The Influence of European on Spanish social law: The labour market reforms in Spain (Lecture for Law Students and Union Representatives in the University of Antwerp, October 2013).
The second European Forum on Demography discussed developments in active aging and family policies in the EU. Over two days, six workshops were held on these themes and on how member states are responding to demographic challenges. Participants focused on issues like increasing the number of people in the workforce for longer, improving work-life balance, reforming education and promoting lifelong learning, reforming pensions, voluntary work, and immigrant integration and family support. The main issue was the need for a better work-life balance to help families. Examples from Germany of funding childcare for employees was discussed. Efforts are needed to improve fertility rates and women's participation in the labor market. The forum also discussed employment for older workers and challenges like lower qualifications and discrimination

Abstract:
It seems to be that Hungary under the Orbán-era has become one of the main fighters for sovereignty in the EU. In this paper I am trying to challenge this over-simplification and show the many faces of the system. According to my hypothesis under the populist-nationalist surface of the Orbán-regime there is disappointing compromise between the government and the globalized capitalism. The most state direct (subsidies, tax benefits) and indirect (labour law against the employees) aids have been given by the “nationalist Orbán’s governments” since the regime change. In this sense I put an emphasize on the investigation this new form of post-modern nationalism, which is based on discursive fight for sovereignty, but at the same time sacrifice it in the context of neoliberal capitalism. In this sense, I will analyse the pact between the Orbán’s governments and neoliberal (especially German) companies. Emphasizing and analysing this embarrassing phenomenon, the abdication of sovereignty and the brutal fight for it, are the main goals of this paper. I am dealing with this paper the discursive and economic nationalism as crucial factors of sovereignty.
The Evolution of Public Sector Employment and Public Debt in the United Kingd...inventionjournals
This paper analyses the evolution of public sector expenditure and public sector employment in the United Kingdom before and during the recent economic crisis. Public sector has come to a moment when significant transformations had to be done, both from a structural and functional point of view. This paper sets the economic, political and social framework in which the process of reorganization took place following the 2008-2010 economic crisis and discusses a series of factors that determined the UK government to undertake these measures. The aim of the research is to provide a complete diagnosis of how public expenditure and employment evolved before the recent economic downturn and describe the functional relationship between public employment size and its costs.
The document discusses employment policy and the European Parliament in the context of the global economic crisis. It provides statistics on unemployment in the EU and expenditures on social protection since 1994. It outlines how the EU and national governments tackled the crisis through economic recovery plans, easing labor markets, and unemployment benefits. It argues structural reforms are needed in financial regulation, supervision, and at the corporate level. A European growth and employment pact is proposed, balancing fiscal stability and growth while focusing on social indicators, public investment, and youth unemployment.
Modern labour theories and practice. Covers issues like employment, unemployment, migration, brain drain, entrepreneurship, workaholism, and trade unions.
Employment Relations in Germany and SwedenAndreea Nan

1) The historical development and key actors within the German system, including trade unions, employers, government, and the dual system of co-determination and collective bargaining.
2) Key aspects of the Swedish tripartite system including trade unions, employers' organizations, and the government's role. It also discusses the Laval case ruling.
3) The effects of globalization and Europeanization on both countries, including issues like decentralization of bargaining and increasing labor flexibility.

The document summarizes recent labor reforms in Spain from 2010 to 2011. It discusses changes introduced by the Spanish government and EU that aimed to reduce labor market segmentation and increase flexibility. Key points include:
- New regulations introduced contracts to promote indefinite hiring with lower firing costs, allowed more flexibility in modifying work conditions, and expanded the role of private employment agencies.
- Recent reforms faced criticism from unions for weakening worker protections. Agreements between unions and employers incorporated some reforms into law to help sustainability of pension systems.
- The impacts of reforms were meant to make temporary hiring more difficult while increasing business flexibility, but critics argue in some cases flexibility for businesses was increased at the expense of worker protections.

The document discusses several potential consequences of Donald Trump's presidency on labor and employment issues in the United States:
1. Trump has pledged to pursue more pro-employer practices like creating 25 million new jobs over 10 years and raising the minimum wage.
2. His policies around immigration and foreign workers hiring could significantly impact low-wage industries by potentially deporting undocumented immigrants and placing new restrictions on hiring foreign labor.
3. Various labor-backed initiatives around increasing the minimum wage, expanding paid leave, regulating unpredictable work scheduling, and enforcing wage theft laws may continue advancing at the state level, even without federal support.

The document discusses the rationale for minimum wage in Malaysia. It aims to ensure workers' basic needs are met, provide social protection, encourage industries to invest in productivity, and reduce reliance on foreign labor. While intended to help workers, minimum wage also faces criticisms like potentially increasing unemployment and costs for businesses. It must be implemented carefully with considerations for employment, inflation, and different stakeholders to achieve its aims without adverse effects.

