Jane Adams Dissent From Militaristic Imperialism Analysis
While it seems that many Americans, businessmen and politicians, eventually saw the war and the
annexation of foreign lands as a good, necessary and honorable endeavor, there were still many more
who felt the imperialism of US policy was not only unnecessary but also destructive to the US way of
life. In the next section of the Imperial Surge, the essays focus on the anti imperialist who publicly
denounced the US and what was happening in the Philippines and Hawaii.
In President Cleveland s Opposition to the Annexation of Hawaii , Thomas Osborne discusses the
reasons why President Cleveland denounced the annexation of Hawaii. In 1893, President Harrison s
administration assisted American sugar planters and overthrew the Hawaiian Queen. ... Show more

discusses the American writers who were critics of the events in the Philippines. There were a few
American writers who supported the American interventions in the Philippines. The number who
opposed the Philippine policies greatly outnumbered the supporters. The most effective writers were
the satirists. Even Theodore Roosevelt admitted to enjoying the observations of Mr. Dooley, Finley
Peter Dunne s philosophical Irish American saloon keeper... (133). Samuel Clemens also used his pen
name, Mark Twain, to attack the administration. He had told a New York newspaper that he had
become convinced that the aim of American policy was not redemption but conquest. (134). Anti
imperialist poets gave the most stinging critics. Imperialism in their eyes was made doubly wrong by
being wrapped in the humbuggery of benevolent assimilation, Christian duty, and the expansion of
liberty. (136). The poets were using the American Dream as the victim of the Imperialistic policies that
the US government was following. American writers varied in the degree that they were willing to
dissent. As was already stated, poets and satirists were in direct opposition, while college professors
were more moderate and literary magazines and journals were evenly divided. While they were vocal
about their beliefs, is seemed to do little to influence either the public or the

Using Cognitive Biases In Research
At first I did not know what the meaning of cognitive biases is, so I had to do some research to better
understand the meaning. From what I have research cognitive biases is basically you see what you
want, and look for things to confirm what you are looking for essentially ignoring or disregarding any
information that disproves your believe. According to CIA.gov it states that Cognitive biases are
mental errors caused by our simplified information processing strategies. It is important to distinguish
cognitive biases from other forms of bias, such as cultural bias, organizational bias, or bias that results
from one s own self interest. (CIA.gov, 2012) another way to look at cognitive biases is that it is a
subconscious decision made on a certain issue. I feel that the best way for intelligence analyst to
reduce or overcome the thought of cognitive biases would be to always look at the different
perspectives to an occurrence before judging it too greatly. ... Show more content on Helpwriting.net

An analyst can also reduce their cognitive biases by simply using critical thinking to think through the
issue or problem allowing the brain to identify logic, reason and empiricism. Using critical thinking
also allows the analyst not to rush into any conclusions or decision that may be wrong or miss leading.

an example of cognitive biases although the threat was there people has a belief that an attack of that
magnitude could never happen in America. People only wanted to see what they wanted, end result

Essay On The Elizabethan Era
Elizabethan Era Then and now
Elizabethan Era is one of many memorable and important events in England. It got its name from

pride through classical ideals, poetry, literature, and more. There are three aspects the states that the

their social classes, with that being said a person who wears old or lame clothes would be in the lower

such as nobles. Today people can wear anything that they want to wear; a poor person can have stylish
clothes and the rich could wear old or dirty clothes. Their entertainment was extremely important to
the people who lived in the Elizabethan era. Elizabethan entertainment was popular when there was
something to celebrate and it often occurred nightly, but there were different types of entertainment
among the classes in England. Rich would do things which the poor couldn t do or afford such as
watch plays, go hunting, jousts among knights, and more. The poor or the middle class would simply
just listen to travelling musicians and actors or to watch public plays. Today rich could only have
entertainment, because the poor has to work to feed themselves and has no spare money to do such
lavish things such as watching movies, going to a basketball game, or go to a concert. During this
period women were considered inferior to men and were not allowed to have a job, this required men
to become the sole source of the family income and to represent it. They would usually work their

Sleep Analysis Essay On Sleep
Sleep Analysis As we learned in lecture, sleep is an important component in improving a person s
overall health. Because sleep is vital for cognitive function and available time to spend sleeping is
limited for college students, like myself, it is advantageous to change sleeping behaviors to maximize
the benefits sleep can provide. After tracking my sleeping schedule for a week, I have noticed some
patterns and behavior that may be affecting the quality of sleep I am getting. Based on my sleep
journal, I could improve my sleep by cutting back on the amount of caffeine I intake and the time
spent on electronics before bed to try to reduce the amount of time needed for me to fall asleep. I
tracked my sleep for one week early on in the semester when I was less busy and able to get more
sleep, however the overall patterns in how I felt when waking up and trouble falling asleep have
remained mostly the same. In this particular week, I got an average of about nine hours of sleep per
weeknight. The recommended amount of sleep per night is between eight to nine hours (Teague 77). I
would say I need at least eight full hours of sleep a night to feel like I am well rested. I did not occur a
sleep debt during this week, however I have experienced weeks were I did accumulate a sleep debt.
When this occurs, I usually try to make up for it by sleeping in on the weekends rather than napping. I
have found that taking naps isn t an effective way for me to reduce my sleep debt because I

The Writer In The Family Short Story
In John Updike s A P, and E.L. Doctorow s The Writer in The Family, two boys take part in a journey
of their early lives and find the words they need to be advocate for themselves. Both Sammy and
Jonathan defy an adult authoritative figure; nevertheless, they handle their rebellion differently.
Despite these differences, their experiences lead them both on a similar path of self discovery. The
opposition and determination these characters demonstrate throughout each story shows the struggles
that come with growing up and accepting oneself as an independent person.
The first similarity these boys face is an adult authority figure. In A P, Sammy works a job and lives a
life he does not want because his parents are expecting him to go down the same path as they did.
Sammy does what is considered normal for someone his age. He describes looking outside and seeing
about twenty seven old freeloaders tearing up Central Street because the sewer broke again. It s not as
if we re on the Cape; we re north of Boston and there s people in this town haven t seen the ocean for
twenty years. (Updike.) In The Writer in the Family, Aunt Francis is asking Jonathan to complete
difficult tasks repeatedly for selfish reasons. After his father dies, Jonathan is made to write letters to
his grandma so that she won t be distressed over the news. His Aunt bullies him into doing this so that
she can feel closer to her late brother, not caring about what pain it may cause Jonathan.

