Discount and Hawkins
Discount and Hawkins Case
Case Synopsis
The subject matter of the case is presented as a negotiation between a real estate developer, Hawkins, and a possible anchor tenant, Discount
Marketplace. Both parties are represented by professional negotiators: Myra Hart is representing the Hawkins Company and Genia is representing the
Discount Marketplace. The Hawkins Company is a real estate developer, who is operating across UK, offering different types of services, such as:
Mortgages, Energy Performance Certificates, Sales and Lettings. They are interested in having Discount Marketplace as a tenant in a proposed
shopping center. The Discount Marketplace is an innovative national retailer with the main activity focused on... Show more content on Helpwriting.net

The Developer wished that the Retailer would deal only with soft goods, and asked them to use same product mix for all locations around the country.
The proposal was declined because the Retailer felt it was limiting to deal with only soft goods. Retailer wanted to be free in selecting the type of
goods and services. Their argument was that they needed to be more flexible regarding their product mix in order to achieve innovation and to follow
their advertising strategy. Also the Retailer didn't agree to use the same product mix across country because their main activity was based around a
strategy of adapting the product mix. In order to get to an agreement the Developer suggested limiting the activity to some percentage of the operation
area. They offered a limit of 10 – 15% for trial. The Retailer accepted the offer and issue was solved.
2. Operating Covenant Developer's concern about the contract duration was that the Discount Marketplace would operate for only as long as the
business would be viable. Their aspiration level was to sign the contract for a period of minimum 15 years and their soft constrain was to sign the
contract for a minimum of 10 years. Developer needed to be sure that the retailer would perform the best they can and they needed to be safe in case
the Marketplace wanted to make sudden changes after signing the contract, like changing the location too soon. The Retailer's aspiration level was to

Advantages Of Anti-Competitive Agreement
CHAPTER IV
ANTI–COMPETITIVE AGREEMNENT
"People of the same trade seldom meet together, even for merriment and diversion, but the conversation ends in a conspiracy against the public, or in
some contrivance to raise prices."
While doing business in India, parties are prohibited from executing anti–competitive agreements. Generally, the agreements which cause or are likely
to cause appreciable adverse effect on competition ("AAEC") are anti–competitive agreements. However, the Competition Act, 2002 ("Act") recognizes
intellectual property rights and to facilitate their protection, the Act permits reasonable restrictions imposed by their owners. Similarly, the Act exempts
agreements between exporters as exports do not impact markets in India. ... Show more content on Helpwriting.net ...
The most obvious example would be that of agreements between enterprises dealing in the same products. However, in general, it is important to define
the relevant market(s). To attract the provision of the law, the products must be substitutes. Being at the same stage of the production chain implies that
the parties to the agreement are both (all) producers, or retailers or wholesaler. As has been interpreted over the years in the U.S. (and enacted more
recently in other countries) a dissention is drawn in this regard between horizontal and vertical agreements. In certain circumstances it can be
established that firms that are collaborating on some socially valuable activity may need to agree to do away with competition so to establish the
cooperative relationship. In this, the European Community law goes beyond the objective of maximizing welfare and explicitly allows some
Restrictive contracts if they promote progressiveness and consumers ultimately stand to gain. The Japanese law also allows for actions in
contravention of the law provided they are in the "public interest". It would be dangerous to allow the kind of discretion in interpretation possible
under the Japanese law. Any exceptions that are permissible should be clearly laid down. However, we recommend that Restrictive contract which are
designed to promote use of energy efficient manufacturing processes and production of Eco–friendly products or conservation of natural resources
should be explicitly permitted as

Negotiation Report Pakistani Prunes Essay
Negotiation simulation:
The Pakistani Prunes
The case is about a negotiation with a competitor to buy Pakistani prunes in order to use them to save lives. In fact, being a world leader of genetic
engineering processes, I need Pakistani prunes to work on people. However, my direct competitor needs Pakistani prunes too and we have to find a
deal before the day after.
The outcome has been buying fifty–fifty in the short term. In fact, we agreed to share the limited resources on the short term, and then find another
agreement 5 years after because each 5 years there are lots of changes thanks to progress of researches etc. we decided during the auction to offer 2
millions as our first offer, and to make our maximum as 4 millions. I ... Show more content on Helpwriting.net ...
At this time, he asked me to do fifty–fifty, I agreed on that statement because I thought that he will spend all his money and I will save some if I need
it in the future. The other issue was to agree on a short term and a long–term agreement because thanks to researches and progress, things are changing
each five years. So we agreed on a fifty–fifty share in the sort term but we also signed to review our agreement in few years, depending on the
progress and changes. My strategy was firstly to try to know more about the other party's ambitions, goals, strategy etc. Dr Sanchez told me a lot about
what he wanted to do with prunes, how much he wanted to spend, what he wanted in the short term and long–term since the beginning of the
discussion so I decided to trust what he said to me, even if I was maybe wrong doing that, I had the feeling that he was trustful, he was open to me
and didn't seem to lie. His strategy was to expose the all situation in order to obtain the maximum he could have from me. I think he knew that he had
a really limited budget and that the best thing would be to cooperate and not to compete. The critical moments has been firstly the moment when he
told how much he had to spend on it because he gave me an important information, the second one has been when I learnt about his goals because I
could analyse the long–term and short–term strategies we had to

What Are The Advantages And Disadvantages Of Hire Purchase
4.The terms of agreements are unlikely to be fair, for the hirer rarely deals on equal footing with the owner. Thus he may be subjected to heavy penalty
on the ground of breach of the agreement.
BENEFITS OF THE HIRE PURCHASE AGREEMENT
There were two reasons for the adoption of the Hire Purchase Act which include: 1) To allow credit to someone who is unable to pay cash for the
goods he wants and who would be glad to pay some deposit and there after pay the balance installment at a stipulated rate of interest. Since this
encourages people to demand more goods, the system has become an instrument of economic policy.

