operationsandsufferedarecto-vaginal fistula,para-colostomyandincisional herniae andshe hasa
permanentcolostomy.Breachof dutyandcausationwere robustlydenied.Causationwascomplex,
the Claimantarguingthather maininjury(the inabilitytorestore gastro-intestinal continuity) was
materiallycontributedtobythe negligentdelayindiagnosingthe anastomoticleak. The claim
settledata JSMfor £250,000.
DanielsvDr Hadoke
The 22 yearoldClaimantsufferedinjury12yearsago whilstworkingasan aircraftengineerinthe
RAF.He sufferedavascularnecrosisof the right(dominant) scaphoidandultimately requiredawrist
fusion,asa resultof failure todiagnose ascaphoidfracture.The Defendantwasworkingasa GP sub-
contractedto the MOD. The Claimanthadto overcome significantlimitationdifficulties,the index
treatmenthavingtakenplace over12 yearsago. The Claimantsucceededatthe trial of the
preliminaryissue of limitation.Afterdetailedquantuminvestigations,the claim settledataJSM in
the sum £310,000.
Faheyv (1) BoltonSalford& TraffordMental HealthNHS Trust (2) TraffordBorough Council.
The case concerneda 5 year oldgirl whowas stabbedtodeathin a ritualistickilling,byhermentally
ill mother.Kevinrepresentedthe victim’sfatherinthe civil claim, havingearlierrepresentedthe
familythroughoutthe statutoryInquirywhichheardevidence overseveral months.The civil claim
was settledforasubstantial (confidential) sum, shortlybeforetrial.
Bravo v Royal Bromptonand HarefieldNHSFoundationTrust
The 79 yearoldmale Claimantunderwentelectivecoronaryarterybypass grafting[CABG] followed
by a revisionoperation.He sufferedanadverse reactiontothe sternal wiresandclipsusedinthe
operation,bothof whichare standardcomponentsusedthroughoutthe NHS.The case concerned
issuesof informedconsentandthe technical performanceof the 2 operations.Liabilityand
causationwere denied.Afterlengthynegotiations,the claimsettled,the Claimantaccepting£75,000
indamages.

responsible forthe clinicwhere the Claimantreceivedtreatment.The claimrequiredexpert
evidence incosmeticsurgery,microbiologyandclinical psychology.The issuesincludedthe technical
performance of the original operationandthe failure toofferadequatepost-operative treatment
togetherwithcomplex causationissues.The treatmentinquestiontookplace overa2 year period,
encompassingover40consultations.Liabilityandcausationwere robustlydeniedbyeach
defendant.The claimsettled,the Claimantaccepting anofferof £70,000 in damages.

The 25 yearoldfemale Claimantunderwentbreastaugmentation.The issuesinthe claimagainstthe
operatingsurgeonincludedpre-operative consentandthe performance of the index operation.The
claimagainstthe SecondDefendantallegedbreachof contract,bothinrelationtothe definitionof
“Surgeon”withinthe SecondDefendant’sstandardtermsandconditionsandbreachof section13 of
the Supplyof Goodsand ServicesAct.The claimhad wide implicationsforthe SecondDefendant,a
national providerof cosmeticsurgery,sinceitwasallegedthat the surgeonselectedbythe Second
Defendantandadvertisedonitswebsite was notadequatelytrainedandqualified.The claimwas
robustlydefendedbybothDefendants.The claimsettledonthe firstdayof the trial,the Claimant
acceptingan offerof £100,000.

The 56 yearoldfemale Claimantunderwentafaceliftoperationperformedbythe Defendant.The
claimconcernedissuesof informedconsentrelatingtothe positioningof the operationscarand the
technical performance of the operation.The claimwasrobustlydefended,the Defendantbeing
anxioustoprotecthisprofessional reputation.The trial tookplace over3 days.The claimsucceeded
and the Claimantwasawardeddamagesinthe sumof £30,000.

The 36 yearoldmale Claimantunderwentlasereye treatment[LASIK(LaserIntrastromal
Keratomileusis)] performedbythe firstDefendantonbehalf of the SecondDefendant.He wasleft
witha significantvisualdefect.The underside of the corneal flaphadbeen negligently laseredbythe
FirstDefendantbefore beingreplaced,producingacontourdeformitywhichwasthe cause if the

Dockeryv Wilkinson
The 46 yearoldClaimantsufferedawhiplashinjuryinaroadtrafficaccidentresultinginchronic
occipital neuralgia.The claimwaspresentedonthe basisthathercontinuingsymptomsrendered
herdisabledwithinthe meaningof the EqualityAct 2010 and she lostthe chance to progress her
teachingcareer.Afterlengthynegotiationsthe claimwassettledfor£310,000.

An unusual case.The 64 yearoldClaimantsufferedsegmental fracturesof the tibiaandfibulawhen
hiscycle was struckby the Defendant’svehicle.The orthopaedicinjurieslargelysettled.However,
the Claimantalsosufferedpsychiatricinjuryinthe formof an obsessive compulsive disorder[ICD
F42.1] witha guardedprognosis.Damageswere eventuallyagreedinthe sum£130,000.
Jacksonv Smethurst
The 25 yearoldClaimantsufferedabrachial plexusinjurywhenhermotorcycle wasstruckbythe
Defendant’svehicle.She workedasa PCSOand itwas herwishto applyfora jobas a Police
Constable inthe Lancashire Constabulary.The Claimantclaimeddamagesforherlostchance of a
careeras a Police Officer.Damageswere agreedinthe sum£350,000.
ObayuwanavPahirathan
The 51 yearoldClaimantsufferedvariousinjuriesinaroad trafficaccidentincludingacomminuted
fracture of the tibial plateau.Inaddition,she sufferedadeteriorationinherpre-existingdiabetes
mellitus.The worseningdiabetesincreasedthe riskof micro-vascularandmacro-vascular
complicationstogetherwithanincreasedriskof jointinfectionandasepticlooseningof the knee

A novel andcomplex cosmeticsurgeryclaim.The 39 yearold female claimantunderwentbuttock augmentationwithinsertionof implants.The claimproceededagainst4defendants:the operating surgeon;a differentsurgeonwhotreatedthe Claimantpost-operativelyandthe 2 companies responsible forthe clinicwhere the Claimantreceivedtreatment.The claimrequiredexpert evidence incosmeticsurgery,microbiologyandclinical psychology.The issuesincludedthe technical performance of the original operationandthe failure toofferadequatepost-operative treatment togetherwithcomplex causationissues.The treatmentinquestiontookplace overa2 year period, encompassingover40consultations.Liabilityandcausationwere robustlydeniedbyeach defendant.The claimsettled,the Claimantaccepting anofferof £70,000 in damages.
