Claim construction from the perspective of a trial lawyer jerrypattersonsheridan
This document discusses various principles of claim construction from the perspective of a trial lawyer. It summarizes guidelines from key cases like Phillips v. AWH Corp. that instruct courts to primarily rely on intrinsic evidence like the claims, specification, and prosecution history to determine the meaning of claim terms to one of ordinary skill in the art. It also discusses debates around how much weight to give the specification in limiting claim scope versus taking the plain meaning.
Winning commercial construction project bids is essential to growing any construction, sub contractor, and general contractor business. Avoid these 13 Deadly Mistakes of Construction Bidding to improve your chances of winning your next construction bid.
This chapter discusses the history and principles of claim construction in patent law. It addresses the following key points:
1. Claims define the scope of the monopoly granted by a patent. Their meaning must be determined through claim construction.
2. Early patents did not always include claims, which only became a required part of patent specifications in the late 18th century. Claims serve to define what is being claimed as the invention.
3. The task of claim construction is to determine what a claim would have meant to a skilled reader as of the relevant date, either the date of patent issuance or publication of the application. It involves a purposive interpretation of the claims in context of the full patent disclosure.
DESIGN AND CONSTRUCTION OF A 50W COLOUR TELEVISION TRANSMITTERAjinihi Ebenezer
This document discusses the design and construction of a 50W colour television transmitter by Ajinhi Ebenezer Oluwadare. It begins with an introduction and objectives. The literature review covers previous studies on television transmission development from early mechanical systems to digital formats. It also discusses relevant theories like Ohm's law, Lenz's law and Faraday's law of electromagnetic induction. The document then presents the design methodology which includes calculations for various stages of the transmitter circuit. It concludes with testing, results, discussion, and recommendations for future work.
Project management involves coordinating project efforts to deliver projects on time and within budget. It ensures the necessary scope and quality are achieved. The document discusses identifying stakeholders and their viewpoints, as stakeholders are important to project success. It also discusses drafting a project initiation document that summarizes the objective, deliverables, rationale, timing, organization, assumptions and success criteria of the project. Defining specific, measurable, actionable and consistent objectives is important so progress can be tracked.
The document provides an overview of omissions in construction contracts, including FIDIC contracts, and remedies for breach of contract due to improper omissions. It discusses how variation clauses typically allow for genuine omissions of work no longer required, but not to omit work and assign it to another contractor without express terms. Case law establishes contractors are entitled to loss of profit damages for improper omissions. The conclusion reiterates that contractors should have the opportunity to perform all contracted work, and omissions to assign work to others requires clear contractual terms or else the contractor can claim loss of profits.

YOUR FACILITATOR
Andy Hewitt Freelance construction contracts and claims consultant,
Hewitt Construction Consultancy, United Arab Emirates
I have almost 40-years experience in the construction industry, which has been gained in the United
Kingdom, West Africa and latterly in the Middle East, where I have been based for the past 15-years. I have
worked on projects in the UK, the United Arab Emirates, Bahrain, Saudi Arabia, Jordan, Oman, Nigeria
and Sudan. I am a fellow of Quantity Surveyors International, a member of the Chartered Institution of
Civil Engineering Surveyors, an associate of the Chartered Institute of Building. I am also a member of the
Dispute Resolution Board Foundation and a Corporate Panel Member of the Dispute Board Federation, both
of which are international organisations that actively promote the avoidance and resolution of construction
disputes. I have held senior contracts, commercial and project management positions with contractors,
sub-contractors and consultants, including several years operating my own practice in the UK which
o ered quantity surveying, estimating and project management services to contractors, subcontractors
consultants and private clients. I have been involved in a wide variety of construction projects including
super high-rise, large low-rise housing developments, hotels, shopping malls, airports, hospitals, heavy civil
engineering, process plants, highways, marine works, water treatment and reclamation plants, pipelines,
marine works, desalination plants and royal palaces. My project and company management skills together
with experience gained in a variety of disciplines and projects within the construction industry have
led me to specialise in the eld of construction contractual issues, claims and dispute management.
Whilst the avoidance of contractual disputes is a priority, if disputes do occur I favour a structured and
proactive approach to their management in order to protect the contractual entitlements of my clients. My
personal background and experience, which includes involvement at many levels and disciplines within
the construction industry, provides a direct bene t to clients in that I can relate to the needs of clients
from both the employer and contractor sides and the individual project personnel through my own past
personal ‘hands-on’ experience.
Publications: Construction Claims & Responses: effective writing and presentation.
e book discusses the di erent types of claims common to construction contracts and presents a step-
by-step guide, which demonstrates the process of building up the submission of a claim or response. It
includes guidelines as to how to set out the claim section by section in a logical manner, to ensure that
the essentials of a successful claim are included. Worked examples of claims for variations, extensions of
time and additional payment are included together with sample wording to demonstrate precisely how
the claim should be presented in order to contain a persuasive argument to support the claim or response.
