The City of Alamo Heights Community Development Services Department submitted a memorandum to the Mayor and City Council regarding a request for the compatibility review of a proposed new single-family residence and detached accessory structure at 164 Oakview E. The Architectural Review Board voted unanimously to recommend approval of the design. The City Council then tabled the case to their September 13th meeting. Neighbors have expressed concerns about privacy, safety issues from the vacant lot, and the proposed design not fitting with the neighborhood.

Demolition of the previous structure was approved by ARB and City Council in April and May 2019, respectively. Previous plans for a new single-family structure were approved in late 2019. The City Council heard the request at their August 23, 2021 meeting and voted to table the case for September 13, 2021. FISCAL IMPACT No projected fiscal impact from this project has been calculated. My below response was sent in for the previous meeting about a month ago. My thoughts on the situation at 164 e oakview have not changed. Currently my family and I reside at 160 . My wife and I have the following concerns regarding this proposal... Approximately 2 years ago this property had another building proposal that was brought to the city. This proposal was going to maintain the front facade of the previous house and was going to be a 1 story dwelling. The previous design was also going to maintain the style of the neighborhood. The new proposal is for a 2-story house with a very modern design. Having a 2-story house next to two 1-story houses makes it very difficult to have any privacy in your house and in your backyard. This new proposal has windows on the west side of the house that will be facing directly into our master bathroom. We also made a very large investment into our backyard space and a 2-story home is going to provide very little privacy. The modern style of this proposal also doesn’t fit with the design of the majority of the other homes on this street. This property has been an eye sore for the past 2 years and the city has done very little if anything to fix the situation as multiple emails and phone calls from concerned residents were made. This property has been unsafe for children in the area as it was not properly demolished nor secured until just recently. This property has cost my family thousands of dollars in pest control bills (as the property has been a haven for rodents) and has affected property values for the entire street. This owner also owns another property a couple of doors down from us and it’s the same story...an unfinished project for over 2 years that is an eye sore, a safety hazard, and has affected home values. We most definitely want a home built on that property and look forward to having new neighbors. We would strongly ask that the builders consider a single story home, a style that fits with the rest of the neighborhood, and a project that has a reasonable timeline. Thanks for your time. We’ve lived on the 100 block of E Oakview for almost 10 years, and these two lots have been nothing but frustrating eyesores. Most importantly, we have many children who are out playing, running & biking from house to house, and these construction sites pose a serious safety threat. We ask the council to please relinquish this “developer’s” opportunity to go forward with these projects, as we have no confidence any progress will ever be made. I use quotations around the word developer since very little has actually been developed on these lots. With the housing boom currently happening in our neighborhood, I would bet that there are many, well qualified people who would love to build a beautiful home and join this close knit group of neighbors. It’s time to give someone else the opportunity. Dear City Council Members: I write in opposition to the proposed new spec house build at 164 E. Oakview. I live just a few hoiLses down on E. Oakview. Please deny the application. I have spoken to a couple of you about this project and voiced my concerns. For those of you who are unaware of the history of this spec house, I will provide a bit of background. This is the builder’s third attempt at a project on E. Oakview. This builder attempted aprior flip house project at 164 E. Ojkview—the site of the curret proposed spec house. He partially demolished the Fouse in 2019, and left it as a partially demolished eyesore for two years. The hard money lender foreclosed on the property this spring. The builder bought the property back from the hard money lender after foreclosure, and is now asking for the City’s approval to take another shot at it. In addition, this same builder attempted second spec house right across the street at 173 E. Oakview. Work went in fits and starts for two years. The hard money lender foreclosed on 173 E. Dakview this spring. Litigation is ongoing, and the builder has filed a lis pendens. Meanwhile, the partially constructed house now sits abandoned behind a construction fence, and will remain such for who knows how long. It is a blight on the neighborhood. Given the facts, I have no reason to believe the builder has the ability to actually complete the proposed project. He has tried twice, and both attempts have ended in foreclosure. He’s given the neighbors a partially demolished house that blighted the neighborhood for two years. He’s