Space Exploration Persuasive Essay
The concept of space exploration was first introduced to the American public in 1961 when President
John F. Kennedy famously stood before congress and vowed that America would put a man on the
moon within the decade. With hopes of defeating the Soviet Union in the Space Race and gaining a
leg up in the Cold War, NASA funding reached its all time high in 1965 1966 when about four percent
of the federal budget was devoted to exploring space. Since then however, funding dedicated to
exploring space has nose dived to about one half of a percent of the federal budget (Tyson), with plans
to cut that figure by an additional $260 million in 2017 (cite NASA funding cuts). Experts in the space
sciences field argue that increased funding in space exploration would re ignite the American economy
and return America to the scientific prominence it was once known for, while, on the other end of the
spectrum, naysayers suggest that exploring space is an economic sink hole that the United States can
no longer afford to deposit to given its own earth bound troubles. The biggest affect increased space
exploration would have could be its change on the education landscape. In 1998, NASA scientists
Adriana Ocampo, Louis Friedman, and John Logsdon explored NASA s effect on education in their
article, Why Space Science and Exploration Benefit Everyone. Though their writing is nearly 20 years
old, Ocampo, Friedman, and Logsdon explain why handcuffing NASA creates a brain drain in

Why Cats Are Better House Pets Than Dogs
There are five key elements in an essay. The analysis, introduction, thesis, support, and conclusion.
The first paragraph of an essay is the introduction. The introduction will catch the reader s attention
and will give them an understanding of what the essay is going to be about. In the introduction
contains the thesis. The thesis statement is the main idea of the essay. For example, Cats are better
house pets than dogs. In the second paragraph, it will include the support and analysis. The analysis is
the reasoning behind the thesis statement. It will explain why, for example, cats are better than dogs.
Then comes in the support. The support will back up the analysis with examples and quotes to prove
the point. In the third paragraph,

Elimination of Poverty in the Welfare State
The welfare State is a system in which the state takes responsibility for the health and welfare of its
citizens/subjects. The state uses benefits, free healthcare, free education and provide adequate living

state is to eliminate poverty, poverty can come in many different forms some worse then others.

The welfare state was first started by the Liberal government between 1906 1919. They started to
introduce new services under social security, health, education, housing, employment and the
treatment of offenders. Rowntree did research into poverty and this influenced the Liberal government
to take responsibility to try to reduce poverty. In 1906 free school meals were introduced, in 1909 old
age pensions were given to those who could no longer work. The most important thing the Liberals
introduced was National Insurance in 1911. These changes mainly helped the old and disabled as it
prevented these groups from going into poverty. However it didn t help those who were unemployed
or already in poverty as they could pay into the National Insurance scheme.
In 1940 50, after winning the Second World War the people of Britain never wanted to return to pre
war conditions. There had been 20 years of mass unemployment and no help was given to those in
poverty. The measures introduced by the Liberal government were not proving successful. The
environments and housing people had to live in were of poor condition and helped spread disease.
The Labour government decided that no one should be allowed to live in poverty and the Welfare state
should be for everybody. To get rid of disease everyone was to have proper healthcare so the National
Health Service was

Literature Review On Easter Island
Easter Island has a unique history that outlines key theories of how man can have detrimental effects
on nature. With our beliefs, customs and general life needs, societies become dependent on our
environment and resources. This can result in an irreversible destruction of an environment and Easter
Island has proven this to be posable. With a society becoming hugely dependant on the limited
resources available and failure to understand the need to preserve these resources for future
generations caused immense pressure. The population confronted problems which they neglected to

Due to Easter Island s location, the climate was considerably different to that of what the Rapa Nui
people were accustomed too. As a result of the unfamiliar climate conditions agriculture become
exceedingly difficult, because of the strong winds which brought with them disturbed salt spray,
cooler temperature and variation in rainfall (Hunt, 2006, p. 413) and (Wright, 2004, p. 59). These
factors constructed an environment that was not suitable for a variety of foods to be cultivated; this
added to the problems that the Rapa Nui people had to endure. Diamond (2005) also reiterates Wright

become challenging for the new settlers. However, their society thrived, with a population reaching
and possibly exceeding 15,000 (Hunt, 2006, p. 412). As the population grew so did the use of

destruction they were causing. They contributed to deforestation, stripping the soils of nutrients and

symptoms usually arise at the age of 60 and the person dies within a year. Many researchers believe
that this disorder is the result of an abnormal protein known as prion. About 5 10% cases reported in
the United States share a genetic basis where this form of dementia is caused by a mutation in the gene
for the prion protein. Patients with Creutzfeldt Jakob disease suffer from the problems associated with

is known to affect the young school going children but may also affect teen agers.
Batten disease is also a fatal hereditary disorder of the central nervous system occurring in childhood.
The symptoms include formation of lipopigments in body tissues and early symptoms include
personality and behavior changes, clumsiness or stumbling. As the disease advances children may

Calculation of Preferred Dividends
How to Calculate Preferred Dividends
Preferred stock (or preference shares) is a special class of stock that pays a fixed dividend set at the
time of issuance. Also, preferred dividends must be paid before common stock dividends. To calculate
the dividends for preferred stocks, you need to multiply the par value of the shares by the dividend
percentage.
Example 1:
If the dividend percentage is 8 percent and the preferred stock was issued at $20 per share, then the
annual dividend is: 8% * $20 = $1.60 per share.
Example 2:
If you owned 10,000 6.5 percent preferred shares which were issued at a par value of $50 per share,
then:
The dividend per share of preferred stock = $50 * 6.5% = $3.25

It is an indication of the cash return that shareholders receive from holding shares in the listed
company.
Formula:
Dividend Per Share (DPS) = Dividends paid to equity shareholders / Number of issued equity shares
Example 1:
Bronze Ltd announced a total of $200,000 in dividends over the last year, and it has 4 million shares
outstanding, then the DPS would be: 200,000 / 4,000,000 = $0.05 per share.
Example 2:
Calculate the DPS for Modern Product Ltd., given the following information:
Dividends proposed $30,000
Ordinary shares of $0.50 each: $600,000
Solution:
Number of shares issued = 600,000 / 0.50 = 1,200,000
DPS = 30,000 / 1,200,000 = $0.025

The year was 1944, and the United States had now been an active participant in the war against Nazi
Germany for almost three and a half years. During this time, numerous battles had occurred which
were fought with determination and intensity on both sides. Amongst the many invasions of World
War II, there is one day which stands out more in the minds of many American soldiers than the
others. That day was June 6, 1944, more commonly known as D Day, part of the invasion of
Normandy, known as Operation Overlord. This operation was the largest amphibious assault in
history. It was a day in which thousands of young Americans, who poured onto the beaches of France,

Unit 30 Digital Graphics Assignment
Unit 30 Digital Graphics Assignment Task 1 (A) Graphics Card A graphics card is a component of a
computer system that helps to generate an image on the computer screen. Graphics cards are
connected between the CPU and the screen in a computer system in order to provide the user with a
clear image on the screen, a graphics card has its own RAM and its own Graphics Processor, and this
means that it does not rely on the CPU to provide the entire RAM for the computer system. The
inclusion of RAM into the graphics card means that the card will take care of most of the graphics
processing allowing the computers RAM to do other jobs and do them more efficiently. The
information process begins in the CPU where it sends information about the image to the graphics
card; the graphics card decides how to use the pixels to create the image on the screen. There are
different types of graphics card available and some are better than others.. A good quality graphics
card produces smoother video and graphics playback and sharper pictures. A good graphics card can
mean a faster refresh rate so if working with photos you can display them quicker and have better
colour resolution. A graphics card can be used where it can produce high definition gameplay and also
enable dual display and even use a television screen as a monitor through the use of a HDMI cable.