Essay about Syndexa and Technology Transfer at Harvard
1. Towards the end of his medical training in the early 1980s, Gokhan Hotamisligil was working on a unique tumor case on a patient and found they
were comprised primarily of fat cells. The fatty tumors were due to a rare condition, Proteus Syndrome. Working in the field of metabolic regulation
Hotamisligil began to explore the underlying pathways for insulin resistance. In his dissertation he discovered that the fat tissue of obese animals and
humans were capable of producing inflammatory mediators. His research helped shape the current view of fat tissue as a "discrete, active organ in its
own right, continuously exchanging messages with the rest of the body by way of the bloodstream." By early 2002 Hotamisligil and his laboratory made

To balance these competing interests, Harvard agreed to receive an equity stake in the company, and Syndexa would pay Harvard a small up–front fee to
license the patents that Hotamisligil had developed. For Syndexa one of the key parts of negotiations was centered on the research that the start–up
intended to fund in Hotamisligil's lab at Harvard. Harvard had major concerns with how the Syndexa–sponsored research will be separated from the
other funds (government– or foundation–funded projects) that Hotamisligil receives. Harvard cannot funnel federally funded inventions to companies,
however at the same time Syndexa was looking for assurance that they would have first crack at intellectual property for a technology that they funded.
Another major issue extending negotiations was the conditions under which Syndexa would make royalty payments to Harvard for products that were
not covered under Harvard patents, but discovered using Harvard technologies. To ensure that Harvard would receive a reasonable return on the
patents it was licensing, Syndexa agreed to pay a small royalty rate if they developed a new therapeutic cure for diabetes using its Harvard license.
Both parties agreed to the concept of an 'identified product', essentially a drug discovered through the use of patents, targets and assays being licensed
from Harvard. Negotiations over what constituted an 'identified product' continued through the rest

Call Money Market in India
A Financial Market can be defined as the market in which financial assets are created or transferred. As against a real transaction that involves
exchange of money for real goods or services, a financial transaction involves creation or transfer of a financial asset. Financial Assets or Financial
Instruments represents a claim to the payment of a sum of money sometime in the future and /or periodic payment in the form of interest or dividend.
The primary function of a financial market is to facilitate the transfer of funds from surplus sectors (lenders) to deficit sectors (borrowers). A financial
market consists of investors or buyers, sellers, dealers and brokers and does not refer to a physical location. The participants in the market ... Show more

Some deposits are repayable instantly on demand. However, the banks cannot instantly take the money back from their borrowers. Banks keep some
cash ready for meeting any demand from their depositors but sometimes, the demand could be higher than the cash in hand.
During the course of the day, after taking care of all their needs, some banks may have surplus cash in hand and some may have a deficit. The bank
having a deficit will borrow money overnight or for any period extending up to 14 days from bank having a surplus. The borrowing bank has to pay
interest on the borrowed money. Thus call money usually serves the role of equilibrating the short–term liquidity position of banks.
The call money market crosses international lines, with funding opportunities located in a number of countries around the world. Because of the
inclusion of international banking institutions, the role of the brokerage firm becomes vital to the individual investor. Brokers will be aware of
applicable banking laws, and how those laws could impact the transaction. This knowledge regarding participants in the call money market allows the
firm to pick and choose among possible avenues for funding with a level of efficiency that would be difficult for the individual.
Call money is also required by banks to meet their CRR requirements. They borrow money from other banks and non bank entities to cover any

The Pros And Cons Of The Schengen Agreement
Before the adoption of the Dublin Regulation, the Schengen Agreement was used to regulate what country would process the asylum application, but
with too many gray areas, clear guidelines were needed (Refugee Council Briefing, 2002). The Regulation cleared up issues concerning responsibility.
If an asylum seeker has a spouse who has refugee status in a EU state, then "that country will be responsible for determining the asylum application"
(Refugee Council Briefing, 2002). Although, this practice is rarely followed, and applications are processed in whatever country the person was
apprehended in and found to be traveling through. Apart from preventing people from applying for asylum in multiple countries, the Regulation was
also used to block... Show more content on Helpwriting.net ...
Apart from trying to control who enters the country, there are endless searches within the country to ensure that everyone who is in the country is there
legally–with the proper paperwork. Additionally, there are methods used to prevent people (refugees) from entering the country in the first place–a case
study to demonstrate this would be Italy. When asylum seekers try to enter Italy, they are off–shored. This practice is done by wealthy countries that do
not wish to compromise themselves with the responsibility of the asylum seekers applications. When analyzed, the Italy–Libya Deal provides a deeper
look into the concept. Nearly one year after the deal was signed, refugees and migrants are still stuck waiting to know what their fate is. Many are stuck
in limbo in Libyan detention camps where people have been "forced to endure torture, arbitrary detention, extortion and unthinkable conditions"

The Issues Of Financial Demands And Permits
In reaching an agreement on the issues of financial demands and permits, our party thought that the last issue in the agenda was the press release;
however, the mayors asked for an annual fixed payment of $250,000.00 per town from the corporation. While our party was not provided with an
acceptable range to which we may agree upon as precluded by the confidential instructions, we instead offered to pay $200,000.00 as a low cost
inducement instead, to which the mayors agreed upon. In an effort to reach an agreement with the counterparts to a positive press release of the
corporation and its project, our party agreed to the payment in the spirit of the consensus decision rule because the need for the positive press release
outweighed the need to minimize costs. In addition, the mayors offered to promote the project in the towns with the use of the $200,000.00 as a form
of marketing expense, which the corporation could then respectively decrease from the marketing budget.
In reaching an agreement on the issues of financial demands, permits, and fixed payments, each one of the parties were able to agree upon a positive
press release with much ease, with an agreement that the mayors would take actions in order to prevent the potential blocking of the access to the site
(see Appendix B for the final contract).

The Naivety Of Grisilde In The Clerk's Tale
In Chaucer "The Clerk's Tale" Grisilde, is portrayed not only as a naГЇve and foolish girl, but also enigmatic and troubling in regard to when she is
interacting with Walter. Grisilde is written as an almost impossibly perfect daughter and wife, which could have something to do with how she
was raised in poverty. Her naiveite isn't necessarily a bad thing since she spent her whole life looking after her father, Janicula, "with everich
obeisanuce and diligence." (230) Naivety for Grisilde, is from that she is humble in the way that she cares for others, and doesn't seek assertion
from her acts of kindness, and so obedience and diligence are where others could think Grisilde was naive and a fool. Which is why she is seen as
the perfect wife for Walter, because Grisilde isn't the type of woman to assert herself and get in the way of others, but we are also made to think that
Walter considered Grisilde virtue and not... Show more content on Helpwriting.net ...
It is also possible that Chaucer wrote her this way on purpose to show us how women were expected to behave back in those times, in a foolish and
naГЇve type of manner. If these types of situations are considered, then yes, we would think that Grisilde was to naГЇve for her own good. However,
this isn't the case, her foolishness and naiveite may come from how when she agreed to be Walters wife she at the time was trembling in fear and
so subconsciously she said yes to everything that Walter asked not knowing that in the end she would be tested on more than one occasion. Grisilde
is not as hopeless as we are made to believe, but because of her situation growing up as a child she comes across as being a little naГЇve and easy to
take advantage of and so we are given the assumption that she has no sense of

