1. The Prevention of Cruelty

3. Introduction:
a) In India different rules in different parts to prevent
unnecessary cruelty to animals.
b) Government of India appointed a committee to study
matters relating to infliction of unnecessary pain or
suffering on animals.
c) Recommendations of this committee had been
considered for passing this act.
4. Objective:
Main objective of this act is to prevent infliction of
unnecessary pain or suffering on animals as well as to prevent
cruelty to animals.
5. Definitions:
Animals:
This term include any living creature except human being.
Phooka or Doom Dev:
It includes a process in which any substance or air is introduced into the female
organ of a milch animal with the intension of drawing of any secretion of milk.
Cruelty:
It is not define under this act but it roughly means the infliction of unnecessary
pain or suffering.
6. • IAEC is a local body, approved by CPCSEA, which empowers to permit
experiments on small animals through an amendment in Rules for
Breeding and Experiments on Animals.
• IAEC is must be reconstituted after every 5 years.
• The minimum qualification for the IAEC Members is as below:
• B.V.Sc. or
• M.Sc. (Zoology/ Animal Sciences/ Animal Biotechnology), or
• M.Sc. / M.Tech (Life Sciences, Biological Sciences/ Biochemistry/
Biotechnology/ Biomedical Engineering) with experience in animal
handling & animal research,
• M. Pharm. with experience in animal handling and animal research,
• MD/ MS with research experience in laboratory animal handling.

7. Composition of IAEC:
Institutional Animals Ethics committee shall include eight members as follows:
IAEC members from the establishment(5)
One biological scientist
Two scientists from different biological disciplines
One veterinarian involved in the care of animal
One scientist in charge of animal facility of the establishment concerned.

8. That suitable records are maintained with respect to expt. performed on animals
That animals intended for the performance of expt. are properly looked after before, during and after
expt.
If possible expt. are not performed merely for the purpose of acquiring manual skill.
That expt. on larger animals are avoided
That expt. on animals are avoided wherever it is possible.
That expt. are performed with due care and humanity.
Every expt. performed by/under the supervision of a person duly qualified in Veterinary Science or
Medicine or Laboratory Animal Science of a University.
Objectives Of IAEC
9. Functions of
IAEC:
• To control and supervision of expt. on animals performed in an
establishment.
• To work for achievement of the objectives as mentioned above.
• IAEC should focus mainly on ensuring ethical and methodical handling
of animals during and after expt., so that they have less suffering.
• IAEC will review and approve all types of protocols for research
involving small animal experimentation before the start of the study.
• To monitor the research throughout the study and after completion of
study, obtain the periodic reports on R & D and shall ensure visit to
animal house facility and laboratory.
10. CPCSEA guidelines for Breeding & stocking of animals:
Breading of animals:
No establishment shall carry on the business of breeding of animals or
trade of animals for the purpose of expt. unless it is registered.
Every breeder/establishment shall, apply for registration within 60
days from the date of commencement of these rules and, stop
breeding of animals if registration is subsequently refused to it by the
Committee.
11. Stocking of
animals:
Animal houses located in a quiet
atmosphere undisturbed by traffic,
& premises kept tidy, hygienic &
animals protected from drought &
extremes of weather;
Animal cages for small
animals & stables for
large animals shall be
such that animals can
live in comfort and
overcrowding is
avoided;
Standards have been
laid down by the Indian
standards institution,
the cages, the stable,
as the case may be,
shall conform to those
standards;
Animals attendants
must be suitably
trained and
experienced in the
duties allotted to
them,
Animals shall be

12. Performance of experiments:
In conducting expt. on animals, regard shall be had to the following conditions:
• Expt. performed in every case by/under the supervision of a person duly qualified.
• Expt. shall be performed with due care and humanity;
• Animals intended for the performance of expt. are properly looked both before and after expt.
• Expt. involving operative procedure more severe than simple inoculation or superficial vein section
performed under the influence of anaesthetic to prevent the animal feeling pain and it shall remain
so throughout the experiment.
• Animals which in the course of expt. under the influence of anaesthetic are so injured that their
recovery would involve pain or suffering shall be destroyed humanely while still under the influence
of anaesthesia.
13. Performance of experiments:
In conducting expt. on animals, regard shall be had to the following conditions:
• When there is reason to believe that an animal is suffering abnormal or severe pain at any stage of
a continuing expt. it shall be painlessly destroyed at that stage without proceeding with the expt.
• The expt. shall not be performed for the purpose of attaining or retaining manual skill except in
schools, colleges and recognised training institutions;
• Experiments shall not be performed by way of an illustration;
• Expt. shall not be performed as a public demonstration;
• The substance known to cause paralysing shall not be used or administered for the purpose of any
expt. except in conjunction with anaesthetic of sufficient depth to produce loss of consciousness;
14. Performance of experiments:
In conducting expt. on animals, regard shall be had to the following conditions:
• No experiment the result of which is already conclusively known, shall be repeated without
previous justification;
• There shall not be applied to the eye of an animal by way of experiment any chemical substance for
the purpose of absorption through the conjunctival membrane or through the cornea calculated to
only give pain.
• Dogs held for experimental purposes shall not be debarked.
• Expt. performed in any institution, the responsibility is placed on the person in charge of the
institution and in cases where experiments are performed outside an institution by an individual
qualified in that behalf, the-experiments, are performed on his responsibility.
15. Transfer & acquisition of animals for experiment:
A breeder shall not transfer any animal by sale or otherwise to an establishment which is not registered
under these rules.
An establishment shall not acquire any animal by sale or otherwise except from a registered
breeder/establishment.
Every establishment after acquisition of a animal or animals shall not transfer such animal or animals by
sale/otherwise to any other establishment or person except to a registered breeder/establishment.
The animals used for experimentation in a production/breed improvement programme may be given out
by the breeder institution for domestic use.
No animal shall be imported by a breeder or an establishment which is available in the country.
A breeder or establishment shall comply, with the directions given by the Committee for the purpose of
controlling and supervising experiments on animals.
16. Records:

17. Powers to suspend or revoke registration:
If the Committee is satisfied on report of the Member-Secretary of the authorised officer of the
Committee may allow the establishment of breeder or if not satisfied suspend or revoke the registration
of such establishment or breeder.
The Committee may, pending the final determination, if, it is of the opinion that an establishment or
breeder has prima facie failed to comply with the provisions of these Riles, suspend the registration of
such establishment or the breeder.
The Committee may in the event of revocation or suspension of registration of an establishment or
breeder, issue such directions as it, deems fit for the care and protection of the animals which are under
the custody or control of such establishment or the breeder.
That in the event of suspension or revocation of a license, such establishment or breeder shall forthwith
on the communication of the order cease to perform any experiment on, any animal or acquire or
transfer any animal.
18. Offences & penalties:
1) Treating animals cruelly is punishable with fine NLT Rs. 10/- which may extend to Rs. 50/-
on first conviction
2) On subsequent conviction with in three year of previous offence, it is punishable with
fine NLT Rs. 25/- which may extend to Rs. 100/- or imprisonment of three months or with
both.
3) Performing operation like Phooka or any other operation to improve lactation which
injurious to health of animal is punishable with fine up to Rs. 1000/- or imprisonment up
to 2 year or with both. Animal may be forfeited by the government.
4) Contravention of any order of committee or breach of law imposed by committee is
punishable with fine up to Rs. 200/-.