Spring Day Poem Analysis
Spring day by Elise is an English cover of the original version by BTS. It is written in first person but
can be applied to the audience s personal experiences. The song explores the ideas of love and death
as it illustrates the grief of losing a friend or loved one.
Throughout the song, winter is shown as a continuous metaphor used to symbolise misery. It s the
salient metaphor of the song as it is repeated and constantly referenced. The composer chose to
display winter in a more cold, lonesome and depressive manner. The surrounding cold of winter that
seems to never disperse illustrates the lack of warmth and happiness in his life. This is further
reinforced with the lack of sunlight in the winter.
The line There s no darkness or season that s in store where there will never be an end directly
compares winter to the persona s depression. It explains to the audience that grief, or winter, is not
everlasting, that spring is approaching and the long winter will finally come to an end. It is the start of
when the persona begins to accept the death of his loved one, whereas previously it was expressed to
be a never ending situation of grief, specifically in the line where I am it s always winter .
Moreover, spring too, is a metaphor, for hope and acceptance and death, that works alongside the
metaphor of winter. Spring is seen as the season of warmth, birth and restoration. The lines Until
spring decides to come again
Until flowers, they bloom again
Please stay where you are and wait for me
Please wait for me explains why it is such an important aspect of this song. Spring is the time in which
the persona may finally reunite with their lost loved one, once reunited, he will no longer be in misery,

Ethanol s Environmental Impact

Global Rough Draft
Ethanol s Affects on the Greater Market
Chain Reaction: Ethanol s Affects on the High Fructose Corn Syrup Market
Since Ethanol has been introduced to American markets its use has risen. However, this change does
not just impact Ethanol production, but also the production and market of other areas that do not
directly impact Ethanol. While it is hard to pinpoint a change in market to a single thing, Ethanol has
an affect on other markets, such as High Fructose Corn Syrup. Ethanol not only has this affect on the
High Fructose Corn Syrup Market, but through this also has a greater affect on related markets such as
Corn and the Sugar markets. Discovering this impact not only reveals the positives and negatives ...

This is primarily because corn is cheaper and easier to produce and use. While this raise in Ethanol
has increased corn production and sales as a whole, it is possible it has lowered corn production for
food consumption across the states. Not only is corn used for human consumption, but it is also used
as a food for animals in factories and on farms. On top of this, corn is also used in a popular
sweetener, High Fructose Corn Syrup. If corn is being used more for Ethanol production, will
production for these categories decrease? One of the reasons it is difficult to identify Ethanol as the
cause of change in sales for each of these markets is because it is not the only variable affecting them.
There is always a group against both corn feeding of livestock and high fructose corn syrup, which
can cause both markets to

Autism Spectrum Disorder ( Asd )
What Is Autism? Autism Spectrum Disorder, (ASD) is a development disorder and affects the brains
normal development in social and communication skills. ASD is now defined as a single disorder and
includes disorders that were previously considered separate such as Childhood Disintegrative
Disorder, Asperger s Syndrome, and Persuasive Developmental Disorder not otherwise specified.
There is no exact cause of ASD, but scientists believe that a variety of factors both genetic and
environmental may play a role. Scientists believe that several genes are involved in the development
of ASD. There is a genetic susceptibility to ASD. This was initially determined by twin and other
family studies. Although many chromosomal and gene abnormalities have been associated with
symptoms of ASD, none of these are present in all affected children (Errol, 2014). Scientists believe
that some genetic problems seem to be inherited, while others happen randomly. Although genetics do
not fully explain the occurrence of ASD, researchers looked at the additional environmental causes
such as prenatal and perinatal factors, early toxin exposure, viral or bacterial infections, vaccinations,
and autoimmune concerns. Scientists are studying how environmental factors affect certain genes. By
studying how environmental factors affect genes, it provides many new ways to study how ASD
develops and changes over time. ASD affects a child s ability to interact and communicate with others.

Berry Gordy Research Paper
Previously working in the automotive industry, Berry Gordy explored the idea of creating a music
record company that would incorporate the automobile assembly line process that would later open
the doors of opportunity for african americans everywhere even to these contemporary times. This
company was called Motown Records; obtaining this goal proved to have some obstacles due to the
encounter of racial tensions that affected every man, woman, and child. Fortunately, a determined will,
aquired from his boxing days, pushed Gordy to continue striving to exchange his love music with

Ever since, I wondered whether this impression was correct. The goal of this thesis is to satisfy this
curiosity and to determine, through textual and visual analyses, if the 1986 television series also
carries a Confucian message, or whether it was solely produced for entertainment purposes. This leads
to the following research question:
How does the 1986 television series Journey to the West convey the novel s original Confucian
message, and what does this suggest for its production purposes?
I argue that authors and producers often attempt to impose their own set of cultural and political
ideologies on its audience through a certain depiction of right and wrong. In this manner, works of
fiction might influence, perhaps even alter, the ideologies of the audience.[3] Accordingly, analyzing
the depiction of ideologies in media content can serve as a basis for further research on if and how
producers intend to influence their audience.
This particular case of Confucianism in the 1986 Journey to the West television series is especially
interesting, due to China s socio political setting of that time. The influence of the Chinese Communist
Party (CCP) on media content[4] combined with its usage of Confucianism to secure its own right to
rule[5] make the Journey to the West television series the perfect medium to promote Confucianism to
the masses. The enormous popularity of Journey to the West

The History Behind Knighthood
After the lords on the social ladder came the knights. A Medieval Knight commits himself to serve his
lord in military service according to the Code of Chivalry. A knight guards and supports his lord in
medieval war. Generally, a knight serves under his lord 40 days in a year in military service. During
the Medieval period of England, knights in training performed tasks in order to become official
knights, to wear their uniforms proudly, and having been chosen by King Arthur in Knights of the