Artist Public Appearance Agreement Essay
The topic I picked for this research paper is "Artist Public Appearance Agreement". In this research paper, I will be explaining the process leading up to
retaining the artist for the performance or appearance and what the agreement could entail. Such things as selecting the artist to the workings of the
contract with the artist or artist's manager.
First, we need to start from where agreement comes into place. As a concert producer, you need to think about selecting a artist or artists for the
performance. Also the date in which you wish to have the artist make the appearance. You will need to pick a date that will give you enough time to
work out all the bugs and prepare accordingly for this event. You need to think of what... Show more content on Helpwriting.net ...
Percentage fees ( fees plus percentage of net income) can be a bit more multifaceted. While flat fees are relatively simple while a set figure will be
the amount paid to the artist to matter what. Many artist with their own contract will include such things as hospitality, a technical rider, fees,
payments, the way the payments should be made, and the policy regarding cancellations or any type of rain dates. Frequently, the contract
determination will be dependent on the budget and its approval. This is where all percentage sums of net income come into play with the
indenture. The advantage of having a contract would be to avoid any form of arguments, legal issues and so on that may arise. Working out all the
details of the agreement can be helpful. This way you will be able to spot light any problem issues that may come up. By doing this you will be able
to fix any problems before they occur, possibly ruining your event. Also any modification to a contract should be reviewed n signed by both parties to
ensure smoothness. Different states can also have many different laws pertaining to performance agreements, and you must abide by all these
regulations or you run the risk of being shut down. "California law stipulates that if the terms of a contract last for more than one year, the contract
must be in writing. A performance agreementВ– an agreement between a performer

In 2000, Amazon and Toys–R–Us entered into a symbiotic agreement that would benefit both corporate entities. Both companies had recently had
unimpressive fiscal years due to differing issues. Toys "R" Us struggled with poor order fulfillment. Although they were equipped with enough
merchandise, other issues kept them from being able to get orders to customers in a timely manner; especially during the busy holiday season.
Conversely, Amazon was forced to write off $34 million because of a miscalculation in inventory and had orders that could not be honored (Ouchi,

After all, the number of customers that shop Amazon.com each day dwarfs the number that shop Toys–R–Us in a given day.
Another aspect of the negotiation that could have been changed, resulting in a more effective and symbiotic outcome, would have been the number of
years the terms included. If the agreement had, instead, called for an annual or bi–annual renegotiation, then perhaps neither organization would have
been prompted to sue. Instead, they may have simply waited out the shorter termed agreement and renegotiated the terms or cancelled the agreement
afterwards.

The Rent Regulation Laws Of 2015
When you were running for mayor you said that you will stand for the 99%, being true to your word you are trying to pass regulations to help that
99%. Especially passing the Rent Regulation Laws of 2015, which will save hundreds of tenants, but it will only solve the issue for the next four
years. Other solutions that you are taking is inclusionary zoning where Developers get tax breaks for having at least 20% of their apartments to
be affordable rent. On the other hand the price of affording rent is far fetch from what is affordable for the working class. As rent increases to a
record high in parts of Brooklyn and Queen. We are now facing with the older tenants being price out. The average household income in New York
City, where the rent is changing faster than wages, renters don 't make enough for the new affordable rent which is about 2000 a month in these

population that was already around nor the gap between the rich and the poor. You said you are a mayor for the working class and their families and

is written by the lessor to the lessee and what type of lease agreement. In this lease agreement we are focusing operating lease with provisions of
NeedSpace and WeHaveIt, which has a 10 year lease term, no options to renew or negotiate renewal offered in the contract and the lessee incurs
certain cost, repairs and maintenance. In regards to ASC 840 leases, according to 840–10–20 and 840–10–05–9A, 840–10–05–9B an operating lease is
when the lessor the owner of the property gives the lessee the right to use property, plant or equipment for a limited amount of time. Meaning the lessee

However, the provision in the lease agreement does not call upon the lessee to make deposits but simply requires the lessee to perform repair and
maintenance on the leased premises.
Alternative 1: Accrual Method
Since there is a contractual liability for the lessee to perform general repair and maintenance, the maintenance requirement provision may be assumed as
a present economic obligation, not just a future commitment. If the fair value estimate of future maintenance expense can be measured with sufficient
reliability, the provision may lead to recognition of an accrued liability for the repair and maintenance performance obligation at the inception of the
lease. The accrued liability for the repair and maintenance can be reversed when payment is made or liability is created through the performance of the
required repair and maintenance.
Alternative 2: Direct expense method
Another way to treat this provision would be not to recognize at the inception of the lease but directly expense the costs when the required maintenance
is performed. Regarding the accrual method in Alternative 1, ASC 360–15–25–5 prescribes "the use of accrue–in–advance (accrual) method of
accounting for planned maintenance activities is prohibited in annual and interim financial reporting periods." This is consistent to FASB's opinion

Contract Of Agency Can Be Split Up Into Two Separate...
Contract of agency can be split up into two separate definitions to help explain it. Firstly, a contract is an agreement which creates or is intended to
create a legal obligation between the parties to it (G.Black, 2011). Secondly, an agency in Scotland can be defined as the relationship which exists
when one person instructs or allows another person to execute business on their behalf (Yvonne McLaren, Commercial Law, Slide 1) (G.Black,
2011). The person who instructs is known as the principal, and the person who acts on behalf of the principal in known as the agent. A contract of
agency would often arise in business situations because the principal is maybe too busy to do it themselves and maybe has bigger priorities, and
would find it easier having someone else do it for them. It is also possible that the principal may require someone else to execute business for them,
because they do not have enough expertise in the area in order to make a well informed choice. It's only fair, and to avoid major problems in court,
there has been set ways in which a contract of agency can be terminated. It can be terminated if the case fulfils any of the following criteria. The
first way that a contract of agency can be terminated is if there is an expiry of time. So to expand, when the contract between an agent and a
principal was made, it could have a specific time period, by which the agent is allowed to act on behalf of the principal, and so when this time period
expires, the

Black Political Actors, Methods And Approach
Black Political Actors
Methods and Approach Our group followed political races in Baltimore City focusing on the Democratic races for Mayor and some city council
districts. We limited our scope to six candidates. Originally, they included former Mayor Sheila Dixon, State Senator Catherine Pugh, attorney
Elizabeth Embry, businessman David Warnock, City Councilmember Nicholas Mosby, and City Councilmember Carl Stokes. Based on aBaltimore
Sun/University of Baltimore poll, these candidates placed in the top six within a crowded field. On April 13, however, Councilmember Mosby dropped
out of the race and pledged his support to Senator Pugh. Therefore, we included the top five remaining candidates. Criminal justice reform and the
economy were the issues candidates discussed the most on the campaign trail. Given the events of Freddie Gray's murder and the city's high
unemployment rate, the emphasis on these issues is understood. Yet, these discussions did not complement our research. Between January2016 and
primary day, only one housing related forum was held. This forum focused on neighborhood revitalization, but did not address renter issues. At another
general issues debate, the Right to Housing Alliance asked the mayoral candidates the first rent court question in nearly two decades. Thus, our group
did not find it surprising that the candidates offered little policy proposals on reforms for renters. On April 26, the Democratic Party held its primary.
Senator Pugh won

