Ernesto Arturo Miranda was arrested for armed robbery. He later confessed to raping an 18 year old girl without being told his rights, as in being able to have an attorney. He  served 11 years in prison and was let on parole in 1972. Later he died in 1976 during a bar fight. Ernesto was 34 years old
The plaintiff argued that the police didn’t give Ernesto Miranda his rights (the 14 th  Amendment)
This is about the 5, 6, and 14 TH  Amendment. The 5 TH  Amendment is guarantees that no one may be deprived, liberty, or property without due process of law. The 6 TH  Amendment is guarantees the right to a trial by jury in criminal cases. The 14 Th  Amendment is citizenship and civil rights.
The state argued, however, that because Miranda had been convicted of a crime in the past, he must have been aware of his rights. The Arizona Supreme Court denied Miranda’s appeal and upheld his conviction.