Athletes College Athletes
Should collegiate athletes get paid? Statistics show that an average college athlete spends 20 hours per
week on their sport (University of Notre Dame). All the time dedicated to their sport takes away time
to complete homework, eat, work, and rest. College athletes should receive compensation for the
amount of time dedicated to their sport, for the amount of revenue brought into the university or
college, to be able to better support themselves and their family and benefit from the profit made by
apparel company contracts with the university or college.
Playing a sport in college, especially at Division 1 schools are very time consuming between
practicing and playing games. The National Collegiate Athletic Association (NCAA) allows 20 hours
of practice a week for athletes, but practices often last longer ( How do College Athletes... ).
Collegiate athletes often do not have enough time to set aside for their classes. Many of these athletes
are spending more time playing their sport than managing their schoolwork. If the athletes do not
show up to every practice, then they tend to feel uncommitted and disincluded. According to an
NCAA survey on college athletes, the most demanding sports are Division 1 and Division 2 baseball.
Division 1 basketball and football are very demanding as well (O Shaughnessy). All athletes have to
make sure they establish their priorities for their sport and academics. College athletes should finish

Broadway Play Compare And Contrast Essay
I watched Broadway Play and Baz Luhrman
The first difference I noticed after watching two scenes was the involvement of audience. Broadway
Play is a recorded film of a live play in which audiences and actors both exist actors must not only
speak their lines to portray and reveal their emotions, but must also speak their lines in a way the
audience can understand it. Baz Luhrman, on the other hand, is a film with a purpose to emphasize the
theme of Romeo and Juliet with its viewers. There are no restrictions in which actors speak their lines,
as long as the main message can be understood by the viewers.
Involvement of audience also can be related to how music is being used in the two scenes. In
Broadway Play, music seems to be used as a transition between dialogues of characters. The scene
first starts off with a lively music, but the sound decreases as Lord Capulet takes control. In Baz
Lurhman, music is used to maximize the emphasis on the love of Romeo and Juliet. An example
would be when Romeo and Juliet are staring at each other, with an aquarium in between. No words are
spoken, but as Romeo and Juliet slowly engage in each other, viewers can easily understand that the
two are in love. ... Show more content on Helpwriting.net ...

much things going on in a scene in Baz Luhrman and it sometimes can be hard to understand what the

One form is when a sorcerer uses projectiles. A sorcerer throws sharp objects including fish hooks or
stones and it hits the victim. Healers heal the victim by removing said object from the body. Another
form of sorcery is the use of poison is food or drinks. This mainly takes place where the majority of
the population hangs out and socializes which in the Aboriginal culture of coen is their version of a
bar. When a person leaves their drink sitting on a table and walk away, a sorcerer will come and
quickly place poison into it. If you visit this particular bar you will be warned by multiple people to
keep your drink in hand or in eye s sight and never leave it alone and vulnerable to sorcery. This can
also be done by shadows that stay in dark places where no one usually goes and wait for someone to
come to them by themselves. These shadows will remove blood and organs and then stitch up their
patient and bring them back to life. These victims tend to die a few days after they are brought back to
life. The younger men are taught about drinking blood by older men of the culture and they would

Using Fixed And Variable Costs Within The Report
Exhibit 2 contains both fixed and variable costs within the report. Other costs we must look at is the
opportunity of the purchased computer equipment, which has a value of roughly $25,500. The leased
computer equipment cannot be cancelled, thus we consider it a sunk cost and do not take it into
consideration. Next, we look at the purpose of creating PDS. The purpose was to help deregulate PTC
and rescind the push through of a rate increase. If they shut down PDS, PTC would have to pay the
market rate for their data needs, which will increase this cost by two fold. Additional issues to take
into consideration are the burdens of finding alternate use for the space PDS is currently renting and
the opportunity cost of wages being paid to the PDS employees. Can we invest the wage pay
somewhere else for a higher return? Asking these questions demonstrates the value of looking at PDS
in depth to determine if more value exists than appears within the initial reports.
Digging deeper, the first number we examine is how many computer hours PDS has to sell to break
even. We will assume the intercompany hours billed at $400 will average 205 per month. The variable
costs include power, parts of operation wages, and materials. Next, we calculate the unit contribution
(sales variable cost). The average cost for power is the total 3 month power cost divided by the total
time computers were used during this time (total revenue plus service hours) or 5028/1110 = $4.53.

Romantic Love Is A Deep Interaction Between Two Persons
Romantic love is a deep interaction between two persons. It is not just any interaction, but one in
which both persons lose themselves in the other. Concentration and fusion into the whole being can
never take place through my agency, nor can it ever take place without me. I become through my
relation to the Thou; as I become I, I say Thou (Buber, pg. 160). So romantic love happens when an
understanding comes to being that the other is you and potentially your entire universe of being for as
long as you are in relation. Although, there can be instances where the relation is involuntary and isn t
fluid. There is pulling and pushing. While I attempt to free myself from the Other, the Other is trying
to free himself from mine; while I seek to enslave the Other, the Other seeks to enslave me (Sartre, pg.
194). So there can be friction in romantic love, but in the end the two are still together. Insofar as to
say that they can t pull away from the universe that is their relation.
The presence of love and sex can cause a person to have a more authentic existence. This is because
love and sex are almost a necessity for everyone. ...sex, which makes up a part of that evil urge with

Emily Dickinson And Death
The Death in Emily Dickinson Like many poets, Emily Dickinson explored the themes of death,
leading to the answers of so many questions, in which she was concerned herself. Her poetry
frequently clarifies her reaction as to why she wrote about death. However, her treatment of death is
unique: Because I could not stop for Death He kindly stopped for me (577). Dickinson expresses
herself being able to accept death as an old friend rather than a force of nature. With many of her
poems, Dickinson elaborates and questions death being incorporated in daily lives as well as the
mysterious life leading after it. Among the understanding of her views of death, numerous people
become frightened as if it were some creature prowling behind something ready to take them at any
second. Death has been stated frequently throughout her poems, each one composed of frustration,
suffering, pain, sorrow, grief, and loneliness. Death is a common theme in her writing. The obsession
Dickinson made of death of darkness, Or rather He passed Us The Dews drew quivering and chill

