SUB : ANSWERS TO QUESTIONNAIRE ON UNIFORM CIVIL CODE (UCC)
Respected Sir,
The following are my answers to the Questionnaire on the Uniform Civil Code :
Q. 1. Are you aware that Article 44 of the Constitution of India provides that "the State shall
endeavour to secure for the citizens a Uniform Civil Code throughout the territory of
India"?
ANS a. Yes, I am aware of Article 44 of the Constitution of India.
b. No. .(x)
In your view, does this matter require any further initiatives? -----
ANS : There is no need ofany Uniform Civil Code nor it requires any further initiatives.
According to Fundamental Rights conferred upon the citizen by the Constitution,
every citizen has right to follow the Religion of his choice and therefore he/she
accepts and follows the Laws and Customs ofthe Religion which he/she chooses.
The Uniform Civil Code violates the Fundamental Right of Citizen to follow the
Tenets of Religion.
Q.2. The various religious denominations are governed by personal laws and customary
practices in India on matters of family law, should the UCC include all or some of these
subjects?

Q3. Do you agree that the existing personal laws and customary practices need codification
and would benefit the people?

ANS b. No. There is no need ofcodification of Personal Laws and the same will not
benefit the people.
c. Personal laws and customary practices should be replaced by a uniform code.(x)
d. Personallaws and customary practices should be codified to bring them in line with
fundamental rights. .(x)
Q.4. Will uniform civil code or codification of personal law and customary practices ensure
gender equality?
a. Yes. .(x)
ANS : b. No.
Q.5. Should the uniform civil code be optional?
a. Yes. .(x)

ANS : It should neither be optional nor compulsory. I strongly oppose UCC.
Q.6. Should the following practices be banned and regulated?

c. Similar customary practices such as Maitri-karaar (friendship deed0 et al.

Q.7. Should the practice of triple talaq be
a. Abolished in toto. .(x)
ANS : b. Practice of Triple Talaq should be Retained as it is as per the Islamic Laws.
c. Retained with suitable amendments. .(x)
Q.8. Do you think that steps should be taken to ensure that Hindu women are better able to
exercise their right to property, which is often bequeueathed to sons under customary
practices ?
a. Yes, Hindu women must be made aware of this right and measures should be taken
to ensure that women, under pressure from family do not forego their property.
b. No there are adequate protections in the existing law.
c. Legal provisions will not help in what is primarily a cultural practice, steps have to
be taken to sensitise the society instead..

Q.9. Do you agree that the two-year period of wait for finalising divorce violates
Christian women's right to equality?
a. Yes, it should be made uniform across all marriages
b. No. This period is sufficient and in-keeping with religious sentiments.
ANS : No Comment.
Q.10. Do you agree that there should be a uniform age of consent for marriage across all
persona laws and customary practices ?
a. Yes. (x)
ANS : b. No, Customary laws locate this age at the attainment of puberty.
c, the prevailing system of recognizing “voidable” marriages is sufficient. (x)
Q.11. Do you agree that all the religious denominations should have the common grounds for
divorce ?
a. Yes, (x)
ANS : b. No,there cannotbe commongrounds fordivorce.The Culturaldifference must
be preserved.
c. No, but there should be the same grounds for divorce available for men and women
within personal law. (x)

Q.12. Would uniform civil code aid in addressing the problem of denial of maintenance or
insufficient maintenance to women upon divorce ?
a. Yes.(x)
ANS : b. No.
Give Reasons : The differentPersonalLaws have differentprovisionsregarding marriage
and maintenance. Muslim Personal Law permits second marriage or more
marriages upon divorce to the women, therefore the provisions for maintenance
under Muslim Laws are made according to the situation.
Q.13. How can compulsory registration of marriages be implemented better?
ANS : Muslim Marriages being a contract, has a certificate known as “NIKAHNAMA”
issued by the Quazi, at the time of marriage. The Quazis are appointed by the
Wakf Boards and are Statutory Authorities under the Quazis Act. The certificate
issued by the Quazi i.e. NIKAHNAMA, which is registered with the WakfBoard,
is itselfa registered certificate ofperformance ofmarriage as the same is already
registered with the Wakf Board.
Apart from maintaining the record by Wakf Board, every marriage is now
required to be registed under the Common Laws with Municipal corporations,
Municipal Council or Gram Panchayat, as the case may be.
Q.14. What measures should we take to protect couples who enter into inter-religion and
inter-caste marriages ?
ANS : Special Marriage Act, is in existence, they are governed by the same and hence no
further measures are required.
Q.15. Would uniform civil code infringe an individual's right to freedom of religion?
ANS : a. Yes. It will infringe my right to freedom of Religion.
b. No. (x)
Give reasons: A religion does not put compulsion on any person to follow it and its
customs. The citizen is all free to follow it or its laws and customs. The persons
who are following a Religion have the beliefin it’s Basic Tenets and are therefore