Essay about Renting Versus Buying
Buying a home can be an exciting experience for anyone. However, in some cases you just might be better off continuing to rent your home. There are
many advantages to buying a home. However, it is not for everyone and buying varies from individual to individual. Currently more people are leaning
towards renting but this could change in the near future.
When someone makes the decision to buy or rent a home they must consider the advantages and disadvantages of each. In buying a home the primary
advantage is that you actually own it. You can do whatever you want with it. Also, you are building equity as the years go by. "People today have
problems saving for their future" (CNN Money, 2014). However, when they buy a home, the... Show more content on Helpwriting.net ...
You might be better off paying a reasonable amount for rent and saving your money when buying seems more logical. Also, it depends on lifestyle
preferences. Some people may not want to do all the work that comes along with owning a home. As of right now many people are leaning towards
renting. This is because the market is going down. Some don't want to commit to a mortgage if when they go to sell they can't find any buyers.
It is likely that the renting trend will decline and buying will increase in the future but it is hard to say when. However, "if rent keeps rising and
prices keep falling, fearful buyers could slowly become bargain hunters." (Business Week, 2014). I feel that people will eventually get tired of spending
there money on rent and will want to invest more in there future. I don't think that the real estate market will ever be a boom again. I believe that
people have learned that just because interest rates are low doesn't mean they can financially take on a mortgage. Overall, buying a house is a big
decision and should be looked at carefully. You should look at the advantages and disadvantages of each and decide what is best for you in your life.
There is no way to pin point if buying or renting is best for anyone. Currently many prefer to rent their homes. However, as rent rise, a majority may
soon change their minds.

The Bombing Of The Twin Towers
The bombing of the Twin Towers in 2001 began a darker age in history. This age would include acts of extreme violence, secrecy, intelligence,
counterintelligence, and a general lack of trust between any two people, not to mention any two countries. In the midst of this, there was a group of
countries in Europe that forewent the distrust and trusted each other enough to open borders between their countries. The agreement which in 1985,
Belgium, France, Germany, Luxembourg, the Netherlands, Portugal and Spain initially signed in Schengen, Luxembourg signed to alleviate borders
for a visa that will allow access to their countries, needing only to be checked at the beginning and the end of the travels in those six countries. These
"states", numbering up to a grand total of 26 now in 2016, have worked together to maintain order and peace in their little piece of the world (Peter).
In 2011 some heads of the European Union regarded the Schengen Agreement as "'one of the most tangible and successful achievements of European
integration'" (Collett). Recently though, it has come under attack. People coming from the war–torn Middle East are swarming to Europe for safety
(Melvin). Not all of them are travelling to protect themselves and their loved ones though. Some people are venturing to Europe to destroy the safety
other so yearn for. With having to balance terrorism, overpopulation, and maintaining their open borders, the Schengen States have to consider these
factors for the

information is from the pictures that I took from the blackboard (the single–text that we agreed upon), and what I remember from my notes to fill in the
gaps: For Issue 1 we agreed on Option 1, which was to "maintain and enhance the water supply". This option ensured that it would be a top priority to
maintain the flow for existing diversions, as well as making sure that no further harm happens. It is important to note that we agreed to add a "scientific

Much like the last option, inclusivity was also agreed upon; all of the parties involved agreed to be a part of the local commision, as they will be

through leasing, purchase of transfer of title. My Strategy A continuous process, I assessed the various conflict styles, as well as how each
individual role conflict style would interact with the styles of the other parties involved (which I will expand on in the next section). It was
important for me to also assess my own style in relation to my role and any predetermined bias (considering my individual background) that I might
have. This meant that my own environmentally conscious views could not influence the way in which I negotiated when representing the Irrigators
group, as they were pushing for things such as more water to produce food and crops. Being aware of this helped me assert my interests when the
other parties would try to sway for other options (which happened often). There were only a few cases where I built coalitions with Pat and Chi. Aside
from that, the coalition forming and grouping happened more amongst the others. Because of my directing type behavior in this negotiation, I believe
that I was able to advocate more vocally than the others at times

Ethical Case Analysis: Bartering Services
Ethical Case Analysis: Bartering Services
I am currently counseling Sam, whom I have diagnosed with adjustment disorder with mixed emotional features. He has progressed so far, but my
anticipated amount of treatment is six months. He mentions that his business is slow and is willing to renovate the bathroom in my new home in
exchange for therapy. Sam's proposal presents the dilemma of whether I should consider bartering or determine a more appropriate approach, such as a
referral.
Ethical Principles involved Bartering with Sam complexes the therapeutic relationship in regards to his autonomy. The proposition will offer him the
option to continue treatment, but if the conditions of the arrangement do not go accordingly, Sam might feel trapped. Agreeing to this business
relationship also constitutes as a dual relationship, which runs the risk of exploitation and infringing the principle of nonmaleficence. However, by
bartering, I will be maintaining beneficence and fidelity because I will be keeping my promise to help Sam and he will have the chance to continue
improving his life.

Terry a student at the Center College has rented an apartment from Mr./Mrs Roberts and from ever since they have been having a huge problem with

What are their needs? And whose obligations are these?" What I have also analysed is that both parties have been harmed/hurt in one way or the
other. This can due to the fact that, they are not paying attention to each other needs effectively. Therefore, both Mr. Roberts and Terry Smith, will
begin to comprehend the consequences of their behavior, by taking responsibility to repair the harm in order to make things right. Thus, both parties
will be interviewed separately, in order to get more information about each other needs, the finally both parties will come together in the decision
process and what justice is required in this case. However, during the meeting with Terry I analysed that because Mr. Roberts fails to attend to her
needs, by fixing the apartment, etc. Consequently, she declined paying her rent and refuses to listen to his complaints about where to put the trash
etc. She mentioned that she is financially stable, so there is no problem for her to pay her rent on time, but where comfort is a concern that is her
priority. She said that just as much as paying her rent that will result making her landlord comfortable, she also wants to be comfortable as well.
Therefore, what I analysed here is that if Mr. Robert pay attention to her needs, she would do the same that will enhance the happiness on both sides.

