Mumbai: Chief Minis-
ter Eknath Shinde on
Tuesday welcomed the
decision of the Election
Commission of India to
grant his faction the
“two swords and a
shield” symbol, saying
it was associated with
Chhatrapati Shivaji Ma-
haraj and also the old
Shiv Sena.
Two swords and a
shield was one of the
symbols the Shiv Sena,
founded by Bal Thack-
eray, used in the 1967-68
civic polls in Mumbai
and elsewhere.
The Shinde faction,
now named “Balasahe-
banchi Shiv Sena” will
be able to use the new
symbolintheNovember
03 Andheri East Assem-
bly bypoll if it decides to
contest the election.
However, its ally BJP is
likely to field its own
candidate against the
Uddhav Thackeray fac-
tion’s nominee.
“Balasahebanchi
Shiv Sena is the Shiv
Sena of the common
man. We accept this de-
cision of the EC. We had
given priority to the
‘sun’ symbol, but it ap-
proved the ‘two swords
and shield’. This is the
symbol of the old Shiv
Sena...This is a Maha-
rashtrian symbol. It is
the symbol of Chhatra-
pati Shivaji and his ma-
valas (soldiers),” he
added.
The rival Sena faction
led by Thackeray has
been granted “flaming
torch” as its symbol af-
ter the EC held last week
that the two groups
would not be able to use
the Sena’s “bow and ar-
row” symbol following
the split.
On Monday, the poll
body had recognized the
Shinde faction as “Bala-
sahebanchi Shiv Sena”
(Balasaheb’s Shiv Sena)
but rejected “trishul”,
“gada” (mace) and “ris-
ing sun” as its poll sym-
bols. Trishul and gada
were rejected as they
had religious connota-
tions.
The Thackeray fac-
tion too had given
trishul and rising sun as
its choices.
Rising sun is the sym-
bol of the DMK, a recog-
nized state party
. The
EC had then asked the
Shinde faction to give
fresh alternate symbols
by Tuesday morning.

proposed “peepal tree”,
“sword and shield” and
“sun” as its choices on
Tuesday
.

don Dawood Ibrahim’s ‘D’
company in connection
with an extortion case, a
police official said.
The police’s anti-
extortion cell (AEC)
had recently arrested
gangster Chhota Shakeel’s
brother-in-law Salim
Qureshi alias Salim Fruit
and businessman Riyaz
Bhati in an extortion case
and charged them under
the stringent Maharashtra
Control of Organised
Crime Act, he said.
The investigation
revealed the role of five
more people--Ajay Ganda,
Feroz Chamda, Sameer
Khan, Papa Pathan and
Amjad Redkar--leading
to their arrest, the official

Mumbai: As part of
its ongoing crack-
down on illegal sub-
stances, the Mumbai
zonal unit of the Nar-
cotics Control Bureau
(NCB) has seized a
whopping 11,300kg of
drugs from different
parts of the country
and arrested 58 per-
sons in the last nine
months, said an offi-
cial on Tuesday.
The quantity is sig-
nificantly higher than
the previous year when
the Mumbai unit of the
federal anti-drug agen-
cy had seized 1,780kg of
drugs.
The agency has also
registered 46 cases from
January 01 to the first
week of October and ar-
rested people from Del-
hi, Uttar Pradesh, Pun-
jab, Madhya Pradesh,
Gujarat and Goa among
other states, said the
NCB official.
Seized drugs includ-
ed large quantities of
cocaine, mephedrone,
ganja, heroin and LSD.
The official, however,
did not specify the col-
lective worth of the
seized drugs.
‘Black cocaine’ is the
drug most in demand in
the market and sold at
Rs20,000 per gram, mak-
ing it the most expen-
sive narcotic substance,
added the official.
Mephedrone is sold
at Rs3,000 per gram.
“Black cocaine is in
highdemandamongpeo-
ple in high society
. Our
focus is on the suppliers
and manufacturers of
such drugs,” he said.
In 2021, the NCB had
seized 1,780kg drugs,
registered 119 cases and
arrested 240 people
from different states, he
said.
Just last week, the
NCB arrested six mem-
bers of an inter-state
drug cartel, including a
former Air India pilot
as part of an operation
led by the Anti Narcot-
ics Cell (ANC), which
seized 1,200kg of me-
phedrone from Thane
and Ankleshwar in
neighbouring Gujarat.
“With the authentica-
tion of the seized sub-
stance, this becomes
one of the biggest sei-
zures of mephedrone in
the country this year,”
an official had said of
the seizure on Friday
.

ing torch with them,
a day after the Elec-
tion Commission of
India (ECI) allotted
“mashaal” symbol to
the party faction.
The party workers
also visited ‘Ma-
toshree’, the private
residence of former
chief minister Uddhav
Thackeray in suburban
Bandra, with a burning
torch in their hands.
The Sena chief asked
party workers to realize
the importance of the
new symbol.
This is being viewed
as the Uddhav Thack-
eray camp’s efforts to
make people aware of
the new symbol, ahead
of the bypoll to Andheri
East Assembly seat in
Mumbai scheduled for
November 03.
The party workers
also took out proces-
sions with the new sym-
bol in different dis-
tricts, including Nag-
pur and Aurangabad.
The apex poll body on
Monday allotted “flam-
ing torch” (mashaal)
election symbol to the
Uddhav Thackeray fac-
tion of Shiv Sena, reject-
ing their claim to the
“trishul”citingreligious
connotation.
In an order on the dis-
pute in the Shiv Sena,
theCommissionallotted
“ShivSena - Uddhav Bal-
asaheb Thackeray” as
the party name for the
Thackeray faction, and
“Balasahebanchi Shiv
Sena” (Balasaheb’s Shiv
Sena) as the name for
the Eknath Shinde

On Tuesday, the Ud-
dhav Thackeray faction
members, including
former Mumbai Mayor
Kishori Pednekar, vis-
ited Bal Thackeray’s
memorial at Shivaji
Park in Dadar area and
paid respects to the late
leader and the party’s
new election symbol.
The Uddhav Thacker-
ay-led faction will con-
test the bypoll to And-
heri East seat in Mum-
bai on the “flaming
torch” symbol.

