c) any other reference lacks the quality of perfection of the proofs of the Qur’an and Sunnah.

Indeed the best speech is the speech of Allaah and the best guidance is that of Muhammad (sallallaahu alayhi wassallam) and the worst of affairs are the newly invented matters in the religion, for every newly invented matter is an innovation and every innovation is misguidance and all misguidance is in the hellfire. 13. DO NOT APPROACH THEM UNTIL
THEY ARE CLEAN
Quran 2:222 They ask thee
concerning women's menstruation.
Say: that is Adha (a harmful thing for
a husband to have a sexual
intercourse with his wife while she
is having her menses) therefore keep
away from women during menses
and do not approach them until they
are clean (from menses and have
taken a bath).
But when they have purified
themselves you may approach
them in any manner time or
place ordained for you by
Allah. For Allah loves those
who turn to Him constantly
and He loves those who keep
themselves pure and clean.
14. DO SOME GOOD ACT FOR YOUR
SOULS?
• Quran 2:223 Your wives are as a
tilth unto you; so approach your tilth
when or how ye will. But do some
good act for your souls beforehand;
and fear Allah and know that ye are
to meet Him (in the Hereafter) and
give (these) good tidings to those
who believe.
15. Quran 2:224 And make not Allah's
(name) an excuse in your oaths
against doing good or acting
rightly or making peace
between persons; for Allah is
one who hear and knows all
things.
16. Quran 2:225 Allah will not call you
to account for thoughtlessness
in your oaths but for the
intention in your hearts; and He
is Oft-Forgiving Most
Forbearing.
17. • Quran 2:226 For those who take an
oath for abstention from their
wives a waiting for four months
is ordained;
• if then they return Allah is Oft-
Forgiving Most Merciful.
• Quran 2:227 But if their intention is
firm for divorce Allah heareth
and knoweth all things.
18. Ibn 'Umar used to say about the
Al-Ila (means the oath taken by a
husband that he would not
approach his wife for a certain
period) which Allah defined (in
the Holy Book),
“If the period of Al-Ila expires,
then the husband has either
to retain his wife in a
handsome manner or to
divorce her as Allah has
ordered”. (Sahi Al-Bukhari V-7 H. No. 213)
19. • Ibn 'Umar added, "When the
period of four months has
expired, the husband should
divorce his wife, but the divorce
does not occur unless the
husband himself declares it. (Sahi
Al-Bukhari V-7 H. No. 213)
20. A DIVORCE IS ONLY PERMISSIBLE
TWICE
• Quran 2:229 A divorce is only permissible
twice: after that the parties should
either hold together on equitable terms
or separate with kindness.
• It is not lawful for you (men) to take
back any of your gifts (from your wives)
except when both parties fear that they
would be unable to keep the limits
ordained by Allah.
21. Quran 2:229 Then if you do indeed fear
that they would not be able to keep
the limits ordained by Allah, then
there is no sin on either of them if
she gives back (the Mahr or a part of
it) something for her freedom.
These are the limits ordained by
Allah; so do not transgress them. If
any do transgress the limits ordained
by Allah such persons wrong
(themselves as well as others).
22. DIVORCES HIS WIFE IN THE THIRD
TIME
• Quran 2;230 And if he has divorced her
(in the third time), then she is not
lawful unto him thereafter until she
has married another husband.
• Then, if the other husband divorces
her, it is no sin on both of them if they
reunite, provided they feel that they
can keep the limits ordained by Allah.
Such are the limits ordained by Allah
which He makes plain for the people
who have knowledge.
•
EITHER TAKE THEM BACK OR SET
THEM FREE
When you divorce women and they
fulfill the term of their prescribe
period (`Iddat) either take them back
on equitable terms or set them free
on equitable terms;
but do not take them back to injure
them or to take undue advantage; if
anyone does that He wrongs his own
soul.
Do not treat Allah's Signs as a
jest but solemnly rehearse
Allah's favors on you and the fact
that He sent down to you the
Book and Wisdom for your
instruction. And fear Allah and
know that Allah is well
acquainted with all things. Quran
2:231
23. DO NOT PREVENT THEM FROM THEIR
(FORMER) HUSBANDS
Quran 232 When ye divorce women
and they fulfil the term of their
(`Iddat) do not prevent them from
marrying their (former) husbands if
they mutually agree on equitable
terms.
This instruction is for all amongst you
who believe in Allah and the Last Day.
That is (the course making for) most
virtue and purity amongst you and
Allah knows and you know not.
24. ALLAH FORBADE “TAHLIL” TAHLLIL TO
MAKE HALLAL THE HARAM
• Example: Tries to arrange a
marriage between his divorce wife
and another man;
• Something a remorseful husband,
after divorcing his wife three times,
tries to arrange a marriage between
his divorce wife and another man on
the condition that the second
husband will divorce her within a
few days, preferably the very next
day. (Al-Kaba’r p.147)
25. “THE MUHALLIL AND THE MUHALLAL-
LAHU”
• Muhallil (the second husband, the
one who agree): The man who is
willing to do something Halal
(permissible). Marrying a divorced
woman in order to make her lawful
for her first husband.
• Muhallal-lahu (the first husband): the
one for whom it is made Halal
(permissible). (Al-Kaba’r p.147
THEY BOTH CURSE BY ALLAH
Ibn. Mas’ood reported Allah’s
messenger as saying: the
Muhallil and the Muhallal-lahu
are both curse by Allah.
