This document outlines the rules and regulations for implementing the Anti-Trafficking in Persons Act in the Philippines. It establishes an Inter-Agency Council Against Trafficking (IACAT) to coordinate efforts to prevent trafficking, protect victims, and rehabilitate those affected. The IACAT will develop programs, monitor implementation, and collaborate with other government agencies and NGOs. 2. RULES AND REGULATIONS KNOWN AS THE
“ANTI-TRIMPLEMENTING REPUBLIC ACT
NO. 9208, OTHERWISE AFFICKING IN
PERSONS ACT.”

3. Purpose. These rules and regulations are
hereby promulgated to institute policies,
establish the institutional mechanism for the
support and protection of trafficked persons
and prescribe the procedures and guidelines
for the implementation of Republic Act No.
9208.

4. Declaration of State
Policy.
The State values the
dignity of every
human person and
guarantees the
respect for individual
rights.

to the enactment of
measures and
development of
programs that will
promote human
dignity, protect the
people from any threat
of violence and
exploitation.

6. Declaration of State Policy.
Eliminate trafficking in persons, and mitigate
pressures for involuntary migration and
servitude of persons, not only to support
trafficked persons but more importantly, to
ensure their recovery, rehabilitation and
reintegration into the mainstream of society.

7. Purpose. These rules and regulations are
hereby promulgated to institute policies,

inherent human dignity of women and men, as
well as the rights of children, as enshrined and
guaranteed in the following international
instruments:

on Human Rights.

12. THE INTER-AGENCY COUNCIL
AGAINST TRAFFICKING (IACAT)
Section 6. Creation. The Inter-Agency Council
Against Trafficking (IACAT) shall be
established which shall be primarily tasked to
coordinate, monitor and oversee the
implementation of the Act.

13. Functions of the Council. The Council shall
have the following powers and functions:
(a) Formulate a comprehensive and
integrated program to prevent and suppress the
trafficking in persons.

14. (b) Promulgate rules
and regulations as
may be necessary for
the effective
implementation of the
Act.
(c) Monitor and
oversee the strict
implementation of the
Act.

15. (d) Coordinate the programs and projects of
the various member agencies to effectively
address the issues and problems attendant to
trafficking in persons.

16. (e) Coordinate the conduct of massive
information dissemination and campaign on the
existence of the law and the various issues and
problems attendant to trafficking through the
National Government Agencies, Local
Government
Units, Concerned
Agencies, and
Non-Government
Organizations.

17. (f) Respond to the
issues/concerns/
brought to their
attention and
report to on the
action taken.

18. (g)Assist in filing of
cases against
individuals, agencies,
institutions or
establishments that
violate the provisions of
the Act.

19. (h)Formulate a program
for the reintegration
of trafficked persons.

20. (i) Secured from any department, bureau,
office, agency, or instrumentality of the
government or from non-government
organizations (NGOs) and other civic
organizations
such
(i) assistance as
may be needed
to effectively
implement the
Act.

21. (j) Complement the shared government
information system for migration established
under Republic Act No. 8042, otherwise known
as the “Migrant
Workers and
Overseas Filipinos Act”
with data on cases
of trafficking in
persons.

22. (k) Develop the
mechanism to
ensure the timely
coordinated and
effective response
to cases of
trafficking in
persons.

23. (l) Recommend
measures to
enhance cooperative
efforts and mutual
assistance among
foreign countries
through bilateral
and/or multilateral
arrangements.

24. (m) Prevent and
suppress international
trafficking in persons.

25. (n) Adopt measures and policies to protect the
rights and needs of trafficked persons who are
foreign nationals in the Philippines.
(o) Initiated training programs in identifying and
providing the necessary intervention or
assistance to trafficked persons.

26. (p) Exercised all the
powers and perform
such other functions
necessary to attain
the purposes and
objectives of the
Act.

27. Functions. The Secretariat shall have the
following functions:
(a)Coordinated under the direction of the
Council, the implementation of the policies
and guidelines promulgated by the Council.

28. (b) Established,
maintain and manage a
central database on
trafficking in persons.

29. (c) Provided
secretariat, records
keeping and other
services to the Council.
(d) Performed such
other functions as may
be directed by the
Council.

30. ROLES AND RESPONSIBILITIES
All member government agencies of the Council
shall have the following common roles and
responsibilities:
(a) Develop policies and programs supportive
and consistent with the
objectives of the Act.

31. (b) Enhanced the
capability of its officers
and personnel involved
in trafficking
issues and concerns
through appropriate
training and staff
support programs.

32. (c) Undertake information, education and
advocacy campaigns against trafficking in
persons;
(d) Maintain a databank on trafficking in
persons to be shared among relevant agencies
and complement the central databank to be
established by the Council; and

33. (e) Document good
practices as bases
for policy formulation
and program
development.

34. REPORTED OF SUSPECTED/ ALLEGED
TRAFFICKED INCIDENT
Who May and To Whom to Report. Any person
who has any knowledge or learns of facts or
circumstances that give rise to a reasonable
belief that a person will be or may.

35. Or has been trafficked shall immediately report
the same, either orally, in writing or through
other means, to any of the nearest barangay
authorities.