The Value Of A Company's Earning And Profitability
QUESTION 1: RELATIVE PROFITABILITY
There are several ways to measure a company's earning and profitability. Return on Equity ("ROE") and Return on Assets ("ROA") are,
historically, among the most widely used measures to assess relative profitability in the banking industry. The technique used in this paper is based
on Dr. Cole's ROE Model. This model helps "demystify" ROE and ROA; and focuses and analyzes the main factors that are driving profitability for
a bank. For this paper, selected financial data for East West Bank ("EWB" or the "Bank") and its Peer Group ("peers") was obtained from the
December 31, 2013 Uniform Bank Performance Report ("UBPR") and various EWB documents ; and from interviews conducted with EWB
management . ... Show more content on Helpwriting.net ...
Thus, EWB's Equity Multiplier ("EM") is also higher than peers (10.09x vs. 8.88x).
EWB's higher ROE compared to peers highlights a higher rate of return on shareholder's equity; nonetheless, it does not provide the complete picture
in itself. Decomposing the ROE to better understand the reason for change, it was determined that 42% of EWB's 2013 ROE was due to leverage, i.e.,
lower relative equity.
Since ROA growth itself will not yield important insights, nine variables have been identified, reflecting variances (Bank vs. Peer) for each in Exhibit
1. The following four key drivers out of the nine have been examined below, to provide a more detailed picture:
1.PROFIT STRENGTHS (HIGHEST POSITIVE VARIANCE)
A.YIELD ON EARNING ASSET ("EA")
Over the past 3 years, EWB's yield on EA has decreased 66 bps from 2011 to 2013 (Exhibit 2). This is essentially owing to the "lowinterest rate
environment" and the lower average yield on non–covered loans . EWB's average yield is above peers (Exhibit 1), as EWB used funds more
efficiently; placing a larger proportion of EA (82.47% vs. 68.63%) in higher yielding assets (i.e., Gross Loans and Fed Funds Sold & Resales); as
illustrated in Exhibit 3. EWB's higher yield on gross loans was attributable to the interest income from the "covered loans" portfolio, which is due to the
additional accretion accounted for under ASC 310–30. As the covered loan balance continues to decrease, the overall yield will

We Must Stop The Privacy Of Service From Someone Misusing...
Terms and conditions are something we encounter daily, yet we do not give a second thought. They are a legally binding document that tells us
what rules we must follow if we want to use a service. The terms and conditions are used to protect the provider of that service from someone
misusing the service. Most of the time they are reasonable but in some occasions they include conditions we would never agree to. For example, we
give a service like Facebook the right to store information about our personal lives when we use it but we also unknowingly give Facebook the right
to use the information for other purposes. Some people who use Facebook may not know that their personal information is actually being sold to other

We can then use that information to make a conclusion. For example, there was a connection between certain search terms in Google and the
spread of the flu. If the certain terms were searched then it was likely that the flu had spread to the area where the search was made (Big Data 2).
Using this information we were able to administer treatments to targeted areas and prevent the spread of the flu. What new technology allows us to
do is process data in a huge scale. It will take data and find correlations between data points. We can then use this correlation and form conclusions
that will help us make decisions. In theory, this practice is beneficial but it will undoubtedly have side effects. If big data was to be widely
implemented into society then companies will use any source of information and use it without any prejudice. Any information that big data can get
its hand on will most likely be used no matter how sensitive it is. With big data, society will have preconceived ideas about an individual based on the
correlation of the individual's characteristic and other people who have the same characteristics. The article "They're Watching You at Work" highlights
an instance when the language and behavior of programmers was used to evaluate their skill. The study found a correlation between using certain
phrases and words with writing good code. So then by looking

The First Nations On The Proposed Windy Energy Project
Introduction
In this report I will outline my recommendation on how to approach the Metlakatla First Nations on the proposed Windy Energy Project. Through my
research I believe a promising opportunity is present in pursuing business negotiations with this community. With our mutual goals of providing
sustainable project developments I believe the Metlakatla community will make strong business partners. In order to establish a respectful and
welcoming negotiation process, Windy Power must strongly understand their values, cultural sensitivities and organizational structure.

As indicated in appendix A, the Metlakatla territory spans roughly 20,000 square kilometers including twenty–one reserves, ten of which are Metlakatla
only (Leighton, 2012). The Metlakatla traditional language is Sm'algyax, but due to the close proximity to Prince Rupert and an aging elder population
very few members fluently speak the language (Metlakatla Governing Council, 2015). Thus there are no significant language barriers that would be of
concern when communicating with the community.
Metlakatla is a signatory to a number of agreements including (Treaty, n.d.): Ongoing: Treaty Negotiations, Marine use Planning Dec 10, 2009:
Reconciliation Protocol: Official recognition of Metlakatla's Aboriginal Rights and Title
Oct 18, 2007: Protected Area Collaborative Management Agreement

2006: Land and Resource Protocol Agreement
Currently the Metlakatla First Nations are at Stage 4 in negotiating a treaty intended to provide use and management of land and resources, set out First
Nations self–government, and create viable First Nations economies (Treaty, n.d.). The outcome of the treaty process will strongly influence the
viability of the project and should be followed closely for any changes that should be made in the assessment process.

Experience with a Chemical Company Sales Expert

him and abandoned him, well...that'd be Victor.Continuing along with this, the monster talks about his journey and misfortunes being brought into this
world to Victor, after he tells his story he then asks for Victor to create a lady companion for him.But even though this sounds like a good idea,Victor
first has to take into consideration that the monster is a murderer of his brother ,William, but he also owes his creation happiness and wants to hide his
creation from his family and for his creation not to hurt anyone anymore so,he agrees he's to make a companion. He then creates a companion in
England and when he completes it, all these thoughts provoke him nervously that have making the companion could fail him and make the matters he
has with creation even worse than before;his creation then sees his companion with delight, when Frankenstein then decides to destroy his companion.
My perspective on this is that destroying his creation's companion was a good decision because there is no certainty that they would of gotten along or
would've fallen for each other, plus if they procreated that make might more evil kinds like