`30.19L compensation for
kin of man killed in crash

Motor Accident
Claims Tribunal
(MACT) has awarded
a compensation of
Rs 30.19 lakh to par-
ents of a 24-year-old
man killed in a road
accident in 2019.
In his order passed
on October 07 and
made available on
Tuesday, MACT mem-
ber HM Bhosale di-
rected the owner of a
generator van and its
insurance company
to jointly and sever-
ally pay the compen-
sation to the claim-
ants along with an
annual interest of 8%
from the date of filing
of the petition.
RS Chahal ap-
peared for the peti-
tioners—Baldev Sin-
gh Gill and Manjit
Kaur, the parents of
the deceased Krishna
Singh Baldev Singh
Gill—who sought a
compensation of
Rs30.52 lakh.
Chahal informed
the tribunal that
Krishna Gill was
travelling with his
girlfriend on a scoot-
er on the Western Ex-
press Highway
around 6.30 am on
May 19, 2019, when a
generator van
rammed into the two-
wheeler. The couple
fell and sustained se-
vere injuries, and
died while undergo-
ing treatment at a
hospital, he said.
Gill earned Rs2.30
lakh per annum, and
the petitioners were
totally dependent on
him, the tribunal was
informed.
Counsels Bhupesh
Dhumatkar, appear-
ing for the owner of
the generator van,
and HC Thanawala
who represented the
insurance company,
vehemently opposed
the claim on various
grounds.
The compensation
awarded by the tribu-
nal includes Rs28.98
lakh towards depend-
encyloss,Rs16,500each
towards loss of estate
and funeral expenses
and Rs88,000 towards
filial consortium.
MACT also ordered
that the father of the
deceased be paid
Rs44,000 and the bal-
ance amount be paid to
hismotherafterinvest-
ing Rs15 lakh in a fixed

Mumbai: Bhagirath
Biyani, chief of the
Bharatiya Janata
Party’s Beed unit al-
legedly committed
suicide at his resi-
dence on Tuesday.
According to a police
official, Biyani shot
himself in the head
with his licensed re-
volver at his house in
Mira Nagar area which
falls under the jurisdic-
tion of Peth Beed police
station.
Biyani,whowasinhis
50s, went to bed on Mon-
day night, but did not
come out of his room
next morning. His fami-
ly members broke the
door and found him ly-
ing lifeless. He was
rushed to a hospital,
where the doctors de-
claredhimbroughtdead.
“Prima facie, this
seems to be a suicide
and police is investing
it in every angle,” said
Beed Superintendent of
Police Nand Kumar
Thakur, adding that a
bullet wound was found
above his ear and fur-
ther probe is underway
.
The BJP leader was
suffering from some
health issues, said an-
other official.

Mumbai, the state
Home Department
has handed over the
investigation of the
case to the Central
Bureau of Investiga-
tion (CBI).

Earlier, the case was
being investigated by
the state Criminal In-

(CID).
The incident took
place at Gadchinchle
village on the night of
April 16, 2020, in the
midst of the COVID-19

wards Surat from Mum-
bai in a car with a driver
to attend a funeral.
A mob of villagers
stopped them and beat
them to death on suspi-
cion that they were
child-lifters, even as a
few police personnel
had reached the spot.

BMC suggests installation of single
body for city road maintenance

Mumbai: The Bri-
hanmumbai Munici-
pal Corporation
(BMC), which has
been facing criti-
cism over potholes
on city roads, pro-
posed that all infra-
structure, including
flyovers and bridges
should come under
its jurisdiction for
maintenance.
The BMC was mak-
ing suggestions dur-
ing the hearing of sev-
eral public interest
litigation (PILs) filed
against the pothole
menace in the Bombay
High Court.
The civic body also
clarified that not all
roads, even in the city
limits, come under its
jurisdiction—some,
the BMC said, were un-
der the management
of agencies such as the
airport authority,
Mumbai Port Trust.
It also proposed to
have a single planning
body which will have
an overarching say on
the issue of poor
roads. During its pres-
entation before the
High Court, the BMC
claimed the agencies
didn’t give any priori-
ty to road repairs that
come under their man-
agement.
The BMC told the
court that the “lacka-
daisical approach” of
these other agencies
put the civic body at in
the crosshairs of city
residents. The munici-
pal body then suggest-
ed that to avoid such
negligence road infra-
structure mainte-
nance, including flyo-
vers and bridges,
should be handed over
to the BMC.

CBI takes over Palghar
sadhus’ lynching case

Mumbai: With the
deadline coming to an
end for shops and
commercial estab-
lishments in Mumbai
to put up Marathi
signboards, the Bri-
hanmumbai Munici-
pal Corporation
(BMC) from Monday
started taking action
against those who
have not yet done.
The BMC’s fourth
deadline to shops for
setting up Marathi
signboards expired on
September 30.
According to Deputy
Municipal Commis-
sioner (Special) Sanjog
Kabre, the BMC has
started issuing notices
to the commercial es-
tablishments.
“Every shop is being
given seven days after
the date of notice issu-
ance for setting up the
new signboard. If they
fail to do so during that
time, we will file a case
in the court against
the owners of the es-
tablishments,” Kabre
said.
The present provi-
sion states a fine of
Rs2,000 per staffer will
be imposed on shops.
If the shop owners
choose to pay the fine
on their own, then the
BMC may not approach
the court.
“At present, there
are more than five lakh
shops and commercial
establishments in
Mumbai and less than
50% of these have Mar-
athi signboards. We
will take photographs
of the shops as evi-
dence as we send them
notices,” Kabre said.
The BMC appointed
60 inspectors at vari-
ous ward and zonal lev-
els for inspecting the
shops. Each of these
officers will inspect
around 50 shops and
the BMC targets to in-
spect 3,000 shops daily.
Meanwhile, Federa-
tion of Retail Traders
and Welfare Associa-
tion (FRTWA) has
written to Chief Minis-
ter Eknath Shinde,
urging a temporary
stay on the order since
the issue is pending at
the Supreme Court.
The FRTWA had ap-
proached the Supreme
Court challenging the
state’s mandate on con-
stitutional grounds.

cate for submitting
objectionable photo-
graphs with a petition
seeking to quash a
rape case.
A division bench
comprising Justice Re-
vati Mohite Dere and
Justice SM Modak in an
order observed that “no
sense of proportion or
discretion” was exer-
cised by the petitioner’s
advocate while annex-
ing the “highly objec-
tionable” photographs
with the plea.

Mumbai: The Bom-
bay High Court has
permitted the father
of a woman in a veg-
etative state after a
road accident to with-
draw Rs1.15 crore de-
posited in court by
the Western Railways
that owned the errant
vehicle. The appeal
filed in the case is
pending hearing.
A division bench
comprising Justice
Gautam Patel and Jus-
tice Gauri Godse in an
interim order passed on
October 06 observed
that it cannot view such
matters with the “clini-
cal coldness” of a civil
suit. A copy of the order
was made available on
Tuesday
.
The court was hear-
ing an appeal filed by
the senior section engi-
neering, Signal Con-
struction of the West-
ern Railway that owned
the vehicle involved in
the accident. It had
challenged a February
2021 order passed by the
Motor Accidents Claim
Tribunal (MACT)
1awarding compensa-
tion of Rs69,92,156 to
Nidhi Jethmalani.
“Here human lives
are at stake. Futures are
at stake; Nidhi’s future
has been completely ex-
tinguished. It is for this
reason that we believe
that an interim order is
not only permissible,
but is absolutely neces-
sary,” said the court.
The accident took
place on May 28, 2017,
when Nidhi (17 years
old at the time) was
crossing the road near
Marine Drive in south
Mumbai when a car
knocked her down.
The victim suffered se-
rious injuries and has
been in a vegetative
state ever since.
Advocate Saumen
Vidyarthi, appearing
for the victim’s father,
told the court that the
original claim for com-
pensation was Rs2.22
crore and the tribunal’s
order awarding
Rs69,92,156 was on the
lower side.
Vidyarthi informed
the court that apart
from the compensation
awarded, the Railways
had deposited Rs1.50
crore in court, the inter-
est of which was used
by the victim’s family
towards her expenses.
He further told the
court that as on date,
there is about Rs1.15
crore still in court.
The court posted the
appeal for hearing on
October 17.

