Madison Checks And Balances
During the second half of the essay, Madison empathized the importance of diving the government
into federal and state to provide "double security" to the people, and "to guard one part of the
society against the injustice of the other part," meaning to protect the rights of the minority against
the majority. The idea behind the separation of the federal and the state governments is once again
to protect, and ensure, the liberty of the masses. By having to different governments, they can
control each other, but also regulate themselves (executive, legislative, and judiciary branches). As
for the protection of the minority, when the majority has an issue in common, then the rights of the
minority become irrelevant. In the essay, Madison proposed ... Show more content on

Throughout the entire document, the reader is constantly reminded of the importance of government
never having the opportunity to take advantage of its power. The proposal for the separation of
government not only into three branches, but also into federal and state governments makes it
evident how important it was for Madison. Most of the proposals introduced by Madison have been
used for the current government and have been proved to be successful. The checks and balances
system was also an essential part for the solution to the government's unavoidable problems
according to Madison. As for the way the human nature was represented in the essay was very
particular to Madison's perception. It is evident men are not perfect, but by stating men are not
angels, it somehow implies they are demons. There are plenty caring, intelligent, capable individuals
in charge of government who do not fit into Madison's spectrum of governors. As for the possibility
of the majority taking away the right from the minority, Madison's insight was quite helpful. It is
clear Madison wanted to avoid having a particular group stepping over others and taking away their
rights. Madison's statement about how society is divided into many distinct groups is remarkably
accurate; the American society is formed of so many different cultures, backgrounds, religions, and
beliefs, and each one has its powers and

Explain the system of checks and balances within the American government and its significance. Be
sure to provide examples and discuss alternative views.
The purpose for our Constitution was to implement a new government with three equal branches
that balance and check each other. The three branches are formed and is important that the maintain
balance in Legislative, executive and Judiciary branches in order for our government to not be
overpower each other. The U.S. Constitution established in 1787 with the purpose to provide
"America 's national government and fundamental laws, and guaranteed certain basic rights for its
citizens." I strongly feel the order of checks and balance should not be changed and I agree to
concept of three branches which maintain branches order and peace in our U.S. Government.
Our founders established WE THE PEOPLE. NOT We the government, NOT We the United States,
NOT We the members of congress just so our nation, country, states and people can be protected
and ensure welfare. In 1828 the meaning of welfare is not the same meaning people are adjusted
today. The meaning of welfare is Exemption from misfortune, sickness, calamity or evil; enjoyment
of health and common blessings of life; prosperity; happiness; applied to person. U.S constitutions
secure the LIBERTY and maintain a "free society for our nation's people." If we take a look at the

he did so without congressional approval. Under the War Powers Resolution the President has 60

However when Mr. Obama passed the 60 day deadline without congressional approval, the question
was posed, "Does President Obama have the authority to bypass the War Powers Resolution and
have the troop remain in Libya?" the short answer is no he does not. I do believe President Obama

Therefore the very act of being in Libya with the allied forces, whether we were staring down the
sights of an M4 at them or firing rockets from drones, we were in opposition to the Libyan military,
and thus involved in hostilities. The Obama administration's argument that our level of involvement
did not qualify as the hostilities referred to in the War Powers resolution is not valid. Based on the
definition of hostilities, we were definitely within the parameters of the War Powers Resolution.
That makes Presidents Obama's decision to ignore the 60 day limit a huge violation of the War
Powers Act. Finally, on several instances the Obama administration ensured congress that the U.S
was stepping down as the leader of the coalition forces and that we would be playing a much
smaller role in the operation. While we did step down from the leadership, the U.S. continued to
deploy the most supplies and weapons, particularly predator missiles, and large numbers of remote
controlled drones. While trying to convince congress that we were stepping down to a non– hostile
role we were still being as hostile as we could be, apart from kicking down Qaddafi's door
ourselves. I'm sure misleading congress to bypass a law is definitely overstepping the bounds of the
President's authority. In conclusion I believe President Obama has clearly overstepped his bounds
and authority in this situation. Not only by ignoring the mandated deadlines set

After the thirteen colonies failed with writing the Articles of Confederation well–known Americans
came together and wanted to write what would be known as the greatest document in American
history. The Articles of Confederation failed because it gave the states too much power and limited
the federal government. The Constitution is known as the supreme law of the land. The Constitution
has three articles and twenty–seven amendments. The three articles are divided by the Legislative
Branch, the Executive Branch, and the Judicial Branch. Each branch has their own power but each
branch also uses checks and balances so one branch does not become more powerful than the other
two. The Constitution was written so every man and woman had equal rights. The first ten
amendments are known as the Bill of Rights. When people hear the term "Bill of Rights" many
people think of just the first amendment which deals with freedom of religion, speech, and press. In
regards to criminal justice the fourth amendment can arguably be the most significant. There can
also be an argument that the 5th, 6th, and 8th amendments are more significant than the 4th
amendment. I honestly believe that these four amendments are for the most part equal when it
comes to the criminal justice system. These four amendments balances each other out and almost
works as a check and balance system. There have been some cases in which the fourth amendment
has played a crucial way in the outcome. The

The American government has many powers that are given to, and checked by each branch. This is
done by a system of Checks and Balances. The system of Checks and Balances states that the
different branches have powers but the other branches have methods to stop each branches powers.
But there are many argument that the system is broken or it isn't. The system is broken because of
many reasons involving the President, Congress and the Supreme Court. The system of Checks and
Balances is broken in many ways. For instance the President had the power to make executive
orders that aren't laws but have the power of one. The president has the power to make an order and

image depicting that the executive branch is too powerful for the other branches to hold back. This
could possibly be that the executive branch gets more powerful as time progresses forward or it
could mean that the executive orders have too much power. This may be because the executive

Checks And Balances Research Paper
The system of checks and balances was created when our founding fathers wrote and ratified the
Constitution in the First Continental Congress in 1787. Although the words checks and balances
weren't actually stated in the original Constitution, the ideas/principles of it still apply. With this, our
founding fathers wanted to make sure that no one branch could have more power than another. They
did this by allowing each branch of government the ability to check the power of the other two
branches of government therefore creating the system of checks and balances. So how does this
system work? It all begins with the Executive branch. The executive branch includes the president
who is assisted by his vice president and his cabinet. The executive branch can check the legislative
branch by: (1) Proposing ... Show more content on Helpwriting.net ...
The legislative branch is made up of Congress which is split into two parts, The Senate and the
House of Representatives. The legislative branch can check the executive branch by: (1) Congress
can overturn a presidential veto with 2/3 vote from both houses (2) Senate can reject proposed
treaties and presidential nominations of federal officials and judges. (3) Congress holds the power to
impeach and remove the President. The legislative branch also checks the judicial branch by holding
the power to: (1) create lower courts (2) Senate can reject nominees for the federal and Supreme
Court (3) Congress can amend the Constitution to overturn decisions of the Supreme Court and has
the power to impeach judges and remove them from the bench. The legislative branch's checks
allow it to make laws to better our nation, control the national budget, and impeach the president if
necessary which is important to keep America on the right track and make sure the other two
branches are obeying the constitution and not abusing their powers by vetoing

