Misrepresentation In Popular Culture
The exclusion, or rather misrepresentation of people of color in popular culture has become a
cataclysm in our society. Regrettably, the exclusion, or blatant misrepresentation hadn't received as
much deserving cognizance until recent controversies surrounding the 2016 Oscars. Seemingly, the
visual of a uniformed–undiversified audience served as a catalyst for awareness; the tension from the
issue unveiled how there was still an undercurrent racism present in the system, and that in turn
exposed how stagnant our society has been on the issues of institutionalized racism. Notwithstanding
the active minds of bell hooks and Melissa Harris–Perry confronting the issue of inaccurate
misrepresentation of POC, the award show revealed much of the unperceived...show more content...
When the misrepresentation of POC in films becomes an indicator that we are not boldly
confronting the issues needed to be confronted, a change must occur. As bell hooks and many
other active progressive thinkers, emboldened by the current racial inequalities of our society,
have asserted, pop culture has a significant impact on our perception of matter. In knowing the
impact, it is imperative that in the concurring systematic oppressions we do not remain stagnant.
Through a close examination of films: Pan, Braveheart, and Ghost in the Shell, we can vividly
see how the overrepresentation of white expose the underlying oppression within our society.
According to the statistics conducted by USC, there is an evident disproportion of minorities in
both film and media. Yet, this disproportion is rarely challenged. The Oscars of 2016 became a
visual catalyst in the need for proper representation. The prevalence of institutionalized racism in
our current society can never truly be effaced if we fail to grasp its strong presence in popular
culture. The existing racism in Hollywood explicitly displays a regression in racial equality in
society. Hollywood is more than "sorority" racist; it is plagued by something far worse: It is plagued
by institutionalized racism. The three movies and their whitewashed cast explore the racism within
the system. In acknowledging the flaws, an effort should be made

Examples Of Misrepresentation In A Contract
Misrepresentation refers to a circumstance where a person is induced to enter into a contract partly
or entirely by untrue information made by the other party. Misrepresentation can lead to a contract to
be voidable. Voidable contract means there is a valid contract whether it is written or verbal. In any
voidable contracts, a party has a choice whether to rescind or to continue with the contract. However,
there are certain circumstances and elements of misrepresentation that can cause a contract to be
voidable. Misrepresentation can occur in a number of ways. Under Section 18 of the Contract Act
1950, misrepresentation includes:– a) Any positive assertion, in a manner not warranted by the
information of the person making it, of that...show more content...
However, if the other party is aware of the misrepresentation and decided to continue to enter the
contract, then the contract is not voidable. This is due to the fact that he fully consented getting into
the contract with full knowledge of the misrepresentation. A misrepresentation is a
misrepresentation of a statement of fact, not of general opinion and in that it influenced a person to
enter into the contract and it is false. A fact must be something current and cannot be something in
the future. One of the famous case of misrepresentation is the case of Bisset v Wilkinson (1927)
AC177. In this case, the seller of the farm that had never run sheep gave his opinion that it would
support 2000 sheeps. This turned out not to be the case, and the buyer sued for the return of his
purchase money. Court held: The court rejected his appeal based on the saying that the statement
made had not been a representation of fact, instead it is merely an expression of the sellers honestly

Mistake vs. Misrepresentation
In brief: Mistake vs Misrepresentation A mistake is inadvertent and only an error on the part of the
person committing it while misrepresentation is often wilful or intentional, done with the intention
of gaining wrongfully. The main difference between Mistake and Misrepresentation is that in the
case of Mistake one or both parties to a contract or what was intended to be a contract unintentionally
or unknowingly made statements not intended to mislead the other. Therefore fraud cannot be
implied from these statements or circumstances. At Common law, a mistake can affect the validity
of a contract "operative mistake", making it null and void. In the case of misrepresentation, false
statements of facts are required to be made which...show more content...
In 1963, the House of Lords stated, obiter, in Hedley Byrne Co Ltd v Heller Partners Ltd [1964]
AC 465 that in certain circumstances damages may be recoverable in tort for negligent

"special relationship" between the parties. It is now clear that a party can claim damages under the
principle in Hedley Byrne where a negligent mis–statement has induced him to enter a contract;

Misrepresentation Of Women In Media
Purpose: The misrepresentation of women in the media has been at its highest. Reality shows
such as Love and Hip Hop, have degraded and exploited women where they are only seen as
objects who compete over men. They are not able to have a identity that is positive. I wanted to
create a platform where you can see the true side of women. Having them tell their stories and
accomplishments. Where they are seen past their physical features and given a voice. The issues
discussed through the interviews are also expressed through my poetry. As women they are taking
their identities back and showing who they really are, regardless of how they are depicted through
the media. Why Did I Start My Website?: It was important for me to address social issues

Innocent Misrepresentation Case Study
Case 13.5: Innocent Misrepresentation This is a case of fraudulent misrepresentation. W.F. Yost,
was the owner of an establishment called Red Barn Barbecue Restaurant who listed it for sale.
Richard Ramano, his wife and his brother–in–law of Rieve Enterprises, became interested in
purchasing the property. They conducted a visual inspection of the premises and began entering into
a contractual agreement of purchase based on the statement "Seller warrants that at the time physical
possession is delivered to buyer, all equipment will be in working order and that the premises will
pass all inspections necessary to conduct such business." (Leagal.com, 2015) After a routine health
inspection uncovered 52 cited health code violations, just two weeks after the Ramano's purchased
the business, the Heath Department shut down the business. The Ramano's file a case of fraud
against Yost for knowingly misrepresenting the material damages of the equipment and building.