Discount And Hawkins

  • 1. Discount and Hawkins Discount and Hawkins Case Case Synopsis The subject matter of the case is presented as a negotiation between a real estate developer, Hawkins, and a possible anchor tenant, Discount Marketplace. Both parties are represented by professional negotiators: Myra Hart is representing the Hawkins Company and Genia is representing the Discount Marketplace. The Hawkins Company is a real estate developer, who is operating across UK, offering different types of services, such as: Mortgages, Energy Performance Certificates, Sales and Lettings. They are interested in having Discount Marketplace as a tenant in a proposed shopping center. The Discount Marketplace is an innovative national retailer with the main activity focused on... Show more content on Helpwriting.net ... The Developer wished that the Retailer would deal only with soft goods, and asked them to use same product mix for all locations around the country. The proposal was declined because the Retailer felt it was limiting to deal with only soft goods. Retailer wanted to be free in selecting the type of goods and services. Their argument was that they needed to be more flexible regarding their product mix in order to achieve innovation and to follow their advertising strategy. Also the Retailer didn't agree to use the same product mix across country because their main activity was based around a strategy of adapting the product mix. In order to get to an agreement the Developer suggested limiting the activity to some percentage of the operation area. They offered a limit of 10 – 15% for trial. The Retailer accepted the offer and issue was solved. 2. Operating Covenant Developer's concern about the contract duration was that the Discount Marketplace would operate for only as long as the business would be viable. Their aspiration level was to sign the contract for a period of minimum 15 years and their soft constrain was to sign the contract for a minimum of 10 years. Developer needed to be sure that the retailer would perform the best they can and they needed to be safe in case the Marketplace wanted to make sudden changes after signing the contract, like changing the location too soon. The Retailer's aspiration level was to have the contract ... Get more on HelpWriting.net ...
  • 2. Advantages Of Anti-Competitive Agreement CHAPTER IV ANTI–COMPETITIVE AGREEMNENT "People of the same trade seldom meet together, even for merriment and diversion, but the conversation ends in a conspiracy against the public, or in some contrivance to raise prices." While doing business in India, parties are prohibited from executing anti–competitive agreements. Generally, the agreements which cause or are likely to cause appreciable adverse effect on competition ("AAEC") are anti–competitive agreements. However, the Competition Act, 2002 ("Act") recognizes intellectual property rights and to facilitate their protection, the Act permits reasonable restrictions imposed by their owners. Similarly, the Act exempts agreements between exporters as exports do not impact markets in India. ... Show more content on Helpwriting.net ... The most obvious example would be that of agreements between enterprises dealing in the same products. However, in general, it is important to define the relevant market(s). To attract the provision of the law, the products must be substitutes. Being at the same stage of the production chain implies that the parties to the agreement are both (all) producers, or retailers or wholesaler. As has been interpreted over the years in the U.S. (and enacted more recently in other countries) a dissention is drawn in this regard between horizontal and vertical agreements. In certain circumstances it can be established that firms that are collaborating on some socially valuable activity may need to agree to do away with competition so to establish the cooperative relationship. In this, the European Community law goes beyond the objective of maximizing welfare and explicitly allows some Restrictive contracts if they promote progressiveness and consumers ultimately stand to gain. The Japanese law also allows for actions in contravention of the law provided they are in the "public interest". It would be dangerous to allow the kind of discretion in interpretation possible under the Japanese law. Any exceptions that are permissible should be clearly laid down. However, we recommend that Restrictive contract which are designed to promote use of energy efficient manufacturing processes and production of Eco–friendly products or conservation of natural resources should be explicitly permitted as ... • 3. Negotiation Report Pakistani Prunes Essay Negotiation simulation: The Pakistani Prunes The case is about a negotiation with a competitor to buy Pakistani prunes in order to use them to save lives. In fact, being a world leader of genetic engineering processes, I need Pakistani prunes to work on people. However, my direct competitor needs Pakistani prunes too and we have to find a deal before the day after. The outcome has been buying fifty–fifty in the short term. In fact, we agreed to share the limited resources on the short term, and then find another agreement 5 years after because each 5 years there are lots of changes thanks to progress of researches etc. we decided during the auction to offer 2 millions as our first offer, and to make our maximum as 4 millions. I ... Show more content on Helpwriting.net ... At this time, he asked me to do fifty–fifty, I agreed on that statement because I thought that he will spend all his money and I will save some if I need it in the future. The other issue was to agree on a short term and a long–term agreement because thanks to researches and progress, things are changing each five years. So we agreed on a fifty–fifty share in the sort term but we also signed to review our agreement in few years, depending on the progress and changes. My strategy was firstly to try to know more about the other party's ambitions, goals, strategy etc. Dr Sanchez told me a lot about what he wanted to do with prunes, how much he wanted to spend, what he wanted in the short term and long–term since the beginning of the discussion so I decided to trust what he said to me, even if I was maybe wrong doing that, I had the feeling that he was trustful, he was open to me and didn't seem to lie. His strategy was to expose the all situation in order to obtain the maximum he could have from me. I think he knew that he had a really limited budget and that the best thing would be to cooperate and not to compete. The critical moments has been firstly the moment when he told how much he had to spend on it because he gave me an important information, the second one has been when I learnt about his goals because I could analyse the long–term and short–term strategies we had to ... Thus he may be subjected to heavy penalty on the ground of breach of the agreement. BENEFITS OF THE HIRE PURCHASE AGREEMENT There were two reasons for the adoption of the Hire Purchase Act which include: 1) To allow credit to someone who is unable to pay cash for the goods he wants and who would be glad to pay some deposit and there after pay the balance installment at a stipulated rate of interest. Towards the end of his medical training in the early 1980s, Gokhan Hotamisligil was working on a unique tumor case on a patient and found they were comprised primarily of fat cells. The fatty tumors were due to a rare condition, Proteus Syndrome. Working in the field of metabolic regulation Hotamisligil began to explore the underlying pathways for insulin resistance. In his dissertation he discovered that the fat tissue of obese animals and humans were capable of producing inflammatory mediators. To balance these competing interests, Harvard agreed to receive an equity stake in the company, and Syndexa would pay Harvard a small up–front fee to license the patents that Hotamisligil had developed. For Syndexa one of the key parts of negotiations was centered on the research that the start–up intended to fund in Hotamisligil's lab at Harvard. Harvard had major concerns with how the Syndexa–sponsored research will be separated from the other funds (government– or foundation–funded projects) that Hotamisligil receives. Harvard cannot funnel federally funded inventions to companies, however at the same time Syndexa