Examples Of Checks And Balances
Some examples of checks and balances in the Constitution occur in situations; such as when
Congress has the authority to provide justice to the federal courts. The president has a discussion
with federal judges about the information gathered from the Senate and their recommendation.
Therefore, the three branches of government all have an opportunity to provide their viewpoint on
how justice should be served in each federal court case. Checks and balances occur when the
executive branch is in charge of foreign affairs, but treaties that deal with foreign governments need
to be discussed with the Senate. Thus, the executive branch and the legislative branch have to
communicate about decisions that relate to foreign treaties and come to an agreement.

Has checks and balances really been doing its job and limiting the government? Checks and
balances is used to keep the government in check and limiting its power. It limits the president to
what he can do, so our government does not turn into a dictatorship. If military actions are
happening the president must run it through Congress. This limits our government and always
checking other branches to make sure it is balanced. Therefore, checks and balances has created a
limited form of government. In document 1 the picture shows each branch can prevent another

In document 6 there is a picture showing the three branches of government are not equal. The
concept is to show there is separation of powers. Montesquieu created the concept of having 3
branches to maintain order in the government. The position in this picture is to show the executive
branch is becoming too powerful. The executive branch can overrule the legislative and judicial
branch. The picture shows a tree with branches cut off with a chainsaw. The part of the tree still left
is holding a chainsaw and is labeled executive branch. The two branches cut off are the judicial and
legislative showing the executive branch has more power than the other 2 branches. However in our
government there has never been problems with checks and balances. In document 4 it says, '' The
President in every possible instance shall consult with Congress before introducing United States
Armed Forces into hostilities.....Within sixty calendar days...." The War Powers Act is to limit the
president and that he must run all military actions by congress for approval. This makes it so our
president cannot just make all the decisions he wants. Within 60 calendar days he must either
declare war or enact permission. Congress must approve anything before actions are to take place.
This shows the executive branch is not all in control. The three branches of government are equal

Checks And Balances: The Paradox Of Democracy
The Constitution was written to ensure that the division of power between the government and the
states. Alexander Hamilton, James Madison, and John Jay penned the constitution, and bore in mind
that the establishment of a new government separate from England, needed to prevent a, "majority
rule" and possible tyranny. Therefore, it was agreed that in order to separate the powers of
government, that the responsibilities would be divided among three separate branches, the
executive, legislative, and judicial, were established in an effort to institute a checks and balances
system into place that, would distribute power. Thereby preventing any form of tyrannical rule. In
addition, another aim of our constitution is to prevent, as mentioned above, majority rule. Majority
rule can be seen as a real threat, as it too can develop into a tyranny, and infringe upon individual
rights. This is what is referred to as the, "paradox of democracy' (POLS210). The checks and

The president also is involved in the process of law making, and can veto a bill, which is then sent
back to congress for amendment and another vote. Congress and the Senate then have an
opportunity to send it back to the President for signing, or to override the veto with a two–thirds
vote in both houses within ten days (POLS210). The President also has the authority to appoint
people to powerful position such as a Supreme Court Judge, and the checks and balances allows
congress to either approve or disapprove the appointment. Both examples show how the checks and
balances work within the government. They demonstrate that each branch has power, yet is highly

The senators have the power to kill the nomination in different ways. The simplest means of
defeating a nomination is when the senators form a coalition on the floor through which majority
vote against the nomination. For instance, president Regan nominee of 1987 Supreme Court Robert
Bork was rejected by the senate. This normally takes place when the senate fully constrained the
president to a point someone on the reversionary point. Moreover, the committee can down play the
nomination from being considered by the full senate which at the end kills the nomination. In
addition, the senate can reject the nominee if they successfully identify negative information on the
appointed nominee by sending to the media and committee hearing. Placing hold or filibuster on

Separation of powers is a principle of our government in which the three branches of government
are divided and all hold equal power. Our Founding Framers who were the Framers of the
constitution wanted to create a stronger national government than that of what we previously had
when the country was under the Articles of Confederation. They also wanted the government to be
more effective and already knew that the people wouldn't want a national government with too
much power like that of an autocracy. Using these standards the Framers of the Constitution
meticulously crafted this principle of separation of powers which included three branches of
government, each with different powers divided up among them, that of which is included in our

The judicial branch's check is so powerful because it is the only one of the branch, so it has to be
powerful in order to keep the system in check and keep all of the branches equal. Their check gives
the branch the ability to declare the actions and laws that the other branches do unconstitutional,
which is basically the power to disapprove of anything that the other branches do. The executive
branch's check to propose laws are so powerful because it allows that branch the ability to create a
new law that they think seems fit. This coincides with another one of their checks to veto laws. If
the president doesn't like a law he can veto it. Though the president can veto a law, the legislative
branch can override it with two–thirds of the vote of both houses, which makes this check powerful.

When the Constitution was first composed, it created a separation of powers which shared its power
with the system of Checks and Balances. The Government consists of three branches; the
Legislative, Judicial, and the Executive. Although they are expected to uphold different

Legislative branch, which consists of the House and the Senate, they are responsible for making the

Whereas the Judicial branch has the role of limiting the powers of the other branches and has the

Differences Between Checks And Balances
The Constitution protects the United States of America from tyranny in multiple ways. The Checks
and Balances system, Separation of Powers, and the Bill of Rights all contribute to protecting the
United States from tyranny. The Checks and Balances system and Separation of Powers divide
powers between the Legislative, Executive, and Judicial branches and the National and State
governments. The Bill of Rights gives citizens rights no tyrant can take away. Tyranny is when there
is cruel or oppressive government or rule in a town, city, state, country, or continent. The Checks
and Balances systems protects the United States from tyranny because it doesn't let one branch have
all the power. The Legislative, Executive, and Judicial branches all balance out each others powers.
For example, the President in the Executive branch nominates judges for the Supreme Court in the
Judicial branch, but the the Supreme Court can declare presidential acts unconstitutional. This way,
the President doesn't get everything he or she wants (nominates, declares, etc.). Another example is
when the Legislative branch makes the laws. After the laws are made, the Judicial branch has to

