All psycho-social qualities essential for healthy inter-personal relationships are cultivated when we live a life of Yoga that is in tune with the eternal Dharma.

Teisinis reguliavimas
- 1980 m. Hagos konvencijos dėl tarptautinio vaikų grobimo civilinių aspektų.
- 1996 m. Hagos Konvencija
- 2003 m. lapkričio 27 d. Tarybos Reglamentas (EB) Nr. 2201/2003
- 2019 m. birželio 25 d. Tarybos Reglamentas Nr. 2019/1111 dėl jurisdikcijos ir
sprendimų, susijusių su santuoka ir tėvų pareigomis bei tarptautiniu vaikų grobimu,
pripažinimo ir vykdymo(nauja redakcija) įsigalioja po 3 m. nuo paskelbimo.
- Valstybės vaiko teisių apsaugos ir įvaikinimo tarnybos prie Socialinės apsaugos ir
darbo ministerijos direktoriaus 2021-01-07 įsakymas Nr. BV-9 Prašymų pagal 1980
m. Hagos konvenciją dėl tarptautinio vaikų grobimo civilinių aspektų pateikimo ir
nagrinėjimo tvarkos aprašas.

Teisinis reguliavimas
1980 m. Hagos konvencija, Reglamentas:
• vaikui, dėl kurio vykdomas procesas ir kuris geba suformuluoti savo nuomonę,
laikantis Teisingumo Teismo praktikos, turėtų būti suteikta reali ir veiksminga
galimybė pareikšti savo nuomonę, ir į šią nuomonę turėtų būti deramai
atsižvelgiama vertinant vaiko interesus.
• Vaiko galimybė laisvai pareikšti savo nuomonę pagal Chartijos 24 str.1 d. ir
atsižvelgiant į JT vaiko teisių konvencijos 12 str. vaidina svarbų vaidmenį
taikant šį reglamentą.
• Tačiau, nors teisė būti išklausytam lieka viena iš vaiko teisių, prievolė išklausyti
vaiką negali būti absoliuti, o turi būti vertinama atsižvelgiant į vaiko interesus,
pavyzdžiui, tais atvejais, kai bylos šalys tarpusavyje susitaria.

Teisinis reguliavimas
• Teisingumo Teismo praktika, Chartijos 24 str. ir Reglamente (EB) Nr. 2201/2003
nereikalaujama, kad kilmės valstybės narės teismas kiekvienu atveju sužinotų
vaiko nuomonę jį išklausydamas.
• Tais atvejais, kai teismas nusprendžia suteikti galimybę išklausyti vaiką,
reikalaujama, kad teismas imtųsi visų tinkamų priemonių tokiam išklausymui
surengti, atsižvelgdamas į vaiko interesus ir kiekvieno atskiro atvejo aplinkybes,
siekiant suteikti vaikui realią ir veiksmingą galimybę pareikšti savo nuomonę.

👤Geriausių vaiko interesų prioritetas taikomas remiantis konkrečia individualaus vaiko situacija,
vertinant ir nustatant, kas naudingiausia vaikui artimiausiu metu ir ateityje vaiko nuomonę, jo
identiškumą, šeimos aplinkos ir šeimos ryšių išsaugojimą ir santykių palaikymą, vaiko poreikių,
atitinkančių jo amžių, vystymąsi, gebėjimus ir brandą bei užtikrinančių tinkamą vaiko raidą, tenkinimą,
fteisės į sveikatą ir mokslą užtikrinimą bei kitus specialius vaiko poreikius. Vaikui turi būti teikiama
tokia apsauga, kokios reikia jo gerovei, taikant visą įmanomą koordinuotą kompleksinę pagalbą
Individualizavimo – priimant su vaiku susijusius
sprendimus, atsižvelgiama į: vaiko amžių,
brandą, jo psichikos ir fizines savybes,
poreikius, socialinės aplinkos ir kitas svarbias
ypatybes bei emocinius ir socialinius ryšius.
👪 Biologinės šeimos prioriteto priimant
sprendimus ar imantis bet kokių veiksmų, susijusių su
vaiku, turi būti atsižvelgiama į vaiko prigimtinę teisę
augti biologinėje šeimoje ir išsaugoti giminystės
ryšius, jeigu tai neprieštarauja vaiko interesams.
Vaiko nuomonės išklausymo ir vaiko dalyvavimo
užtikrinimo turi būti išklausytas visais su juo susijusiais
klausimais ir į vaiko nuomonę, įvertinus jo amžių ir brandą,
turi būti atsižvelgiama, jeigu tai neprieštarauja vaiko
interesams.
