Throughout the current period of prison history, known as the period of mass incarceration, the United States has been “the world’s leader in incarceration with 2.2 million people currently in the nation’s prisons and jails – a 500% increase over the last forty years” (Sentencing Project, 2018). This dramatic increase in prison populations over such a short period of time, coupled with the fact that prisons have been brought out from isolation and into the public view, has created an influx of nationally recognized concerns.
Review the following short introductions to several of those concerns and select 2 concerns to address in your paper.
Adequate Medical Attention:
In Estelle V. Gamble, 429 U.S. 97 (1976), the Supreme Court ruled that all incarcerated persons have a right to receive “adequate” medical attention. The failure of the state to provide such attention constitutes a violation of the Eight Amendment; namely, the cruel and unusual punishment clause. In a short article for Health Law Perspectives, Conway (2009), examines the concept of deliberate indifference as related to Estelle. As well, he discusses the conflicts that many people feel when they, as law abiding, tax paying citizens, cannot afford health insurance or to see a medical provider when needed, yet a convicted felon is given free and frequent access to medical services often times without being charged.
Administrative Segregation:
The United States Supreme Court has not banned the use of Administrative Segregation in American prisons or other places of confinement. Rather, in general, the use of such is still at the discretion of each individual state. Many correctional administrators within those states argue that administrative segregation housing is an absolute necessity. It allows agencies to maintain safe prison systems by removing the most violent or incorrigible offenders from the general population. Thus giving those offenders who wish to take advantage of programmatic and rehabilitative services the opportunity to do so. However, recently Supreme Court Justice Kennedy began to question the constitutionality of solitary confinement and administrative segregation. Furthermore, in light of the psychological and behavioral effects often attributed to long term segregated housing, there is a growing social concern over its use as a permanent management tool.
Excessive Force:
Correctional officials are often required to use force to prevent serious and imminent harm, as well as to maintain the safety and security of the correctional facility. In Whitley v. Albers, 475 U.S. 312 (1986), the Supreme Court noted that if “force was applied in a good faith effort to maintain or restore discipline,” then it does not constitute an Eight Amendment violation of cruel and unusual punishment. In Hudson v. McMillian, 503 U.S. 1 (1992), however, the Court qualified their response to ensure that the use of excessive force is clearly recognized as unconstitutional. ...

Understanding the history of probation and parole is important because it helps us to see how we developed
the system that we use today. In fact, many of the current supervision and administration practices that are
used in probation and parole differ very little from the original concepts developed hundreds of years ago. In
ancient times, such as in the time of the Code of Hammurabi, most crimes were punished with physical
torture or death (King & Horne, 1915). Even fast forwarding to the thirteen colonies (of the present day United
States of America), physical torture and death were used often for punishment for crimes (Alarid, 2015). Fines
were also sometimes imposed, and failure to pay those fines resulted in imprisonment in “debtor’s prison.”
Our early colonial criminal justice system continued to use the forms of punishment that were familiar to them
because these were the traditional punishments inflicted for crimes in their native lands and they made the
most sense to them as a society. Punishments for various crimes also varied based upon how seriously the
society viewed that offense. For example, in medieval times, property crimes were punished very seriously
because many people were fighting for land ownership during that period (Alarid, 2015). As we began to
evolve as a society in the United States, we modeled a lot of our criminal justice system after the system of
the English; however, because we developed a constitution that provided for more justice for the common
man, we modified the system to be more fair and reasonable.
As you will see as you read the chapters assigned for this unit, the modern probation and parole systems
developed out of the goals of the criminal justice system—rehabilitation, incapacitation, deterrence,
restitution, and punishment (Abadinsky, 2012). Our probation and parole systems have also oscillated, as
discussed in the introduction, between the main goals of rehabilitation and punishment. As the pendulum for
the entire system has swung back and forth throughout the years, so has the administration of probation and
parole.

You work as a paralegal in a public defender’s office. The public defender hopes to gain funding to support programs that respond to criminal justice issues and that promote a more just society. Earlier in this course, you had an opportunity to criminology through the works of Messer et al. (2016), Salvatore (2017) and Zoutewelle-Terovan & Skardhamar (2016). These authors consider how criminology may help to explain factors that associate with crime. Recall for example the consideration of life course theory in Messer et al. (2016). To help the public defender with preparation, you have been asked to create a paper between six and eight pages in length. Your description of processes, explanation of issues, and analysis of critical perspectives will provide the foundation for the public defender’s address to the local legislative committee, and thereby promote support for programs and laws that address large societal problems and that promote the social justice principles of equality, solidarity, and human rights to build a more just society.

