 Unlike a POA, it only applies when the adult is not
capable of making decisions themselves
 When choosing a representative, you should use the
same care and diligence as choosing an attorney

Pre-Determined Pay
• It is a set amount of money to be paid on pay days
during deployment so life at home is not impacted.
Why Pre-Determined Pay?
• Pre-Determined Pay will ensure members are
paid even if we lose connectivity and cannot
complete payroll.
• The remaining balance of your OP Allowances will
be paid out on mid December pay, prior to our
return from deployment.
Benefits of PDP
• Reduces stress for members and families knowing
pay will be completed and deposited as per normal
• Opportunity to save deployment allowances
• Allows members to purchase canteen items and
receive cash to go ashore without using normal
household income
• Can pay portions should the need arise during the
deployment
Determining PDP amount
• In the box on the top right of your pay statement,
there is a box 3rd from the bottom called Current
Pay Entitlement. Take that number and divide by
2. Please round down to the nearest dollar. That is
the number you will set as your PDP amount.

Deployment Allowances and Tax Relief
• The deployment allowances HMCS Ottawa will be entitled to are
as follows:
• Operations Foreign Service Premium (Ops FSP)
• Hardship Allowance (HA)
• Hardship Allowance Bonus (HAB)(those previously deployed)
• Risk Allowance (RA)
• Tax Relief
• Sea Duty Allowance (SDA) will be ceased while in receipt of the
above allowances
Tax Relief
• Tax relief will be engaged during deployment and
claimed on 2023 taxes.
• It will show on box 43 of the T4 and entered on
line 244 of the tax return.
• This benefit begins 11 Aug, when the ship leaves
Esquimalt.
Operations Foreign Service Premium
(OPs FSP)
• This allowance is points based. Calculated at one
point per month while on deployment.
• Level 1, 0-6 months to level 6, 169+ months.
• As of 1 Apr 23 the lowest level is $991.00 monthly
and the highest level is $2086.00 monthly.
• This benefit begins on 11 Aug, when the ship
leaves Esquimalt.
Hardship Allowance (HA)
• This allowance is paid at a monthly rate determined by
the Chairperson of the Departmental Hardship and Risk
Committee and released via message
• Because OP Horizon is a new iteration of OP Projection,
the HA level has not been determined.
• OP Projection level will be used.
• HA level for OP Projection is level 2 at a rate of $443.00
monthly
• This benefit begins on 11 Aug, when the ship leaves
Esquimalt.
Hardship Allowance Bonus (HAB)
• This is to compensate for repeated deployments.
• HAB is calculated based on points (earn one point
per month of deployment) and percentage.
• Entitlement begins at the 7 point mark.
Risk Allowance (RA)
• This allowance is paid at a monthly rate determined by the
Chairperson of the Departmental Hardship and Risk Committee
and released via message
• Because OP Horizon is a new iteration of OP Projection, the RA
level has not been determined.
• OP Projection level will be used.
• RA level for OP Projection is level 1 at the rate of $221.00
monthly
• This benefit begins on 11 Aug, when the ship leaves Esquimalt.
Custodial Expense
• The intent of this benefit is to provide assistance for expenses
associated with maintaining a vacant residence while on
deployment outside Canada.
• Eligible mbrs:
Mbrs with no dependants who do not live in single quarters;
Service Couples who are both away for service reasons;
and
Single parents, if their dependants are under 18 and will not
be residing in the principle residence during deployment.
Custodial Expense cont’d
• Actual and reasonable expenses from a commercial firm of up to
$275 per month, supported by receipts.
• Eligible commercial costs include those related to snow removal,
lawn maintenance, security, minor maintenance and additional
insurance costs.
• Normal recurring expenses such as property taxes, electricity are
not eligible for reimbursement.
Family Care Assistance
• FCA is designed to help offset child and family care costs incurred
in excess of those paid during normal working hours for single
parents or service couples who are both absent for service
reasons.
• Can be reimbursed up to $75.00/day with receipts from a
commercial provider or $35.00/day with a personal declaration.
• Commercial provider means an individual or company in the
business of providing dependent care services.
Vehicle Storage
• The intent of this benefit is to reimburse a mbr for the storage and minor
roadworthiness restoration of a vehicle.
• Entitlement:
Storage in commercial storage facility at actual and reasonable cost,
supported by receipts; or
When commercial storage is not available or practical, DCBA may
authorize non-commercial storage at $30/month.
Vehicle Storage cont’d
• When a vehicle is stored in a commercial storage facilities, the mbr
may be reimbursed expenses that are required to restore the
vehicle to roadworthiness up to $200. These expenses may
include labour charges associated with a mandatory safety check,
towing charges, brake cleaning/adjustments and labour and minor
parts associated with a minor tune up.
Home Leave Travel Allowance
• HLTA is a benefit normally approved for members of the Canadian
Armed Forces (CAF) deployed overseas for a minimum of 120
days but may be approved for those deployed for less than 120
days but at least 60 days.
• 10.21.02(1) (Intent) The intent of this section is to assist a member
who is deployed or assigned to a place of duty outside Canada to
reunite with their Family Member.