State of Good Faith in English Contract Law
The law of contract in many legal systems requires that parties should act in good faith. English law
refuses to impose such a general doctrine of good faith in the field of contract law. However, despite
not recognizing the principle, English contract law is still influenced by notions of good faith. As Lord
Bingham affirmed, the law has developed numerous piecemeal solutions in response to problems of
unfairness. This essay will seek to examine the current and future state of good faith in English
contract law. Good faith was described by Lord Bingham in Interfoto as playing fair, coming clean, or
putting one s cards face upwards on the table. It owes its origins to the law of equity and can be traced
back to the case of Carter v ... Show more content on Helpwriting.net ...
With a good faith requirement, it could be argued that a culture of trust and cooperation would emerge
which would compel a duty of disclosure. The doctrine of frustration is another piecemeal solution
that enables fairer performance of contracts. Frustration acknowledges that it is unjust to tie a party s
obligations entirely to the contract. Frustration is invoked to rectify certain unfair situations where
unforeseen contingencies have occurred. This doctrine provides for acts beyond the control of either
party, which renders performance impossible. As Lord Bingham stated, the doctrine of frustration was
to give effect to the demands of justice, to achieve a just and reasonable result, to do what was
reasonable and fair, as an expedient to escape from injustice where such would result from
enforcement of a contract in its literal terms after a significant change in circumstances. Lord Simon in
Panalpina stresses this point that frustration was developed as an expedient to escape from injustice .
However one main limitation of the doctrine is the requirement of foreseeability of the frustrating
event. Frustration is thus rarely used and will only be applied where a change to the foundation of the
contract has destroyed the basis of the contract. The problem with the doctrine of frustration as
piecemeal solution is that some events are inevitably impossible to predict. Therefore a good faith

Domestic Violence As A Public Health Problem Essay
Domestic violence as a public health problem is studied from an epidemiological perspective.
Epidemiology is the core of public health, providing insight into the causes, prevalence, and control of
disease in populations. Partner abuse is defined, risk factors, prevalence, and consequences are
addressed from both the civilian and military perspectives as it relates to the batterer, spouse, and
children. Most of what is known about domestic violence from a scientific perspective are through a
civilian lens. A growing body of research on partner abuse in the military is emerging with most
studies conducted on the Army. The article reports on the results of an in depth study of the
epidemiology of partner abuse in all branches of the military. Rates of violence are higher in military
populations than is civilian populations. Data further suggests that more severe forms of abuse occur
in military families. Evidence based prevention and intervention approaches were recommended with
a focus on real and perceived barriers to treatment.
The article serves as a foundation for my paper. It is scientifically based, epidemiologically focused on
the definition, causes, distribution and treatment options for domestic violence. It supports my
position that domestic violence is a major public health issue of civilian and military populations. The
article further addresses the entire family and both the civilian and military communities. It is also one

Reconstructive and Aesthetic Plastic Surgery is one of the most mediatic specialties, however, it
remains without a completely adequate definition. McCarthy, a professor at New York University,
considers it a problem solving specialty, since it is not restricted by an organ system, pathology or

Although it is commonly associated with cosmetic surgery, the origin of this specialty lies in its
reconstructive aspect. Therefore, I chose to explore this aspect and, since% of the patients submitted to
the observed interventions were female, I decided to focus this monograph in an area of so much
importance for the woman as the breast.

reconstruction, according to the type of technique used, into the following categories: implant

Star online Higher food prices push February inflation above forecast , both of the news are expecting
the inflation rate of Malaysia will increase in 2016. We are adopting the news as our fundamental
analysis to the futures trading to predict the effect of macroeconomic variable which is inflation that
could affect the stock price movement in April. As we can read from the news, Malaysia s inflation
rate rose at a faster than expected pace of 4.2% in Febraury from a year ago following higher food
prices and a jump in alcoholic beverages and tobacco. Moreover, the Statistics Department also
proposed that the Consumer Price Index (CPI) for February rose by 4.2% to 114.5 compared with
109.9 a year ago. Economists had forecast a 4.1% increase. As we know, CPI is proxy as inflation.
CPI is the benchmark inflation and it uses a basket of goods approach that aims to compare a
consistent base of products from year to year, focusing on products that are bought and used by
consumers on a daily basis. The price of your milk, eggs, and daily essential are all captured in the
CPI. So, based on our analysis that rely on news that release to the public from January to March, we

Sheth (2008) sighted that private hospitals possesses centralized care. Therefore, student nurses are
exposed to a conducive learning brought by ideal nursing practice exhibited in the health care setting.
In the said type of hospital, Colladilla and Argos (2000) claimed more opportunities available both
professionally and personally for its staff. Thus, student nurses in return could profit from it. Also,
these hospitals are equipped with well maintained facilities, highly technologic equipment and
complete medical supplies. (Johns, 2000) Thus, familiarization begins and would further evolve to
learning. Adequate manpower plus limited handled patients could provide a centralized care.
However, there are also disadvantages. Limited assignments are given to student nurses because they
make sure they give quality care to patients due to patient s payment for services rendered. There are
strict norms associated with providing health care interventions. Herewith, staffs nurses have
significant liability to their patients. They can not afford to make mistakes. That is why, unlike in
public hospitals, students learn more through observation of the different procedures done in the
hospital. Public hospital provides culturally competent care (Vaknin, 2008). In public hospitals,
student nurses learn from actual experience. They can assume

Podcasts And Content Marketing Essay
Content marketing began as a simple concept; one simply wrote blogs and articles related to specific
products and/or services and promoted them; however, content creation in 2018 has come full circle.
Businesses today have tried to keep up with content trends and have used different tools to promote
content in 2018.
Podcasts and Content Marketing
One of these content trends is the use of podcasts. Keep in mind that podcasting has been used by
many professions for quite some time now but its use in content marketing is relatively new.
Podcasting is fast catching. Approximately 40% people in the US listen to at least one podcast on a
regular basis. This trend has been observed in both genders. In addition, podcast listeners often buy ...

Format: Set up your basic show format. There is no right or wrong way to set up a podcast. The
important thing is that you feel comfortable with the entire idea, flow, and format. Some podcasters
ask questions from the listeners, others only provide a running commentary, and yet others wait until
the end to answer questions. However, for effective content creation in 2018, it might be a good idea
to interview an expert who answers relevant questions. This way you can provide your audience with a
more credible source and you also don t have to answer every question that your audience may ask.
Length: Remember, a podcast should not go on forever. Most people keep it for 45 60 minutes. This
seems like an appropriate length because anything longer than this could bore your listeners and force
them to sign off.
Engaging the listeners: One of the most critical elements of a podcast is that it should have content
that is both engaging and interesting for the audience. An effective way to do so is by picking up
trending topics, invite guests and experts and keep the flow of information smooth and relevant. Your
audience wants to learn something and they want to derive information from your podcast. You need
to make sure you are able to provide the information. Therefore, your best content advice in 2018 is

