“January and February, we were getting updates from the RCMP and (Canada Border Services
Agency),” Falk said Monday. “We’ve been making the same inquiries from the same individuals,
and they tell us that Ottawa has gagged them and that they are unable to provide us that
information.”

Nowhere in this 1951 treaty is anything mentioned about refugee
status procedures. The word “asylum” is not even mentioned in any
of its 46 articles. The most relevant obligation is found in article 33,
which stipulates that refugees cannot be returned to a country where
their “life or freedom would be threatened.” This basic guarantee is
not the same as a right of asylum in that it allows some flexibility as
long as refugees’ lives are not endangered. Unless a Canadian court
determines the U.S. is no longer safe, there is no violation of the
convention if migrants arriving at the Quebec border are returned to
upstate New York. This principle is what allows Australia’s
controversial policy of intercepting boat people and offloading them
onto what Canberra considers to be safe Pacific islands.

What is not “fair” or “equal”, however, is the treatment of legitimate refugee and immigrant claimants
who are pushed to the back of an increasingly long line for making the mistake of following the rules.
They get the short end of the stick while illegal queue-jumpers wanting out of Trump’s America as if
their lives were in peril get treated with kid gloves rather than being hauled back onto American soil
as they would be if they tried the same stunt at any legitimate Canada-U.S. border crossing.
Trudeau never mentioned this, of course — nor his father, or himself, as the creators of today’s crisis
at our border.
That would have kicked an already over-poked hornet’s nest.
