from an owner that is not a US citizen or a
US residentAlien then you may be subject
to F.I.R.P.T.A. Tax. In Arizona on the Ari-
zona Residential Real Estate Contract you
will find a section in the contract that reads:
“SelleragreestocomplywiththeIRSreport-
ing requirements. If applicable, seller agrees
to complete, sign, and deliver to Escrow
Company a certificate indicating whether
thesellerisaforeignpersonoranonresident
alien pursuant to the Foreign Investment in
Real Property Tax Act (“FIRPTA”). Buyer
and seller acknowledge that if the seller is a
foreign person, the buyer must withhold tax
equalto10%ofthepurchaseprice,unlessan
exemptionapplies.”
Nowthat10%wouldbeduetotheIRSwith-
in 20 days of closing. The only way around
thatwouldbeifPRIORtoclosingtheIRSre-
ceivesallthedocumentationnecessarytore-
view for request of a withholding certificate.
A withholding certificate would be issued
only if the IRS feels there is no tax liability,
example of this would be due to loss at sale.
Otherwise if that money is not in the IRS’s
hands on that 20th day there will be penal-
ties and late fees added to the 10%. This is
really a very costly oversight if it is not dis-
closedand handled properly. Another way
toavoidthistaxwithholdingwouldbeifone
oftheTenExemptionstowithholdingapply.
Otherwise you must follow the IRS guide-
lines in paying this tax. Your best resource
shouldyoufindyourselfinasituationwhere
you have to address FIRPTA tax is the IRS
web page www.IRS.gov. All the informa-
tion and forms are right at your finger tips
and they come with detailed instructions.

Owning property is very
important, and when you
deal with someone who is
going to help you buy or sell
property, find someone that
knowswhatthey’redoing. If
you use the phone book and
chooseaRealtorfromtheyellowpages,
you probably couldn’t make a better
decision than if you used the telephone
book to choose a brain surgeon.
When you tell anyone that you want to
purchase a house, you will be surprised
at the number of real estate people who
want to represent you. Agents come
out of the thin air. You won’t have
to concern yourself too much about
finding an agent, you do need to worry
about finding the RIGHT ONE.
The most important thing when
either buying or selling a home is to
select the right real estate agent, but
people usually go about it backwards.
They should first select the real estate
agent, one who will understand what
they need (buying or selling) and can
navigate the system for them.
Advertising is designed to make the
brokers’ and agents’ phones ring.
Typically, no one buys the house they
called for, but from that point on,
they’re joined at the hip with a real
estate agent. They don’t know anything
about whether they are good, bad or
indifferent or new to the business..
You should make inquiries before
you sign with an agent or broker.
Commissions are usually substantial,
so some real estate agents will try to
sell you anything. They’ll tell you every
house is the best house they’ve ever
seen, every room is the prettiest, your
kids are going to love it, and your dog
is going to bark nicely. They’ll tell you
anything, OUCH! (never at M&DP)
If you’re selling your property:
Your property may be the most
valuable thing you own and it is of
utmost importance to find an agent
you can trust!
A real estate agent has a high fiduciary
duty -- a duty of trust, loyalty and
confidence. It is the most important
duty of any sales person or broker in
real estate.
Choose the broker or real estate
agency first, then ask the agency to
recommend a couple of their best
agents. Then stick with him/her. If
you see a house for sale and call the
agent listed on the sign, that agent’s first
concern will be representing the seller,
not you, the buyer. Sometimes the
broker is associated with a franchise.
If you select a franchised broker, But
beware. You aren’t guaranteed a great
agent just because you selected a well-
knownrealestatefranchise.Youshould
select a firm based on that office’s
reputation -- not the reputation of the
national firm.
Consider choosing an agent who is a
Realtor. In addition to being licensed
by the state to sell real estate, Realtors
belong to the National Association of
RealtorsandmustabidebyastrictCode
of Ethics. The National Association of
Realtors has a code of ethics that will
knock your socks off, and they are very
strict in dealing with people who don’t
abide by them.
Choose an agent that handles homes
in your price range and area.
Choose an agent who listens to your
needs and takes the time to explain
things you might not understand.
Choose an agent who works on your
time schedule.
Choose an agent who can and
will provide other services such as
referring you to financial institutions
and building contractors.

INGREDIENTS:
1 pound white flaky fish, such as mahi
mahi or orata
1/4 cup canola oil
1 lime, juiced
1 tblspns ancho chili powder
1 jalapeno, coarsely chopped
1/4 cup chopped fresh cilantro leaves
8 flour tortillas
GARNISH:
Shredded white cabbage
Hot sauce
Crema or sour cream
Thinly sliced red onion
Thinly sliced green onion
Chopped cilantro leaves
Pureed Tomato Salsa
DIRECTIONS:
Preheat grill to medium-high heat.
Place fish in a medium size dish.
Whisk together the oil, lime juice,
ancho, jalapeno, and cilantro and
pour over the fish. Let marinate for
15 to 20 minutes.
Remove the fish from the marinade
place onto a hot grill, flesh side
down. Grill the fish for 4 minutes
on the first side and then flip for 30
seconds and remove. Let rest for 5
minutes then flake the fish with a
fork.
Place the tortillas on the grill and grill
for 20 seconds. Divide the fish among
the tortillas and garnish with any or
all of the garnishes.

Pulled pork (recipe below) 1 cup pico de gollo
1 cup block bean puree 1 cup sour cream
(recipe below) 8 oz. jock cheese
12 corn tortillas, fried 4 sprigs cilantro
1 cup guacamole
PULLED PORK
Ingredients:
2 oz. applewood chips 2 cloves garlic. whole
(soaked in water for 1 shallot, whole
30 minutes) 5 sprigs thyme
2 lbs. pork butt I bay leaf
To taste salt and pepper 1/2 cup light beer
I carrot, diced 1 cup orange juice
1 sweet onion, diced
Prepare the Pulled Pork:
Preheat oven to 275 degrees. Season the pork butt with salt and pepper. Using a stove-top
smoker on high heat. place the soaked wood chips in the bottom of the pan. Place the pork
on the rack, cover and smoke for 30 minutes. In a saute pan, saute the carrots, onion,
garlic and shallot until soft. Add the beer and orange juice and bring to a simmer.
Place the smoked pork butt into a braising pan and cover with the onion mixture. Add the
bay leaf and thyme. Cover with aluminum foil and cook for four hours. Remove from the
oven. allow to cool and shred the pork. Pour some of the braising liquid on the pork to
keep it moist.
BLACK BEAN PUREE
Ingredients:
1/2 lb. dry black beans 1 tsp. cumin
preferred (or one con) 1 jolopeno, diced
1 red onion, diced To taste salt and pepper
1 bunch cilantro
Prepare the Black Bean Puree:
Place the black beans in a container and cover with water. Soak overnight. Remove the
beans from the water and place in a large pot. Cover
with fresh water. Add the onion. cilantro, cumin, jala-
peno and a little salt. Cook until the beans are tender.
Using a hand-held mixer, puree the beans until they
are smooth. Season with salt and pepper.
On the bottom of the plate, make a round circle of
the black bean puree. Driule sour cream across the
plate. Starting with the crispy corn tortilla, spread the
guacamole on it. Place pork on top and sprinkle with
the jock cheese and pico de gallo. Repeat with two
more tortillas. Stack all three tortillas one on top of
the other, and place in the center of the plate. Garnish
with more cheese, pico de gallo and a cilantro sprig.