Potato Famine In Ireland In The 1800 s
In the early 1800 s, Ireland was primarily rural. Most farmers worked on rented land from wealthy
landlords. All of the corn and crops that they raise go to the landlords which are later exported to
England. Potatoes are the main food of the impoverished Irish farmers who grew potatoes and other
grains. The potato originated in South America but wasn t brought to Ireland until later in the 16
century. Potatoes were so loved that they replaced barley and oats that poor people previously ate.
This was really devastating because barley and oats were among the few things that poor people could
afford. Poor people might have been able to get at least three potatoes every week. By the mid 1800 s,
a fungus infected the potato crop. Plants became black

if there is a knife carelessly lying about and one of the patient, who is mentally ill comes and pick it
up, not knowing that it is harmful and if misused it could seriously hurt them. Unclean environment:
This is a major hazard because if the environment in a nursing home is unclean this can lead to
spreading diseases, infections and causes the environment to start to smell and that could add up to the
patients illness. Nursery: In a nursery there are many hazards so staffs need to be extra careful on what
they leave hanging around especially when dealing with younger children. Also there are round the

loose wires hanging carelessly around at a nursery it is more likely that one half of the children in a
class would trip over it and get badly injured so if possible keep the wires out of reach . Toys left
carelessly on the floor: This is really important because if there are toys on lying on the floor
carelessly it is more likely that a child could trip over it or put it in their mouth and injury themselves
with it. Cleaning products: Cleaning product should be kept far away from a nursery area and should
be kept in an area that children cannot reach and locked up because if this hazard is seen by a child in

Descriptive Essay About Halloween
The Best Halloween The best Halloween I ever had was at my cousin Dexter s house in Utah, and it
was completely awesome hanging out with him and his friend Dawson. Halloween began when I
arrived at Dexter s house. Dexter! What s up bro. I shouted. Not much how are you He questioned
Good I said, I m just excited to start Trick or Treating. started out in my Tyler Young costume
unloading all of my suitcases for the night with my family. We brought in our clothes, then got
together for a family picture. My sister was a witch, my cousin Gentri was also a witch, Dexter was a
ninja and his little sister Morgan was a skeleton. Dexter didn t think to get a costume so he used a
bunch of black clothes and a ski mask in order to look like a ninja. To begin with we started out as a
family, going together and saying, trick or treat! at every door, but eventually Dexter, Dawson and I
began to go ahead so we could get more candy. As we went to one house two people jumped off their
high porch, which was like 15 feet over the ground, and began fighting each other with lightsabers, It
was pretty amazing. Their Lightsabers glowed brightly in the dark night. They looked like they were
from the movie Star Wars. After passing that house we would run from house to house, and at each
house we would get a big king sized candy bars. It was like I was in Candyland. This is the best
Halloween ever, I m getting so much candy. I told Dexter excitedly. We went on a huge loop of the

The Public Broadcasting Service At The Super Bowl Halftime
The Public Broadcasting Service which was founded in 1970 was the first network to ever show
nudity on television. Once in 1975 and a rerun in 1986, ever since then it had been escalating. It
started off with full frontal female nudity, at the time it wasn t too bothersome, but since then, time has
been changing. As of 2004 and because of Janet Jackson s breast during the live performance at the
super bowl halftime show caused a moral panic causing the Federal Communications Commissions to
make their rules stricter and all because of the public pressure. Due to this premium channels such as

Anyone who has seen the show will tell you that it is about a man addicted to alcohol, drugs and sex.
At times it may seem like he is selfish and fears no consequences for his actions. Some may even say
he is a womanizer who doesn t respect or even care for the women he speaks to. As the show goes on,
it is clear that there is more to Hank than just booze, cigarettes and females. He is still in love with his
ex; Karen who is played by Natascha McElhone. He is a father of a 12 year old girl named Becca
whom he shares with Karen, the love of his life, or so he thinks. After moving to Los Angeles, he
suffers from writer s block and gets caught up in the cities superficiality and shallowness. This causes
Hank to get deeper into his self destructive tendencies. The relationship he has with his daughter is
quite abnormal, although she is 12 she s been exposed to more mature things which has caused her to
grow up a bit quicker. Hank being the alcoholic he is falls asleep on the couch during his turn to take
of Becca. She gives him a blanket, blanket, and even makes breakfast for him in the mornings. Becca
even asks about Hank s vasectomy he gets done in one episode and asks him how the boys are doing .
To most people this would seem a bit inappropriate and even child neglect. In the first episode, it starts
off with Hank running out of a woman s bed whose husband just got home. First thing being portrayed
could be is that he has no morals, why

Murphy Oil USA, Incorporated V. National Labor Relations...
While labor relation laws have provided legal stability for employers and employees to exercise and
pursue their respective rights and interests, not all conflicts and disputes are resolved based on
precedence of law. The National Labor Relations Board (NLRB) enforces the right of employees to
engage in concerted activities for mutual aid or protection and takes the position that class and
collective action waivers in employment and other agreements are unlawful. Although the National
Labor Relations Act (NLRA) provides employees certain rights, some labor relation issues decided by
the NLRB have been challenged in some cases and supported in others by the Supreme Court and the
United States Courts of Appeals. Murphy Oil USA, Incorporated v. National Labor Relations Board
addresses arbitration agreements that bar employees from concerted activities in any forum are within
the parameters of being considered an unfair labor practice. Lavin and DiMichele (2017) mentions
that five circuits challenged the subject of whether class waivers are enforceable with three circuits
holding that they must be enforced and two deciding that enforcement ... Show more content on

Horton v. NLRB, Murphy Oil revised its arbitration agreement in March 2012 however; the revision
did not apply to the employees involved in the Alabama lawsuit due to their employment status
occurring prior to March 2012. A petition to review Board s decision in D.R. Horton made its way to
the Fifth Circuit Court and in its decision, the court rejected the Board s analysis of arbitration
agreements contending that NLSA statutes do not override the Federal Arbitration Act (FAA). The
FAA codifies the federal policy of enforcing arbitration agreements behooving any party preparing to
enter into a contractual relationship to ensure that a dispute resolution clause of the contract is clear
and explicit. This holding meant that D.R. Horton did not engage in unfair labor practices hindering

Vitro Fertilization ( Ivf ) Essay
Have you ever heard of an in vitro fertilization (IVF) ? Well, the term in vitro is Latin for in glass
.With IVF treatment, the egg is fertilized with sperm in a petri dish. Typically, many eggs are retrieved
from the biological mother (who may or may not be the intended parent), as not every egg will
fertilize, and not every fertilized egg will become a viable embryo. A few days after fertilization, the
best embryo or embryos are transferred to the mothers or surrogate s uterus via a catheter through
cervix. Any extra embryos may be cryopreserved (cooling them below the freezing point of water) for
future cycles. This method was pioneered by Robert G. Edwards, a retired Professor of Human
Reproduction at Cambridge University, was heralded as the Creator of Modern Reproductive
Medicine. He paired with Patrick Steptoe, a practicing Gynecologist at Oldam General Hospital who
pioneered the use of laparoscopy (a surgical procedure in which a fiber optic instrument is inserted
through the abdominal wall to view the organs in the abdomen or to permit a surgical procedure) in
gynecology. Their collaboration started in 1968 when Edwards attended a lecture that Steptoe gave on
laparoscopy at the Royal Society of Medicine in London. Both achieved gracefully in fertilization and
cell division of eggs in vitro in a petri dish with freshly extracted semen, but were unable to
successfully implant the fertilized egg into the female uterus until 1978. They manipulated hormone