Besides discussing the key lessons learned from previous studies on platform work, Section 2 briefly illustrates the national trends and initiatives in policy making. At the same time, it presents and discusses the main outcomes of domestic litigation. After introducing the Pillar of Social Rights, Section 3 analyses two important achievements at the EU level, namely the Directive on transparent and predictable working conditions and the Recommendation on access to social protection for workers and the self-employed. In the same vein, Section 4 assesses the elasticity of the triad of EU Directives regulating atypical employment. It is argued that the narrow construction of their personal ambit of application may represent an insurmountable obstacle for platform workers. However, a dynamic and uniform interpretation of the CJEU case law could result in classifying some platform workers as falling under the scope of the social acquis in some socio-legal areas.
The document discusses social dialogue and updating labor relations systems. It notes that while international labor standards aim to protect workers, they have not been fully effective and mechanisms of social dialogue have only mitigated conflict. It argues that labor must be viewed in the contexts of today's knowledge economy, globalization, and commodification. Social dialogue is presented as a tool to deal with economic and social problems through cooperation between government, workers, and employers organizations. Key aspects of flexicurity policies are also outlined, including labor market policies, lifelong learning, social protection, and social dialogue. The document stresses that flexicurity models must be adapted to each country's experiences and that Brazil requires shifts toward collective bargaining and a more balanced responsibility between job and

This document summarizes research on the effects of minimum wages. It finds that minimum wages generally reduce employment opportunities for low-skilled workers, as conventional economic models predict. UK studies show small effects, but the UK is a poor setting due to confounding welfare changes and a lack of regional variation. Better evidence from Canada, US, and OECD country panels show clearer adverse employment effects. Alternative policies like improving education and subsidizing low-paid work may better help the poor without negative employment impacts.

This document discusses the development of social policy and legislation in the UK and European Union. It provides an overview of key acts and regulations related to welfare in the UK and EU frameworks. It also outlines the historical phases of social policy in the EU from an initial neo-liberal period to later periods of increased social action, stagnation, and renewed optimism as the internal market developed. Key institutions like the European Court of Justice and documents like the Charter of Fundamental Social Rights of Workers are also mentioned.
Preparing for the nature of changing workEliaINMvula
The document proposes that governments prepare for changes in the nature of work due to technology by investing in human capital through education, strengthening social protections, and increasing revenue. It recommends early childhood education to develop skills like problem-solving and teamwork. Governments should expand social insurance, job training for adults, and infrastructure access to help people transition between jobs. Raising taxes can fund these efforts and help societies benefit from new technologies through a strengthened social contract and support for workers.
Consultation européenne sur des salaires minimums équitablesPaperjam_redaction
This document introduces a consultation with social partners on ensuring fair minimum wages in the EU. It notes that one in six EU workers earn a low wage, and in-work poverty has increased. Minimum wages can help protect low-wage workers and reduce inequalities while supporting overall wage growth if set appropriately. However, increases must consider employment and competitiveness effects. The consultation aims to address challenges around fair minimum wages while respecting national traditions and social partner autonomy in wage setting.
This editorial summarizes the key points from the World of Work Report 2009. It discusses that while the global economy is showing signs of recovery, the global jobs crisis is far from over and could worsen without adequate action. It estimates that at least 20 million jobs have been lost and about 5 million more workers are at risk of job losses. Nearly 43 million workers are also at risk of long-term labor market exclusion. Premature withdrawal of stimulus measures could prolong the crisis and undermine recovery. Continued job-centered stimulus in line with the Global Jobs Pact, along with financial sector reforms, are needed to address the crisis and make recovery sustainable.
Informal sector labour markets in developing countries 0Dr Lendy Spires
This document discusses characteristics of informal labor markets in developing countries. It presents two opposing views on the causes of informal markets - either as a residual sector absorbing excess labor or a dynamic sector of entrepreneurship. It then examines examples of involuntary informal employment driven by state intervention and labor market segmentation in China, South Africa, and India. Specifically, it discusses how China's hukou system and South Africa's labor regulations have segmented their labor markets. The document also notes evidence that wage differentials can exist between large and small firms independently due to efficiency wage theories, as seen in Zimbabwe. Overall, the document analyzes factors contributing to both voluntary and involuntary informal employment.
Labour Policy in Indian Five Years Plan.pptxKaushik Kundu
Labour policy in India aims to increase productivity while also protecting workers' rights and welfare. Key aspects of labour policy outlined in the document include:
1. Establishing a minimum wage, improving working conditions, and encouraging workers' participation in management to promote industrial harmony essential for economic growth.
2. Recognizing trade unions and collective bargaining, while also expecting unions to take on greater responsibilities in national development.
3. Expanding vocational training programs to meet the increasing demand for skilled labour in a developing economy.