Mumbai: The new
diktat to bus conduc-
tors by the Brihan-
mumbai Electric Sup-
ply Transport (BEST),
regarding docking of
pay if the hand-held
ticketing machines
are damaged, has not
gone down well with
its employees.
According to a BEST
circular, at the end of
duty hours when ad-
ministration staffers
collect the machines,
some of them are found
damaged. The staffers
have observed many in-
stances of the plastic
flaps over the display to
be forced or cut open,
affecting its correct
storage procedure.
“This…also makes it
non-functional in the
long run. If machines
are found in that condi-
tion, the money for re-
placing spare parts will
be recovered from em-
ployees, as per prevail-
ing policy and rates,”
read the circular.
In response, trade un-
ions have threatened to
take to the streets in
protest. “Your office
provides you with lap-
tops, but do they ask
you to reimburse them
if some part of it is not
functional? The BEST
is doing exactly this
and has issued a rate
card per broken part of
ticket machines,” said
Shashank Sharad Rao,
Convener, BEST Work-
ers Joint Action Com-
mittee.
The BEST listed pric-
es of 15 items in the cir-
cular, including the
LCD and front cover of
the ticket dispenser at
Rs4,737. The battery,
back body, printer
bracket and speakers
are worth Rs2,214,
Rs1,582, Rs 960 and
Rs490 respectively
.
“The machine may
face technical problems
and not work properly.
In such cases, salaries
of employees will get
cut. It will be unfair and
hence the protest,” he
pointed out.

accountant of the forest
department was arrested
in Thane for alleg-
edly taking a bribe of

Anti-Corruption Bureau
(ACB) said on Tuesday.
The accountant initially
demanded Rs70,000,
but settled on Rs50,000.
The buyer, before giving

the Churchgate railway station
in Mumbai on Tuesday. The
Government Railway Police

her to JJ hospital, where she was operated. The
accused, identified as Roshan Naik was produced

questing them to urgently
deploy Central Forces in the
wake of Mominpur violence

“I am compelled to write
this letter to you at this hour
because the gravity of the
situation has prompted this
urgency
. The Hindu commu-
nity has come under attack
in the Khidderpore Momin-
pur area of Kolkata on the
eve of Lakshmi Puja. Many
shops and bikes belonging to
Hindus have been vandalised
by hooligans and anti socials.
The onslaught has similari-
ties to the Panchla violence
which happened in June in
the Uluberia area of the How-
rah district. At that time the
violence spread across West
Bengal, especially in the Na-
dia and Murshidabad dis-
tricts,” the letter read.
Adhikari wrote he appre-
hended that as the West Ben-
gal Government is reluctant
to act against the perpetra-
tors this time as well, as be-
cause they belong to a certain
community
, this time too this
may flare up and start to
spread across the state result-
ing in loss of lives and prop-
erty; both Public  Private.
The State Government has
already meekly surrendered
in front of the wrath of the
goons, who have taken over
the Ekbalpur Police Station,

Meanwhile, a war of words
broke out between the ruling
Trinamool Congress and the

that law and order has wors-
ened in West Bengal, draw-
ing a sharp retort from the
ruling TMC which accused
the BJP of trying to vitiate

the area, was stopped and ar-
rested on Monday
.
Police said clashes broke
out between two groups in
the Khidderpore-Mominpur
area on Sunday evening over
some local issues, in which
several people were injured.
The agitators also staged a
protest outside the Ekbalpur
police station.
Personnel of the police in-
cluding those of the Rapid
Action Force (RAF) were de-
ployed in the area. Majumdar,
who wanted to visit the area,
was stopped at the Chin-
grighata area in north Kolka-
ta and was asked to go back as
Prohibitory Orders under
Section 144 of the CrPC had
been imposed in the area.
“Sukanta Majumdar was
later arrested and taken to
Lalbazar police headquar-
ters,” a senior police official
said. Hitting out at the saf-
fron camp for allegedly try-
ing to vitiate the atmosphere
of the state, senior TMC lead-
er Sougata Roy said the po-
lice had taken all the steps
needed to bring the situation
under control.
“The miscreants have been
arrested. What will Sukanta
Majumdar do by going there
apart from giving hate
speeches? The BJP is trying
to vitiate the atmosphere of
the state. The BJP should
stop politicising every inci-
dent,” Roy said.

court’s judgment reducing
his sentence in the case.
Mumbai: The Bombay High Court has reserved its order on
a plea filed by actor Salman Khan against a Mumbai court
order refusing to issue him an interim relief in a defamation
case filed by him against his Panvel farmhouse neighbour
Ketan Kakkar. Sessions Court had earlier refused to pass a
restraining order against his neighbour’s post which Sal-
man had moved the Bombay High Court. On Tuesday, the
High Court, after hearing the matter, reserved its order.
New Delhi: BJP legislator Vikram Saini and 11 others were
sentenced on Tuesday to two years imprisonment in a
Muzaffarnagar riots case by a special MP/MLA court which
convicted them of rioting and other offences. The court
acquitted 15 other accused in the case for lack of evidence.
The BJP MLA and 26 others were facing trial for their al-
leged role in the violence at Kawal village when a crowd was
returning after the cremation of two Jat youths.
New Delhi: Observing that an accused going to court
is “fundamental to the criminal system”, the Supreme
Court on Tuesday refused to entertain a plea which said
production of undertrial prisoners before court on every
date should not be ordered as a “matter of routine”,
while raising the issue of safety. A bench headed by Chief
Justice UU Lalit said as an idea it is good but the practical
application would create a lot of difficulty.

stan’s Railways and
Aviation Minister Kha-
waja Saad Rafique said
on Tuesday that no pro-
posal is under consid-
eration to resume air
and rail link between
Pakistan and India.
The air and land link
between the two coun-
tries were suspended
following India’s move
to revoke the special sta-
tusof JammuandKash-
mir in 2019. The train –
Samjhauta Express –
and Lahore-Delhi bus
service were also sus-
pended. “Currently, no
proposal to resume air
and rail traffic between
Pakistan and India is
under consideration at
the moment,” the minis-
ter said in a reply to a
question during a me-
dia talk. Before the rela-
tions soared between
the two countries, Paki-
stan International Air-
lines (PIA) had been
operating two weekly
flights to New Delhi