submitting themselves voluntarily to the laws and customs ofthe Religion which
he or she chooses.. Therefore there cannot be any grievance of any follower of
religion regarding its laws and customs, as they have submitted to it, voluntarily
without any coercion. The citizensare enjoying theirPersonalPaws underArticle
25 of the Constitution of India and Uniform Civil Code would infringe the
individual’s right to freedom of Religion.
Q.16. What measures should taken to sensitize the society towards a common code or
codification of personal law ?
ANS : No measures should be taken to sensitize the society towards a common code or
codification of personal law. If any measures are taken, it amounts to
manipulation of the society.
REMARKS : Article 44 ofthe Constitution ofIndia is under Part IVofthe Constitution
of India, which are Directive Principals. Article 25 is under Part III of the
Constitution ofIndia, which confers Fundamental Rights on the Citizens, which
cannot be violated in any circumstances.
Regarding Gender Inequality, it must be borne in mind that a person cannot be
said to be a follower of a Religion who denies its laws, therefore he/she cannot
make grievance to change the same,as he/she doesn’tfollows it. Article 25 confers
right on the Citizen to follow or not to follow any religion and its laws. There is
no compulsion on any citizen to follow the religion under coercion. Therefore
there is no needto bring Uniform CivilCode,as the same violatesthe fundamental
rights of the Citizen.
At present there is no exigencies in respect ofpublic order, morality or health,
which could invite the situation to enact Uniform Civil Code.

Marg, New Delhi – 110001 SUB : ANSWERS TO QUESTIONNAIRE ON UNIFORM CIVIL CODE (UCC) Respected Sir, The following are my answers to the Questionnaire on the Uniform Civil Code : Q. 1. Are you aware that Article 44 of the Constitution of India provides that "the State shall endeavour to secure for the citizens a Uniform Civil Code throughout the territory of India"? ANS a. Yes, I am aware of Article 44 of the Constitution of India. b. No. .(x) In your view, does this matter require any further initiatives? ----- ANS : There is no need ofany Uniform Civil Code nor it requires any further initiatives. According to Fundamental Rights conferred upon the citizen by the Constitution, every citizen has right to follow the Religion of his choice and therefore he/she accepts and follows the Laws and Customs ofthe Religion which he/she chooses. The Uniform Civil Code violates the Fundamental Right of Citizen to follow the Tenets of Religion. Q.2. The various religious denominations are governed by personal laws and customary practices in India on matters of family law, should the UCC include all or some of these subjects?