also given the neighbors the partially built, now abandoned spec house at 173 E. Oakview which he has tied up in litigation. Enough is enough. I can only go on this builder’s dismal track record of failed projects on my street, and I cannot imagine the proposed project will be any different. My neighbors and I have had to endure the endless nuisance and nonsense of 164 E. Oakview and 173 E. Oakview for the past 2+ years. Council approval of the proposed spec house project guarantees we will be subjected to yet another nuisance and eyesore for years to come. Do not allow this builder to do this yet again. I can only go on this builder’s dismal track record of failed projects on my street, and I cannot imagine the proposed project will be any different. My neighbors and I have had to endure the endless nuisance and nonsense of 164 E. Oakview and 173 E. Oakview for the past 2+ years. Council approval of the proposed spec house project guarantees we will be subjected to yet another nuisance and eyesore for years to come. Do not alLow this builder to do this yet again. I know we stand together as Oakview neighbors to preserve and uphold the city ordinances and we would expect no less from developers. We do not believe they will maintain high standards in maintenance and development that are expected of the AH community- the builder’s history has proven this. I would hope that the city council would like to ensure the upkeep of our beautiful community; however with the approval of this new build, it would be evident that this is not a priority by the city. I have spoken to a couple of you about this project and voiced my concerns. For those of you who are unaware of the history of this spec house, I will provide a bit of background. This is the builder’s third attempt at a project on E. Oakview. This builder attempted a prior flip house project at 164 E. Oakview — the site of the current proposed spec house. He partially demolished the house in 2019, and left it as a partially demolished eyesore for two years. The hard money lender foreclosed on the property this spring. The builder bought the property back from the hard money lender after foreclosure, and is now asking for the City’s approval to take another shot at it. In addition, this same builder attempted a second spec house right across the street at 173 E. Oakview. Work went in fits and starts for two years. The hard money lender foreclosed on 173 E. Oakview this spring. Litigation is ongoing, and the builder has filed a lis pendens. Meanwhile, the partially constructed house now sits abandoned behind a construction fence, and will remain such for who knows how long. Given the facts, I have no reason to believe the builder has the ability to actually complete the proposed project. He has tried twice, and both attempts have ended in foreclosure. He’s given the neighbors a partially demolished house that blighted the neighborhood for two years. He’s also given the neighbors the aftiaIIy built, now abandoned spec house at 173 E. Oakview which he has tied up in litigation. Enough is enough. I can only go on this builder’s dismal track record of failed projects on my street, and I cannot imagine the proposed project will be any different. My neighbors and I have had to endure the endless nuisance and nonsense of 164 E. Oakview and 173 E. Oakview for the past 2+ years. Council approval of the proposed spec house project guarantees we will be subjected to yet another nuisance and eyesore for years to come. Do not allow this builder to do this yet again. Please ask yourself: How would you feel if this was happening on your street? Please do not allow this on our street. Do not allow this builder to start yet another project here — especially when the abandoned hulk of his last failed project still looms across the street, as a decaying reminder of his inability to finish a project, and a reminder of his complete disrespect for the neighborhood. I hope the City will stand with the neighbors and support the citizens of Alamo Heights, and deny this application. I can only go on this builder’s dismal track record of failed projects on my street, and I cannot imagine the proposed project will be any different. My neighbors and I have had to endure the endless nuisance and nonsense of 164 E. Oakview and 173 E. Oakview for the past 2+ years. Council approval of the proposed spec house project guarantees we will be subjected to yet another nuisance and eyesore for years to come. Do not allow this builder to do this yet again. Please ask yourself: How would you feel if this was happening on your street? Please do not allow this on our street. Do not allow this builder to start yet another project here — especially when the abandoned hulk of his last failed project still looms across the street, as a decaying reminder of his inability to finish a project, and a reminder of his complete disrespect for the neighborhood. I hope the City will stand with the neighbors and support the citizens of Alamo Heights, and deny this application. My below response was sent in for the previous meeting about a month ago. My thoughts on the situation at 164 e oakview have not changed. Currently my family and I reside at 160 . My wife and I have the following concerns regarding this proposal... Approximately 2 years ago this property had another building proposal that was brought to the