How UPI spelling doom for candy business

New Delhi (PTI): Those visiting Europe will be able to make pay-
ments through UPI as the NPCI International Payments Ltd (NIPL)
has entered into a partnership with European
payment services facilitator Worldline. NIPL
is the global arm of the National Payments
Corporation of India (NPCI). The partnership
between NIPL and Worldline is aimed at ex-
panding acceptance of Indian payment means
across Europe, as per joint release issued on
Tuesday. Under the partnership, Worldline’s QR code-based mecha-

New Delhi: Toshiba India on
Tuesday signed a deal with In-
dian EV startup EVage to supply
its SCiB rechargeable lithium-ion
cells to power the next 10,000
EVage electric commercial vehi-
cles. With this agreement, EVage
has become the first company
in the world to use Toshiba’s
SCiB technology for delivery
vans. EVage is a key supplier of
electric vans to global companies
like Amazon and India’s largest
logistics company, Delhivery,
among others.
New Delhi: Warren Buffet-
backed Chinese electric
carmaker BYD unveiled its first
passenger car in India, an elec-
tric sport-utility vehicle (SUV),
marking its entry into the main-
stream market amid a broader
global expansion. BYD, which
already sells electric buses
and electric vehicles (EVs) for
corporate fleets in India. Book-
ings for the BYD Atto 3 electric
SUV are open in the country.
Deliveries, the company says,
will begin in January 2023.

The funding in Indian start-
ups nosedived a massive 80
per cent (year-on-year) in
the third quarter (July-Sep-
tember period) this year,
with the late-stage funding
seeing the biggest fall, a re-
port showed on Tuesday
.
Indian startups raised $3
billion in Q3, which was
also 57 per cent lower as
compared to the previous
quarter (Q2) this year.
The average ticket size
also witnessed a drop
across all funding stages,
with the late stage seeing
the biggest fall of over 70
per cent, from $142 million
in Q3 2021 to $42 million in
Q3 2022.
This indicated that in-
vestors are not willing to
make large investments
until economic conditions
stabilise, reports market
intelligence platform
Tracxn.
“India is currently expe-
riencing a funding slow-
down which is expected to
continue for the next 12-18
months and the effects of
the funding slowdown are
expected to intensify going
forward,” said Neha Singh,
Co-Founder of Tracxn.
Executives across the

New Delhi: India’s geospatial
economy is expected to cross
Rs 63,000 crore by 2025, grow-
ing at a rate of 12.8%, and will
provide employment to over
10 lakh people mainly through
geospatial startups, said Union
minister of state for Science
and Technology Jitendra Singh
on Tuesday. Addressing the
second United Nations World
Geospatial Information Con-
gress, the minister said in the
current boom of technology-led
startups, there are around 250
geospatial startups in India.
To provide a fillip, the Indian
government has provisioned for
a Geospatial Incubator. Singh
added that national organisa-
tions like Survey of India, Geo-
logical Survey of India, National
Atlas and Thematic Mapping
Organisation, Indian Space
Research Organisation (ISRO)
and National Informatics Centre
implemented several GIS-based
pilot projects across a range of
domains like waste resource
management, forestry, urban
planning, etc. to demonstrate
the applications of Geospatial
Technology. The minister
said geospatial technology
and Geographic Information
System (GIS) is going to make
a significant impact in the way
India has been adopting this

Nitin Gadkari launches

New Delhi: Union minis-
ter Nitin Gadkari on Tues-
day launched Japanese car
maker Toyota’s first-of-its-
kind pilot project on flex
fuel-strong hybrid electric
vehicle (FFV-SHEV) that
can run on 100 per cent
ethanol.Duringthelaunch,
the Toyota Corolla Altis
FFV-SHEV
, which has been
imported from Toyota Bra-
zil for the pilot project, was
unveiled.
Speaking on the occa-
sion, Union Road Trans-
port minister Nitin Gad-
kari said pollution is a big
concern in India and the
transport sector is contrib-
uting to pollution.
“Therefore, there is a
need to encourage use of
electric vehicles and vehi-
cles that run on biofuels
like ethanol and metha-
nol,” he added.

Senior politician
Chhagan Bhujbal, who
was then in Shiv Sena,
had won the election
from Mazgaon constit-
uency in Mumbai on
the “flaming torch”
symbol when the or-
ganization did not
have a fixed poll sym-
bol yet.
Bhujbal later re-
belled and quit Shiv
Sena to join Congress.
He is now a prominent
leader of the Sharad
Pawar-led Nationalist
Congress Party (NCP).
The “flaming torch”
symbol was used by
the Shiv Sena in the
past during civic body
and Assembly polls.
Shiv Sena MP Ga-
janan Kirtikar, who
has been with the par-
ty since its inception,
told PTI that most of
the candidates of the
party got the “sword
and shield” symbol in
1968 when they con-
tested the maiden civic
polls, including Mum-
bai. In 1985, many can-
didates got “flaming
torch” as the symbol,
he recalled.
The Shiv Sena was
founded in 1966 and
it took 23 years for
the party to get the
dedicated “bow and
arrow” symbol.
The Sena was rec-
ognized as a state
party in 1989, which
meant it could use a
uniform symbol in
the state.
But earlier, from
1966 to 1989, it con-
tested on different
symbols in the Lok
Sabha, Assembly and
civic polls.

Mumbai: The West-
ern Railway (WR)
added 25 extra seats
for women in all non-
air conditioned sub-
urban local trains.
The WR in a release
said 25 seats in a sec-
ond-class compart-
ment have been ear-
marked in the 11th
coach from the Church-
gate end (or second
coach from Virar end)
by providing a parti-
tion. The coach is adja-
cent to the existing la-
dies compartment i.e.
tenth from Churchgate
end or third from the
Virar end.
The facility has been
implemented from Oc-
tober 08, it was stated.
According to rail-
way officials, the move
is expected to provide
women a some relief
from overcrowding
during peak hours.
With this, the seat-
ing capacity of a sub-
urban local train for
women has increased
to 25.47% from the ear-
lier 23.32%, as a train
would previously have
273 seats for women of
total 1,170 seats. After
the modification, the
number has risen to
298, a railway official
stated on Tuesday.