The 3 braches of government are thus the legislative, Judicial and Executive. In order to ensure than
no one branch of government receives or becomes in control of too much power, the phenomenon of
checks and balances was introduced. It essentially gives each branch of government the authority to

Congress can however override the president's Veto with two thirds vote. There are also some

In this case the supreme court decided that the segregation of schools was unconstitutional.
Congress then needed to put into effect policy that would desegregate schools. There were several
more cases that went to the supreme court after and because of this ruling. Some of these include

Constitution DBQ After the revolutionary war, the Articles of Confederation were written and in
effect for 6 years. Then they realized that they needed to be revised. During the constitutional

Have you ever wondered how our government got to be as organized as it is now? Well, it was not
always that way; we used to not have 3 branches of government like we do today. They decided that
each branch will have certain powers to make our country run smoothly; and this process is called
checks and balances. Without the 3 branches powers being balanced, our life as citizens would be
completely out of whack and uncontrolled. It is very important to know which branch has what
power, and how each one functions and works to make our government successful because with the
3 branches of government being balanced, life would be much more under control than it would be
if the branches power was not balanced.

The executive branch has power over the judicial branch because it has the right to appoint judges
and the ability to override judicial decisions and grant pardons.
The Judicial Branch's power is the power to interpret laws. It also has the authority to approve
appointments to the federal courts. The president is the person that appoints supreme court and other
federal judges. Courts can also judge legislative acts to be unconstitutional, and that is another big
thing the courts have over the legislative branch.
All three branches have major responsibilities that they take care of everyday, and they balance the
powers equally. They each have distinct jobs to do, and that supports the U.S. A and helps our
country function smoothly. The Legislative Branch has the power to also override a veto by a two–
thirds vote in both the Senate and the House of Representatives if they choose to. The executive
branch has the right to appoint judges and the ability to override judicial decisions and grant
pardons. Finally, the Judicial Branch may remove the president through impeachment. Overall, each
of the branches has their own responsibilities, and they use their powers to unite the nation in peace.

Every system in the world needs to be checked and balanced, if it's a school system or a small

there are three branches. The legislative branch, executive branch, and the judicial branch. Each

with the senate and house and representatives. The executive branch has the president in it and it

This is the branch the reviews the laws that are proposed and explain them to the public. Just like
the other two branches the judicial branch also has its checks and balances. In the judicial branch
they are allowed to rule something unconstitutional this gives them a lot of power. The president in
the executive branch however has the ability to appoint judges for the judicial branch, so it isn't a
bunch of people chosen by the judicial branch, but from the president so they have a check. Another
check and balance is that the congress can impeach or remove any of the judges from office. This
allows the congress to make sure that there are no bad judges or judges that shouldn't be in office
there. Those are great checks and balances for the judicial branch to have because if they didn't have

Checks and Balances
Checks and Balances. Checks and balances is a system that is a part of out U.S. Constitution. This
system was put in to place so that no part of government would have too much power. The three
branches: judicial, legislative and executive are constantly granting and checking the other branches
actions, this is to make sure no one person can gain an excessive amount of control in government.
For example according to ," the legislative branch is in charge of making laws. The executive
branch can veto the law, thus making it harder for the legislative branch to pass the law. The judicial
branch may also say that the law is unconstitutional and thus make sure it is not a law.The
legislative branch can also remove a president or judge that is not doing his/her job properly. The
executive branch appoints judges and the legislative branch approves the choice of the executive
branch. Again, the branches check and balance each other so that no one branch has too much
power". Senate rejected a president's nominee to the Supreme Court. The senate has rejected a total
of 12 nominees out of 159 nomination for Supreme Court Justice that presidents have submitted for
confirmation. In 1795 George Washington was the first president to have his nomination for Chief
Justice rejected. Robert Bork for Associate Justice nomination by Ronald Reagan was the last to be
rejected in 1987 by the senate. The Senate sometimes take their time confirming nominees, which
includes 24 they've postponed.

Checks And Balances Essay
Creating checks and balances in the United States (US) Government was a goal achieved by
dividing power into three governmental branches; legislative branch (Congress), executive branch
(Presidency), and a judiciary branch. The power flows from the Judicial Branch to both Congress
and Presidency and back again from both branches. The power also flows back and forth between
Congress and the Presidency. According to Founder James Madison, they had to "enable the
government to control the governed, and the next place to oblige it to control itself" (5). Although
the Constitution gives the national government authority over foreign affairs, there was an essential
tug of war created for the ultimate control between the legislative branch and ... Show more content

The President's power over foreign policy are limited and bound by the rules of the law and requires
approval from Congress. For example, in 1998, President Clinton sent American ground force in to
Yugoslavia without legislative approval (262). Congress also primary controls federal spending and
subsequently, the House would not allow the use of funds for deploying troops without prior
approval and ultimately rejected a motion to declare war against Yugoslavia (262). Congress also
rejected an order to remove troops from Yugoslavia, but in an effort to limit the President's power
over military action without approval, Congress enacted the War Powers Resolution (265). To
ensure checks and balances are met, another way Congress has asserted its own role in this policy
area is through oversight authority. When the party that controls the White House is also the
majority in the house, oversight is hardly considered. An example of this was when in the wake of
9/11, the Bush administration encouraged Congress to neglect oversight of defense policy
intelligence because the President need to have free range to wage war (241).
Both Congress and the President have very important and different roles in foreign policy. Congress
having a role in foreign policy making is very important because it ensures the check and balance
system is working and allows for more efficient policy making. Congress and the executive

Checks And Balances System
In the United States' democratic government, the system of checks and balances is used to ensure
that no tyranny is to take place in the government. The checks and balances system is supposed to
do its job by allowing the three branches to make "checks" on one another and work with one
another. The checks and balances system does not work, this was proven during the Indian Removal
Act, 1830, and the trial Worcester VS Georgia, 1832. One of the governing branches is the
Legislative Branch. Legislative has the most power out of the three, meaning that between the three
branches the power is unevenly held. When the power isn't even then that will give an upperhand to
one and another will have no control, while one remains in the middle. Legislative has been given

This is a problem because if they choose they could allow one branch to continue an act that is
unconstitutional, and the other wouldn't be able to do anything. An example of this is when
president Jackson chose to not enforce a law because of his own personal views, even though
Judicial deemed it unconstitutional. Legislative had the power and opportunity to check executive,
but chose to not do so, Judicial was incapable of checking either branches caused by its lack of
power. This shows how the system of checks and balances is ineffective because of the unevenly
held power. Second in command due to power is Executive. Led by the president, they are capable
of vetoing a proposed law, appoint federal posts, and grant pardons. Their jobs include enforcing
laws that are made and passed by congress, and to act as the commander and chief of the armed
forces. The president is also required to take an oath when he