city. This proposal was going to maintain the front facade of the previous house and was going to be a 1 story dwelling. The previous design was also going to maintain the style of the neighborhood. The new proposal is for a 2-story house with a very modern design. Having a 2-story house next to two 1-story houses makes it very difficult to have any privacy in your house and in your backyard. This new proposal has windows on the west side of the house that will be facing directly into our master bathroom. We also made a very large investment into our backyard space and a 2-story home is going to provide very little privacy. The modern style of this proposal also doesn’t fit with the design of the majority of the other homes on this street. This property has been an eye sore for the past 2 years and the city has done very little if anything to fix the situation as multiple emails and phone calls from concerned residents were made. This property has been unsafe for children in the area as it was not properly demolished nor secured until just recently. This property has cost my family thousands of dollars in pest control bills (as the property has been a haven for rodents) and has affected property values for the entire street. This owner also owns another property a couple of doors down from us and it’s the same story...an unfinished project for over 2 years that is an eye sore, a safety hazard, and has affected home values. We most definitely want a home built on that property and look forward to having new neighbors. We would strongly ask that the builders consider a single story home, a style that fits with the rest of the neighborhood, and a project that has a reasonable timeline. Thanks for your time. We’ve lived on the 100 block of E Oakview for almost 10 years, and these two lots have been nothing but frustrating eyesores. Most importantly, we have many children who are out playing, running & biking from house to house, and these construction sites pose a serious safety threat. We ask the council to please relinquish this “developer’s” opportunity to go forward with these projects, as we have no confidence any progress will ever be made. I use quotations around the word developer since very little has actually been developed on these lots. With the housing boom currently happening in our neighborhood, I would bet that there are many, well qualified people who would love to build a beautiful home and join this close knit group of neighbors. I have spoken to a couple of you about this project and voiced my concerns. For those of you who are unaware of the history of this spec house, I will provide a bit of background. This is the builder’s third attempt at a project on E. Oakview. This builder attempted aprior flip house project at 164 E. Ojkview—the site of the curret proposed spec house. He partially demolished the Fouse in 2019, and left it as a partially demolished eyesore for two years. The hard money lender foreclosed on the property this spring. The builder bought the property back from the hard money lender after foreclosure, and is now asking for the City’s approval to take another shot at it. In addition, this same builder attempted second spec house right across the street at 173 E. Oakview. Work went in fits and starts for two years. The hard money lender foreclosed on 173 E. Dakview this spring. Litigation is ongoing, and the builder has filed a lis pendens. Meanwhile, the partially constructed house now sits abandoned behind a construction fence, and will remain such for who knows how long. It is a blight on the neighborhood. Given the facts, I have no reason to believe the builder has the ability to actually complete the proposed project. He has tried twice, and both attempts have ended in foreclosure. He’s given the neighbors a partially demolished house that blighted the neighborhood for two years. He’s also given the neighbors the partially built, now abandoned spec house at 173 E. Oakview which he has tied up in litigation. Enough is enough. I can only go on this builder’s dismal track record of failed projects on my street, and I cannot imagine the proposed project will be any different. My neighbors and I have had to endure the endless nuisance and nonsense of 164 E. Oakview and 173 E. Oakview for the past 2+ years. Coincidentally, I am in the Custom Homes construction supply business, and this builder ordered windows from me for the house at 173 F. Oakview back in March 2 days before he was foreclosed on. His deposit check bounced. He said he’d come in the following week with another check, but he never showed up. Based on what I’ve seen on E. Oakview, and the hot check the builder wrote me, I do not believe he has the ability to actually complete his proposed spec house project at 164 F. Oakview. We’ve lived on the 100 block of E Oalcview for almost 10 years, and these two lots have been nothing but frustrating eyesores. Most importantly, we have many children who are out playing, mnning & biking from house to house, and these construction sites pose a serious safety threat. We ask the council to please relinquish this “developer’s” opportunity to go forward with these projects, as we have no confidence any progress will ever be made. With the housing boom currently happening in our neighborhood, I would bet that there are many, well qualified people who would love to build a beautiful home and join this close knit group of neighbors.     