A Rainy Day And The Temperatures
The Path 1. Today is a rainy day and the temperature has been in the low forties all day. The
environment has shaped my behavior immensely today. I tend to be extremely productive on rainy
days. I love the rain and it puts me in a mellow happy mood and when I m in those moods I tend to do
things to improve my day of life like cleaning and doing homework. Tweaking the environment is
about making the right behaviors a little bit easier and the wrong behavior a little bit harder. I am
actually writing a majority of this paper today, which happens to be black Friday. Usually on black
Friday my parents make my brother and I leave the house. My mom and dad go shopping early in the
morning and wrap a lot of the presents later in the day. Since it was raining and I was kicked out of the
house for the greater good, I figured I would trap myself in Starbucks and crank out as much work as I
could. Having the change of setting and mood of the environment around me I was able to stay more
focused than I would have if I were trying to do work on my kitchen table. I am a person who gets
easily distracted so shaping the environment to make change easier for me would consist of trial and
error for what works. Trying new things and recording their outcome, then sticking to what works best
it a great was to shape the environment and behavior. An Amazon 1 click style tweak I can create for
myself to make my goal easier would be to get a time every week where I go to a quiet place, whether

In the next section of the Imperial Surge, the essays focus on the anti imperialist who publicly denounced the US and what was happening in the Philippines and Hawaii. Samuel Clemens also used his pen name, Mark Twain, to attack the administration. He had told a New York newspaper that he had become convinced that the aim of American policy was not redemption but conquest. (134). Anti imperialist poets gave the most stinging critics. Imperialism in their eyes was made doubly wrong by being wrapped in the humbuggery of benevolent assimilation, Christian duty, and the expansion of liberty. (136). The poets were using the American Dream as the victim of the Imperialistic policies that the US government was following. American writers varied in the degree that they were willing to dissent. As was already stated, poets and satirists were in direct opposition, while college professors were more moderate and literary magazines and journals were evenly divided. From what I have research cognitive biases is basically you see what you want, and look for things to confirm what you are looking for essentially ignoring or disregarding any information that disproves your believe. According to CIA.gov it states that Cognitive biases are mental errors caused by our simplified information processing strategies. It is important to distinguish cognitive biases from other forms of bias, such as cultural bias, organizational bias, or bias that results from one s own self interest. (CIA.gov, 2012) another way to look at cognitive biases is that it is a subconscious decision made on a certain issue. • 5. Sleep Analysis Essay On Sleep Sleep Analysis As we learned in lecture, sleep is an important component in improving a person s overall health. Because sleep is vital for cognitive function and available time to spend sleeping is limited for college students, like myself, it is advantageous to change sleeping behaviors to maximize the benefits sleep can provide. After tracking my sleeping schedule for a week, I have noticed some patterns and behavior that may be affecting the quality of sleep I am getting. Based on my sleep journal, I could improve my sleep by cutting back on the amount of caffeine I intake and the time spent on electronics before bed to try to reduce the amount of time needed for me to fall asleep. I tracked my sleep for one week early on in the semester when I was less busy and able to get more sleep, however the overall patterns in how I felt when waking up and trouble falling asleep have remained mostly the same. In this particular week, I got an average of about nine hours of sleep per weeknight. The recommended amount of sleep per night is between eight to nine hours (Teague 77). I would say I need at least eight full hours of sleep a night to feel like I am well rested. I did not occur a sleep debt during this week, however I have experienced weeks were I did accumulate a sleep debt. When this occurs, I usually try to make up for it by sleeping in on the weekends rather than napping. I have found that taking naps isn t an effective way for me to reduce my sleep debt because I ... • 7. Space Exploration Persuasive Essay The concept of space exploration was first introduced to the American public in 1961 when President John F. Kennedy famously stood before congress and vowed that America would put a man on the moon within the decade. With hopes of defeating the Soviet Union in the Space Race and gaining a leg up in the Cold War, NASA funding reached its all time high in 1965 1966 when about four percent of the federal budget was devoted to exploring space. Since then however, funding dedicated to exploring space has nose dived to about one half of a percent of the federal budget (Tyson), with plans to cut that figure by an additional $260 million in 2017 (cite NASA funding cuts). Experts in the space sciences field argue that increased funding in space exploration would re ignite the American economy and return America to the scientific prominence it was once known for, while, on the other end of the spectrum, naysayers suggest that exploring space is an economic sink hole that the United States can no longer afford to deposit to given its own earth bound troubles. The biggest affect increased space exploration would have could be its change on the education landscape. In 1998, NASA scientists Adriana Ocampo, Louis Friedman, and John Logsdon explored NASA s effect on education in their article, Why Space Science and Exploration Benefit Everyone. The song explores the ideas of love and death as it illustrates the grief of losing a friend or loved one. Throughout the song, winter is shown as a continuous metaphor used to symbolise misery. It s the salient metaphor of the song as it is repeated and constantly referenced. The composer chose to display winter in a more cold, lonesome and depressive manner. The surrounding cold of winter that seems to never disperse illustrates the lack of warmth and happiness in his life. This is further reinforced with the lack of sunlight in the winter. The line There s no darkness or season that s in store where there will never be an end directly compares winter to the persona s depression. It explains to the audience that grief, or winter, is not everlasting, that spring is approaching and the long winter will finally come to an end. It is the start of when the persona begins to accept the death of his loved one, whereas previously it was expressed to be a never ending situation of grief, specifically in the line where I am it s always winter . Moreover, spring too, is a metaphor, for hope and acceptance and death, that works alongside the metaphor of winter. Spring is seen as the season of warmth, birth and restoration. The lines Until spring decides to come again Until flowers, they bloom again Please stay where you are and wait for me Please wait for me explains why it is such an important aspect of this song. Spring is the time in which the persona may finally reunite with their lost loved one, once reunited, he will no longer be in misery, however, the lines suggests that they may only reunite after death. Thus spring symbolises both happiness and death and acceptance. The image used on slide 8, shows a person walking sadly down a street. On his side of the street it is winter, on the other side its summer. ASD is now defined as a single disorder and includes disorders that were previously considered separate such as Childhood Disintegrative Disorder, Asperger s Syndrome, and Persuasive Developmental Disorder not otherwise specified. There is no exact cause of ASD, but scientists believe that a variety of factors both genetic and environmental may play a role. Scientists believe that several genes are involved in the development of ASD. There is a genetic susceptibility to ASD. This was initially determined by twin and other family studies. Although many chromosomal and gene abnormalities have been associated with symptoms of ASD, none of these are present in all affected children (Errol, 2014). Scientists believe that some genetic problems seem to be inherited, while others happen randomly. Although genetics do not fully explain the occurrence of ASD, researchers looked at the additional environmental causes such as prenatal and perinatal factors, early toxin exposure, viral or bacterial infections, vaccinations, and autoimmune concerns. Scientists are studying how environmental factors affect certain genes. By studying how environmental factors affect genes, it provides many new ways to study how ASD develops and changes over time. The goal of this thesis is to satisfy this curiosity and to determine, through textual and visual analyses, if the 1986 television series also carries a Confucian message, or whether it was solely produced for entertainment purposes. This leads to the following research question: How does the 1986 television series Journey to the West convey the novel s original Confucian message, and what does this suggest for its production purposes? I argue that authors and producers often attempt to impose their own set of cultural and political ideologies on its audience through a certain depiction of right and wrong. In this manner, works of fiction might influence, perhaps even alter, the ideologies of the audience.[3] Accordingly, analyzing the depiction of ideologies in media content can serve as a basis for further research on if and how producers intend to influence their audience. This particular case of Confucianism in the 1986 Journey to the West television series is especially interesting, due to China s socio political setting of that time. Broadway Play is a recorded film of a live play in which audiences and actors both exist actors must not only speak their lines to portray and reveal their emotions, but must also speak their lines in a way the audience can understand it. Baz Luhrman, on the other hand, is a film with a purpose to emphasize the theme of Romeo and Juliet with its viewers. There are no restrictions in which actors speak their lines, as long as the main message can be understood by the viewers. Involvement of audience also can be related to how music is being used in the two scenes. In Broadway Play, music seems to be used as a transition between dialogues of characters. The scene first starts off with a lively music, but the sound decreases as Lord Capulet takes control. In Baz Lurhman, music is used to maximize the emphasis on the love of Romeo and Juliet. An example would be when Romeo and Juliet are staring at each other, with an aquarium in between. Other costs we must look at is the opportunity of the purchased computer equipment, which has a value of roughly $25,500. The leased computer equipment cannot be cancelled, thus we consider it a sunk cost and do not take it into consideration. Next, we look at the purpose of creating PDS. The purpose was to help deregulate PTC and rescind the push through of a rate increase. If they shut down PDS, PTC would have to pay the market rate for their data needs, which will increase this cost by two fold. Additional issues to take into consideration are the burdens of finding alternate use for the space PDS is currently renting and the opportunity cost of wages being paid to the PDS employees. Can we invest the wage pay somewhere else for a higher return? Asking these questions demonstrates the value of looking at PDS in depth to determine if more value exists than appears within the initial reports. Digging deeper, the first number we examine is how many computer hours PDS has to sell to break even. We will assume the intercompany hours billed at $400 will average 205 per month. The variable costs include power, parts of operation wages, and materials. Next, we calculate the unit contribution (sales variable cost). It is not just any interaction, but one in which both persons lose themselves in the other. Concentration and fusion into the whole being can never take place through my agency, nor can it ever take place without me. I become through my relation to the Thou; as I become I, I say Thou (Buber, pg. 160). So romantic love happens when an understanding comes to being that the other is you and potentially your entire universe of being for as long as you are in relation. Although, there can be instances where the relation is involuntary and isn t fluid. There is pulling and pushing. While I attempt to free myself from the Other, the Other is trying to free himself from mine; while I seek to enslave the Other, the Other seeks to enslave me (Sartre, pg. 194). So there can be friction in romantic love, but in the end the two are still together. Insofar as to say that they can t pull away from the universe that is their relation. With a good faith requirement, it could be argued that a culture of trust and cooperation would emerge which would compel a duty of disclosure. The doctrine of frustration is another piecemeal solution that enables fairer performance of contracts. Frustration acknowledges that it is unjust to tie a party s obligations entirely to the contract. Frustration is invoked to rectify certain unfair situations where unforeseen contingencies have occurred. This doctrine provides for acts beyond the control of either party, which renders performance impossible. As Lord Bingham stated, the doctrine of frustration was to give effect to the demands of justice, to achieve a just and reasonable result, to do what was reasonable and fair, as an expedient to escape from injustice where such would result from enforcement of a contract in its literal terms after a significant change in circumstances. Lord Simon in Panalpina stresses this point that frustration was developed as an expedient to escape from injustice . However one main limitation of the doctrine is the requirement of foreseeability of the frustrating event. Frustration is thus rarely used and will only be applied where a change to the foundation of the contract has destroyed the basis of the contract. The problem with the doctrine of frustration as piecemeal solution is that some events are inevitably impossible to predict. Therefore a good faith ... Get more on HelpWriting.net ...

