UN CONVENTION ON THE RIGHTS OF PERSONS WITH
DISABILITIES - TIMELINE

• Adoption by the United Nations General Assembly - 13
December 2006
• Opened for signature - 30 March 2007
• After sign by 20 countries, Entry into force – 3 May 2008
• First Conference of States Parties – 31 October & 3
November 2008
• First session of the Committee on the Rights of Persons with
Disabilities – 23-27 February 2008
• As of november, 2019 the signatories are 163 & 181 parties
which include 180 states & the 25 european union.
•It aims to ensure that disabled people enjoy the same human
rights as everyone else and that they can participate fully in society
by receiving the same opportunities as others.
• It is the international human rights treaty of UN & it makes sure
dignity & rights of persons with disabilities to be maintained by all
the country.
• The persons with disabilities enjoys full equality under the law.
• As per this treaty they are full & equal members of society.
Convention was the first human right treaty of the 21st century.
History
• UN declared the year from 1981 to 1992 as the years of the person with
disabilities & UNCRPD treaty discussion on this phase.
• A committee was formed to know about the rights & problems, & committee
recommended to form a treaty between the countries to ensure full rights for
the people with disabilities.
• Sweden & Italy gave the outline of treaty but no decision was taken on that
but denied by the members of UN that they have enough rule & law for that
time.
• In 2000, the 5 biggest NGOs working for the welfare of PWD appealed UN
to adopt an international treaty to ensure the rights of PWDs.
• In 2001, UN generally assembly formed a committee on recommendation of
Mexico, in this work Mexico & new Zealand help to make the process fast &
finally on 13 December 2006 adopted by UN General Assembly.
• In the history of un convention to receive the highest no. of signatories.
Content of UNCRPD CONVENTION
• It has two parts.
1. Preamble – it is having 25 paragraphs stating that’s why is
formed & its purposes, in paragraphs number eleven all the
countries accepted that PWDs face problems & are
undertreated & all the countries should provide equal rights to
them.
It also have wording from the Vienna Declaration & Programmes
of action. “all human rights are universal, indivisible,
interdependent & interrelated.
2. It has a set of 50 articles in which principles, purposes, how to

DISABILITIES - WHAT IS UNIQUE ABOUT CRPD?

• ‘Nothing about us, without us’ - a forceful call from
persons with disabilities around the world to have their
human rights respected, protected and fulfilled on an
equal basis with others.
• A policy instrument which is cross-disability and
cross- sectoral: includes all persons with disabilities,
including persons with intellectual and psychosocial
disabilities, and all areas of life.
• Legally binding, both for public authorities and
private entities.

DISABILITIES - HUMAN RIGHTS BASED APPROACH

• The Convention marks a ‘paradigm shift’ in attitudes
and approaches to persons with disabilities.
• Persons with disabilities are not viewed as
"objects" of charity, medical treatment and social
protection
• Rather as "subjects" with rights, who are capable of
claiming those rights and making decisions for their
lives based on their free and informed consent as well
as being active members of society
• The Convention gives universal recognition to the
dignity of persons with disabilities

Article 1 CRPD
“To promote, protect and ensure the full and equal
enjoyment of all human rights and fundamental
freedoms by all persons with disabilities, and to
promote respect for their inherent dignity”
‘Persons with disabilities include those who have
long-term physical, mental, intellectual or sensory
impairments which in interaction with various
barriers may hinder their full and effective
participation in society on an equal basis with
others’
Article-2
• It have definition of concept that are discussed in the treaty. For
ex.- what is language, discrimination, universal design &
reasonable accomodations.
• Discrimination-It means any distinction, exclusion or restriction on
the basis of disability which has the purpose or effect of impairing
the recognition, enjoyment or exercise, on an equal basis with
others, of all human rights and fundamental freedoms in the
political, economic, social, cultural, civil or any other field. It
includes all forms of discrimination, including denial of reasonable
accommodation.

connect PWDs with the society for equality & in effective
manner, equal opportunities & accessibility are included
in this article.

