समझती ह ै त ि क उत्व सी क मग रकी कवरेज को
सशक् त िन य ज सके । ित:िि भ रतसरक रि नम्ननललखतस्कीम िन तीह, ै िथ तत:
1. लघ ु शीषकत एवं रंभ :
a. यह स्कीम व सीभ रतीयिीम योजन 2017 कही ज एगी।
b. यह 1 िगस्त, 2017 से ल गू होगी।
3. 2. योज्य त :
a. यह योजन भ रतके उन सभीन गगरक जो उत्व सििगधनयम,1983 (1983 क 31) के िंतगतत
यथ िपेि क्षतउत्व सस्वीकृ ि तके ि लए आवेदनकरतेह और उसे प्त करलेते ह, एवं
प सपोटर्णे ी के

ि नरपेक्षउत्व सििगधनयम,1983 के खण्ड 2 (ओ) के िंतगतत श ि मलक यर् ेि णय के िधीनआने व ले
ि ववभन्न व्यवस यहतेुव सी रोजग रके ि लए ज नेव ले उत्व ि सय के ि लए ििनव यर्होगी। ii. इस योजन
के िंतगततल भ उसदशे म युिथव आंनतरक संघषर्की ि स्गथतम ल गू नह ह गे ि जसके ि लएभ रत के उक् त
पॉि लसीध रक न गगरक क यर्के ि लए गये ह य जह ं के ि लए य न करनेहतेुसरक रीय पर मशज री
की गई ह ।
3. वपरभ ष :
इस स्कीमम जि तक संदभर्म िन्यथ िपेि क्षतन ह ,
‘’उत्व सी’’क त त्पयर्भ रत के ऐसेन गगरक स े ह जोउत्व सकरन च हत ह ै िथव उत् ै व स
करत ह ै िथव
ि जसनेउत्व सकर ि लय ह ै ललकनइसमि नम्ननललखतश ि मलनह ह : े
(क) उत्व सीक िआ त, च ह े ऐस िआ त उसके स थ गय हो िथव उसदशेम उत्व सीके स थ रहने के योजन
हतेुि द म ज त ह ै ि जसमउसउत्व सीने क नूनी रूपम उत्व स ि कय ह; ै
(ख) कोई व्नयक् त जो18 वषर्की आयुहोने के पश्च ति कसी भीसमय भ रत से ि हरतीन वषर्तक रह ह ै
िथव ऐसे व्नयक् त की पत्नी िथव िच्च हो;
‘’उत्व स संरक्षीसे त त्पयर्उत्व स ििगधनयमकीध र 3 के िंतगतत ि नयुक् त उत्व ससंरक्षी से ह ै और
इसम ध र 5 के िंतगतत ि धकृ तव्नयक् त श ि मलह। ै
‘’िीम कं पनी’’से त त्पयर्िीम ििगधनयम,1938 के िंतगततिन ई गई औरपंजीकृ तकी गई कपंनी के ि कसी
िीम कत र्से ह। ै
‘’भ रतीयिीम ि ववनय मक औरि वक स ि धकरण(आईआरडीएआई)’’सेत त्पयर्िीम ि ववनय मक और
ि वक स
4. ि धकरणििगधनयम,1999 के िनुस रिन ए गए भ रतीय िीम ि ववनय मक औरि वक स ि धकरणसे
ह। ै
4. उत्व स स्वीकृ ि तके ि लएआवेदनकरन े व ल ककतपयव्नयक् तय र िीम पॉि लसीलने े के
ि लए िपक्षे ए े ं :-
i. यह उन सभी उत्व ि सयि जन्ह व सी रोजग रहतुउत्व स स्वीकृ ि त प्त करनेकी आवश्यकत
ह, ै के े
ि लए भ रतम क यरततऔर भ रतीयिीम ि ववनय मक औरि वक स ि धकरण(आईआरडीएआई) म
ि ववधवतपंजीकृ ति कसीिीम कं पनीसे िीम पॉि लसीलेने के ि लए ििनव यर्होग । ii. उत्व स स्वीकृ ि त