Checks and Balances system in the US
Throughout history some governments have been in upheaval. For example, France had a rough
social system. It was made of three estates: the clergy, the nobility and lastly the Middle Class. The
third estate, which was the Middle Class, was paying almostly all of the taxes. The monarch did
nothing to help, so he was overthrown. This started a revolution. Other governments though such as
America have had a stable government throughout much of its history. To know how the United
States government maintains relative peace, it is important to understand the checks and balances
system of the US government, the history behind this system and why it works.
In order to understand the complexities of the checks and balance system, one must first know what
it is. In Kelly´s article "Checks and Balances in American Government" on the three branches of
government he says "It is the system that the U.S. Constitution set up to ensure that no one branch

The checks and balances system was needed because there were problems with the Articles of the
Confederation. The Articles created a weak central government because power was given more to
the states rather than the government ("Policies"). This caused the checks and balances system to be
needed. They put this system in because they did not want the government to become too powerful
either. In the article by Bok called "Baron de Montesquieu, Charles–Louis de Secondat" Baron de
Montesquieu who was from France was a great enlightenment thinker during the time of the
Renaissance, who proposed this system of checks and balances in 1748 ("Separation"). In addition,

Civilization. Checks and balances The Constitution separates the power of government into three
branches: the legislative power is vested in the Congress, the executive power rests with the
President and his bureaucracy and the judicial power is granted to the Supreme Court and other

the Constitution, each branch is also given the power, duty and ability to control and balance the

As to foreign affairs the President nominates ambassadors with the consent of the Congress. The
President can make treaties with other countries, but only when two–third of the Congress concurs.
The Congress can also advise the President on foreign affairs. As mention above the President limits
the legislative power of Congress by his ability to veto laws. Today the President also plays a role as
a law–initiator who proposes bills, which he follows closely through Congress and he uses
legislative aids to lobby for their passage. His legitimacy as a law initiator is to be found in the
constitutional clauses requiring the President to inform Congress about the "State of the nation" and
to suggest measures that he consider "necessary and expedient". Furthermore, he has the power to
convene Congress if he deems it necessary. As mentioned the judicial power is vested in the
Supreme Court and inferior federal Courts, and the Supreme Court checks and balances the other
branches through its power of judicial review. Congress has the constitutional power to create
tribunals inferior to the Supreme Court and to change the number of judges. The president
nominates the federal judges with the approval of Congress. In this essay we have seen how the

Checks And Balances Of The Senate
The checks and balances that the founders of our country put into place to limit the power of the
executive branch have failed and allowed the Prime Minister to gather unprecedented and
unchecked power. There is a need to establish or re–establish effective checks for the prime
minister, at different steps along the policy making process. The traditional checks and balances on
the executive branch have come from the house of commons, the senate, and the Governor General.
These institutions are meant to work together to ensure that the country is being governed fairly and
in the name of the people. However, over the last thirty years the power has been moving away from
the legislative branch towards the executive. In a system where majority ... Show more content on

The original purpose of the senate was two–fold, firstly they were meant to add some degree of
regional representation to the debate. The one–hundred and five senators are separated into regions
with a set number coming from each of the regions of the country. Secondly, the senate was meant
to be in the words of Sir John a Macdonald "a chamber for a sober second thought" , that is to say
that it provides a second opinion on bills and any other legislation that has passed through the house
of commons. The modern senate however does not fulfill these two functions adequately anymore,
instead the regional distribution is not done equally, so there are areas that are very over represented
and others such as British Columbia that are woefully under represented . And the sober second
thought that the senate is meant to offer is instead turning into a more symbolic confirmation similar
to the royal assent that the Governor General gives in the name of the Queen. This second issue
happens because the senate lacks the legitimacy of the house of commons because they are not
elected. In modern times the public is weary of a body of un elected officials affecting the
legislation of their chosen elected officials. Now to effectively reform the senate there are three
main areas that will need to change namely the distribution of seats, the way in which senators are
chosen, and the affiliations of the senators themselves. Firstly, the original purpose of regional
representation in the senate was to counteract the representation by population in the house of
commons. This helped to ensure that French speaking Quebecois, and the western provinces were
not marginalized by the English speaking majority and the power of Ontario in national policy
making. The distribution of the seats is done as follows, first the country was split into four regions

American Independence from Great Britain in 1776. They also participated in framing and adopting

for putting the new government, outlined in the new Constitution into effect. The framers were
afraid of majority rule, so they created three separate branches of the government; Legislative,

As explained in the Legislative paragraph, the President may sign a bill passed by Congress into law
or may veto it – or deny it from becoming a law. Along with a 2/3 majority vote by the senate, the
President can make treaties with foreign nations. The President may be impeached by a majority in
the House and removed from office by a two–thirds majority in the Senate for "treason, bribery, or
other high crimes and misdemeanors". He also has the power to pardon, or release, criminals
convicted of offenses against the Federal Government, enact executive orders, and (with the consent

To me, a "balanced relationship" is preferable in general. The idea of Checks and Balances in my
opinion is the most important because it holds each branch to its own set of authoritative functions
and responsibilities. Furthermore, each brach has "checks" which limit each branch to their powers.
(No one branch may become too dominant of the others.) I believe this concept is one of the most
important in the Constitution because, in summary, it prevents corruption and abuse of power all
while suggesting good ideas into our Federal Government. An example of Checks and Balances

Let's start with the president's ability to veto. The president can veto or send a bill back to congress.

When drafting the Constitution of the United States the founding fathers took great precautions in
ensuring that no one branch of government became too powerful. By dividing the power of each
branch the fathers hoped to ensure that the United States would not become subject to abuse by one
branch that could ultimately lead to an authoritarian regime. In order to do this, the drafters of the
Constitution implemented a system of checks and balances in nearly all aspects of the new
republic's government. One of these checks and balances was the distribution of foreign policy

In order to understand the powers of Congress, one first must look at Article I of the Constitution
that enumerates several of Congress's foreign affairs powers. This includes the many different
powers like the ability to regulate commerce with foreign nations, declare war with foreign nations,
raise money for and support the many branches of the military like the army navy and airforce as
well as maintaining these military organizations. The Constitution also allows for Congress to check
two of the President's foreign affairs powers, make treaties and appointing diplomats. The act of
both making treaties and appointing diplomats are however dependent on Senate approval.
Congress's general powers also allow the collection of taxes to draw money from the Treasury, and
to make all laws which shall be necessary and proper that allow the legislative branch to control
many foreign policy decisions. For example, the last session of Congress during the Obama
administration was able to pass a variety of laws that affect America's foreign policy that ranged
from electronic surveillance to North Korean sanctions, to border security to wildlife trafficking.