The basis for this is due to the statue that states that regardless if the misrepresentation is made
innocently or knowingly, misrepresentation of a material fact acted on by the other party to his
detriment is a ground for rescission of a contract. (Leagal.com, 2015) Meaning that due to the
wording in the contract that the facility and equipment purchased would pass all health inspections;
Yost, while claiming innocent misrepresentation entered into a fraudulent contract. As a side note,
Yost's credibility comes into question due to the amount of citations that were recorded in a two
week time frame, from sanitation, structural integrity, plumbing, to the stove being condemned.
These are not citations that are made lightly by the Health Department furthering the Ramao's claim

Representation And Misrepresentation
P3: Describe the law with respect to misinterpretation in given situation. Difference between
representation and misrepresentation: Representation – true statement by one or more parties to the
agreement, Misrepresentation – false or untrue statement by one party which is believed on by the
other party when they enter a contract. However, if one party did not rely on the statement and
attempts to seek the true of the false statement it is not considered misrepresentation. If
misrepresentation occurs damages can be recovered depending on the type of misrepresentation.
Rules of misrepresentation 1.)Only state the fact, opinions cannot be misrepresentation. For

2.)Negligent misrepresentation – A person is liable for negligence if they make false statement and
have no reasonable ground to believe that the statement they made is true. For example: Hedley
Byrne v Heller (1964)– Hedley and Byrne were advertising company and they ask their bank Heller
to see their financial situation and they replied that the state of company finance is good. However,
after Hedley and Byrne went bankrupt and sued Heller for false statement which has cause business
to close down. Effect on contract: Negligent misrepresentation will allow the injured party to rescind
contract or claim damages. 3.)Innocent misrepresentation – false statement but not deliberate. The
representor reliably believes that the statement is true. For example: For example if a person A
makes a misrepresentation to person B to say that the computer is able to work in Apple software
and Person B believed that the statement was true. Therefore, by person B believing the statement

UAE and UK laws 15–OCT–2014 What is Misrepresentation and Duress? As per definition,
misrepresentation is the crime of misstating facts to obtain money, goods, or benefits of another to
which the accused is not entitled. When you promise someone some specifications about a subject
and they turn out to be untrue. As for duress, it is the use of force, false imprisonment, or threats; to
persuade someone to not act according to their will. Misrepresentation can be fraudulent, negligent

according to UK laws: Misrepresentation laws in the USA fall under the name of "Misrepresentation
Act of 1967" as this is what persuaded the addition of these laws. Its existence is solely based on the
protection of customers from being defrauded into making a purchase or entering a contract based
on a truth that is actually nonexistent. Types of misrepresentation as per 1967 act are fraudulent,
negligent and innocent misrepresentation (explained earlier). Unlike the UAE laws, UK laws
consider each of the three types of misrepresentation and punishes for them differently. In all three of
them, termination of the contract is viable, and a compensation for the time and money wasted is
also required. The UK laws differ between the types of misrepresentation in whether there should be
a fine paid by the defendant or not. Fraudulent misrepresentation requires the defendant to pay a fine
to the claimant, while on the other hand negligent or innocent misrepresentation doesn't require

Misrepresentation Of Women In Film
In this film trailer "Miss Representation", it documents a series of admirable and influential female's
views. It explores how the media's misrepresentations of women have led to the underrepresentation
of women in positions of power and influence. "Miss Representation" stands for the
misrepresentation of women. In the beginning of the trailer, the film demonstrates some pictures and
news to reveal the current social situation that the women are at a comparative disadvantage of the
social. And 97% of the information that people expose is collected, edited and reported in a male
perspective which means that the men dominate the mainstream acceptance of the social. However,
the women comprise 51% of the population, but only a few of the women are in authority....show

over 10 hours of various media inclduing watching TV, listening to music and surfing the internet on

difference to the whole world. In the second half of the film, it talks about that the women are getting
materialization. The female adolescents get across the message that the appearance is the most
important thing to the female, and their values depend on the appearance. At the same time, the male
adolescents receive the same message that the appearance is an important point to judge the female.
They learn it from the advertisement, movies, television shows, video games, and wherever people
can see. Therefore, no matter what the women do, their own value still depends on their appearance
because that is what the male think about and played up in the

