Trans-General until 1990, when he started Fasano Associates.
Mr. Fasano now serves as President of Fasano Associates, with primary responsibility for directing the fi rm’s

County Circuit Court Judge since 1994. Kenton County
has the third largest caseload in the Commonwealth of
Kentucky. She is a 1979 graduate of Chase College of
Law. Her private practice included real estate, zoning,
municipal, probate, personal injury, and family law. She
currently serves as Chief Circuit Judge. She has been
active with local and state bar committees and groups