The doctrine of separation of powers developed over many centuries. This practice doctrine can be
traced to the British Parliament's gradual assertion of power and resistance to royal decrees during
the 14th century. Political theorist, John Locke wrote about the concept of separation of powers in
his Second Treatise of Government (1690). In the United States, the separation of powers is a
fundamental constitutional principle. The framers of this Constitution saw the need to divide power
within the government to prevent a single group from ruthlessly taking over the country. Articles I

The legislative branch, Congress, has the power to make laws valid for the whole country. Powers
like the regulation of taxes, regulation of commerce between the states and with foreign countries,
the power to declare war, and the power to impeach the President are some of the issues the
legislative branch has to deal with. Congress has two chambers (or "houses"): the Senate and the
House of Representatives ("the house").
Executive power is vested in the office of the President of the United States. The President has the
dual role of being the chief of state and the head of government. The President is also commander in
chief of the armed forces. He issues executive orders, and appoints Supreme Court justices (with
senate approval). The president is also called "the chief legislator" because he indirectly proposes
many bills, considers all bills from Congress and signs them into law or vetoes them.
Judicial power is given to the Supreme Court. All nine federal judges are appointed by the President
and serve "during good behavior," usually meaning for life. The judges cannot be removed from
office except for criminal behavior or malfeasance. This makes them less vulnerable to political
pressure and outside influence. The main feature of the independent role for the courts lies in their
power to interpret the Constitution. They review the "constitutionality" of laws and executive
orders. There are

Separation of Powers and Checks and Balances
There are both similarities and differences, when referring to checks and balances and separation of
powers. Both have to do with the Government. But separation of powers is a model of government
in which different parts of the government are in charge of different tasks; in the United States, these
parts are known as the Legislative, Executive, and Judicial. Checks and balances is a means of
trying to ensure that these three parts of government stay equal, and that one does not try to take
over another.
Separation of powers was first introduced as a government model in ancient Greece, and was used
largely in the Roman republic. Under this Government model, the state is divided into separate and

Checks and balances does not separate the powers, rather it expands off of it. Checks and balances
gives each entity of government a different advantage over the other.
Some examples are:
1. The president can veto laws, but congress can overrule the veto with 2/3rd vote.
2. The president and congress could agree on a law, but the supreme court can rule it
unconstitutional.
3. Congress can pass laws, but the president has the option to veto them.
4. The president can appoint judges and other officials, but the senate must approve of them first.
There are many real life examples of checks and balances being used in the US. Take Andrew
Jackson for example. He vetoed over 20 bills after the civil war! Another one would be in 1936,
when the Supreme Court declared the NIRA and the AAA, which were 2 new deal programs passed
during the Roosevelt administration unconstitutional. After the civil war, congress also overrode
over 20 presidential votes!
There are no clear similarities and differences between separation of powers and checks and