spring. The builderbought the property back from the hard money lender after foreclosure, and is now asking for the City’s approval to take another shot at it. In addition, this same builder attempted a second spec house right across the street at 173 F. Oakview. Work went in fits and starts for two years. The hard money lender foreclosed on 173 E. Oakview this spring. Litigation is ongoing, and the builder has filed a us pendens. Meanwhile, the partially,constmcted house now sits abandoned behind a construction fence, and will remain such, for who knows how long. It is a blight on the neighborhood. Given the facts, I have no reason to believe the builder has the ability to actually complete the proposed project. He has tried twice, and both attempts have ended in foreclosure. He’s given the neighbors a partially demolished house that blighted the neighborhood for two years. He’s also given the neighbors the partially built, now abandoned spec house at 173 E. Oakview which he has tied up in litigation. Enough is enough. I can only go on this builder’s dismal track rebord of failed projects on my street, and I cannot imagine the proposed project will be any different. My neighbors and I have had to endure the endless nuisance and nonsense of 164 E. Oakview and 173 F. Oakview for the past 2+ years. Council approval of the proposed spec house project guarantees we will be subjected to yet another nuisance and eyesore for years to come. Do not allow this builder to do this yet again. Please ask yourself: How would you feel if this was happening on your street? Please do not allow this on our street. Do not allow this builder to start yet another project here — especially when the abandoned hulk of his last failed project still looms across the street, as a decaying reminder of his inability to finish a project, and a reminder of his complete disrespect for the neighborhood. I hope the City will stand with the neighbors and support the citizens of Alamo Heights, and deny this application: I will send you power points with a photo chronology of both properties in separate emails to follow. We’ve lived on the 100 block of E Oakview for almost 10 years, and these two lots have been nothing but frtistrating eyesores. Most importantly, we have many children who are out playing, running & biking from house to house, and these construction sites pose a serious safety threat. We ask the council to please relinquish this “develgper’s” opportunity to go forward with these projects, as we have no confidence any progress will ever be made. I use qttations around the word developer since very little has actually been developed on these lots. With the housing boomurrently happening in our nighborhbod, I would bet that there are many, well qualified people who would loveto build a beautiful home and join this close knitgroup of neighbors. Most importantly, we have many children who are out playing, running & biking from house to house, and these construction sites pose a serious safety threat. We ask the council to please relinquish this “developer’s” opportunity to go forward with these projects, as we have no confidence any progress will ever be made. I use quotations around the word developer since very little has actually been developed on these lots. With the housing boom currently happening in our neigh borbood, I would bet that there are many, well qualified people who would love to build a bçautiful home and join this close knit group of neighbors. The builder bought the property back from the hard money lender after foreclosure, and is now asking for the City’s approval to take another shot at it. In addition, this same builder attempted a second spec house right across the street at 173 E. Oakview. Work went in fits and starts for two years. The hard money lender foreclosed on 173 E. Oakview this spring. Litigation is ongoing, and the builder has filed a us pendens. Meanwhile, the partially constructed house now sits abandoned behind a construction fence, and will remain such for who knows how long.     Given the facts,I have no reason to believe the builder has the ability to actually complete the proposed project. He has tried twice, and both attempts have ended in foreclosure. He’s given the neighbors a partially demolished house that blighted the neighborhood for two years. He’s also givep the neighbors the partially built, now abandoned spec house at 173 E. Oakview which he has tied up in litigation. Enough is enough. I can only go on this builder’s dismal track record of failed projects on my street, and I cannot imagine the proposed project will be any different. My neighbors and I have had to endure the endless nuisance and nonsense of 164 E. Oakview and 173 E. Oakview for the past 2+ years. Council approval of the proposed spec house project guarantees we will be subjected to yet another nuisance and eyesore for years to come. Do not allow this builder to do this yet again. Please ask yourself: How would you feel if this was happening on your street? Please do not allow this on our street. Do not allow this builder to start yet another project here especially when the abandoned hulk of his last failed project still looms across the street, as a decaying reminder of his inability to finish a project, and a reminder of his complete disrespect for the neighborhood.
