If a consumer purchases software (like, perhaps, a word processor or a note taking software) and that leads to some harm- perhaps the software allows malware to run on their computer, locking all their data for ransom, or their private data is stolen, then do they have any recourse?
In the area of private law suits, a consumer would likely first look to products liability. Product liability law acts as a form of insurance to protect users - if a product is built in an unsafe way, and it injures you, you may sue the retailer or manufacturer of the product.
There are three general theories a consumer can recover under:
Design defect: the product was designed in an unsafe way
Manufacturing defect: the specific instance of a product was assembled incorrectly and had a one-off manufacturing flaw
Failure to warn claim: the product had non-obvious ways it could harm the consumer, that the consumer should be told about
Although these suits are common for defective products such as lawn mowers, coffee makers, and other consumer goods, they are not used by purchasers or users of software. The primary reason why this is so far is that products liability is so focused on physical harms- it covers serious injuries like losing your finger to a bagel cutter, for instance, and the fact that until somewhat recently, most software couldn’t physically harm you. (Although alternatively, some users can recover if they had a contract with the software creator or provider - as in the Trustwave Incident Response suit)
The rise of the Internet of Things is about to change a lot of that. There have already been a small number of cases where liability was found where buggy software caused physical harm to some consumers. Returning to the fridge, what if someone could connect remotely to your fridge, and adjust the temperature to be a little too warm, leading you to get food poisoning? What if they could do so without the temperature display in the fridge changing, so it looked like it was still cold enough?
This talk will explore the background of product liability law, and discuss how and why IOT might bring about a change in expanding coverage of software flaws.

Exploring new mobile and cloud platforms without a governance strategy can
have consequences.
At the beginning of my IT career, I witnessed a number of decisions and project management practices which, at the
time, just didn't seem to make sense. But I was young, and I often thought to myself that the people involved must have
some other reasoning, some justification for their actions that I was just not privy to.
In short, I remained quiet when I should have spoken up. What two decades of experience has taught me is that there
is rarely reasoning or justification behind actions that, at a gut-level, are clearly bad IT practices. We inherently
recognize when common sense has taken a back seat.
There is most definitely a dark side to BYOD. For the most part, I am an advocate for the consumerization of IT (using
non-standard apps and tools as a way to increase end user engagement and productivity) and support the bring-your-
own-device model.
However, as a seasoned manager and IT operations leader, I recognize the risks that come with the model if
organizations do not properly plan out their strategies, putting sufficient protections and governance practices in place
to manage the potential risks that could come from these unsupported devices and applications. End users often want
what’s NEW, but there are valid reasons for imposing and enforcing safeguards when giving mobile business users
access to your otherwise secure, scalable, and compliant systems.
Some people equate governance with bureaucracy and hierarchical systems, but those perceptions often come from a
lack of appreciation for the potential risks involved. Governance is about checks and balances -- supporting the tools
and systems your end users want, but in a way that is manageable and which follows defined protocols.

$2 billion.
While most IT professionals understand these risks viscerally, some business users need to crash and burn before
they are willing to adjust their risky behaviors, which is not a message your employer wants to hear. Luckily, there is

How and why this firm built mask-detecting
software

The software can scan crowds of people for
masks, check their temperatures and measure
their heart rates.
But CodeFirm’s newest product isn’t the tool of
an Orwellian state, Chief Revenue Officer Joel
Martin told Orlando Business Journal. “We don’t
want to become software for Big Brother.”
Instead, Faevision, developed by Orlando-based
CodeFirm Solutions LLC, is meant to make life
easier for businesses managing large groups of
people during the pandemic. The system
developed by the local tech solutions firm can scan for these indicators and more,
sending an alert to employees. And it does this while keeping data anonymous and
complying with privacy laws like HIPAA.
Of course, the applications of Faevision go beyond coronavirus. It also can be used
for security, to measure people flow or automate tasks like ushering in a theater,
CEO Troy Parker said. The software can be integrated with existing camera systems,
but CodeFirm is working with an unnamed Central Florida company to make
cameras that allow the full range of applications.

Here, Parker shares with OBJ why CodeFirm decided to launch Faevision and why
computer vision is the next “wave of technology.”
How did the firm decide to develop Faevision? Originally we were working on an
HR-type solution. It would be automating time clocks based on facial recognition
and then linking up with calendars and going to chatbots where you can ask of
anyone in the organization, “Where is this person?” The second Covid happened,
we said let’s just make an algorithm that detects whether or not someone’s wearing
their PPE when they walk in. It spiraled from there. We took that algorithm and
expanded upon it.
Does the software have applications beyond the pandemic? What we’re hoping is
that people are willing to take the jump because of Covid. Then they'll stay because
say, with a water park, we could detect if a child is drowning. We can detect, with a
pretty good degree of certainty and it’ll only get better over time, that these are the
signs of someone who’s drowning. In case, for whatever reason, that a lifeguard is
preoccupied with something else.
Do you think this type of solution will become more common because of the
pandemic? We’re trying to provide what is going to be the next major adoption
wave of technology for these industries. This is definitely coming, whether Covid
will spark it or not, but I think Covid is probably the best chance for people to adopt
this technology. You should purchase our suite, because I think ours is more
comprehensive than anything out there, but in general there’s a lot of options out
there. A lot of people will be making the jump right now.
Why do businesses typically hesitate to adopt a system like this? The first thing is
people have an inherent thing against Big Brother-esque feels. It’s also the price
point of the initial set up. You have to guarantee return on investment. The problem
was computer vision, machine learning, artificial intelligence, those all have been
prohibitively expensive until about three years ago. A lot of people don’t want to
jump into it because it’s not widely adopted yet, although it will be.
What’s your responses to these concerns? We’re anonymizing the data. It’s not
affecting anyone’s privacy. We’re just automating the job of what used to take a
person to manually look. That price point has been dropping significantly as it
becomes easier and easier. We’ve hit scale. There’s open-source knowledge out
there. Those price points go lower and lower. This is just a matter of in the next five

years we will be reaching that tipping point of early adopters to mid-stage adopters