• Responsibility of the countries, the implementation for the
countries who ratified this law, & research & design
technology for the welfare of PWDs & help them in every
possible way.
• Law and policy review
• To adopt new legislation and policy to implement CRPD
• To modify or abolish existing legislation and policy that
constitutes discrimination against persons with disabilities;
• To mainstream the human rights of persons with
disabilities in all policies and programmes.
• Research and development of universally
designed goods, services, equipment and
facilities, and new technologies, including
information and communications
technologies, mobility aids, devices and
assistive technologies
• Training of professionals and staff working
with persons with disabilities in the rights
recognized in this Convention so as to better
provide the assistance and services
guaranteed by those rights.
• Articles 5–32 define the rights of persons with disabilities and the
obligations,of states parties towards them. Many of these mirror
rights affirmed in other UN conventions such as the International
Covenant on Civil and Political Rights, International Covenant on
Economic, Social and Cultural Rights and the Convention Against
Torture, but with specific obligations ensuring that they can be fully
realized by persons with disabilities.
• Rights specific to this convention include the rights
to accessibility including the information technology, the
rights to live independently and be included in the community
(Article 19), to personal mobility (article 20), habilitation and
rehabilitation (Article 26), and to participation in political and
public life, and cultural life, recreation and sport (Articles 29
and 30).
In addition, parties to the Convention must raise
awareness of the human rights of persons with disabilities
(Article 8) 1. Raise awareness

4. Promote positive awareness, and
Ensure access to roads, buildings, and information (Article
9). Accessibility 1.To enable persons with disabilities to
live independently and participate fully in all aspects of life.

accessibility
•Articles 33–39 govern reporting and monitoring of the
convention by national human rights institutions (Article
33) and the Committee on the Rights of Persons with
Disabilities (Articles 34 through 39).
•Articles 40–50 govern ratification, entry into force,
relation to "regional integration
organizations," reservations, amendment, and
denunciation of the Convention. Article 49 requires that
the Convention be available in accessible formats,
and Article 50 provides that the Convention's "Arabic,
Chinese, English, French, Russian and Spanish texts"
are "equally authentic."

  • 2. UN CONVENTION ON THE RIGHTS OF PERSONS WITH DISABILITIES - TIMELINE ........................................................................................................................................................................................ • Adoption by the United Nations General Assembly - 13 December 2006 • Opened for signature - 30 March 2007 • After sign by 20 countries, Entry into force – 3 May 2008 • First Conference of States Parties – 31 October & 3 November 2008 • First session of the Committee on the Rights of Persons with Disabilities – 23-27 February 2008 • As of november, 2019 the signatories are 163 & 181 parties which include 180 states & the 25 european union.
  • 3. •It aims to ensure that disabled people enjoy the same human rights as everyone else and that they can participate fully in society by receiving the same opportunities as others. • It is the international human rights treaty of UN & it makes sure dignity & rights of persons with disabilities to be maintained by all the country. • The persons with disabilities enjoys full equality under the law. • As per this treaty they are full & equal members of society. Convention was the first human right treaty of the 21st century.
  • 4. History • UN declared the year from 1981 to 1992 as the years of the person with disabilities & UNCRPD treaty discussion on this phase. • A committee was formed to know about the rights & problems, & committee recommended to form a treaty between the countries to ensure full rights for the people with disabilities. • Sweden & Italy gave the outline of treaty but no decision was taken on that but denied by the members of UN that they have enough rule & law for that time. • In 2000, the 5 biggest NGOs working for the welfare of PWD appealed UN to adopt an international treaty to ensure the rights of PWDs. • In 2001, UN generally assembly formed a committee on recommendation of Mexico, in this work Mexico & new Zealand help to make the process fast & finally on 13 December 2006 adopted by UN General Assembly. • In the history of un convention to receive the highest no. of signatories.
  • 5. Content of UNCRPD CONVENTION • It has two parts. 1. Preamble – it is having 25 paragraphs stating that’s why is formed & its purposes, in paragraphs number eleven all the countries accepted that PWDs face problems & are undertreated & all the countries should provide equal rights to them. It also have wording from the Vienna Declaration & Programmes of action. “all human rights are universal, indivisible, interdependent & interrelated. 2. It has a set of 50 articles in which principles, purposes, how to Implement the UNCRPD in the whole world have been discussed.

UN CONVENTION ON THE RIGHTS OF PERSONS WITH DISABILITIES - WHAT IS UNIQUE ABOUT CRPD? ........................................................................................................................................................................................ • ‘Nothing about us, without us’ - a forceful call from persons with disabilities around the world to have their human rights respected, protected and fulfilled on an equal basis with others. • A policy instrument which is cross-disability and cross- sectoral: includes all persons with disabilities, including persons with intellectual and psychosocial disabilities, and all areas of life. • Legally binding, both for public authorities and private entities.