balances relies on the idea of separation of powers,

Madison Checks And Balances

  • 1. Madison Checks And Balances During the second half of the essay, Madison empathized the importance of diving the government into federal and state to provide "double security" to the people, and "to guard one part of the society against the injustice of the other part," meaning to protect the rights of the minority against the majority. The idea behind the separation of the federal and the state governments is once again to protect, and ensure, the liberty of the masses. By having to different governments, they can control each other, but also regulate themselves (executive, legislative, and judiciary branches). As for the protection of the minority, when the majority has an issue in common, then the rights of the minority become irrelevant. In the essay, Madison proposed ... Show more content on Helpwriting.net ... Throughout the entire document, the reader is constantly reminded of the importance of government never having the opportunity to take advantage of its power. The proposal for the separation of government not only into three branches, but also into federal and state governments makes it evident how important it was for Madison. Most of the proposals introduced by Madison have been used for the current government and have been proved to be successful. The checks and balances system was also an essential part for the solution to the government's unavoidable problems according to Madison. As for the way the human nature was represented in the essay was very particular to Madison's perception. It is evident men are not perfect, but by stating men are not angels, it somehow implies they are demons. There are plenty caring, intelligent, capable individuals in charge of government who do not fit into Madison's spectrum of governors. As for the possibility of the majority taking away the right from the minority, Madison's insight was quite helpful. It is clear Madison wanted to avoid having a particular group stepping over others and taking away their rights. Madison's statement about how society is divided into many distinct groups is remarkably accurate; the American society is formed of so many different cultures, backgrounds, religions, and beliefs, and each one has its powers and ... • 2. The System Of Checks And Balances Kevin nunez Power and Politics midterm essay. DR. Zagorcheva Explain the system of checks and balances within the American government and its significance. Be sure to provide examples and discuss alternative views. The purpose for our Constitution was to implement a new government with three equal branches that balance and check each other. The three branches are formed and is important that the maintain balance in Legislative, executive and Judiciary branches in order for our government to not be overpower each other. The U.S. Constitution established in 1787 with the purpose to provide "America 's national government and fundamental laws, and guaranteed certain basic rights for its citizens." I strongly feel the order of checks and balance should not be changed and I agree to concept of three branches which maintain branches order and peace in our U.S. Government. Our founders established WE THE PEOPLE. NOT We the government, NOT We the United States, NOT We the members of congress just so our nation, country, states and people can be protected and ensure welfare. In 1828 the meaning of welfare is not the same meaning people are adjusted today. The meaning of welfare is Exemption from misfortune, sickness, calamity or evil; enjoyment of health and common blessings of life; prosperity; happiness; applied to person. U.S constitutions secure the LIBERTY and maintain a "free society for our nation's people." If we take a look at the first three articles of the U.S. ... Get more on HelpWriting.net ...
  • 3. Checks and Balances Essay Ben Favorite POL 101 American Government J. M. Pullen 3/15/12 Checks and Balances In late 2011 President Obama sent troops to Libya to aid in the search for Col. Muammar el–Qaddafi, and he did so without congressional approval. Under the War Powers Resolution the President has 60 days (in some cases 90 days) to acquire permission from congress for the mission to continue. However when Mr. Obama passed the 60 day deadline without congressional approval, the question was posed, "Does President Obama have the authority to bypass the War Powers Resolution and have the troop remain in Libya?" the short answer is no he does not. I do believe President Obama was in fact overstepping his bounds for several reasons, first I believe in the ... Show more content on Helpwriting.net ... Therefore the very act of being in Libya with the allied forces, whether we were staring down the sights of an M4 at them or firing rockets from drones, we were in opposition to the Libyan military, and thus involved in hostilities. The Obama administration's argument that our level of involvement did not qualify as the hostilities referred to in the War Powers resolution is not valid. Based on the definition of hostilities, we were definitely within the parameters of the War Powers Resolution. That makes Presidents Obama's decision to ignore the 60 day limit a huge violation of the War Powers Act. Finally, on several instances the Obama administration ensured congress that the U.S was stepping down as the leader of the coalition forces and that we would be playing a much smaller role in the operation. While we did step down from the leadership, the U.S. continued to deploy the most supplies and weapons, particularly predator missiles, and large numbers of remote controlled drones. While trying to convince congress that we were stepping down to a non– hostile role we were still being as hostile as we could be, apart from kicking down Qaddafi's door ourselves. I'm sure misleading congress to bypass a law is definitely overstepping the bounds of the President's authority. In conclusion I believe President Obama has clearly overstepped his bounds and authority in this situation. Not only by ignoring the mandated deadlines set ... Get more on HelpWriting.net ...
  • 4. Checks And Balances Essay After the thirteen colonies failed with writing the Articles of Confederation well–known Americans came together and wanted to write what would be known as the greatest document in American history. The Articles of Confederation failed because it gave the states too much power and limited the federal government. The Constitution is known as the supreme law of the land. The Constitution has three articles and twenty–seven amendments. The three articles are divided by the Legislative Branch, the Executive Branch, and the Judicial Branch. Each branch has their own power but each branch also uses checks and balances so one branch does not become more powerful than the other two. The Constitution was written so every man and woman had equal rights. The first ten amendments are known as the Bill of Rights. When people hear the term "Bill of Rights" many people think of just the first amendment which deals with freedom of religion, speech, and press. In regards to criminal justice the fourth amendment can arguably be the most significant. There can also be an argument that the 5th, 6th, and 8th amendments are more significant than the 4th amendment. I honestly believe that these four amendments are for the most part equal when it comes to the criminal justice system. These four amendments balances each other out and almost works as a check and balance system. There have been some cases in which the fourth amendment has played a crucial way in the outcome. The ... • 5. Checks And Balances Dbq The American government has many powers that are given to, and checked by each branch. This is done by a system of Checks and Balances. The system of Checks and Balances states that the different branches have powers but the other branches have methods to stop each branches powers. But there are many argument that the system is broken or it isn't. The system is broken because of many reasons involving the President, Congress and the Supreme Court. The system of Checks and Balances is broken in many ways. For instance the President had the power to make executive orders that aren't laws but have the power of one. The president has the power to make an order and an example is order number 9066 which stated, "Presidential order signed by Franklin D. Roosevelt, which authorized the ... It shoes that there are few powers of the president in the system of Checks and Balances, while the legislative branch topples over them in sheer number with the judicial branch of to the side. Another example of the system being broken is in document 6. Document 6 shows an image depicting that the executive branch is too powerful for the other branches to hold back. This could possibly be that the executive branch gets more powerful as time progresses forward or it could mean that the executive orders have too much power. This may be because the executive orders have the force of law but doesn't need to be approved by congress, which means that the ... Get more on HelpWriting.net ...
  • 6. Checks And Balances Research Paper The system of checks and balances was created when our founding fathers wrote and ratified the Constitution in the First Continental Congress in 1787. Although the words checks and balances weren't actually stated in the original Constitution, the ideas/principles of it still apply. With this, our founding fathers wanted to make sure that no one branch could have more power than another. They did this by allowing each branch of government the ability to check the power of the other two branches of government therefore creating the system of checks and balances. So how does this system work? It all begins with the Executive branch. The executive branch includes the president who is assisted by his vice president and his cabinet. The executive branch can check the legislative branch by: (1) Proposing ... Show more content on Helpwriting.net ... The legislative branch is made up of Congress which is split into two parts, The Senate and the House of Representatives. The legislative branch can check the executive branch by: (1) Congress can overturn a presidential veto with 2/3 vote from both houses (2) Senate can reject proposed treaties and presidential nominations of federal officials and judges. (3) Congress holds the power to impeach and remove the President. The legislative branch also checks the judicial branch by holding the power to: (1) create lower courts (2) Senate can reject nominees for the federal and Supreme Court (3) Congress can amend the Constitution to overturn decisions of the Supreme Court and has the power to impeach judges and remove them from the bench. The legislative branch's checks allow it to make laws to better our nation, control the national budget, and impeach the president if necessary which is important to keep America on the right track and make sure the other two branches are obeying the constitution and not abusing their powers by vetoing ... • 7. Examples Of Checks And Balances Some examples of checks and balances in the Constitution occur in situations; such as when Congress has the authority to provide justice to the federal courts. The president has a discussion with federal judges about the information gathered from the Senate and their recommendation. Therefore, the three branches of government all have an opportunity to provide their viewpoint on how justice should be served in each federal court case. Checks and balances occur when the executive branch is in charge of foreign affairs, but treaties that deal with foreign governments need to be discussed with the Senate. Thus, the executive branch and the legislative branch have to communicate about decisions that relate to foreign treaties and come to an agreement. ... Get more on HelpWriting.net ...