Bizarre Pentium IV. Therefore it is reasonable to assume that the statements made regarding
reliability and suitability were representations made to induce the contract. The issue is whether
Valentino purposefully made false statements, was reckless or innocent in those statements. A
Fraudulent statement is knowing the statement to be false or being reckless to whether it's false.
Defined in Derry v Peek (1889) by Lord Herschell as a "false statement made knowingly or without
belief in its truth or recklessly careless whether it be true or false". Recklessly careless means the
representee had foreseen it may be false but did not care. There is an element of dishonesty here. In
fraudulent cases the burden of proof is on the claimant, this means the claimant must prove the
defendants guilt. It's very hard to prove a fraudulent misrepresentation; if unsuccessful the
defendants' representations are presumed innocent. Innocent misrepresentations are made when the
representor genuinely believes the false statement. It would be unlikely that TLC could prove

The Misrepresentation Of Social Groups
The misrepresentation of social groups in texts creates negative impacts for them in present society.
It is evident that the marginalization of women through social classes is demonstrated throughout
The Awakening. In Kate Chopin's poignant novel, the misrepresentation of women in society will be
effectively discussed through an in–depth analysis of the different aspects in the text that exclude
women, with particular reference to Edna Pontellier. This will be proven through the exploration
of the differences between the social classes among men and women which is particularly
evident with Leonce's superiority compared to Edna's inferiority. Likewise, with the way women
are represented in relationships as seen through men having more responsibility and control in
making decisions. Ultimately, Edna's choices in regards to the exclusion of women will be
foreseen as the start of the feminist phase. First of all, the differences in social classes allow
readers to understand the societal norms of the 1800s. This is evident throughout the different
roles and responsibilities Edna and Leonce are "given" from society. Edna's responsibilities
support why women are excluded from going to the big city like men; as society believes it is
wrong for women to be bold. This is proven when the narrator states an intoxicated Leonce's
thoughts after his late argument with Edna, for not taking care of her own children "If it was not a
mother's place to look after children, whose on earth was

Gender Misrepresentation In The Media
Media representations include the ways in which the media portrays particular groups. When gender
is viewed through the lens of media representations, the disparity between male and female gender
portrayal is evident. Media, technology, and social media are also used to misrepresent and to
underrepresent gender identity. To understand the inequality of gender representation as examined
through the media today, one must look at the history of the relationship between the forms of mass
communication and their effect on gender perception. One must also recognize the current state of
gender inequality in media, including patterns that demonstrate a long history of biased portrayals of
gender in today's society.
Women continue to be underrepresented on television and in other media forms compared with men
on television and the actual population. The underrepresentation of female characters is particularly
profound in drama and action movies and somewhat less so in situation comedies. A recent analysis
of music videos from multiple music television networks found three times as many males as
females. Within film rather than television, there was a study conducted that proved that the content
analysis of popular G–rated titles and found a 3–1 ratio in favor of males. This is absolutely absurd
and this is exactly why I wanted to focus my essay on gender and the media, but particularly the
misrepresentation of women in the media.
Women are also misrepresented as only having value in

Misrepresentation Of Women In The Media
Miss Representation conveys that media is derogative to the most powerful women in the United
States. People learn more from the media than any other source because it is the message and
messenger. Americans devote about 10 hours and 39 minutes daily to consuming media (Howard).
The media's misrepresentation of women in movies, television shows, and advertisements negatively
shapes politics, our national discourse, children's inquisitive minds, and ultimately society. The
danger behind these stereotyped images of women is that their effect is subconscious, meaning we
slowly become accustomed to a sexist portrayal of women without even immediately realizing it. To
cease our unrealistic, prejudiced expectations of women, a culture change is necessary. Early on,
adolescents get the message that a woman's worth is mostly based on her looks, not her intelligence.
This norm is harmful to girls because they end up comparing themselves to an impossible standard
and feel ashamed when they cannot achieve it. Conversely, boys end up judging real women much
more harshly and start treating them like objects. Because adolescents have different interpretive
and emotional abilities from the rest of society, they are a particularly vulnerable group of people.
They are often exposed to the things they see in movies, television shows, and video games with
little to no mediation. The director of the movie, Jennifer Siebel Newsom, worries about the
pressure her daughter will feel to be like

Role Of Misrepresentation Of Women In Media
Women have been misrepresented in the media for many years. Stereotypes have been around
forever in media, but were portrayed more visibly in the earlier years. Although this
misrepresentation of women is less subtle, the outcome of this issue is extensively impacting
consumers and women in general. The impact of these stereotypes discourage women to pursue their
goals, cause self–esteem issues, and hurt their chances at bigger roles in the business and political
world. This also gives others false ideas and expectations. Some primary examples of concern
include the value of women and girl's looks over their personalities, the false imagery of the LGBT
community, and society not taking women in politics and news seriously.

