"If an employee has been guilty of serious misconduct, habitual neglect of duty, incompetence or
conduct incompatible with his duties, or prejudicial to the employer's business, or if he has been
guilty of willful disobedience to the employer's orders in a matter of substance, the law recognizes
the employer's right summarily to dismiss the delinquent employee."

Unionized or tenured employees are a special case when it comes to being able to dismiss an
incompetent employee. For example, a professor, who has tenure, fits the special case of an
employee who has worked for numerous years in the position and is then seemingly guaranteed the

Once a person decides to make teaching their career choice their next steps are to research all
aspects of the position. Among one of the first things a teacher investigates is the obtaining of
tenure. Tenure is important because it provides a sense of security for the teacher. The securing of
tenure means that as long as a teacher performs their duties in an effective manner they will have job
security. An increase of tenured teachers on a staff means that you have an abundance of
experienced teachers on your staff. These teachers therefore have acquired a great deal of
knowledge and expertise. These teachers can serve as role models and support new staff members.
These tenured teachers also become the academic leaders of the school serving as professional
development team leaders, grade level chairpersons and general all around support for the school.
Many principals however, have a problem with a staff of teachers with tenure. As a principal, this
means that you must handle these teachers a little differently because they are the underlying
instructional leaders of the school. As principal, this means that you have to present new ideas and
strategies to your tenured staff a little differently because if they object to the ideas you cannot

system are marginalised by peers and institutions (Kilonzo & Magak, 2013). Industrial R&D,
however, has its ultimate goal the improvement of the industry's economic position (Bridgstock,
1998). Hence, the "ideal type" industrial science focuses on applied research (Sauermann &
Stephan, 2013), which involves solving practical problems desirable in the market (Aghion,
Dewatripont & Stein, 2008). As such, industrial scientists are discouraged to publish their results
since no corporation wishes to reveal a potentially significant discovery to its competitors
(Bridgstock, 1998). Thus, secrecy appears to be heavily relied upon across most industries (Cohen,

Another key driver of academic science is freedom in research whereas industrial scientists'
decisions are largely dictated by managers of the firm. Because of their research mission, academics
are allowed to decide on how and what tasks to undertake based on their intrinsic interest (Aghion,

beneficiary of that intrigue due to her spouse 's fraud. The misfortune here is the party denied of a

wife in the New South Wales Supreme Court looking for that the property be exchanged back to the

herself was not a knowing party to the fraud.

of our actions, by teaching us persistence or leading us the opposite way. Through his book, Dr.
Cleamon Moorer guides the readers through an intimate journey about his progression from failure
to promise. In the small town of Detroit, Moorer was raised by Christian parents, who taught him
love, obedience, and enforced discipline, but most importantly, they nurtured his faith in Jesus
Christ. Cleamon Moorer flourished in academics during both elementary and middle school,
however, his mischievousness throughout those years earned him many disciplinary sessions. In
high school, misbehavior became history, yet, his GPA suffered in the low C's. But with his father's
tough discipline and Moore's own effort and faith in God, he later received candidacy for the
National Honor's Society. As his college experience began, Cleamon Moore was honored to attend
GMI and work along many of his classmates at GM, but when the courses became more difficult

Since salary is determined by the amount of experience, administrations could maximize a payroll
budget by cutting out the more experienced teachers in favor of less expensive, inexperienced

Another great thing about tenure is that it allows teachers to have a teaching style that may conflict

that cut almost 300 million dollars from higher education and more controversially took tenure out

Amendment. Zaino references back to the story of two professors who publicly stated very
unpopular opinion. They ended up fired due to their public statements. According to Zaino, these
two should have not been fired. On the other hand, the professors should have known better because
they represent a university. These professors knew what the consequences would be after making
their statements. Besides the fact that I disagree with Jeanne Zaino, the essay is fairly written. It is
not perfect due to its poor assumptions of what the reader must already know and believe. Although,
these are key components, the author did a good job by explaining what was currently happening

higher education community (Nye & Maxey, 1994). According to McKenney and Cejda (2000),
minority representation in the American higher education system has generally been a major issue
for the academic community as a whole.
Racial and ethnic diversity has become increasingly more challenging throughout colleges and
universities across the United States. Little progress has been made, for instance, for minority
faculty members to move up through the leadership ranks. There are large disparities for minority
faculty members when data and "demographic trends" in faculty and institutional leadership are