was looking for assurance that they would have first crack at intellectual property for a technology that they funded. Another major issue extending negotiations was the conditions under which Syndexa would make royalty payments to Harvard for products that were not covered under Harvard patents, but discovered using Harvard technologies. To ensure that Harvard would receive a reasonable return on the patents it was licensing, Syndexa agreed to pay a small royalty rate if they developed a new therapeutic cure for diabetes using its Harvard license. Banks keep some cash ready for meeting any demand from their depositors but sometimes, the demand could be higher than the cash in hand. During the course of the day, after taking care of all their needs, some banks may have surplus cash in hand and some may have a deficit. The bank having a deficit will borrow money overnight or for any period extending up to 14 days from bank having a surplus. The borrowing bank has to pay interest on the borrowed money. The Pros And Cons Of The Schengen Agreement Before the adoption of the Dublin Regulation, the Schengen Agreement was used to regulate what country would process the asylum application, but with too many gray areas, clear guidelines were needed (Refugee Council Briefing, 2002). If an asylum seeker has a spouse who has refugee status in a EU state, then "that country will be responsible for determining the asylum application" (Refugee Council Briefing, 2002). When asylum seekers try to enter Italy, they are off–shored. This practice is done by wealthy countries that do not wish to compromise themselves with the responsibility of the asylum seekers applications. • 12. The Issues Of Financial Demands And Permits In reaching an agreement on the issues of financial demands and permits, our party thought that the last issue in the agenda was the press release; however, the mayors asked for an annual fixed payment of $250,000.00 per town from the corporation. While our party was not provided with an acceptable range to which we may agree upon as precluded by the confidential instructions, we instead offered to pay $200,000.00 as a low cost inducement instead, to which the mayors agreed upon. In an effort to reach an agreement with the counterparts to a positive press release of the corporation and its project, our party agreed to the payment in the spirit of the consensus decision rule because the need for the positive press release outweighed the need to minimize costs. In addition, the mayors offered to promote the project in the towns with the use of the $200,000.00 as a form of marketing expense, which the corporation could then respectively decrease from the marketing budget. In reaching an agreement on the issues of financial demands, permits, and fixed payments, each one of the parties were able to agree upon a positive press release with much ease, with an agreement that the mayors would take actions in order to prevent the potential blocking of the access to the site (see Appendix B for the final contract). The Naivety Of Grisilde In The Clerk's Tale In Chaucer "The Clerk's Tale" Grisilde, is portrayed not only as a naГЇve and foolish girl, but also enigmatic and troubling in regard to when she is interacting with Walter. Grisilde is written as an almost impossibly perfect daughter and wife, which could have something to do with how she was raised in poverty. Her naiveite isn't necessarily a bad thing since she spent her whole life looking after her father, Janicula, "with everich obeisanuce and diligence." (230) Naivety for Grisilde, is from that she is humble in the way that she cares for others, and doesn't seek assertion from her acts of kindness, and so obedience and diligence are where others could think Grisilde was naive and a fool. However, this isn't the case, her foolishness and naiveite may come from how when she agreed to be Walters wife she at the time was trembling in fear and so subconsciously she said yes to everything that Walter asked not knowing that in the end she would be tested on more than one occasion. • 27. Contract Of Agency Can Be Split Up Into Two Separate... Contract of agency can be split up into two separate definitions to help explain it. Firstly, a contract is an agreement which creates or is intended to create a legal obligation between the parties to it (G.Black, 2011). Secondly, an agency in Scotland can be defined as the relationship which exists when one person instructs or allows another person to execute business on their behalf (Yvonne McLaren, Commercial Law, Slide 1) (G.Black, 2011). The person who instructs is known as the principal, and the person who acts on behalf of the principal in known as the agent. A contract of agency would often arise in business situations because the principal is maybe too busy to do it themselves and maybe has bigger priorities, and would find it easier having someone else do it for them. It is also possible that the principal may require someone else to execute business for them, because they do not have enough expertise in the area in order to make a well informed choice. It's only fair, and to avoid major problems in court, there has been set ways in which a contract of agency can be terminated. It can be terminated if the case fulfils any of the following criteria. The first way that a contract of agency can be terminated is if there is an expiry of time. So to expand, when the contract between an agent and a principal was made, it could have a specific time period, by which the agent is allowed to act on behalf of the principal, and so when this time period expires, the ... Some people may not want to do all the work that comes along with owning a home. As of right now many people are leaning towards renting. This is because the market is going down. Some don't want to commit to a mortgage if when they go to sell they can't find any buyers. It is likely that the renting trend will decline and buying will increase in the future but it is hard to say when. However, "if rent keeps rising and prices keep falling, fearful buyers could slowly become bargain hunters." (Business Week, 2014). I feel that people will eventually get tired of spending there money on rent and will want to invest more in there future. I don't think that the real estate market will ever be a boom again. I believe that people have learned that just because interest rates are low doesn't mean they can financially take on a mortgage. Overall, buying a house is a big decision and should be looked at carefully. You should look at the advantages and disadvantages of each and decide what is best for you in your life. There is no way to pin point if buying or renting is best for anyone. Currently many prefer to rent their homes. However, as rent rise, a majority may soon change their minds. ... • 31. The Bombing Of The Twin Towers The bombing of the Twin Towers in 2001 began a darker age in history. This age would include acts of extreme violence, secrecy, intelligence, counterintelligence, and a general lack of trust between any two people, not to mention any two countries. In the midst of this, there was a group of countries in Europe that forewent the distrust and trusted each other enough to open borders between their countries. The agreement which in 1985, Belgium, France, Germany, Luxembourg, the Netherlands, Portugal and Spain initially signed in Schengen, Luxembourg signed to alleviate borders for a visa that will allow access to their countries, needing only to be checked at the beginning and the end of the travels in those six countries. These "states", numbering up to a grand total of 26 now in 2016, have worked together to maintain order and peace in their little piece of the world (Peter). In 2011 some heads of the European Union regarded the Schengen Agreement as "'one of the most tangible and successful achievements of European integration'" (Collett). Recently though, it has come under attack. People coming from the war–torn Middle East are swarming to Europe for safety (Melvin). Not all of them are travelling to protect themselves and their loved ones though. Some people are venturing to Europe to destroy the safety other so yearn for. With having to balance terrorism, overpopulation, and maintaining their open borders, the Schengen States have to consider these factors for the ... Get more on HelpWriting.net ...