Yogendra Thakur, who
has authored several
books on Shiv Sena
and Bal Thackeray, in
an article in the July
23 issue of Marmik
magazine, said senior
party leader Madhukar
Sarpotdar contested
the 1985 Assembly poll
from the Kherwadi seat
in northwest Mumbai
on the “flaming torch”
symbol. Bal Thackeray
had campaigned for him.
At that time, a flaming
torch was placed on the
left side of the stage to
convey the message to
voters about the party
symbol, Thakur said.
Marmik, a magazine
dedicated to cartoons,
was edited by Bal Thac-
keray and his brother
Shrikant in the 1960s
when the Sena founder
through his caricatures
portrayed what he called
“injustice” against the
“Marathi manoos”. In
the 1985 Maharashtra
Assembly polls, while
some candidates con-
tested on the “flaming
torch” symbol, the
others contested on the
“bat”, “sun” and “cup
and saucer” symbols,
Kirtikar said. Chhagan
Bhujbal was one of the
candidates elected on
the “flaming torch” sym-
bol. In October 1970,
during a bypoll in Mum-
bai, necessitated due to
the death of Communist
leader Krishna Desai,
Wamanrao Mahadik
contested on the “rising
sun” symbol and won,
Kirtikar said.
Explaining the history
behind the Shiv Sena’s
symbols, Yogendra
Thakur said in 1988,
the Election Commis-
sion of India decided
that all political parties
need to be registered.
Bal Thackeray then
decided the Shiv Sena
should also be regis-
tered. A panel compris-
ing Shiv Sena leader
Subhash Desai, advo-
cate Balkrishna Joshi
and Vijay Nadkarni was
formed to prepare a
constitution for the par-
ty with Manohar Joshi’s
guidance. Bal Thac-
keray suggested some
changes in the draft and
after necessary amend-
ments, the team went
to Delhi to present its
case before the election
body. They submitted
all the necessary doc-
uments and the party
was registered. This
had also helped the
Shiv Sena get the “bow
and arrow” symbol on
which it contested the
subsequent elections,
Thakur said.

Mumbai: Customs officials seized 3.07 kg
gold worth Rs1.63 crore after arresting two
passengers who arrived from Dubai at the
Mumbai international
airport, an official said
on Tuesday. The gold
dust in wax form was
found concealed in
the undergarments of
the duo—a man and
a woman—who are of
Indian origin. The entire gold was recovered in two
packets, said the Mumbai Airport Customs official.
The arrested persons were produced before a
court which remanded them in judicial custody,
the official added.

high court had granted
bail to the former min-

credits in the bank ac-
count of his family
trust were not the pro-
ceeds of crime.
The HC, however,
stayed the implementa-
tion of its order till Oc-
tober 13 after the ED
submitted it will chal-
lenge the order in the
apex court.

, flagged by

e are told and taught,
that there is nothing
greater than the power
of the Human Spirit.
We tend to dismiss this
as yet another ‘lecture’
from the grown-ups.
Yet, every now and again, when
we encounter an incident that
defies all logic, it quells any
doubts or questions, that it is
indeed, the all-conquering hu-
man spirit, that is one of the
world’s great saviours.
Only recently, the world was
amazed when a group of Thai
school students along with their
soccer coach were found alive
inside a cave inundated by a
flood, a full nine days after be-
ing trapped within! How did
they survive? How did they find
the courage and the gumption
to defy the odds that were so
heavily stacked against them?
Was it an indefinable higher
power? Was it destiny? Luck?
Or their sheer will to live? I sus-
pect it was the last option.
Not unlike Phoenix who rose
from the Ashes, the Human
Spirit, self-belief and unwaver-
ing faith in oneself, make an
individual the best possible ver-
sion of himself or herself. In
life, countless circumstances
from the time we are young stu-
dents through to when we’re
elderly will test this reserve of
the human spirit within us and
are the one factor that will sepa-
rate us, from the rest of this,
there is absolutely no doubt. For
it is truly the stuff we’re made
of on the inside, that will be our
making or our undoing.
Let us take a prevalent sce-
nario that we face as students
– bullying. When that tall, enor-
mous, insurmountable lad rags
us, pokes fun at us, humiliates
us, and reduces us to a tiny in-
significant spec; it is the human
spirit within us that comes to
the fore and makes us stand up
to this unsavoury denunciation.
It is our absolute sense of self-
preservation, our most primal
need for respect, that makes us
disregard various other seem-
ingly overpowering factors and
gives us strength, courage, con-
viction and the guts to stand our
ground.
Each time we are in a situa-
tion where it seems like failure
is inevitable – from a modest lit-
tle speech we have to deliver at
school to our important exami-
nations, to that first splash as a
non-swimmer in the apparently
oceanic pool, to the first day at
college as a ‘fresher’; ALL of it,
and how we cope, handle, and
emerge victorious, comes down
to the human spirit that resides
within us.
So how do we know it's there?
Running through our veins.
Lurking in our systems. Self-
belief. The knowledge that the
worst outcome of most situa-
tions will be ‘no’, nothing worse.
That if we don’t believe that it
is within our grasp, we would
have never tried and live to re-
gret it. Faith that at the most
unexpected, inopportune, and
desperate of times, it is this in-
tangible power inside us that
will come to our aid. Save us,
secure us, resurrect us.
Students today are faced with
insurmountable challenges.
The pressures of incredibly un-
realistic marks and grades. The
peer expectations of being ‘cool’
and relevant. The societal sup-
positions of vocational, sexual,
and various other ‘traditional’
lines are to be followed. This
kind of environment has made
it extremely difficult for young
students to undertake any kind
of truthful self-discovery, and
follow through with the conver-
sion of those unearthed pas-
sions into lifelong pursuits. I
would hedge my bets with that
same ‘will’  human spirit be-
ing the only recourse and anti-
dote to the myriad of burdens
that distract and dissuade
young children from finding
and following their real calling.
In simple terms, when the hu-
man spirit manifests in a young-
ster as courage, conviction and
confidence; only then can that
individual combat the barrage
of predetermined, forecasted
and anticipated choices that are
often consciously, and almost
regularly unconsciously, thrust
upon a young individual. Self-
belief and strong will then, are
essentials for young students to
embody
.
That is the ONLY thing that
the twelve young kids captured
in that deadly cave had to hold
on to. Else, how do you explain
their survival?