Do you agree that the existing personal laws and customary practices need codification and would benefit the people? a. Yes. .(x) ANS b. No. There is no need ofcodification of Personal Laws and the same will not benefit the people. c. Personal laws and customary practices should be replaced by a uniform code.(x) d. Personallaws and customary practices should be codified to bring them in line with fundamental rights. .(x) Q.4. Will uniform civil code or codification of personal law and customary practices ensure gender equality? a. Yes. .(x) ANS : b. No. Q.5. Should the uniform civil code be optional? a. Yes. .(x) b. Practice of Triple Talaq should be Retained as it is as per the Islamic Laws. c. Retained with suitable amendments. .(x) Q.8. Do you think that steps should be taken to ensure that Hindu women are better able to exercise their right to property, which is often bequeueathed to sons under customary practices ? a. Yes, Hindu women must be made aware of this right and measures should be taken to ensure that women, under pressure from family do not forego their property. b. No there are adequate protections in the existing law. c. Legal provisions will not help in what is primarily a cultural practice, steps have to be taken to sensitise the society instead.. ANS : No Comment. Q.9. Do you agree that the two-year period of wait for finalising divorce violates Christian women's right to equality? a. Yes, it should be made uniform across all marriages b. No. This period is sufficient and in-keeping with religious sentiments. ANS : No Comment. Q.10. Do you agree that there should be a uniform age of consent for marriage across all persona laws and customary practices ? a. Yes. (x) ANS : b. No, Customary laws locate this age at the attainment of puberty. c, the prevailing system of recognizing “voidable” marriages is sufficient. (x) Q.11. Do you agree that all the religious denominations should have the common grounds for divorce ? a. Yes, (x) ANS : b. No,there cannotbe commongrounds fordivorce.The Culturaldifference must be preserved. c. No, but there should be the same grounds for divorce available for men and women within personal law. (x)
  • 4. 4 Q.12. Would uniform civil code aid in addressing the problem of denial of maintenance or insufficient maintenance to women upon divorce ? a. Yes.(x) ANS : b. No. Give Reasons : The differentPersonalLaws have differentprovisionsregarding marriage and maintenance. Muslim Personal Law permits second marriage or more marriages upon divorce to the women, therefore the provisions for maintenance under Muslim Laws are made according to the situation. Q.13. How can compulsory registration of marriages be implemented better? ANS : Muslim Marriages being a contract, has a certificate known as “NIKAHNAMA” issued by the Quazi, at the time of marriage. The Quazis are appointed by the Wakf Boards and are Statutory Authorities under the Quazis Act. The certificate issued by the Quazi i.e. NIKAHNAMA, which is registered with the WakfBoard, is itselfa registered certificate ofperformance ofmarriage as the same is already registered with the Wakf Board. Apart from maintaining the record by Wakf Board, every marriage is now required to be registed under the Common Laws with Municipal corporations, Municipal Council or Gram Panchayat, as the case may be. Q.14. What measures should we take to protect couples who enter into inter-religion and inter-caste marriages ? ANS : Special Marriage Act, is in existence, they are governed by the same and hence no further measures are required. Q.15. Would uniform civil code infringe an individual's right to freedom of religion? ANS : a. Yes. It will infringe my right to freedom of Religion. b. No. (x) Give reasons: A religion does not put compulsion on any person to follow it and its customs. The citizen is all free to follow it or its laws and customs. The persons who are following a Religion have the beliefin it’s Basic Tenets and are therefore
  • 5. 5 submitting themselves voluntarily to the laws and customs ofthe Religion which he or she chooses.. Therefore there cannot be any grievance of any follower of religion regarding its laws and customs, as they have submitted to it, voluntarily without any coercion. The citizensare enjoying theirPersonalPaws underArticle 25 of the Constitution of India and Uniform Civil Code would infringe the individual’s right to freedom of Religion. Q.16. What measures should taken to sensitize the society towards a common code or codification of personal law ? ANS : No measures should be taken to sensitize the society towards a common code or codification of personal law. If any measures are taken, it amounts to manipulation of the society. REMARKS : Article 44 ofthe Constitution ofIndia is under Part IVofthe Constitution of India, which are Directive Principals. Article 25 is under Part III of the Constitution ofIndia, which confers Fundamental Rights on the Citizens, which cannot be violated in any circumstances. Regarding Gender Inequality, it must be borne in mind that a person cannot be said to be a follower of a Religion who denies its laws, therefore he/she cannot make grievance to change the same,as he/she doesn’tfollows it. Article 25 confers right on the Citizen to follow or not to follow any religion and its laws. There is no compulsion on any citizen to follow the religion under coercion. Therefore there is no needto bring Uniform CivilCode,as the same violatesthe fundamental rights of the Citizen. At present there is no exigencies in respect ofpublic order, morality or health, which could invite the situation to enact Uniform Civil Code.