  • 8. Checks And Balances Dbq Has checks and balances really been doing its job and limiting the government? Checks and balances is used to keep the government in check and limiting its power. It limits the president to what he can do, so our government does not turn into a dictatorship. If military actions are happening the president must run it through Congress. This limits our government and always checking other branches to make sure it is balanced. Therefore, checks and balances has created a limited form of government. In document 1 the picture shows each branch can prevent another branch from becoming too powerful. For example in the document it shows that the legislative branch can reject presidential appointments. This allows the branches to stay balanced ... Show more content on Helpwriting.net ... In document 6 there is a picture showing the three branches of government are not equal. The concept is to show there is separation of powers. Montesquieu created the concept of having 3 branches to maintain order in the government. The position in this picture is to show the executive branch is becoming too powerful. The executive branch can overrule the legislative and judicial branch. The picture shows a tree with branches cut off with a chainsaw. The part of the tree still left is holding a chainsaw and is labeled executive branch. The two branches cut off are the judicial and legislative showing the executive branch has more power than the other 2 branches. However in our government there has never been problems with checks and balances. In document 4 it says, '' The President in every possible instance shall consult with Congress before introducing United States Armed Forces into hostilities.....Within sixty calendar days...." The War Powers Act is to limit the president and that he must run all military actions by congress for approval. This makes it so our president cannot just make all the decisions he wants. Within 60 calendar days he must either declare war or enact permission. Congress must approve anything before actions are to take place. This shows the executive branch is not all in control. • 9. Checks And Balances: The Paradox Of Democracy The Constitution was written to ensure that the division of power between the government and the states. Alexander Hamilton, James Madison, and John Jay penned the constitution, and bore in mind that the establishment of a new government separate from England, needed to prevent a, "majority rule" and possible tyranny. Therefore, it was agreed that in order to separate the powers of government, that the responsibilities would be divided among three separate branches, the executive, legislative, and judicial, were established in an effort to institute a checks and balances system into place that, would distribute power. Thereby preventing any form of tyrannical rule. In addition, another aim of our constitution is to prevent, as mentioned above, majority rule. Majority rule can be seen as a real threat, as it too can develop into a tyranny, and infringe upon individual rights. This is what is referred to as the, "paradox of democracy' (POLS210). Congress and the Senate then have an opportunity to send it back to the President for signing, or to override the veto with a two–thirds vote in both houses within ten days (POLS210). The President also has the authority to appoint people to powerful position such as a Supreme Court Judge, and the checks and balances allows congress to either approve or disapprove the appointment. This system is known as Checks and Balances. The system has been put on the effect due to many instances over the course of the year history. The designed system of Checks and Balances is very open yet complex. For example, if the President executive is not fulfilling his responsibilities as a leader or behaving inappropriately, the Legislative Branch Congress can limit him through the power of impeachment. The simplest means of defeating a nomination is when the senators form a coalition on the floor through which majority vote against the nomination. For instance, president Regan nominee of 1987 Supreme Court Robert Bork was rejected by the senate. This normally takes place when the senate fully constrained the president to a point someone on the reversionary point. Moreover, the committee can down play the nomination from being considered by the full senate which at the end kills the nomination. In addition, the senate can reject the nominee if they successfully identify negative information on the appointed nominee by sending to the media and committee hearing. Placing hold or filibuster on nominees, the senators have the upper hand of blocking votes from taking place because the advantage of the senate's lack of formal means to end the debate. • 11. Checks And Balances Separation of powers is a principle of our government in which the three branches of government are divided and all hold equal power. Our Founding Framers who were the Framers of the constitution wanted to create a stronger national government than that of what we previously had when the country was under the Articles of Confederation. They also wanted the government to be more effective and already knew that the people wouldn't want a national government with too much power like that of an autocracy. Using these standards the Framers of the Constitution meticulously crafted this principle of separation of powers which included three branches of government, each with different powers divided up among them, that of which is included in our Constitution. ... The judicial branch's check is so powerful because it is the only one of the branch, so it has to be powerful in order to keep the system in check and keep all of the branches equal. Their check gives the branch the ability to declare the actions and laws that the other branches do unconstitutional, which is basically the power to disapprove of anything that the other branches do. The executive branch's check to propose laws are so powerful because it allows that branch the ability to create a new law that they think seems fit. This coincides with another one of their checks to veto laws. If the president doesn't like a law he can veto it. Though the president can veto a law, the legislative branch can override it with two–thirds of the vote of both houses, which makes this check powerful. • 12. Checks And Balance Essay When the Constitution was first composed, it created a separation of powers which shared its power with the system of Checks and Balances. The Government consists of three branches; the Legislative, Judicial, and the Executive. The Checks and Balances system, Separation of Powers, and the Bill of Rights all contribute to protecting the United States from tyranny. The Checks and Balances system and Separation of Powers divide powers between the Legislative, Executive, and Judicial branches and the National and State governments. The Bill of Rights gives citizens rights no tyrant can take away. Tyranny is when there is cruel or oppressive government or rule in a town, city, state, country, or continent. The Checks and Balances systems protects the United States from tyranny because it doesn't let one branch have all the power. The power flows from the Judicial Branch to both Congress and Presidency and back again from both branches. The power also flows back and forth between Congress and the Presidency. According to Founder James Madison, they had to "enable the government to control the governed, and the next place to oblige it to control itself" (5). Congress also rejected an order to remove troops from Yugoslavia, but in an effort to limit the President's power over military action without approval, Congress enacted the War Powers Resolution (265). To ensure checks and balances are met, another way Congress has asserted its own role in this policy area is through oversight authority. When the party that controls the White House is also the majority in the house, oversight is hardly considered. An example of this was when in the wake of 9/11, the Bush administration encouraged Congress to neglect oversight of defense policy intelligence because the President need to have free range to wage war (241). The checks and balances system is supposed to do its job by allowing the three branches to make "checks" on one another and work with one another. The checks and balances system does not work, this was proven during the Indian Removal Act, 1830, and the trial Worcester VS Georgia, 1832. One of the governing branches is the Legislative Branch. Legislative has the most power out of the three, meaning that between the three branches the power is unevenly held. When the power isn't even then that will give an upperhand to one and another will have no control, while one remains in the middle. Legislative has been given too much ... Legislative had the power and opportunity to check executive, but chose to not do so, Judicial was incapable of checking either branches caused by its lack of power. The original purpose of the senate was two–fold, firstly they were meant to add some degree of regional representation to the debate. The one–hundred and five senators are separated into regions with a set number coming from each of the regions of the country. Secondly, the senate was meant to be in the words of Sir John a Macdonald "a chamber for a sober second thought" , that is to say that it provides a second opinion on bills and any other legislation that has passed through the house of commons. The modern senate however does not fulfill these two functions adequately anymore, instead the regional distribution is not done equally, so there are areas that are very over represented and others such as British Columbia that are woefully under represented . And the sober second thought that the senate is meant to offer is instead turning into a more symbolic confirmation similar to the royal assent that the Governor General gives in the name of