Misrepresentation In Film
Asking for proper representation within the entertainment industry should not be an outrageous
request. However, it seems that it is a request that is always ignored, or, (if it is acknowledged),
executed poorly and inaccurately. One common instance occurs in nearly every film set in ancient
Egypt, more specifically, and most recently, "Gods of Egypt," which has a primary cast composed
almost entirely of white members, thus neglecting the history of the film's setting and adding to the
monotonous cycle of misrepresentation. Currently, though, there are issues with representation in
regards to the upcoming film, "Anything" which stars Matt Bomer playing the role of a transgender
woman.
While it is important that films of this nature are made, and their stories and characters are shared
with viewers, the casting choice is upsetting as once again, a non–trans person was cast in a role that
could have been filled with an actual member of the trans community. This is not to say that trans
men and women who are actors and actresses should be restricted to films that are only about
transgendered characters or situations that involve...show more content...

other words, 'be patient' by executive producer Mark Ruffalo, but there is no time for patience or
forgiveness when the transgender community continuously faces violence and heinous acts upon
trans men and women. The community is simply asking for representation, asking for a chance to be
given the spotlight so that they may share personally what they have been through, and instead they
have been faced with further erasure of their issues and insights into matters involving them. They
shouldn't have to 'be patient' and they shouldn't have to settle when they are being overlooked yet
again and are failed to be given the representation they

MSW Behind My Name Discrimination Essay
Misrepresentation Question 1: No, I should not identify myself as MSW and JD; I should only

4.06(c) of the NASW Code of Ethics says that "social workers should ensure that their
representations to clients, agencies, and the public of professional qualifications, credentials,
education, competence, affiliations, services provided, or results to be achieved are accurate."
Therefore, adding MSW behind my name would be a false representation of my qualifications,
credentials, and education. My clients have the right to know what my qualifications are and do
not deserve to be lied to. As a Christian, it would be wrong to have MSW behind my name because
it would be dishonest in who I am, not only to myself but also my clients. If I were to have the

welfare association and was involved in abortion rights advocacy. At one of the rallies she identified
herself as the executive director of the statewide social welfare association. Unless I left the center

would not be appropriate for me to share with my massage clients that I can also offer therapy to

Human beings consume media every day. Nostalgically, we remember watching many television
shows and movies– some of those were of the Disney variety. Whether you watched or still watch
those movies, you are familiar with the catchy songs, funny and memorable scenes. But, if you step
out of that box you will also see a lot of the Disney movies, more specifically the Disney's princesses'
ones, have hidden gender roles and represent the women in a certain way over the course of
decades of princesses. The misrepresentation of women by implementing gender roles, which is
defined as "how we're expected to act, speak, dress, groom, and conduct ourselves based upon our

princesses have evolved from their damsels–in–distress personas to the independent, ambitious
women, and proof that the misrepresentation of women being damsels, who need a man's help
because they are inferior– or they are content with the role of being a cooking, cleaning, house wife,
or created as the outcast for being ambitious– still exists, the topic of how Disney presents women is
more complex than what it seems. To begin, it can be seen that Disney has evolved from their
damsels–in–distress persona by introducing new

Misrepresentation of Women in The Media Essay
"People learn more from media than any other single source of information" (Missrepresentation).
This quote exemplifies how society learns and creates their standards about people, places, and

power over society and it's time to change that; especially when it comes to the media's view of
women. Women are constantly being misrepresented. This misrepresentation of women in the media