• The Family Member is defined as follows for HLTA purposes
These are in specific order and it does not represent a list from which members can
choose:
• Spouse or common-law partner; or
• Child, Step-Child, Legal Ward, Adopted Child; or
• Parent or Step Parent; or
• Sibling, Half-Sibling or Step-Sibling; or
• Grandparents; and if still no
• A person designated by the member to be their next of kin

• Entitlement to claim HLTA is dependent upon:
• the operation being authorized mission leave (Comd CJOC); and
• the member being authorized a specific period of leave (TF Comd).
• When authorized, normally the travel options are:
• the member returns home to their Family Member;
• the member and one Family Member both travel to a suitable Third location;
• the member may choose to travel to a Third location without reuniting with a Family
Member.

• HLTA must be taken while serving at the post or the benefit lapses
(you can’t cash it out)
• Cannot be taken within the first or last 30 calendar days at the
post.
• Those leaving the ship early for the 1 in 4 duty watch will still get
their Mission Leave in Lieu. This is calculated against working
days.

Home Leave Travel Allowance cont’d
• CAF operations - Special Leave (Mission) (SL(M)) up to a maximum of two and
one-half calendar days per 30 continuous days in theatre. Total of 11 SL(M).
• In addition, members will be authorized Special Leave (Mission Travel) (SL(MT))
to get to and from your leave destination.
• Actual number of SL(MT) days is mission specific as approved by the Comd
CJOC and has not been determined yet.
• SL(M) and SM(MT) are indicated separately on the CF100 Leave Pass

• GoC position is that Canadian citizens may only travel with one
passport.
• For CAF members the passport to be used is the one they deploy
under.
• If it is anticipated that travel will be to/through a country with a visa
requirement, then the member must get the required visa for their
passport.

• All travel regardless of the type of HLTA (Home or 3rd Location) is to be
directly to/from post to/from a (1) destination as per the MFSI and DCBA
clarification.
• Members are not entitled to any form of a stopover during the travel
period – no intentional interruptions of the journey to or from the post,
including any overnight stay, with the exception of the time to connect
with the next flight.

For all HLTA Requests the following are to be sent to PSP:
• Signed copy of members CF100
• Completed and signed copy of HLTA Travel Request form
• Copy of passport for member and any NOK travelling when PSP
is booking the travel

• PSP will raise itineraries and cost sheet(s) for review and approval,
within 24-48hrs of receipt of all required documentation.
• Where members are travelling same dates/destination (major hub)
they will be, where possible, travelling under the same itinerary for
safety, ease of making adjustments due to Operational
requirement (change of port, early recall, etc).
• HR Admin will review itinerary for accuracy (name, dates, etc) and
advise if approved for the eTicket to be issued, or;

• HR Admin will advise PSP of changes for corrections (names,
dates, timings, Operational Reasons).
• Where a group of members are travelling on the same itinerary HR
Admin should provide blanket approval to proceed to ticketing for
all members to expedite process.
• Once approved eTicket will be issued.

• Any changes to travel after ticket is issued for an:
• Operational reason (may included cancelation or changes to a
members leave date) or;
• Repatriation Home (member leaving, not returning to mission), may
occur before member starts travel or while member is on HLTA
Costs are covered under HLTA and are not the members
responsibility to pay.
• Personal reason are NOT covered under HLTA and are the members
responsibility to pay.

