4. Projects requiring EC
• Under EIA notification1994 w.e.f.7-7-2004
– Any construction project including new townships, industrial townships,
settlement colonies, commercial complexes, hotel complexes, hospitals
and office complexes for 1000 persons or above or discharging sewage
of 50000 lpd or above or with an investment of Rs.50 crores or above
– Industrial estates accommodating industrial units in an area of 50
hectares or above but including the industrial estates irrespective of
area if their pollution potential is high
• Under EIA notification 2006 w.e.f.14-9-2006
– Building and construction pojects with builtup area more than 20000
sq.mts
– Townships and Area Development Projects equal to or more than 50
hectares and or builtup area equal to or more than 150000 sq.mts
5. Projects requiring KSPCB Consent
Projects which require both Consent for Establishment (CFE), Consent
for Operation (CFO) and Consent for Expansion (CFExp)
•All projects covered under EIA notification 2006
•w.e.f. 14-5-2007
– Residential Apartments 50 units and above or having builtup area 5000
sq.mts and above
– Educational Institutions (non-residential) with builtup area 10000 sq.mts
and above
– Commercial Construction projects (hotel, commercial complexes etc.)
with builtup area 2000 sq.mts and above
– Layouts of area 10 acres and above
•State Govt. notification dated 4-8-2010
– Residential and commercial construction of less than 20000 sq.mts in
sewered area exempted from obtaining consent
6. Categorization of Construction Projects
• RED category
– Hospitals covered under BMW Rules
– Hotels (3 star & above) and hotels having 100 rooms and above
– Industrial Estates/Parks/complexes/areas/EPZ/SEZ/Biotech
Park/Leather complex
• Orange category
– Building & construction projects > 20000 sq.mts builtup area
– Hotels (< 3 star) or hotels having >20 rooms and < 100 rooms
– Infrastructure development project (other than those covered under Red
and Green)
– Townships and Area Development Projects equalto or more than 50
hectares
• Green category
– Hotels with < 20 bed rooms or banquet hall or with minimum floor area
of 100 sq.mts or a restaurant with a minimum seater capacity of 36
– Commercial Complexes,Office Complex/Banks, Cinema Theaters
having built up area < 20000 sq. mts. In non sewered areas and having
independent STPs/and DG sets (vide State DEE notification 4-8-2010)

Note:
Appropriate disinfectant shall be used to ensure some residual
in the treated sewage preferably in the range of 1 to 3 mg/L
Reuse means Landscape irrigation, Vehicle Washing, Toilet Flushing,
Use in fire protection and commercial air conditioners
13. Important Conditions
• Administrative Charges
– 5 times the Consent fee to be paid if construction activity is
already started without prior CFE or EC
• Guarantee Money to be paid by the builder as a proof of
commitment to provide, O&M STP
– Upto 50 kld Rs. 5 lakhs
– 50 kld - 150 kld Rs. 15 lakhs
– 150 kld - 300 kld Rs. 25 lakhs
– 300 kld - 500 kld Rs. 35 lakhs
– > 500 kld Rs. 50 lakhs
– Builder should construct STP and operate for 2 years to the
standards stipulated by the Board and then only handover to
Residents Association
– Forfeiture of GM in case of Non compliance
14. Regulatory Concerns
• Occupier/applicant for consent – Role and extent
• How the responsibility is transferred to Residents Association ?
• What documents are handed over during such transfer ?
• Fund earmarked for implementing EMP
15. Eco-caring/Green Building
• “A Eco-caring/Green Building could be defined as one,
which encompasses the use of clean energy, renewable
energy, efficient use of water, use of recycled or
recyclable materials and provides healthy indoor air
quality.”