First India Bureau Mumbai: Chief Minis- ter Eknath Shinde on Tuesday welcomed the decision of the Election Commission of India to grant his faction the “two swords and a shield” symbol, saying it was associated with Chhatrapati Shivaji Ma- haraj and also the old Shiv Sena. Two swords and a shield was one of the symbols the Shiv Sena, founded by Bal Thack- eray, used in the 1967-68 civic polls in Mumbai and elsewhere. The Shinde faction, now named “Balasahe- banchi Shiv Sena” will be able to use the new symbolintheNovember 03 Andheri East Assem- bly bypoll if it decides to contest the election. However, its ally BJP is likely to field its own candidate against the Uddhav Thackeray fac- tion’s nominee. “Balasahebanchi Shiv Sena is the Shiv Sena of the common man. We accept this de- cision of the EC. We had given priority to the ‘sun’ symbol, but it ap- proved the ‘two swords and shield’. This is the symbol of the old Shiv Sena...This is a Maha- rashtrian symbol. It is the symbol of Chhatra- pati Shivaji and his ma- valas (soldiers),” he added. The rival Sena faction led by Thackeray has been granted “flaming torch” as its symbol af- ter the EC held last week that the two groups would not be able to use the Sena’s “bow and ar- row” symbol following the split. On Monday, the poll body had recognized the Shinde faction as “Bala- sahebanchi Shiv Sena” (Balasaheb’s Shiv Sena) but rejected “trishul”, “gada” (mace) and “ris- ing sun” as its poll sym- bols. Trishul and gada were rejected as they had religious connota- tions. The Thackeray fac- tion too had given trishul and rising sun as its choices. Rising sun is the sym- bol of the DMK, a recog- nized state party . The EC had then asked the Shinde faction to give fresh alternate symbols by Tuesday morning. TheShindegrouphad proposed “peepal tree”, “sword and shield” and “sun” as its choices on Tuesday . Shinde faction spokes- person Sheetal Mhatre said the new symbol was a “blessing of Chhatra- pati Shivaji” and will defeat “evil powers”. The police’s anti- extortion cell (AEC) had recently arrested gangster Chhota Shakeel’s brother-in-law Salim Qureshi alias Salim Fruit and businessman Riyaz Bhati in an extortion case and charged them under the stringent Maharashtra Control of Organised Crime Act, he said. The investigation revealed the role of five more people--Ajay Ganda, Feroz Chamda, Sameer Khan, Papa Pathan and Amjad Redkar--leading to their arrest, the official said. The quantity is sig- nificantly higher than the previous year when the Mumbai unit of the federal anti-drug agen- cy had seized 1,780kg of drugs. The agency has also registered 46 cases from January 01 to the first week of October and ar- rested people from Del- hi, Uttar Pradesh, Pun- jab, Madhya Pradesh, Gujarat and Goa among other states, said the NCB official. Seized drugs includ- ed large quantities of cocaine, mephedrone, ganja, heroin and LSD. The official, however, did not specify the col- lective worth of the seized drugs. ‘Black cocaine’ is the drug most in demand in the market and sold at Rs20,000 per gram, mak- ing it the most expen- sive narcotic substance, added the official. Mephedrone is sold at Rs3,000 per gram. “Black cocaine is in highdemandamongpeo- ple in high society . Our focus is on the suppliers and manufacturers of such drugs,” he said. In 2021, the NCB had seized 1,780kg drugs, registered 119 cases and arrested 240 people from different states, he said. Just last week, the NCB arrested six mem- bers of an inter-state drug cartel, including a former Air India pilot as part of an operation led by the Anti Narcot- ics Cell (ANC), which seized 1,200kg of me- phedrone from Thane and Ankleshwar in neighbouring Gujarat. “With the authentica- tion of the seized sub- stance, this becomes one of the biggest sei- zures of mephedrone in the country this year,” an official had said of the seizure on Friday . In his order passed on October 07 and made available on Tuesday, MACT mem- ber HM Bhosale di- rected the owner of a generator van and its insurance company to jointly and sever- ally pay the compen- sation to the claim- ants along with an annual interest of 8% from the date of filing of the petition. RS Chahal ap- peared for the peti- tioners—Baldev Sin- gh Gill and Manjit Kaur, the parents of the deceased Krishna Singh Baldev Singh Gill—who sought a compensation of Rs30.52 lakh. Chahal informed the tribunal that Krishna Gill was travelling with his girlfriend on a scoot- er on the Western Ex- press Highway around 6.30 am on May 19, 2019, when a generator van rammed into the two- wheeler. The couple fell and sustained se- vere injuries, and died while undergo- ing treatment at a hospital, he said. Gill earned Rs2.30 lakh per annum, and the petitioners were totally dependent on him, the tribunal was informed. Counsels Bhupesh Dhumatkar, appear- ing for the owner of the generator van, and HC Thanawala who represented the insurance company, vehemently opposed the claim on various grounds. The compensation awarded by the tribu- nal includes Rs28.98 lakh towards depend- encyloss,Rs16,500each towards loss of estate and funeral expenses and Rs88,000 towards filial consortium. According to a police official, Biyani shot himself in the head with his licensed re- volver at his house in Mira Nagar area which falls under the jurisdic- tion of Peth Beed police station. Biyani,whowasinhis 50s, went to bed on Mon- day night, but did not come out of his room next morning. His fami- ly members broke the door and found him ly- ing lifeless. He was rushed to a hospital, where the doctors de- claredhimbroughtdead. “Prima facie, this seems to be a suicide and police is investing it in every angle,” said Beed Superintendent of Police Nand Kumar Thakur, adding that a bullet wound was found above his ear and fur- ther probe is underway . The BJP leader was suffering from some health issues, said an- other official. Mumbai (PTI): Nearly two-and-a-half years after three people, in- cluding two sadhus (monks), were lynched by a mob in Palghar district near Mumbai, the state Home Department has handed over the investigation of the case to the Central Bureau of Investiga- tion (CBI). Home Minister Dev- endra Fadnavis con- firmed the development to the media on Tuesday . Earlier, the case was being investigated by the state Criminal In- vestigation Department (CID). The BMC was mak- ing suggestions dur- ing the hearing of sev- eral public interest litigation (PILs) filed against the pothole menace in the Bombay High Court. The civic body also clarified that not all roads, even in the city limits, come under its jurisdiction—some, the BMC said, were un- der the management of agencies such as the airport authority, Mumbai Port Trust. It also proposed to have a single planning body which will have an overarching say on the issue of poor roads. During its pres- entation before the High Court, the BMC claimed the agencies didn’t give any priori- ty to road repairs that come under their man- agement. The BMC told the court that the “lacka- daisical approach” of these other agencies put the civic body at in the crosshairs of city residents. The munici- pal body then suggest- ed that to avoid such negligence road infra- structure mainte- nance, including flyo- vers and bridges, should be handed over to the BMC. First India Bureau Mumbai: With the deadline coming to an end for shops and commercial estab- lishments in Mumbai to put up Marathi signboards, the Bri- hanmumbai Munici- pal Corporation (BMC) from Monday started taking action against those who have not yet done. The BMC’s fourth deadline to shops for setting up Marathi signboards expired on September 30. According to Deputy Municipal Commis- sioner (Special) Sanjog Kabre, the BMC has started issuing notices to the commercial es- tablishments. “Every shop is being given seven days after the date of notice issu- ance for setting up the new signboard. If they fail to do so during that time, we will file a case in the court against the owners of the es- tablishments,” Kabre said. The present provi- sion states a fine of Rs2,000 per staffer will be imposed on shops. If the shop owners choose to pay the fine on their own, then the BMC may not approach the court. “At present, there are more than five lakh shops and commercial establishments in Mumbai and less than 50% of these have