– Members in transit, especially within Canada, presented with an unexpectedly long
connection time, possibly as a result of aircraft mechanical or weather related issues,
who are considering not taking their next scheduled connection in favour of continuing
travel via a potentially faster alternate means, must understand that that decision will
cause the airline to treat the member as a ‘no show’.
– Once declared a no-show, the airline will cancel all remaining unused segments of
the ticket, including the member’s return flight to theatre generating a requirement for
a new one-way return ticket at considerably more cost.
– Members who take action to change their approved travel itinerary will be responsible
to staff the reimbursement of alternate costs for DCBA approval and, in addition,
members will be responsible for any additional costs associated with rebooking return
airfare, including any associated cancellation or change fees.

– Members who become medically or otherwise unable to travel prior to the
start or while on HLTA, should advise PSP and their CoC immediately to
cancel or amend their travel arrangements.
– During normal working hours, M-F, members should contact the PSP HLTA
Team to coordinate flight changes. For afterhours notification to cancel or
amend tickets, members should contact the RescueLine After Hours Support
ASAP.
– Failure to cancel a ticket prior to departure will cause the member to be
treated as a ‘no show’ by the airline(s) and, as a result, the ticket will be
cancelled, flight amendments or refund activity will not be possible and the
member will require a new one-way ticket at considerably more cost.

HLTA CLAIMS
• PSP will prepare member claims package and all required forms
(CF52) in digital format.
• PSP will forward the digital claim package back, for member review
and signatures, and processing and payment by the ship.

What is required from members?
• Boarding passes
• Receipts for claimable expenses incurred
Receipts MUST clearly indicate, Amount, Currency paid in, Date of Purchase
Statutory Declarations cannot be accepted and Credit Card Statements cannot be
used in lieu of an actual receipt.
A Credit Card Statement should only be submitted to substantiate any cost
occurred, in other than CAD, for cost member was charged by the card provider in
CAD.

What is considered a Home Location?
• Member’s last place of duty in Canada, or;
• Where the member normally resides, or;
• Where the eligible Family Member normally resides, or;
• The residential property that an eligible Family Member, as per 10.21.01,
occupies for more than 183 days in a continuous 365 day period.
*These could all be different or could be one in the same.

• All Home travel is booked by PSP
• There is no max allowance for Home HLTA travel, the cost
to get the member home is the cost to get them home via
the most direct economical refundable routing.
• Total travel time less than 24 hours as per SLA with CJOC
• Avoid lay-overs longer than 5 hours (when and where possible)
• Minimum connection time of 1.5hrs (when and where possible) between
flights.

What is claimable?
– the most economical commercial means of ground transportation for travel
to/from/to airport/home/airport
– Car rental – first day and last day
– Cost of fuel (gas station NOT refueling by rental agency) to refuel rental car
– PMV via a Google map showing the mileage, mileage will be compensated
at the low kilometric rate
– any airport parking receipts, not exceeding 3hrs, if PMOV used as above

• premium economy, business or first class travel;
• meals;
• lodging;
• incidental expenses; (luggage fees, seat selection fees)
• fuel if PMV kilometric rate is claimed;
• automobile rental and associated costs (refueling packages or

What is considered Third Location?
• Members may proceed on leave to a location other than Home with or without
reuniting with an eligible Family Member.
• Travel must be direct from post to/from intended destination
• A third location is any location outside a radius of 800 km from the member’s
‘immediate’ NOK, your residence or last place of duty, and located 50km
outside the Theatre of Operations (Port of Call)
• That does not mean a member cannot travel to Canada as a third location
• Members may not travel to their home or former place of duty via travel to a third
location and vice versa

• Restricted countries that members cannot travel to and/or transit
thru will be set by each ROTO for that specific mission based upon
the OP Sec of the mission, and as per Government of Canada
Travel Advisories.
• Members are to advise PSP of any travel restrictions, especially for
locations they cannot transit thru when submitting their HLTA
request.

• Research your intended destination for the Visa requirements on
the passport you will be travelling under before leaving Canada
• Visa requirements:

Third location HLTA has a set travel allowance, as established by DCBA, for
the location where members are departing from.
• The allowance rate is based upon a members arrival to the mission NOT
when HLTA is taken
• The allowance is provided only for the travel of a member or a member
and one (1) eligible Family Member.
• Members expenses are covered first, and if any allowance remaining it
can then be applied to Family Member travel.
• The Family Member does not receive a seperate allowance rate.