Engaging the listeners: One of the most critical elements of a podcast is that it should have content that is both engaging and interesting for the audience. An effective way to do so is by picking up trending topics, invite guests and experts and keep the flow of information smooth and relevant. While labor relation laws have provided legal stability for employers and employees to exercise and pursue their respective rights and interests, not all conflicts and disputes are resolved based on precedence of law. The National Labor Relations Board (NLRB) enforces the right of employees to engage in concerted activities for mutual aid or protection and takes the position that class and collective action waivers in employment and other agreements are unlawful. Although the National Labor Relations Act (NLRA) provides employees certain rights, some labor relation issues decided by the NLRB have been challenged in some cases and supported in others by the Supreme Court and the United States Courts of Appeals. Murphy Oil USA, Incorporated v. • 51. A Rainy Day And The Temperatures The Path 1. Today is a rainy day and the temperature has been in the low forties all day. The environment has shaped my behavior immensely today. I tend to be extremely productive on rainy days. I love the rain and it puts me in a mellow happy mood and when I m in those moods I tend to do things to improve my day of life like cleaning and doing homework. Tweaking the environment is about making the right behaviors a little bit easier and the wrong behavior a little bit harder. I am actually writing a majority of this paper today, which happens to be black Friday. Usually on black Friday my parents make my brother and I leave the house. My mom and dad go shopping early in the morning and wrap a lot of the presents later in the day. Since it was raining and I was kicked out of the house for the greater good, I figured I would trap myself in Starbucks and crank out as much work as I could. Having the change of setting and mood of the environment around me I was able to stay more focused than I would have if I were trying to do work on my kitchen table. I am a person who gets easily distracted so shaping the environment to make change easier for me would consist of trial and error for what works. Trying new things and recording their outcome, then sticking to what works best it a great was to shape the environment and behavior.