Mar- athi signboards. We will take photographs of the shops as evi- dence as we send them notices,” Kabre said. The BMC appointed 60 inspectors at vari- ous ward and zonal lev- els for inspecting the shops. Each of these officers will inspect around 50 shops and the BMC targets to in- spect 3,000 shops daily. Meanwhile, Federa- tion of Retail Traders and Welfare Associa- tion (FRTWA) has written to Chief Minis- ter Eknath Shinde, urging a temporary stay on the order since the issue is pending at the Supreme Court. The FRTWA had ap- proached the Supreme Court challenging the state’s mandate on con- stitutional grounds. First India Bureau Mumbai: The Bombay High Court has im- posed a fine of Rs25,000 on an advo- cate for submitting objectionable photo- graphs with a petition seeking to quash a rape case. A division bench comprising Justice Re- vati Mohite Dere and Justice SM Modak in an order observed that “no sense of proportion or discretion” was exer- cised by the petitioner’s advocate while annex- ing the “highly objec- tionable” photographs with the plea. A copy of the October 07 order made available on Tuesday . The bench found the photographswhilehear- ing the petition filed by the accused man’s wife seekingtoquashtheFIR and charge sheet filed against him in a rape case. “Advocates fail to re- alize that these peti- tions are filed or placed before the Registry and get circulated through various departments, exposing the parties in- volved in the photo- graphs,” said the court. It further noted that annexing such photo- graphs was an invasion of privacy of the parties and directed the advo- cate to remove the same from the petition copy . “We expect all advo- cates to exercise some discretion while annex- ing photographs which are highly objectiona- ble,” said the court. The appeal filed in the case is pending hearing. A division bench comprising Justice Gautam Patel and Jus- tice Gauri Godse in an interim order passed on October 06 observed that it cannot view such matters with the “clini- cal coldness” of a civil suit. A copy of the order was made available on Tuesday . The court was hear- ing an appeal filed by the senior section engi- neering, Signal Con- struction of the West- ern Railway that owned the vehicle involved in the accident. It had challenged a February 2021 order passed by the Motor Accidents Claim Tribunal (MACT) 1awarding compensa- tion of Rs69,92,156 to Nidhi Jethmalani. “Here human lives are at stake. Futures are at stake; Nidhi’s future has been completely ex- tinguished. It is for this reason that we believe that an interim order is not only permissible, but is absolutely neces- sary,” said the court. The accident took place on May 28, 2017, when Nidhi (17 years old at the time) was crossing the road near Marine Drive in south Mumbai when a car knocked her down. The victim suffered se- rious injuries and has been in a vegetative state ever since. Advocate Saumen Vidyarthi, appearing for the victim’s father, told the court that the original claim for com- pensation was Rs2.22 crore and the tribunal’s order awarding Rs69,92,156 was on the lower side. Vidyarthi informed the court that apart from the compensation awarded, the Railways had deposited Rs1.50 crore in court, the inter- est of which was used by the victim’s family towards her expenses. He further told the court that as on date, there is about Rs1.15 crore still in court. The court posted the appeal for hearing on October 17. First India Bureau Mumbai: The new diktat to bus conduc- tors by the Brihan- mumbai Electric Sup- ply Transport (BEST), regarding docking of pay if the hand-held ticketing machines are damaged, has not gone down well with its employees. According to a BEST circular, at the end of duty hours when ad- ministration staffers collect the machines, some of them are found damaged. The staffers have observed many in- stances of the plastic flaps over the display to be forced or cut open, affecting its correct storage procedure. “This…also makes it non-functional in the long run. If machines are found in that condi- tion, the money for re- placing spare parts will be recovered from em- ployees, as per prevail- ing policy and rates,” read the circular. In response, trade un- ions have threatened to take to the streets in protest. “Your office provides you with lap- tops, but do they ask you to reimburse them if some part of it is not functional? The BEST is doing exactly this and has issued a rate card per broken part of ticket machines,” said Shashank Sharad Rao, Convener, BEST Work- ers Joint Action Com- mittee. The BEST listed pric- es of 15 items in the cir- cular, including the LCD and front cover of the ticket dispenser at Rs4,737. The battery, back body, printer bracket and speakers are worth Rs2,214, Rs1,582, Rs 960 and Rs490 respectively . “The machine may face technical problems and not work properly. In such cases, salaries of employees will get cut. It will be unfair and hence the protest,” he pointed out. New Delhi (Agencies): The funding in Indian start- ups nosedived a massive 80 per cent (year-on-year) in the third quarter (July-Sep- tember period) this year, with the late-stage funding seeing the biggest fall, a re- port showed on Tuesday . Indian startups raised $3 billion in Q3, which was also 57 per cent lower as compared to the previous quarter (Q2) this year. The average ticket size also witnessed a drop across all funding stages, with the late stage seeing the biggest fall of over 70 per cent, from $142 million in Q3 2021 to $42 million in Q3 2022. New Delhi: India’s geospatial economy is expected to cross Rs 63,000 crore by 2025, grow- ing at a rate of 12.8%, and will provide employment to over 10 lakh people mainly through geospatial startups, said Union minister of state for Science and Technology Jitendra Singh on Tuesday. Addressing the second United Nations World Geospatial Information Con- gress, the minister said in the current boom of technology-led startups, there are around 250 geospatial startups in India. To provide a fillip, the Indian government has provisioned for a Geospatial Incubator. Singh added that national organisa- tions like Survey of India, Geo- logical Survey of India, National Atlas and Thematic Mapping Organisation, Indian Space Research Organisation (ISRO) and National Informatics Centre implemented several GIS-based pilot projects across a range of domains like waste resource management, forestry, urban planning, etc. to demonstrate the applications of Geospatial Technology. The minister said geospatial technology and Geographic Information System (GIS) is going to make a significant impact in the way India has been adopting this technology moving ahead. Mumbai (PTI): The “flaming torch” (mashaal) and “two swords and a shield” symbols allotted to the factions led by Uddhav Thackeray and Maharashtra Chief Minister Eknath Shinde by the Election Commission were once associated with the parent par- ty- Shiv Sena, at dif- ferent intervals be- fore it got the hal- lowed “bow and ar- row” symbol. The Shiv Sena, founded by Bal Thack- eray, had successfully contested an election in 1985 using the “flam- ing torch” symbol which is now allotted to the Uddhav Thack- eray faction “Shiv Sena Uddhav Balasa- heb Thackeray”, by the EC amid the factional feud that began in June. The Shinde fac- tion was allotted the “two swords and a shield” symbol. Senior politician Chhagan Bhujbal, who was then in Shiv Sena, had won the election from Mazgaon constit- uency in Mumbai on the “flaming torch” symbol when the or- ganization did not have a fixed poll sym- bol yet. Bhujbal later re- belled and quit Shiv Sena to join Congress. He is now a prominent leader of the Sharad Pawar-led Nationalist Congress Party (NCP). The “flaming torch” symbol was used by the Shiv Sena in the past during civic body and Assembly polls. Shiv Sena MP Ga- janan Kirtikar, who has been with the par- ty since its inception, told PTI that most of the candidates of the party got the “sword and shield” symbol in 1968 when they con- tested the maiden civic polls, including Mum- bai. In 1985, many can- didates got “flaming torch” as the symbol, he recalled. The Shiv Sena was founded in 1966 and it took 23 years for the party to get the dedicated “bow and arrow” symbol. The Sena was rec- ognized as a state party in 1989, which