• The Third location allowance rate is solely to get the CAF
member to/from post to destination and NOT to travel to multiple
Third locations after arrival.
• If a member travels from the intended Third location to any other
location(s) they must return back to the original Third location
destination at their own expense.
• Members may claim the required ground transportation (taxi,
bus, etc) to travel post/airport/post and or airport/hotel/airport.

• Members may request PSP to assist with booking their travel and/or eligible
Family Member as per 10.1.01.
• PSP will pay travel cost up to the max of the allowance rate, for member and the
eligible Family Member, and any cost above this amount would be paid by the
member.
OR
• Members may book their own and/or their eligible Family Members travel, but
advances are not given.
• Travel expenses will only be reimbursed up to the max of the allowance rate
upon the members return from HLTA, and filing their receipts and other claim
documents.

Members, or the Family Member being claimed, who book their own travel
should:
• Verify what travel/medical coverage they already have through their
current credit card and/or insurance providers;
• If none, it is highly recommended to purchase some form of optional
travel insurance, but such optional insurance is NOT claimable.
• The Economy fare travel is booked at includes a piece of checked
luggage built into the Base Airfare.
• If none, any optional luggage fees are not claimable.

Cruises, Tours and Safaris
– Can only be claimed if travel is directly from post to start of cruise, tour, or safari
and directly back from event to post from the same point as where the event
began.
1) No stopovers
2) No overnights
– Either before the start of or end of a Cruise, Tour or Safari
– Reimbursement is for only the transportation only portion of the package, if it the
package cost includes accommodations beverages and meals then 50% of the
invoices cost is claimable.

• An all-inclusive resort is NOT, under any circumstances considered
a tour package and ONLY the Airfare portion will be reimbursable.
• Must be substantiated with a receipt that clearly separates the
airfare cost from any accommodation, beverages and meals.

3rd Location: What is Claimable?
• May claim transportation expenses up to the maximum allowance rate of
the mission.
• Must verify that intent has been met and that ninety percent (90%) was
spent on transportation expenses to receive full amount; otherwise
members will only be reimbursed for their actual and reasonable
claimable expenses.
• Transportation (Economy Airfare) from post to destination
• Ground transportation to/from/to Post/Airport and/or Airport/Destination

Ship’s PA
• Daily “sick parade”: Much like you would receive in a walk-in
clinic;
• Urgent care: Staff is trained to provide urgent care such as
suturing, IV therapy, IV antibiotics, etc.;
• Emergent care: Staff is trained in Advanced Cardiac Life
Support, Advanced Trauma Life Support, & Acute Care Team
Training. If a situation outside the skill set of the PA there is a 24
hour line that will connect them to any specialist they require.
Sick Bay
• There is a helicopter on board that can fly the injured or sick
sailor to the nearest advance care facility. This could be
ashore or to another ship (such as a US Carrier) that can
provide a higher level of care.
• The senior leadership of the ship takes the crew’s health as
a priority.
• The patient will always travel with a medic and an escort.
EVAC
• Every member should have enough medication on board to last
until Jan 2024.
• Members should also bring a supply of their frequently used
Over the Counter (OTC) medications such as Tylenol, Motrin,
and allergy medications, as well as their preferred sea sickness
medication.
• OTC medications can be requested from the Base Pharmacy.
• Meclazine (Bonamine): request through Base Pharmacy (six
month supply). Request will be filled from civilian compounding
pharmacy. Please allow 3 days to fill.
Rx
• If you ever feel that your family member is ill or their mental
health has changed please feel free to get in touch with the
MFRC, Base Duty Officer or Padre.
• They will inform me of your concerns and I in turn will see
that your loved one gets the help they need.

• They may be of assistance by:
– Morale support to the deployed, families and the Chain of
Command
– Assist with referrals for various military and community resources
– Providing short term crisis counseling
– Mentoring Peer Supporters
– Providing Religious Services/Spiritual Care
– Advocates who care for all
What does the Chaplain do?
• The chaplain has unfettered access to the CO, XO, and Cox’n.
– This means that the CO, XO, and Cox’n maintain an open door
policy for the chaplain.
– The chaplain does not need to speak with anyone else in the
member’s chain of command in order to speak with the CO, XO,
or Cox’n in order to address concerns.
– The chaplain will, however, attempt to resolve issues at the most
appropriate level within the chain of command.