UN CONVENTION ON THE RIGHTS OF PERSONS WITH DISABILITIES - HUMAN RIGHTS BASED APPROACH ........................................................................................................................................................................................ • The Convention marks a ‘paradigm shift’ in attitudes and approaches to persons with disabilities. • Persons with disabilities are not viewed as "objects" of charity, medical treatment and social protection • Rather as "subjects" with rights, who are capable of claiming those rights and making decisions for their lives based on their free and informed consent as well as being active members of society • The Convention gives universal recognition to the dignity of persons with disabilities

UN CONVENTION ON THE RIGHTS OF PERSONS WITH DISABILITIES - PURPOSE ........................................................................................................................................................................................ Article 1 CRPD “To promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity” ‘Persons with disabilities include those who have long-term physical, mental, intellectual or sensory impairments which in interaction with various barriers may hinder their full and effective participation in society on an equal basis with others’
  • 9. Article-2 • It have definition of concept that are discussed in the treaty. For ex.- what is language, discrimination, universal design & reasonable accomodations. • Discrimination-It means any distinction, exclusion or restriction on the basis of disability which has the purpose or effect of impairing the recognition, enjoyment or exercise, on an equal basis with others, of all human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field. Reasonable accomodation • It means necessary and appropriate modification and adjustments not imposing a disproportionate or undue burden, where needed in a particular case, to ensure to persons with disabilities the enjoyment or exercise on an equal basis with others of all human rights and fundamental freedom.

Article-3 • How to defeat dicrimination, freedom of election, to connect PWDs with the society for equality & in effective manner, equal opportunities & accessibility are included in this article. • Respect for inherent dignity, individual autonomy including the freedom to make one’s own choices, and independence of persons • Non-discrimination

GENERAL PRINCIPLES (Art 3) ........................................................................................................................................................................................ • Full and effective participation and inclusion in society • Respect for difference and acceptance of persons with disabilities as part of human diversity and humanity • Equality of opportunity • Accessibility • Equality between men and women • Respect for the evolving capacities of children with disabilities and respect for the right of children with disabilities to preserve their identities

Accessibility: Important as a means to empowerment and inclusion. Both a general principle and a stand-alone article (article 9) Access must be ensured to: • Justice (article 13) • Living independently and being included in the community (article 19) • Information and communication services (article 21) • Education (article 24) • Health (article 25) • Habilitation and rehabilitation (article 26)
  • 15. • Work and employment (article 27) - human resource policies and practices • Adequate standard of living and social protection (article 28) • Participation in political and social life (article 29) • Participation in cultural life, recreation, leisure and sport (article 30)

GENERAL OBLIGATIONS (Art 4) ........................................................................................................................................................................................ • Responsibility of the countries, the implementation for the countries who ratified this law, & research & design technology for the welfare of PWDs & help them in every possible way. • Law and policy review • To adopt new legislation and policy to implement CRPD • To modify or abolish existing legislation and policy that constitutes discrimination against persons with disabilities; • To mainstream the human rights of persons with disabilities in all policies and programmes.
  • 17. • Research and development of universally designed goods, services, equipment and facilities, and new technologies, including information and communications technologies, mobility aids, devices and assistive technologies • Training of professionals and staff working with persons with disabilities in the rights recognized in this Convention so as to better provide the assistance and services guaranteed by those rights.
  • 18. • Articles 5–32 define the rights of persons with disabilities and the obligations,of states parties towards them. Many of these mirror rights affirmed in other UN conventions such as the International Covenant on Civil and Political Rights, International Covenant on Economic, Social and Cultural Rights and the Convention Against Torture, but with specific obligations ensuring that they can be fully realized by persons with disabilities. • Rights specific to this convention include the rights to accessibility including the information technology, the rights to live independently and be included in the community (Article 19), to personal mobility (article 20), habilitation and rehabilitation (Article 26), and to participation in political and public life, and cultural life, recreation and sport (Articles 29 and 30).
  • 19. In addition, parties to the Convention must raise awareness of the human rights of persons with disabilities (Article 8) 1. Raise awareness 2. Foster respect 3. Combat stereotypes 4. Promote positive awareness, and Ensure access to roads, buildings, and information (Article 9). Accessibility 1.To enable persons with disabilities to live independently and participate fully in all aspects of life. 2.   • 20. •Articles 33–39 govern reporting and monitoring of the convention by national human rights institutions (Article 33) and the Committee on the Rights of Persons with Disabilities (Articles 34 through 39). •Articles 40–50 govern ratification, entry into force, relation to "regional integration organizations," reservations, amendment, and denunciation of the Convention. Article 49 requires that the Convention be available in accessible formats, and Article 50 provides that the Convention's "Arabic, Chinese, English, French, Russian and Spanish texts" are "equally authentic."

Conclusion UNCRPD offers a vision for people with disabilities Importance of Article 27 – Work & Employment Social participation - Economic independence - Family and relationships respect - Finally, by identifying strengths and opportunities as well as better addressing weaknesses and threats, is a much needed duty the effort of improving the lives of persons with disabilities.