meant it could use a uniform symbol in the state. But earlier, from 1966 to 1989, it con- tested on different symbols in the Lok Sabha, Assembly and civic polls. The WR in a release said 25 seats in a sec- ond-class compart- ment have been ear- marked in the 11th coach from the Church- gate end (or second coach from Virar end) by providing a parti- tion. The coach is adja- cent to the existing la- dies compartment i.e. tenth from Churchgate end or third from the Virar end. The facility has been implemented from Oc- tober 08, it was stated. According to rail- way officials, the move is expected to provide women a some relief from overcrowding during peak hours. With this, the seat- ing capacity of a sub- urban local train for women has increased to 25.47% from the ear- lier 23.32%, as a train would previously have 273 seats for women of total 1,170 seats. Bal Thackeray had campaigned for him. At that time, a flaming torch was placed on the left side of the stage to convey the message to voters about the party symbol, Thakur said. Marmik, a magazine dedicated to cartoons, was edited by Bal Thac- keray and his brother Shrikant in the 1960s when the Sena founder through his caricatures portrayed what he called “injustice” against the “Marathi manoos”. In the 1985 Maharashtra Assembly polls, while some candidates con- tested on the “flaming torch” symbol, the others contested on the “bat”, “sun” and “cup and saucer” symbols, Kirtikar said. Chhagan Bhujbal was one of the candidates elected on the “flaming torch” sym- bol. In October 1970, during a bypoll in Mum- bai, necessitated due to the death of Communist leader Krishna Desai, Wamanrao Mahadik contested on the “rising sun” symbol and won, Kirtikar said. Explaining the history behind the Shiv Sena’s symbols, Yogendra Thakur said in 1988, the Election Commis- sion of India decided that all political parties need to be registered. Bal Thackeray then decided the Shiv Sena should also be regis- tered. A panel compris- ing Shiv Sena leader Subhash Desai, advo- cate Balkrishna Joshi and Vijay Nadkarni was formed to prepare a constitution for the par- ty with Manohar Joshi’s guidance. Bal Thac- keray suggested some changes in the draft and after necessary amend- ments, the team went to Delhi to present its case before the election body. They submitted all the necessary doc- uments and the party was registered. This had also helped the Shiv Sena get the “bow and arrow” symbol on which it contested the subsequent elections, Thakur said. Mumbai: Customs officials seized 3.07 kg gold worth Rs1.63 crore after arresting two passengers who arrived from Dubai at the Mumbai international airport, an official said on Tuesday. The gold dust in wax form was found concealed in the undergarments of the duo—a man and a woman—who are of Indian origin. The entire gold was recovered in two packets, said the Mumbai Airport Customs official. The arrested persons were produced before a court which remanded them in judicial custody, the official added. Jalna: A Jalna court on Tuesday sentenced a 30-year-old man to life imprisonment for bludgeoning his mother Vridavani Shinde (60) to death with a stick when she refused to sell the household stock of grain and give him the money to buy alcohol. District and session court judge VM Mohite convicted Sakhram Yadaji Shinde of charges under relevant provisions of the Indian Penal Code and sentenced him to life imprisonment, and fined him Rs5,000. A bench, comprising of Justices DY Chan- drachud and Hima Koh- li, said the observations made by the HC in its order will not affect the trial in the case and dis- missed the appeal filed by the Enforcement Di- rectorate (ED). On October 04, the high court had granted bail to the former min- ister in the case observ- ing two components of credits in the bank ac- count of his family trust were not the pro- ceeds of crime. The HC, however, stayed the implementa- tion of its order till Oc- tober 13 after the ED submitted it will chal- lenge the order in the apex court. Two components of credits (Rs10.42 crore and Rs1.12 crore) in the account of a trust con- trolled by the Desh- mukh family , flagged by the ED, were “not pro- ceeds of crime,” a sin- gle-judge bench of the HC had said in the order. The HC also said the statements given by for- mer Mumbai Police commissioner Param Bir Singh and dis- missed officer Sachin Waze alleging that Deshmukh had taken money from police of- ficers for favourable postings were “prima facie hearsay”. We tend to dismiss this as yet another ‘lecture’ from the grown-ups. Yet, every now and again, when we encounter an incident that defies all logic, it quells any doubts or questions, that it is indeed, the all-conquering hu- man spirit, that is one of the world’s great saviours. Only recently, the world was amazed when a group of Thai school students along with their soccer coach were found alive inside a cave inundated by a flood, a full nine days after be- ing trapped within! How did they survive? How did they find the courage and the gumption to defy the odds that were so heavily stacked against them? Was it an indefinable higher power? Was it destiny? Luck? Or their sheer will to live? I sus- pect it was the last option. Not unlike Phoenix who rose from the Ashes, the Human Spirit, self-belief and unwaver- ing faith in oneself, make an individual the best possible ver- sion of himself or herself. In life, countless circumstances from the time we are young stu- dents through to when we’re elderly will test this reserve of the human spirit within us and are the one factor that will sepa- rate us, from the rest of this, there is absolutely no doubt. For it is truly the stuff we’re made of on the inside, that will be our making or our undoing. Let us take a prevalent sce- nario that we face as students – bullying. When that tall, enor- mous, insurmountable lad rags us, pokes fun at us, humiliates us, and reduces us to a tiny in- significant spec; it is the human spirit within us that comes to the fore and makes us stand up to this unsavoury denunciation. It is our absolute sense of self- preservation, our most primal need for respect, that makes us disregard various other seem- ingly overpowering factors and gives us strength, courage, con- viction and the guts to stand our ground. Each time we are in a situa- tion where it seems like failure is inevitable – from a modest lit- tle speech we have to deliver at school to our important exami- nations, to that first splash as a non-swimmer in the apparently oceanic pool, to the first day at college as a ‘fresher’; ALL of it, and how we cope, handle, and emerge victorious, comes down to the human spirit that resides within us. So how do we know it's there? Running through our veins. Lurking in our systems. Self- belief. The knowledge that the worst outcome of most situa- tions will be ‘no’, nothing worse. That if we don’t believe that it is within our grasp, we would have never tried and live to re- gret it. Faith that at the most unexpected, inopportune, and desperate of times, it is this in- tangible power inside us that will come to our aid. Save us, secure us, resurrect us. Students today are faced with insurmountable challenges. The pressures of incredibly un- realistic marks and grades. The peer expectations of being ‘cool’ and relevant. The societal sup- positions of vocational, sexual, and various other ‘traditional’ lines are to be followed. This kind of environment has made it extremely difficult for young students to undertake any kind of truthful self-discovery, and follow through with the conver- sion of those unearthed pas- sions into lifelong pursuits. I would hedge my bets with that same ‘will’ human spirit be- ing the only recourse and anti- dote to the myriad of burdens that distract and dissuade young children from finding and following their real calling. In simple terms, when the hu- man spirit manifests in a young- ster as courage, conviction and confidence; only then can that individual combat the barrage of predetermined, forecasted and anticipated choices that are often consciously, and almost regularly unconsciously, thrust upon a young individual. Self- belief and strong will then, are essentials for young students to embody . That is the ONLY thing that the twelve young kids captured in that deadly cave had to hold on to.