• Ottawa participates in Sentinel which is a Chaplain led peer
support program functioning in the RCN. 67 OTT personnel
have undergone some basic peer support training.

• When I have a problem and I don’t know where to turn
• For information or referral to services
• When I need to talk to someone who listens
• For religious counsel, services or prayer

  • 60. Pre-Determined Pay • It is a set amount of money to be paid on pay days during deployment so life at home is not impacted.
  • 61. Why Pre-Determined Pay? • Pre-Determined Pay will ensure members are paid even if we lose connectivity and cannot complete payroll. • The remaining balance of your OP Allowances will be paid out on mid December pay, prior to our return from deployment.

Benefits of PDP • Reduces stress for members and families knowing pay will be completed and deposited as per normal • Opportunity to save deployment allowances • Allows members to purchase canteen items and receive cash to go ashore without using normal household income • Can pay portions should the need arise during the deployment
  • 63. Determining PDP amount • In the box on the top right of your pay statement, there is a box 3rd from the bottom called Current Pay Entitlement. Take that number and divide by 2. Please round down to the nearest dollar. That is the number you will set as your PDP amount. Example on the next slide.

Deployment Allowances and Tax Relief • The deployment allowances HMCS Ottawa will be entitled to are as follows: • Operations Foreign Service Premium (Ops FSP) • Hardship Allowance (HA) • Hardship Allowance Bonus (HAB)(those previously deployed) • Risk Allowance (RA) • Tax Relief • Sea Duty Allowance (SDA) will be ceased while in receipt of the above allowances
  • 66. Tax Relief • Tax relief will be engaged during deployment and claimed on 2023 taxes. • It will show on box 43 of the T4 and entered on line 244 of the tax return. • This benefit begins 11 Aug, when the ship leaves Esquimalt.
  • 67. Operations Foreign Service Premium (OPs FSP) • This allowance is points based. Calculated at one point per month while on deployment. • Level 1, 0-6 months to level 6, 169+ months. • As of 1 Apr 23 the lowest level is $991.00 monthly and the highest level is $2086.00 monthly. • This benefit begins on 11 Aug, when the ship leaves Esquimalt.
  • 68. Hardship Allowance (HA) • This allowance is paid at a monthly rate determined by the Chairperson of the Departmental Hardship and Risk Committee and released via message • Because OP Horizon is a new iteration of OP Projection, the HA level has not been determined. • OP Projection level will be used. • HA level for OP Projection is level 2 at a rate of $443.00 monthly • This benefit begins on 11 Aug, when the ship leaves Esquimalt.
  • 69. Hardship Allowance Bonus (HAB) • This is to compensate for repeated deployments. • HAB is calculated based on points (earn one point per month of deployment) and percentage. • Entitlement begins at the 7 point mark.

Risk Allowance (RA) • This allowance is paid at a monthly rate determined by the Chairperson of the Departmental Hardship and Risk Committee and released via message • Because OP Horizon is a new iteration of OP Projection, the RA level has not been determined. • OP Projection level will be used. • RA level for OP Projection is level 1 at the rate of $221.00 monthly • This benefit begins on 11 Aug, when the ship leaves Esquimalt.
  • 71. Custodial Expense • The intent of this benefit is to provide assistance for expenses associated with maintaining a vacant residence while on deployment outside Canada. • Eligible mbrs: Mbrs with no dependants who do not live in single quarters; Service Couples who are both away for service reasons; and Single parents, if their dependants are under 18 and will not be residing in the principle residence during deployment.

Custodial Expense cont’d • Actual and reasonable expenses from a commercial firm of up to $275 per month, supported by receipts. • Eligible commercial costs include those related to snow removal, lawn maintenance, security, minor maintenance and additional insurance costs. • Normal recurring expenses such as property taxes, electricity are not eligible for reimbursement.
  • 73. Family Care Assistance • FCA is designed to help offset child and family care costs incurred in excess of those paid during normal working hours for single parents or service couples who are both absent for service reasons. • Can be reimbursed up to $75.00/day with receipts from a commercial provider or $35.00/day with a personal declaration. • Commercial provider means an individual or company in the business of providing dependent care services.