Thus, the following information is from the pictures that I took from the blackboard (the single–text that we agreed upon), and what I remember from my notes to fill in the gaps: For Issue 1 we agreed on Option 1, which was to "maintain and enhance the water supply". This option ensured that it would be a top priority to maintain the flow for existing diversions, as well as making sure that no further harm happens. It is important to note that we agreed to add a "scientific monitoring system" to ensure that there is still a pollution limit. Furthermore, we agreed to have some storage monitoring in place. If the... Show more content on Helpwriting.net ... Much like the last option, inclusivity was also agreed upon; all of the parties involved agreed to be a part of the local commision, as they will be developing joint research studies and monitoring. It was concluded that the commission will manage any land and water that would be acquired through leasing, purchase of transfer of title. My Strategy A continuous process, I assessed the various conflict styles, as well as how each individual role conflict style would interact with the styles of the other parties involved (which I will expand on in the next section). It was important for me to also assess my own style in relation to my role and any predetermined bias (considering my individual background) that I might have. This meant that my own environmentally conscious views could not influence the way in which I negotiated when representing the Irrigators group, as they were pushing for things such as more water to produce food and crops. Being aware of this helped me assert my interests when the other parties would try to sway for other options (which happened often). There were only a few cases where I built coalitions with Pat and Chi. Aside from that, the coalition forming and grouping happened more amongst the others. • 34. Ethical Case Analysis: Bartering Services Ethical Case Analysis: Bartering Services I am currently counseling Sam, whom I have diagnosed with adjustment disorder with mixed emotional features. He has progressed so far, but my anticipated amount of treatment is six months. He mentions that his business is slow and is willing to renovate the bathroom in my new home in exchange for therapy. Sam's proposal presents the dilemma of whether I should consider bartering or determine a more appropriate approach, such as a referral. Ethical Principles involved Bartering with Sam complexes the therapeutic relationship in regards to his autonomy. The proposition will offer him the option to continue treatment, but if the conditions of the arrangement do not go accordingly, Sam might feel trapped. Agreeing to this business relationship also constitutes as a dual relationship, which runs the risk of exploitation and infringing the principle of nonmaleficence. Terry on the other hand, claims that paying her rent on time is not a big deal, but her living condition needs immediate attention, in which she had spoken to Mr. Roberts countless times about, but he fails to repair the apartment. What I have also analysed is that both parties have been harmed/hurt in one way or the other. This can due to the fact that, they are not paying attention to each other needs effectively. Therefore, both Mr. Roberts and Terry Smith, will begin to comprehend the consequences of their behavior, by taking responsibility to repair the harm in order to make things right. Thus, both parties will be interviewed separately, in order to get more information about each other needs, the finally both parties will come together in the decision process and what justice is required in this case. However, during the meeting with Terry I analysed that because Mr. Roberts fails to attend to her needs, by fixing the apartment, etc. Consequently, she declined paying her rent and refuses to listen to his complaints about where to put the trash etc. She mentioned that she is financially stable, so there is no problem for her to pay her rent on time, but where comfort is a concern that is her priority. She said that just as much as paying her rent that will result making her landlord comfortable, she also wants to be comfortable as well. • 37. The Value Of A Company's Earning And Profitability QUESTION 1: RELATIVE PROFITABILITY There are several ways to measure a company's earning and profitability. Return on Equity ("ROE") and Return on Assets ("ROA") are, historically, among the most widely used measures to assess relative profitability in the banking industry. The technique used in this paper is based on Dr. Cole's ROE Model. This model helps "demystify" ROE and ROA; and focuses and analyzes the main factors that are driving profitability for a bank. For this paper, selected financial data for East West Bank ("EWB" or the "Bank") and its Peer Group ("peers") was obtained from the December 31, 2013 Uniform Bank Performance Report ("UBPR") and various EWB documents ; and from interviews conducted with EWB management . ... Show more content on Helpwriting.net ... Thus, EWB's Equity Multiplier ("EM") is also higher than peers (10.09x vs. 8.88x). EWB's higher ROE compared to peers highlights a higher rate of return on shareholder's equity; nonetheless, it does not provide the complete picture in itself. Decomposing the ROE to better understand the reason for change, it was determined that 42% of EWB's 2013 ROE was due to leverage, i.e., lower relative equity. Since ROA growth itself will not yield important insights, nine variables have been identified, reflecting variances (Bank vs. Peer) for each in Exhibit 1. The following four key drivers out of the nine have been examined below, to provide a more detailed picture: 1.PROFIT STRENGTHS (HIGHEST POSITIVE VARIANCE) A.YIELD ON EARNING ASSET ("EA") Over the past 3 years, EWB's yield on EA has decreased 66 bps from 2011 to 2013 (Exhibit 2). This is essentially owing to the "lowinterest rate environment" and the lower average yield on non–covered loans . EWB's average yield is above peers (Exhibit 1), as EWB used funds more efficiently; placing a larger proportion of EA (82.47% vs. 68.63%) in higher yielding assets (i.e., Gross Loans and Fed Funds Sold & Resales); as illustrated in Exhibit 3. EWB's higher yield on gross loans was attributable to the interest income from the "covered loans" portfolio, which is due to the additional accretion accounted for under ASC 310–30. As the covered loan balance continues to decrease, the overall yield will ... Get more on HelpWriting.net ...
  • 38. We Must Stop The Privacy Of Service From Someone Misusing... Terms and conditions are something we encounter daily, yet we do not give a second thought. They are a legally binding document that tells us what rules we must follow if we want to use a service. The terms and conditions are used to protect the provider of that service from someone misusing the service. Most of the time they are reasonable but in some occasions they include conditions we would never agree to. For example, we give a service like Facebook the right to store information about our personal lives when we use it but we also unknowingly give Facebook the right to use the information for other purposes. Some people who use Facebook may not know that their personal information is actually being sold to other companies and used for... Show more content on Helpwriting.net ... We can then use that information to make a conclusion. For example, there was a connection between certain search terms in Google and the spread of the flu. If the certain terms were searched then it was likely that the flu had spread to the area where the search was made (Big Data 2). Using this information we were able to administer treatments to targeted areas and prevent the spread of the flu. What new technology allows us to do is process data in a huge scale. It will take data and find correlations between data points. We can then use this correlation and form conclusions that will help us make decisions. In theory, this practice is beneficial but it will undoubtedly have side effects. If big data was to be widely implemented into society then companies will use any source of information and use it without any prejudice. Any information that big data can get its hand on will most likely be used no matter how sensitive it is. With big data, society will have preconceived ideas about an individual based on the correlation of the individual's characteristic and other people who have the same characteristics. When I first arrived at his house, he was on a conference call with several people in Oklahoma and many from many different other states. They were listening to a researcher from DuPont talk about how many different chemicals, both new and old, were performing in field trials. Yes,sureFrankenstein is created as one,but who created him and abandoned him, well...that'd be Victor.Continuing along with this, the monster talks about his journey and misfortunes being brought into this world to Victor, after he tells his story he then asks for Victor to create a lady companion for him.But even though this sounds like a good idea,Victor first has to take into consideration that the monster is a murderer of his brother ,William, but he also owes his creation happiness and wants to hide his creation from his family and for his creation not to hurt anyone anymore so,he agrees he's to make a companion. He then creates a companion in England and when he completes it, all these thoughts provoke him nervously that have making the companion could fail him and make the matters he has with creation even worse than before;his creation then sees his companion with delight, when Frankenstein then decides to destroy his companion.