Misrepresentation Essay

  • 1. Misrepresentation In Popular Culture The exclusion, or rather misrepresentation of people of color in popular culture has become a cataclysm in our society. Regrettably, the exclusion, or blatant misrepresentation hadn't received as much deserving cognizance until recent controversies surrounding the 2016 Oscars. Seemingly, the visual of a uniformed–undiversified audience served as a catalyst for awareness; the tension from the issue unveiled how there was still an undercurrent racism present in the system, and that in turn exposed how stagnant our society has been on the issues of institutionalized racism. Notwithstanding the active minds of bell hooks and Melissa Harris–Perry confronting the issue of inaccurate misrepresentation of POC, the award show revealed much of the unperceived...show more content... When the misrepresentation of POC in films becomes an indicator that we are not boldly confronting the issues needed to be confronted, a change must occur. As bell hooks and many other active progressive thinkers, emboldened by the current racial inequalities of our society, have asserted, pop culture has a significant impact on our perception of matter. In knowing the impact, it is imperative that in the concurring systematic oppressions we do not remain stagnant. Through a close examination of films: Pan, Braveheart, and Ghost in the Shell, we can vividly see how the overrepresentation of white expose the underlying oppression within our society. According to the statistics conducted by USC, there is an evident disproportion of minorities in both film and media. Yet, this disproportion is rarely challenged. The Oscars of 2016 became a visual catalyst in the need for proper representation. The prevalence of institutionalized racism in our current society can never truly be effaced if we fail to grasp its strong presence in popular culture. The existing racism in Hollywood explicitly displays a regression in racial equality in society. Hollywood is more than "sorority" racist; it is plagued by something far worse: It is plagued by institutionalized racism. The three movies and their whitewashed cast explore the racism within the system. In acknowledging the flaws, an effort should be made Get more content on HelpWriting.net
  • 2. Examples Of Misrepresentation In A Contract Misrepresentation refers to a circumstance where a person is induced to enter into a contract partly or entirely by untrue information made by the other party. Misrepresentation can lead to a contract to be voidable. Voidable contract means there is a valid contract whether it is written or verbal. In any voidable contracts, a party has a choice whether to rescind or to continue with the contract. However, there are certain circumstances and elements of misrepresentation that can cause a contract to be voidable. Misrepresentation can occur in a number of ways. Under Section 18 of the Contract Act 1950, misrepresentation includes:– a) Any positive assertion, in a manner not warranted by the information of the person making it, of that...show more content... However, if the other party is aware of the misrepresentation and decided to continue to enter the contract, then the contract is not voidable. This is due to the fact that he fully consented getting into the contract with full knowledge of the misrepresentation. A misrepresentation is a misrepresentation of a statement of fact, not of general opinion and in that it influenced a person to enter into the contract and it is false. A fact must be something current and cannot be something in the future. One of the famous case of misrepresentation is the case of Bisset v Wilkinson (1927) AC177. In this case, the seller of the farm that had never run sheep gave his opinion that it would support 2000 sheeps. This turned out not to be the case, and the buyer sued for the return of his purchase money. Court held: The court rejected his appeal based on the saying that the statement made had not been a representation of fact, instead it is merely an expression of the sellers honestly held Get more content on HelpWriting.net
  • 3. Mistake vs. Misrepresentation In brief: Mistake vs Misrepresentation A mistake is inadvertent and only an error on the part of the person committing it while misrepresentation is often wilful or intentional, done with the intention of gaining wrongfully. The main difference between Mistake and Misrepresentation is that in the case of Mistake one or both parties to a contract or what was intended to be a contract unintentionally or unknowingly made statements not intended to mislead the other. Therefore fraud cannot be implied from these statements or circumstances. At Common law, a mistake can affect the validity of a contract "operative mistake", making it null and void. In the case of misrepresentation, false statements of facts are required to be made which...show more content... In 1963, the House of Lords stated, obiter, in Hedley Byrne Co Ltd v Heller Partners Ltd [1964] AC 465 that in certain circumstances damages may be recoverable in tort for negligent mis–statement causing financial loss. The liability depends on a duty of care arising from a "special relationship" between the parties. It is now clear that a party can claim damages under the principle in Hedley Byrne where a negligent mis–statement has induced him to enter a contract; Get more content on HelpWriting.net
  • 4. Misrepresentation Of Women In Media Purpose: The misrepresentation of women in the media has been at its highest. Reality shows such as Love and Hip Hop, have degraded and exploited women where they are only seen as objects who compete over men. They are not able to have a identity that is positive. I wanted to create a platform where you can see the true side of women. Having them tell their stories and accomplishments. Where they are seen past their physical features and given a voice. The issues discussed through the interviews are also expressed through my poetry. As women they are taking their identities back and showing who they really are, regardless of how they are depicted through the media. • 5. Innocent Misrepresentation Case Study Case 13.5: Innocent Misrepresentation This is a case of fraudulent misrepresentation. W.F. Yost, was the owner of an establishment called Red Barn Barbecue Restaurant who listed it for sale. Richard Ramano, his wife and his brother–in–law of Rieve Enterprises, became interested in purchasing the property. They conducted a visual inspection of the premises and began entering into a contractual agreement of purchase based on the statement "Seller warrants that at the time physical possession is delivered to buyer, all equipment will be in working order and that the premises will pass all inspections necessary to conduct such business." (Leagal.com, 2015) After a routine health inspection uncovered 52 cited health code violations, just two weeks after the Ramano's purchased the business, the Heath Department shut down the business. The Ramano's file a case of fraud against Yost for knowingly misrepresenting the material damages of the equipment and building. The basis for this is due to the statue that states that regardless if the misrepresentation is made innocently or knowingly, misrepresentation of a material fact acted on by the other party to his detriment is a ground for rescission of a contract. (Leagal.com, 2015) Meaning that due to the wording in the contract that the facility and equipment purchased would pass all health inspections; Yost, while claiming innocent misrepresentation entered into a fraudulent contract. As a side note, Yost's credibility comes into question due to the amount of citations that were recorded in a two week time frame, from sanitation, structural integrity, plumbing, to the stove being condemned. Difference between representation and misrepresentation: Representation – true statement by one or more parties to the agreement, Misrepresentation – false or untrue statement by one party which is believed on by the other party when they enter a contract. However, if one party did not rely on the statement and attempts to seek the true of the false statement it is not considered misrepresentation. However, after Hedley and Byrne went bankrupt and sued Heller for false statement which has cause business to close down. Effect on contract: Negligent misrepresentation will allow the injured party to rescind contract or claim damages. 3.)Innocent misrepresentation – false statement but not deliberate. The representor reliably believes that the statement is true. • 7. Misrepresentation Essay Mohamed Adel Yakoub SSN: 1711 LLAW110 Dr. Tarek Al Tawil Misrepresentation according to UAE and UK laws 15–OCT–2014 What is Misrepresentation and Duress? As per definition, misrepresentation is the crime of misstating facts to obtain money, goods, or benefits of another to which the accused is not entitled. When you promise someone some specifications about a subject and they turn out to be untrue. As for duress, it is the use of force, false imprisonment, or threats; to persuade someone to not act according to their will. Misrepresentation can be fraudulent, negligent or innocent. Misrepresentation according to UK laws: Misrepresentation laws in the USA fall under the name of "Misrepresentation Act of 1967" as this is what persuaded the addition of these laws. Its existence is solely based on the protection of customers from being defrauded into making a purchase or entering a contract based on a truth that is actually nonexistent. Types of misrepresentation as per 1967 act are fraudulent, negligent and innocent misrepresentation (explained earlier). Unlike the UAE laws, UK laws consider each of the three types of misrepresentation and punishes for them differently. In all three of them, termination of the contract is viable, and a compensation for the time and money wasted is also required. The UK laws differ between the types of misrepresentation in whether there should be a fine paid by the defendant or not. Fraudulent misrepresentation requires the defendant to pay a fine to the claimant, while on the other hand negligent or innocent misrepresentation doesn't require payment of a Get more content on HelpWriting.net