Throughout the current period of prison history, known as the period of mass incarceration, the United States has been “the world’s leader in incarceration with 2.2 million people currently in the nation’s prisons and jails – a 500% increase over the last forty years” (Sentencing Project, 2018). This dramatic increase in prison populations over such a short period of time, coupled with the fact that prisons have been brought out from isolation and into the public view, has created an influx of nationally recognized concerns.
Review the following short introductions to several of those concerns and select 2 concerns to address in your paper.
Adequate Medical Attention:
In Estelle V. Gamble, 429 U.S. 97 (1976), the Supreme Court ruled that all incarcerated persons have a right to receive “adequate” medical attention. The failure of the state to provide such attention constitutes a violation of the Eight Amendment; namely, the cruel and unusual punishment clause. In a short article for Health Law Perspectives, Conway (2009), examines the concept of deliberate indifference as related to Estelle. As well, he discusses the conflicts that many people feel when they, as law abiding, tax paying citizens, cannot afford health insurance or to see a medical provider when needed, yet a convicted felon is given free and frequent access to medical services often times without being charged.
Administrative Segregation:
The United States Supreme Court has not banned the use of Administrative Segregation in American prisons or other places of confinement. Rather, in general, the use of such is still at the discretion of each individual state. Many correctional administrators within those states argue that administrative segregation housing is an absolute necessity. It allows agencies to maintain safe prison systems by removing the most violent or incorrigible offenders from the general population. Thus giving those offenders who wish to take advantage of programmatic and rehabilitative services the opportunity to do so. However, recently Supreme Court Justice Kennedy began to question the constitutionality of solitary confinement and administrative segregation. Furthermore, in light of the psychological and behavioral effects often attributed to long term segregated housing, there is a growing social concern over its use as a permanent management tool.
Excessive Force:
Correctional officials are often required to use force to prevent serious and imminent harm, as well as to maintain the safety and security of the correctional facility. In Whitley v. Albers, 475 U.S. 312 (1986), the Supreme Court noted that if “force was applied in a good faith effort to maintain or restore discipline,” then it does not constitute an Eight Amendment violation of cruel and unusual punishment. Understanding the history of probation and parole is important because it helps us to see how we developed
the system that we use today. In fact, many of the current supervision and administration practices that are
used in probation and parole differ very little from the original concepts developed hundreds of years ago. In
ancient times, such as in the time of the Code of Hammurabi, most crimes were punished with physical
torture or death (King & Horne, 1915). Even fast forwarding to the thirteen colonies (of the present day United
States of America), physical torture and death were used often for punishment for crimes (Alarid, 2015). Fines
were also sometimes imposed, and failure to pay those fines resulted in imprisonment in “debtor’s prison.”
Our early colonial criminal justice system continued to use the forms of punishment that were familiar to them
because these were the traditional punishments inflicted for crimes in their native lands and they made the
most sense to them as a society. Punishments for various crimes also varied based upon how seriously the
society viewed that offense. For example, in medieval times, property crimes were punished very seriously
because many people were fighting for land ownership during that period (Alarid, 2015). As we began to
evolve as a society in the United States, we modeled a lot of our criminal justice system after the system of
the English; however, because we developed a constitution that provided for more justice for the common
man, we modified the system to be more fair and reasonable.
As you will see as you read the chapters assigned for this unit, the modern probation and parole systems
developed out of the goals of the criminal justice system—rehabilitation, incapacitation, deterrence,
restitution, and punishment (Abadinsky, 2012). Our probation and parole systems have also oscillated, as
discussed in the introduction, between the main goals of rehabilitation and punishment. As the pendulum for
the entire system has swung back and forth throughout the years, so has the administration of probation and

Correctional psychology is the application of psychological theory and
research to the correctional system (Clements et al., 2007; Magaletta,
Patry, Dietz, & Ax, 2007). We begin this chapter with overviews of the
structure of the correctional system and the history of correctional psy-
chology in the United States. Next, we discuss in greater detail two of the
most important topics in correctional psychology: offender assessment and
management. The selection, training, and support of correctional staff are
covered in Chapter 9 .

Background
You work as a paralegal in a public defender’s office. In an upcoming presentation to a local legislative committee, the public defender plans to address criminal justice issues, constitutional principles, cultural sensitivity, and diversity awareness to promote social justice goals in local communities. You have been asked to assist the public defender in preparing the presentation. To this end, you will explore processes and issues in three criminal cases, applications for criminology, and relevant critical perspectives toward the goal of building a more just society.
Your Task
The public defender hopes to gain funding to support programs that respond to criminal justice issues and that promote a more just society. Earlier in this course, you had an opportunity to criminology through the works of Messer et al. (2016), Salvatore (2017) and Zoutewelle-Terovan & Skardhamar (2016). These authors consider how criminology may help to explain factors that associate with crime. Recall for example the consideration of life course theory in Messer et al. (2016). To help the public defender with preparation, you have been asked to create a paper between six and eight pages in length. Your description of processes, explanation of issues, and analysis of critical perspectives will provide the foundation for the public defender’s address to the local legislative committee, and thereby promote support for programs and laws that address large societal problems and that promote the social justice principles of equality, solidarity, and human rights to build a more just society.
The public defender has come across three distinct cases that highlight the criminal justice issues that the legislature needs to address. Each case is preceded by a video summary that will comprise a portion of the public defender’s presentation to the legislative committee. To provide context for the public defender’s presentation to the legislative committee, the initial part of your paper should explain issues and describe processes about the following case scenarios:

The classical view of punishment was fueled by the notion that offenders were evil men and women who had to be punished severely or killed for their egregious acts. It was felt that the demons that possessed the offenders would never leave except by expiation and punishment.
As the influence of natural and social science grew, many individuals began to reexamine the widely accepted idea that crime resulted from demonic possession, free will, or mental imbalance. Positivists took a progressive stance and began to analyze the causes of crime and punishment.

An example of this constrained assistance was the World Bank, which imposed restrictions that included privatization of health care, as well as required limitations on universal access.