Vehicle Storage • The intent of this benefit is to reimburse a mbr for the storage and minor roadworthiness restoration of a vehicle. • Entitlement: Storage in commercial storage facility at actual and reasonable cost, supported by receipts; or When commercial storage is not available or practical, DCBA may authorize non-commercial storage at $30/month.
  • 75. Vehicle Storage cont’d • When a vehicle is stored in a commercial storage facilities, the mbr may be reimbursed expenses that are required to restore the vehicle to roadworthiness up to $200. These expenses may include labour charges associated with a mandatory safety check, towing charges, brake cleaning/adjustments and labour and minor parts associated with a minor tune up.

Home Leave Travel Allowance • HLTA is a benefit normally approved for members of the Canadian Armed Forces (CAF) deployed overseas for a minimum of 120 days but may be approved for those deployed for less than 120 days but at least 60 days. • 10.21.02(1) (Intent) The intent of this section is to assist a member who is deployed or assigned to a place of duty outside Canada to reunite with their Family Member.

Home Leave Travel Allowance cont’d • All travel regardless of the type of HLTA (Home or 3rd Location) is to be directly to/from post to/from a (1) destination as per the MFSI and DCBA clarification. • Members are not entitled to any form of a stopover during the travel period – no intentional interruptions of the journey to or from the post, including any overnight stay, with the exception of the time to connect with the next flight. • Any stopover initiated by the member for personal reasons will result in a forfeiture of all travel related expenses associated with that leave travel.

Home Leave Travel Allowance cont’d – Members in transit, especially within Canada, presented with an unexpectedly long connection time, possibly as a result of aircraft mechanical or weather related issues, who are considering not taking their next scheduled connection in favour of continuing travel via a potentially faster alternate means, must understand that that decision will cause the airline to treat the member as a ‘no show’. – Once declared a no-show, the airline will cancel all remaining unused segments of the ticket, including the member’s return flight to theatre generating a requirement for a new one-way return ticket at considerably more cost. – Members who take action to change their approved travel itinerary will be responsible to staff the reimbursement of alternate costs for DCBA approval and, in addition, members will be responsible for any additional costs associated with rebooking return airfare, including any associated cancellation or change fees.

Home Leave Travel Allowance cont’d – Members who become medically or otherwise unable to travel prior to the start or while on HLTA, should advise PSP and their CoC immediately to cancel or amend their travel arrangements. – During normal working hours, M-F, members should contact the PSP HLTA Team to coordinate flight changes. For afterhours notification to cancel or amend tickets, members should contact the RescueLine After Hours Support ASAP. – Failure to cancel a ticket prior to departure will cause the member to be treated as a ‘no show’ by the airline(s) and, as a result, the ticket will be cancelled, flight amendments or refund activity will not be possible and the member will require a new one-way ticket at considerably more cost.

If you have a POA from another jurisdiction, it can be valid in BC if it comes with a notarized letter stating that it meets all of the validity requirements in the originating jurisdiction. Enduring POA Continues even when you`re incapacitated POAs can: Can come into effect upon the occurrence of a certain event (springing) Have time limits Restrict certain activities/decision Constrain the Attorney to specified activities/decisions Have alternates Give the attorney the power of appointment (i.e. can name a replacement Attorney) *can even allow the attorney to transfer property to, or otherwise benefit, themselves* ***typically only used when a spouse is the attorney, very risky***

Although it is a legal document, there is NO REQR FOR INSTITUTIONS TO ACCEPT! COORDINATE IN ADVANCE – go to each institution and ask AHEAD of TIME - Hence don’t leave the signing until the last minute. Probably don’t want to waste time litigating this. - To clarify, an institution has a legal obligation to take instructions from an Attorney, however, if they refuse to recognize the POA, the only way to force them to act on the Attorney’s instructions is to obtain a court order, it is hardly ever worth the time and money to take these issues to court, just use whatever documents they want you to use.