26. MARRIAGE IS BASED ON
ATTRACTION
•Ibn. Abbas reported that when the
Prophet was asked the Muhallil, he
replied: Marriage is base on
attraction and not on deception.
The book of Allah (swt) is not to be
made light of. Both should taste
sexual intercourse, (with the
intention of remaining in the
marriage permanently). (Al-Kaba’r p.
147)
27. HE NEITHER ASKED ME TO DO IT
Ibn. Umar reported that a man
asked him: what would you say if
I married a woman to make her
lawful for her divorce husband,
although he neither asked me to
do it nor knew about it? Ibn.
Umar replied: not allowed! (Al-Kaba’r
p. 147)
28. I SHALL PUNISH THEM BY
STONING TO DEATH
• Ibn. Mundhir reported Umar bin Al-
Khatab as saying [during his
caliphat]: If I come across any
Muhallil and Muhallal-lahu, I shall
punish them by stoning to death.
• And when Umar bin Al-Khatab was
asked about “Tahlil” he replied: that
is “Adultery”. (A-Kaba’r p. 148)
29. BOTH ADULTERERS EVEN IF THEY
LIVE TWENTY YEARS
• Abdullah bin Shareek Ameri reported
that Ibn. Umar was asked for a ruling
on the following situation: a man
who was married to his cousin
divorce her irrevocably (for the 3rd
time), but was then sorry for it and
wanted to remarry her. Another man
had come forward to do “Tahlil” for
him.
Ibn Umar then replied: both will
be adulterers, even if they live
together for twenty years, as
long as he married her for the
sake of making her lawful for her
previous husband. (Al-Kaba’r p148)
30. LEAVE WIDOWS BEHIND
• Quran 2:234 If any of you die and
leave widows behind they shall wait
concerning themselves four months
and ten days: when they have
fulfilled their term there is no blame
on you if they dispose of themselves
in a just and reasonable manner.
And Allah is well acquainted with
what you do.
31. Quran 2:235 There is no blame on
you if ye make an offer of
betrothal (kasunduang
pagpapakasal) or hold it in your
hearts.
Allah knows that ye cherish them
in your hearts:
but do not make a secret contract
with them except in terms honorable
nor resolve on the tie of marriage till
the term prescribed is fulfilled.
And know that Allah knoweth what is
in your hearts and take heed of Him;
and know that Allah is Oft Forgiving
Most Forbearing. Q. 2:235
32. DIVORCE WOMEN BEFORE
CONSUMMATION OR THE FIXATION
OF THEIR DOWER
Quran 2:236 There is no blame on you if
ye divorce women before
consummation or the fixation of their
dower; but bestow on them (a suitable
gift) the wealthy according to his
means and the poor according to his
means; a gift of a reasonable amount
is due from those who wish to do the
right thing.
DIVORCE THEM BEFORE CONSUMMATION
BUT AFTER THE FIXATION OF A DOWER
Quran 2:237 And if ye divorce
them before consummation but
after the fixation of a dower for
them then the half of the dower
(is due to them) unless they
remit it.
Or (the man's half) is remitted by him
in whose hands is the marriage tie;
and the remission (of the man's half)
is the nearest to righteousness.
And do not forget liberality between
yourselves. For Allah sees well all
that you do.
33. THOSE OF YOU WHO DIE AND LEAVE
WIDOWS
• Quran 2:240 Those of you who are
about to die and leave behind them
wives should bequeath (gumawa ng
huling habilin) for their widows a
year's maintenance and residence;
but if they leave (the residence)
there is no blame on you for what
they do with themselves provided it
is reasonable and Allah is Exalted in
Power Wise.
FOR DIVORCED WOMEN
MAINTENANCE
For divorced women maintenance
(should be provided) on a reasonable
(scale). This is a duty on the
righteous. Quran 2:241
Thus doth Allah make clear His Signs
to you: in order that you may
understand. Quran 2:242
34. MARRY WOMEN OF YOUR CHOICE
TWO OR THREE OR FOUR
Quran 4:3 If you fear that ye shall not
be able to deal justly with the orphans
marry women of your choice two or
three or four; but if you fear that you
shall not be able to deal justly (with
them) then only one or (a slaves) that
your right hands possess. That will be
more suitable to prevent you from
doing injustice.
AND GIVE THE WOMEN (ON
MARRIAGE) THEIR DOWER AS A FREE
GIFT
Quran 4:4 And give the women (on
marriage) their dower as a free
gift; but if they of their own good
pleasure remit any part of it to
you take it and enjoy it with right
good cheer.
FEED AND CLOTHE THEM
THEREWITH
Quran 4:5 To those weak of
understanding make not over your
property which Allah hath made a
means of support for you but feed
and clothe them therewith and
speak to them words of kindness
and justice.
35. THE QURAN THE ONLY HOLY
BOOK TO SAY MUCH BETTER TO
MARRY ONLY ONE!
Quran 4:3 If you fear that ye shall
not be able to deal justly with the
orphans marry women of your
choice two or three or four; but if
you fear that you shall not be able
to deal justly (with them) then
only one or (a slaves) that your
right hands possess. That will be
more suitable to prevent you from
doing injustice.
