3. In a 1999 Pepsi advertisement for a points program, a
youngster appears in a Harrier jump aircraft and displays
the words “HARRIER FIGHTER 7,000,000 PEPSI POINTS.”
A 21-year-old with initiative noticed that points could be
purchased for 10 cents each and wrote a check for
$700,085.00 to acquire the necessary 7,000,000 points.
He sued Pepsi for breach of contract because they
wouldn’t allow him to claim a plane valued at about $23
million.

4. Unfortunately, Leonard’s claim was denied because no
one could legitimately consider the offer made in the
advertisement. With statements like “the callow
adolescent shown in the commercial is a highly
implausible pilot, one who could scarcely be trusted with
the keys to his parents’ automobile, much less the prized
aircraft of the United States Marine Corps,” the court’s
observations, however, are a fantastic source of deadpan
humor.