It explores how the media's misrepresentations of women have led to the underrepresentation of women in positions of power and influence. "Miss Representation" stands for the misrepresentation of women. In the beginning of the trailer, the film demonstrates some pictures and news to reveal the current social situation that the women are at a comparative disadvantage of the social. And 97% of the information that people expose is collected, edited and reported in a male perspective which means that the men dominate the mainstream acceptance of the social. In the second half of the film, it talks about that the women are getting materialization. The female adolescents get across the message that the appearance is the most important thing to the female, and their values depend on the appearance. At the same time, the male adolescents receive the same message that the appearance is an important point to judge the female. They learn it from the advertisement, movies, television shows, video games, and wherever people can see. Misrepresentation in Business Law Introduction to Business Law– Assignment 1B Advise TLC Ltd. as to any possible action they may have for misrepresentation against answer Ltd. _____________________________________________________________________ Treitel in The Law of Contract (2003) defines a contract as: "An agreement giving rise to obligations which are enforced or recognised by law. The factor which distinguishes contractual from other legal obligations is that they are based on the agreement of the contracting parties." This quote illustrates the basic criteria for a contract. Answer are the experts and Valentino is their representative, he inspects the needs of TLC and recommends the Bizarre Pentium IV. Therefore it is reasonable to assume that the statements made regarding reliability and suitability were representations made to induce the contract. The issue is whether Valentino purposefully made false statements, was reckless or innocent in those statements. A Fraudulent statement is knowing the statement to be false or being reckless to whether it's false. Defined in Derry v Peek (1889) by Lord Herschell as a "false statement made knowingly or without belief in its truth or recklessly careless whether it be true or false". Recklessly careless means the representee had foreseen it may be false but did not care. There is an element of dishonesty here. In fraudulent cases the burden of proof is on the claimant, this means the claimant must prove the defendants guilt. It's very hard to prove a fraudulent misrepresentation; if unsuccessful the defendants' representations are presumed innocent. Innocent misrepresentations are made when the representor genuinely believes the false statement. It would be unlikely that TLC could prove Valentino's Get more content on HelpWriting.net
  • 11. The Misrepresentation Of Social Groups The misrepresentation of social groups in texts creates negative impacts for them in present society. It is evident that the marginalization of women through social classes is demonstrated throughout The Awakening. In Kate Chopin's poignant novel, the misrepresentation of women in society will be effectively discussed through an in–depth analysis of the different aspects in the text that exclude women, with particular reference to Edna Pontellier. This will be proven through the exploration of the differences between the social classes among men and women which is particularly evident with Leonce's superiority compared to Edna's inferiority. Likewise, with the way women are represented in relationships as seen through men having more responsibility and control in making decisions. Ultimately, Edna's choices in regards to the exclusion of women will be foreseen as the start of the feminist phase. First of all, the differences in social classes allow readers to understand the societal norms of the 1800s. This is evident throughout the different roles and responsibilities Edna and Leonce are "given" from society. Edna's responsibilities support why women are excluded from going to the big city like men; as society believes it is wrong for women to be bold. This is proven when the narrator states an intoxicated Leonce's thoughts after his late argument with Edna, for not taking care of her own children "If it was not a mother's place to look after children, whose on earth was Get more content on HelpWriting.net
  • 12. Gender Misrepresentation In The Media Media representations include the ways in which the media portrays particular groups. When gender is viewed through the lens of media representations, the disparity between male and female gender portrayal is evident. Media, technology, and social media are also used to misrepresent and to underrepresent gender identity. To understand the inequality of gender representation as examined through the media today, one must look at the history of the relationship between the forms of mass communication and their effect on gender perception. One must also recognize the current state of gender inequality in media, including patterns that demonstrate a long history of biased portrayals of gender in today's society. Women continue to be underrepresented on television and in other media forms compared with men on television and the actual population. The underrepresentation of female characters is particularly profound in drama and action movies and somewhat less so in situation comedies. A recent analysis of music videos from multiple music television networks found three times as many males as females. Within film rather than television, there was a study conducted that proved that the content analysis of popular G–rated titles and found a 3–1 ratio in favor of males. This is absolutely absurd and this is exactly why I wanted to focus my essay on gender and the media, but particularly the misrepresentation of women in the media. • 13. Misrepresentation Of Women In The Media Miss Representation conveys that media is derogative to the most powerful women in the United States. People learn more from the media than any other source because it is the message and messenger. Americans devote about 10 hours and 39 minutes daily to consuming media (Howard). The media's misrepresentation of women in movies, television shows, and advertisements negatively shapes politics, our national discourse, children's inquisitive minds, and ultimately society. The danger behind these stereotyped images of women is that their effect is subconscious, meaning we slowly become accustomed to a sexist portrayal of women without even immediately realizing it. To cease our unrealistic, prejudiced expectations of women, a culture change is necessary. Early on, adolescents get the message that a woman's worth is mostly based on her looks, not her intelligence. This norm is harmful to girls because they end up comparing themselves to an impossible standard and feel ashamed when they cannot achieve it. Conversely, boys end up judging real women much more harshly and start treating them like objects. Because adolescents have different interpretive and emotional abilities from the rest of society, they are a particularly vulnerable group of people. They are often exposed to the things they see in movies, television shows, and video games with little to no mediation. The director of the movie, Jennifer Siebel Newsom, worries about the pressure her daughter will feel to be like Get more content on HelpWriting.net
  • 14. Role Of Misrepresentation Of Women In Media Women have been misrepresented in the media for many years. Stereotypes have been around forever in media, but were portrayed more visibly in the earlier years. Although this misrepresentation of women is less subtle, the outcome of this issue is extensively impacting consumers and women in general. The impact of these stereotypes discourage women to pursue their goals, cause self–esteem issues, and hurt their chances at bigger roles in the business and political world. This also gives others false ideas and expectations. Some primary examples of concern include the value of women and girl's looks over their personalities, the false imagery of the LGBT community, and society not taking women in politics and news seriously. Misrepresentation Case Study Misrepresentation and Potential Fraud letter dated April 28, 2016 Mr. Brent: This firm represents St. David's North Austin Medical Center ("Hospital") in connection with all matters relating to your April 28, 2016 letter to Michael Michelson, which you titled "Fraud and Potential Misrepresentation." In the letter, you expressed concerns regarding a settlement agreement between Hospital and GEICO Insurance Company. According to your letter, Hospital treated your client for injuries sustained in a motor vehicle accident, resulting in $19,372.00 in medical expenses (the "Patient Account"). As recognized in your letter, Hospital filed a valid hospital lien in regard to your client's admission. Thereafter, Hospital and GEICO, which was acting in its...show more content... You then state that if you sue GEICO, you may also add Hospital in order to "avoid the empty chair." An empty chair only arises, however, where a person or entity who may be liable for a claim is not joined to litigation. In your letter, you do not identify any wrongful conduct on the part of Hospital that would give rise to an "empty chair," nor do you enumerated any claim for which Hospital may be–even in part–liable. Indeed, given the facts of this matter, no action for fraud or misrepresentation could arise in favor of your client and against Hospital. In the letter, you do not identify any false representation made by Hospital to your client. Instead, the only misrepresentation you identify appears to have been made by GEICO to Hospital, and not to your client. You also fail to indicate how your client somehow detrimentally relied on this alleged misrepresentation or suffered an actual economic injury thereby. If anything, the settlement benefited your client by discharging the Patient Account and the hospital Get more content on HelpWriting.net
  • 16. Misrepresentation In Film Asking for proper representation within the entertainment industry should not be an outrageous request. However, it seems that it is a request that is always ignored, or, (if it is acknowledged), executed poorly and inaccurately. One common instance occurs in nearly every film set in ancient Egypt, more specifically, and most recently, "Gods of Egypt," which has a primary cast composed almost entirely of white members, thus neglecting the history of the film's setting and adding to the monotonous cycle of misrepresentation. Currently, though, there are issues with representation in regards to the upcoming film, "Anything" which stars Matt Bomer playing the role of a transgender woman. While it is important that films of this nature are made, and their stories and characters are shared with viewers, the casting choice is upsetting as once again, a non–trans person was cast in a role that could have been filled with an actual member of the trans community. This is not to say that trans men and women who are actors and actresses should be restricted to films that are only about transgendered characters or situations that involve...show more content... In response to the outrage over the casting, they have been told to 'have a little compassion,' or, in other words, 'be patient' by executive producer Mark Ruffalo, but there is no time for patience or forgiveness when the transgender community continuously faces violence and heinous acts upon trans men and women. The community is simply asking for representation, asking for a chance to be given the spotlight so that they may share personally what they have been through, and instead they have been faced with further erasure of their issues and insights into matters involving them. They shouldn't have to 'be patient' and they shouldn't have to settle when they are being overlooked yet again and are failed to be given the representation they Get more content on HelpWriting.net