the Queen. This second issue happens because the senate lacks the legitimacy of the house of commons because they are not elected. In modern times the public is weary of a body of un elected officials affecting the legislation of their chosen elected officials. Now to effectively reform the senate there are three main areas that will need to change namely the distribution of seats, the way in which senators are chosen, and the affiliations of the senators themselves. Firstly, the original purpose of regional representation in the senate was to counteract the representation by population in the house of commons. • 32. Checks And Balances Essay Mangan, 8th, Civics Exam Many people believe that the president of the United States has more power than any other government branch. However, this very far from the truth. In reality, all three branches of government have an equal amount of power. This is made so by checks and balances, the Constitution, and Judicial review. Checks and balances are one of the main things that keeps the president inline. This is because Checks and Balances allow other branches to make sure that the president isn't abusing his powers. If in fact he is, they then can re–distribute the powers. In this way it is almost guaranteed that the president can't have too much power. As you can see this is a pretty effective way of maintaining a "power equilibrium" ... Show more content on Helpwriting.net ... This is the American Constitution aka the "Supreme Law of the Land". In this all powerful document there is a list of what all the president is capable of doing. Surprisingly it's actually a lot shorter than you might think. Most of the president's rights are listed on only one section. That is Article 2, Section1, Clause2 which states, "The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, when called into the actual Service of the United States; he m¬ay require the Opinion, in writing, of the principal Officer in each of the executive Departments, upon any Subject relating to the Duties of their respective Offices, and he shall have Power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment..." This system is written in our Constitution. The ideal principles of making laws, enforcing and interpreting laws should be independent and efficient in limiting each other's power. The two houses of congress provide limitations on each other. This system was created because our founding fathers figured they did not want any tyranny. This was one of their many goals and with this came federalism that balanced state and national government. Jefferson and others felt this is what we needed to become more democratic and get closer to our people. The checks and balances was created on the philosophy of Baron de ... It's also why dictatorships are far more efficient in crisis situations i.e. war, then democracies. (Separation of Powers) Some likes to believe that Machiavellian ideas about society do not hold, but the thought of philosophy, they do. Without separation of powers, there wouldn't be a dictatorship, but feudal order, where the president for life hands out favors to his assemblies which later on combines economic issues and violence to keep control of society. However, if poorly instructed, with separation of powers one power keeps other powers in check; if that does not work in society, nothing else does. This idea in the Constitution has stopped many problems from arising. Real life conflicts that test the system have occurred throughout history. After the Civil War President Andrew Johnson vetoed over 20 bills. After the Civil War Congress overrode over 20 Presidential vetoes. • 34. System Of Checks And Balances When drafting the Constitution of the United States the founding fathers took great precautions in ensuring that no one branch of government became too powerful. By dividing the power of each branch the fathers hoped to ensure that the United States would not become subject to abuse by one branch that could ultimately lead to an authoritarian regime. In order to do this, the drafters of the Constitution implemented a system of checks and balances in nearly all aspects of the new republic's government. One of these checks and balances was the distribution of foreign policy power between Congress and the President. This balance of power would be an important deterrent to one branch of the government abusing its power which could result in ... Show more content on Helpwriting.net ... In order to understand the powers of Congress, one first must look at Article I of the Constitution that enumerates several of Congress's foreign affairs powers. This includes the many different powers like the ability to regulate commerce with foreign nations, declare war with foreign nations, raise money for and support the many branches of the military like the army navy and airforce as well as maintaining these military organizations. The Constitution also allows for Congress to check two of the President's foreign affairs powers, make treaties and appointing diplomats. The act of both making treaties and appointing diplomats are however dependent on Senate approval. Congress's general powers also allow the collection of taxes to draw money from the Treasury, and to make all laws which shall be necessary and proper that allow the legislative branch to control many foreign policy decisions. For example, the last session of Congress during the Obama administration was able to pass a variety of laws that affect America's foreign policy that ranged from electronic surveillance to North Korean sanctions, to border security to wildlife trafficking. Congress can likewise assume an oversight position on foreign policy issues that enables them increase their power. • 36. The Importance Of Checks And Balances Benjamin Franklin once said "The constitution only gives people the right to pursue happiness, you have to catch in yourself." We have the constitution so that we can give the citizens the basic rights they deserve. In the US Constitutional Convention, they transfer a plan for a stronger federal government with three branches; executive, legislative and judicial. Along with a system of checks and balances so that no single branch would have too much power. I want to focus on the importance of 5 principles of the government, because they are very important because they help the people in every way. Such as popular sovereignty, limited government, separation of power, checks and balances, and federalism. Popular sovereignty is when people are giving government powers consent, the Preamble and the 1st amendment are great examples. In the ... Show more content on Helpwriting.net ... • 37. Checks and Balances Essay Checks and Balances The doctrine of separation of powers developed over many centuries. This practice doctrine can be traced to the British Parliament's gradual assertion of power and resistance to royal decrees during the 14th century. Political theorist, John Locke wrote about the concept of separation of powers in his Second Treatise of Government (1690). In the United States, the separation of powers is a fundamental constitutional principle. The framers of this Constitution saw the need to divide power within the government to prevent a single group from ruthlessly taking over the country. Articles I through III of the Constitution of the United States place each of the basic powers of government in a separate branch. This ... Show more content on Helpwriting.net ... The legislative branch, Congress, has the power to make laws valid for the whole country. Powers like the regulation of taxes, regulation of commerce between the states and with foreign countries, the power to declare war, and the power to impeach the President are some of the issues the legislative branch has to deal with. Congress has two chambers (or "houses"): the Senate and the House of Representatives ("the house"). Executive power is vested in the office of the President of the United States. The President has the dual role of being the chief of state and the head of government. The President is also commander in chief of the armed forces. He issues executive orders, and appoints Supreme Court justices (with senate approval). The president is also called "the chief legislator" because he indirectly proposes many bills, considers all bills from Congress and signs them into law or vetoes them. Judicial power is given to the Supreme Court. All nine federal judges are appointed by the President and serve "during good behavior," usually meaning for life. The judges cannot be removed from office except for criminal behavior or malfeasance. This makes them less vulnerable to political pressure and outside influence. The main feature of the independent role for the courts lies in their power to interpret the Constitution. They review the "constitutionality" of laws and executive orders. There are ... • 38. Separation of Powers and Checks and Balances There are both similarities and differences, when referring to checks and balances and separation of powers. Both have to do with the Government. But separation of powers is a model of government in which different parts of the government are in charge of different tasks; in the United States, these parts are known as the Legislative, Executive, and Judicial. Checks and balances is a means of trying to ensure that these three parts of government stay equal, and that one does not try to take over another. Separation of powers was first introduced as a government model in ancient Greece, and was used largely in the Roman republic. Under this Government model, the state is divided into separate and independent entities. The normal ... Show more content on Helpwriting.net ... Checks and balances does not separate the powers, rather it expands off of it. Checks and balances gives each entity of government a different advantage over the other. Some examples are: 1. The president can veto laws, but congress can overrule the veto with 2/3rd vote. 2. The president and congress could agree on a law, but the supreme court can rule it unconstitutional. 3. Congress can pass laws, but the president has the option to veto them. 4. The president can appoint judges and other officials, but the senate must approve of them first. There are many real life examples of checks and balances being used in the US. Take Andrew Jackson for example. He vetoed over 20 bills after the civil war! Another one would be in 1936, when the Supreme Court declared the NIRA and the AAA, which were 2 new deal programs passed during the Roosevelt administration unconstitutional. After the civil war, congress also overrode over 20 presidential votes! There are no clear similarities and differences between separation of powers and checks and balances, because checks and balances expand off of the idea of separation of powers. Checks and balances relies on the idea of separation of powers, ... Get more on HelpWriting.net ...