2. The Influence of European on Spanish
social law: The labour market reforms in
Spain
Les conséquences sur le droit social
espagnol des pressions de l’UE: La
Réforme du Travail en Espagne
Universiteit Antwerpen. Faculteit Rechten.
25/10/2013
3. What is Spain’s main problem?
1º UNEMPLOYMENT
2º CORRUPTION AND FRAUD
3º ECONOMIC PROBLEMS
4º POLITICIANS
3
4. POINTS OF INTEREST CONCERNING THE
SPANISH LABOUR MARKET
1. Focused on the building industry (“housing
bubble burst” in 2009); services and
tourism.
2. Characterized by small companies (8 out of
every 10 have two, one or no employees).
3. In July 2013, the unemployment rate was
26,4%.
4
5. Unemployment and voulnerable groups:
• The Unemployment
rate is high amont the
young people, 51 % of
whom are unemployed
BUT MORE ALARMING
IN:
• ADULTS OVER 45 and
OLDER POPULATION
(+55)
• IMMIGRANTS
• “Brain drain”.
5
6. 4. National Minimum Wage: 645,30 e. (month) /
21,51 e. (day)
The average salary: 19.900 e. (year)
The most common salary is 15.500 e. (year)
5.Market duality between workers wiht
permanent contracts and temporary workers.
6
7. 6. State regulation trhough labour laws has
exerced a strong influence in shaping labour
relations;
collective
bargaining
has
influenced in salaries and daily working
hours (nowdays, this change with reforms).
7. The role of the judicial authority in
conflict management has increased at the
expense of Public Labour Authorities.
7
8. EXPLANATION OF THE LABOUR
MARKET REFORMS
•The Conservative Government promoted a series
of legislatives amendments by taking “urgent”
measures (undermining the idea of democray and
functioning of the Parliament)
•Criticism (Manifesto in favour of Decent work and
Total collective freedom): the Goverment grants
exorbitant powers to employers and don’t
contemplates collective bargaining as a tool for
correcting unfair labour relationship.
8
9. POLITICAL FRAMEWORK OF REFORM
•To blame labour laws for the poor functioning of
the labour market
•The idea of a large number of public service
workers and that their working condicions were
privileged.
•Political opinion created the idea that “Spanish
had lived beyond their means”
9
10. THE MAIN LINES OF THE REFORM
1. The Law includes
measures intended
to favour the
“worker’s
employability”:
• 1.1 Widened the scope
of Temporary
Employment Firms.
• 1.2 Promoted
temporary contracts for
training for workers (1630): They earn less
thant National
Minimum Wage.
10
11. 2. Promotes permanent
contracts and favour
creation of
employment:
• 2.1 New permanent
contract for SMEs with
a one-year probationary
period.
• 2.2 Promotes Part-time
contracts with
possibility to do
overtime.
11
12. 3.1 Make easier to change
worker’s fonctions.
3. Favour internal
flexibility as an
alternative to job
destruction
(Wide ranging powers to the
employer: the employer
as “The Lord of the
manor).
3.2 Allow the employer
distribute 10% of the
annual working day
irregularly.
3.3 Greater powers to
employer to make
substantial changes of
working conditions
12
13. AS A RESULT:
Working conditions
that the employer
should change may
be related with:
• SALARY
• WORKING DAY or
DAILY WORKING
HOURS.
• REDUCTIONS IN PAYS
OR PAY FREEZE IN
COLLECTIVE
BARGAINING
• MORE DAILY WORKING
HOURS (WITHOUT
COMPENSATION)
In fact, Not in SMEs, but in COMPANIES WITH
OVER 50 or 250 WORKERS
13
14. Another consequence of importance
of powers granted to company
manegement: situations in which
the employer unlawfully asks the
salaried worker to become selfemployed if he/she whises to
continue working for the company.
14
15. 3.4 The reform gives priority to firm level
collective agreements.
3.5 Possibility of “opting out” from a wide
number of obligations from collective bargaining
of productive sectors.
3.6 The reform terminate with so called “ultraactivity” of collective agreements.
15
16. 4. The Government
“favour the
effectiveness of the
labour market and
reduce duality”
4.1 In collective
dismissals, eliminating
the autorisation of the
Public Labour
Administration
4.2 It’s easier for the
employer to sack
workers either by
protecting reasons for
dismissal by law, or by
reducing the amonut
paid in compensation.
16
17. In fact, companies have taken
advantage of this opportunity to
reduce staff members, in
preference to the option of
making working conditions more
flexible
17
18. THE CONTINUATION OF LABOUR
REFORMS-SHORT TERM PLANS
• The pension system.
• The active labour market policies: the support of greater
presence of private placement agencies.
•Providing the working population with the level
competence needed (the needs of the labour market).
•Reduce number of people at risk of poverty.
18
19. CONCLUSION ON WHAT THE
LABOUR REFORMS HAVE MEANT:
1. A power imbalance in favour of the
employer.
2. An increase in situations of irregular or
atypical employment, which is also
related to the informal economy
19
20. 3. Loos of Union bargaining power in
relation to working conditions.
4. Loos of power of the Public
Administration to mediate in resolving
labour conflicts, and increase in the
importance of the Labour Courts.
20
21. 5. The labour reforms have been a disaster in
targeting job creation.
6. Loos of an important number of Public
Administration workers.
7. To sum up, the labour market reforms are
not resolving the unemployment situation:
poverty and social inequality are increasing
21
22. The Popular Party’s form of
government and way of legislating is
taking its toll on Spanish democracy.
The establishment of the State of
Spain as a Welfare State has been
called into question.
22