  • 17. MSW Behind My Name Discrimination Essay Misrepresentation Question 1: No, I should not identify myself as MSW and JD; I should only have JD. In providing MSW behind my name, I would be lying about my credentials. Standard 4.06(c) of the NASW Code of Ethics says that "social workers should ensure that their representations to clients, agencies, and the public of professional qualifications, credentials, education, competence, affiliations, services provided, or results to be achieved are accurate." Therefore, adding MSW behind my name would be a false representation of my qualifications, credentials, and education. My clients have the right to know what my qualifications are and do not deserve to be lied to. As a Christian, it would be wrong to have MSW behind my name because it would be dishonest in who I am, not only to myself but also my clients. If I were to have the MSW behind my name, I would constantly...show more content... This is different from number one in that I would have these credentials obtained. Overall, I do not think it would be appropriate for me to have my MSW listed on my brochure for massage therapy. This is similar to case 5.10 in that the social worker was an executive director of a social welfare association and was involved in abortion rights advocacy. At one of the rallies she identified herself as the executive director of the statewide social welfare association. Unless I left the center that I was counseling at and started my own private practice that offered counseling and massages, it would not be appropriate for me to share with my massage clients that I can also offer therapy to them. Even though it might boost business, I would be going against the counseling center that I am already employed at, because clients might want to start attending the massage therapy and counseling instead of staying at the counseling center that they already Get more content on HelpWriting.net
  • 18. Human beings consume media every day. Nostalgically, we remember watching many television shows and movies– some of those were of the Disney variety. Whether you watched or still watch those movies, you are familiar with the catchy songs, funny and memorable scenes. But, if you step out of that box you will also see a lot of the Disney movies, more specifically the Disney's princesses' ones, have hidden gender roles and represent the women in a certain way over the course of decades of princesses. The misrepresentation of women by implementing gender roles, which is defined as "how we're expected to act, speak, dress, groom, and conduct ourselves based upon our assigned sex," and stereotypes, which is defined as "a widely accepted judgment or bias about a person or group – even though it's overly simplified and not always accurate," though subliminal, can be seen in those children's movies, (Planned Parenthood 2017). Though, there is proof that these princesses have evolved from their damsels–in–distress personas to the independent, ambitious women, and proof that the misrepresentation of women being damsels, who need a man's help because they are inferior– or they are content with the role of being a cooking, cleaning, house wife, or created as the outcast for being ambitious– still exists, the topic of how Disney presents women is more complex than what it seems. To begin, it can be seen that Disney has evolved from their damsels–in–distress persona by introducing new Get more content on HelpWriting.net
  • 19. Misrepresentation In Haiti I am Haitian–American, a child of immigrants. A descendant of Haiti. Misrepresentation plagues this island nation overwhelmed with endless suffering. No one sees the beauty of Haiti through a television screen. All they see is misery – natural disaster, disease and poverty–writ large on the evening news. When most Americans think ofHaiti, they see problems and a stressed people. However, there is a resilience and a beauty of spirit to Haitians. Even after years upon years of being dehumanized, my people have never broken. Our culture is constantly belittled, but we smile and gather strength from the sun that shines on our island and we persevere. In a hemisphere full of different western ethnicities, Haitians reign supreme as underdogs. Get more content on HelpWriting.net
  • 20. Misrepresentation of Women in The Media Essay "People learn more from media than any other single source of information" (Missrepresentation). This quote exemplifies how society learns and creates their standards about people, places, and things. All sources and mediums of media impact billions of lives every day. The media holds this power over society and it's time to change that; especially when it comes to the media's view of women. Women are constantly being misrepresented. This misrepresentation of women in the media is negatively impacting America by corrupting both the youth and adults. This is occurring because of the hyper–sexualization of women, wrongly portraying women in leadership positions, and creating stereotypes of women in movies and television. "You can't be what...show more content... When Victoria's Secret is allowed to have models prance around on screen but Lane Bryant Ads (lingerie for plus size women) is banned then there's a problem. The media is portraying these models who are thin to the point where it is unhealthy. And the media is feeding society lies. A perfect example is of Gerran Tyler. Tyler was a 12 year old supermodel. She walks the run way for clients like Marc Jacobs, Calvin Klein, and Betsey Johnson. She's tall, thin, the perfect model because she hasn't hit puberty yet. She walked during New York Fashion Week and posed for these designer brands advertisements. This body type is unachievable for almost all adult women (Roberts). Somebody in their twenties or thirties doesn't have the ability to look like a twelve year old girl, but this is how these designers are telling us to look. Tyler had an amazing career and high expectations but the fame didn't last long. As she got older and hit puberty she began to develop boobs, hips, and curves. She began getting less and less bookings. Her supermodel career was virtually over. "Eighty percent of 10–year–old American girls say they have been on a diet" and the, "Number one magic wish for young girls 11–17 is to be thinner" (Missrepresentation). This self–esteem problem with young girls is a result of these unobtainable ideas of beauty. Jennifer Siebel, creator of the documentary Missrepresentation, says Get more content on HelpWriting.net