May Not be Required if: You have no assets You have joint accounts No real estate transactions are anticipated You have reliable access to the internet Your insurance policies will not be up for renewal while you are away Health/personal care decisions will be discussed next Decisions around child care are legally complex and fall under each province’s family law regime. If the member is separated or divorced or is living in a mixed/blended family, they should speak to a family law lawyer to get advice on their specific circumstances. - In BC it is sometimes possible to appoint a temporary guardian, but members should consult a lawyer as a court order may still be required.
  21. Choose your attorney carefully. Not someone with financial problems – not someone you don’t get along with – a bankrupt cannot act as Attorney There are potential consequences resulting from picking the wrong attorney, among them the wrong attorney could: Drain bank accounts. Liquidate assets. Buy assets with your money. Does not respect your wishes. Bottom line is that no matter who you choose there is always some risk that they could misuse or mismanage your finances, your attorney is someone you trust to make decisions that are in your best interest and they can’t have any incentive to act against your best interest.

Rep Agmts are valid in BC – if planning to use it out of province, confirm with a lawyer in that jurisdiction first Other provinces will have different names for Rep Agmts If you do not have a Rep Agmt, the Health Care (Consent) and Care Facility (Admission) Act sets out who the doctors would turn to as a substitute decision maker i.e. spouse, adult children, parents, siblings, etc. (it may not be who you want and all members in each class are considered equals)

A Rep Agmt can place restrictions and/or constraints on the types of decisions a pers representative can make A Rep Agmt can work with or independently of an advance directive An advance directive sets out specific treatments that you want or do not want A Rep Agmt gives your representative the authority to make medical decisions on your behalf The Personal Representative must only act in the best interest of the Adult and in accordance with their instructions, or if those are not known, in accordance with their values and beliefs.
  24. A document that instructs how an estate should be distributed in the case that the will maker dies. It can also set out who is to care for any minor children or adult dependents, who takes the pets, funeral arrangements, etc. Everyone has likely filled out a military Will certificate under DAOD 7012. A will certificate provides a record, as applicable, that a CAF member: -does not wish to complete a will; -has a will but has decided not to place it with the CF for safekeeping; -has a marriage or civil union contract that contains testamentary dispositions; or -has not made a will because the CAF member is domiciled in the province of Quebec and has not reached the age of majority. *(see DAOD 7012-1)
  25. A will helps make the distribution of an estate much easier. It gives control to the will maker to distribute their property and assets as they wish. In a will you normally appoint an executor and trustee, who can be one or more individuals or an institution that will distribute your estate according to your wishes set out in the will. If you have children you will also appoint a guardian If no will = Intestate, this can tie up estate for a long time and distribution will be based on provincial law. In the meantime the estate sits until an administrator is appointed.

A CAF Will is best suited for: Spouse and no kids Single members Simple finances ******ensure the will is witnessed and an Affidavit of Execution is completed by your witness**** BUT ONLY IF IT IS FILLED OUT PROPERLY!!!! Clerks are generally good about ensuring names, dates, signatures, and witness affidavits are complete Member must name an executor Member must name must complete the residue portion of the will at a minimum - Even if you are a single member with no children or dependents it may not be suitable. As an example, a CAF will is not suitable if you wanted to leave money to other minors or disabled family members because it does not allow for the creation of trusts.

We strongly recommend that you retain a civilian lawyer and not just rely on a CF will, if: Mixed/blended families Children in or outside marriage You want to create a trust for your children You have complicated finances You have specific requests for division of assets Notaries can also do Wills, but they cannot do certain things like create trusts. Will kits: - there are many companies doing these - My recommendation is to get professional advice! – create lots of business for lawyers due to validity issues and unclear terms If you do a will kit, make sure you also have a CF will certificate.
  28. adult/Attorney: safeguard the original – (you get the original – most institutions want originals or certified true copies from a lawyer/notary) Do not take them with you – they won’t help you on ship
  29. Double check who you have named as your beneficiary, ensure that is who you want. SDB beneficiary does not automatically change with change in life circumstances (ie. Divorce) When a beneficiary is named in any registered investment or insurance policy, it does not form part of the deceased’s estate and goes directly to the named beneficiary.

This is proof of your consent for your child to travel with a person/spouse out of the country May need for travel to the US – out of province Must have the original on you when you travel, keep with passports OR they will not let you out of the country. Travel letters should be signed within the unit

According to DAOD 7000-1, in BC, any regular force officer can sign these for you Travel letters. Ask any commissioned Reg F officer to sign it—preferably one who will carry a cell phone in case they need to receive a call from Border Services