के ि लएसंिंि धतउत्व ससंरक्षी (पीओई) कोआवेदनकरनेव ल भ रतक त्येक न गगरक ि नम्ननललखतको
श ि मलकरते हुए िीम पॉि लसी प्त करेग :
क) िीम पॉि लसीन्यूनतम दो/तीनवषर्की िववध के ि लए वैध होगी और इसके ि द रोजग रलसंवद की िववध
के दौर ननवीकरणीयहोगी।
ख) िीम कृ तव्नयक् त को ि वदशेम रोजग र के समय आककस्मक मृत्युिथव रोजग रखोने ल यक स्थ यी
ि वकल ंगत के म मलेम 10 ल ख रू. की िीम र ि श द नकी ज एगी।िीम िववध के दौर नि नयोक् त म
िदल वय िीम कृ तव्नयक् त के स्थ नम वपरवतनतहोने कीि स्गथतम भी यह िीम वैध रहगे । िीम
पॉि लसीकी िववध के दौर निीम कृ त व्नयक् त के भ रतय िन्य तीसरे दशेम दौरे के दौर न भीिीम वैध रहगे
।
ग) ि वदशेि स्थतभ रतीय ि मशनऔर पोस्ट र आककस्मक मृत्युय रोजग र खोनेल यक स्थ यी
ि वकल ंगत के म णप को िीम कं वपनय र स्वीक रि कय ज एग । तीसरे दशे म होने के समयउस दशेके
भ रतीयि मशन/पोस्ट र ि दये गये आककस्मक मृत्यु/रोजग र खोनेल यक स्थ यी ि वकल ंगत के म ण
प और भ रतम संिंि धतउत्व स संररक्षय र ि दये गये म ण प स्वीक यर्ह गे।
घ) आककस्मक मृत्युके म मलेम, प ि थवतशरीरको ले ज ने कील गत के िल व िीम कृ त व्नयक् त के भ रत म
ि नव सके ि नकटतमिंतर ष्त ीय हव ई ि े तक एक वपरच रक के इकॉनोमी ेणी के व पसी हव ई भ ड़ े पर
वहन की गई ल गत की ि तवपतर्भी िीम कू ंपनी र की ज एगी। िीम कृ तव्यि क् त स्थ यीि वकल ंगत के
म मलेम िीम कृ तव्नयक् त के ि नव स के ि नकटतमिंतर ष्त ीयहव ई ि े तक एक वपरच रक के इकॉनोमीणे
ी के व पसीहव ई भ ड़ की ि तपूि तर्भी िीम कं पनी र कीज एगी। ि तवपूतर्के द वेको य पूणर्होने के
90 ि दन के भीतर िीम कं पनी के समक्षस्तुत ि कय ज एग ।
5. ङ) ि वदशेम रोजग र के समयि कसीदघुटतन /श रीि रक चोट के क रणऐसी दघुटतन कीि नतथ से 12 महीन के
भीतरहोने व लीआककस्मक मृत्य ु य स्थ यीि वकल ंगत के म मलेम िीम कं पनी िीम कृ तर ि शक
भुगत न करेगी,िशत ि क ऐस िीम पॉि लसीकीिववध के दौर नहोत ह ै और ऐसी मृत्युय स्थ यी
ि वकल ंगत क क रण ककथतदघुटतन हो।ऐसे म मलम दघुटतन /श रीि रक चोट के ि रे म सूचन ,उस
दघुटतन /श रीि रक चोट कीि नतथ से30 ि दन के भीतर िीम कं पनी कोभेजनी होगी। इसके िल व आककस्मक
मृत्यु/स्थ यीि वकल ंगत की ि नतथ से 90 ि दनके भीतर द वेस्तुत करनेह गे। 90 ि दनके भीतरद वे संिंधी
दस्त वेज कोजम न ि कएज न े के म मलेम भ रतीयि मशन/पोस्ट र ज रीम ण प ि जसमयह उल्लेख
ह ै ि क वपररस्गथतय ंिीम कृ तव्नयक् त के ि नयं ण से ि हर थ , िीम कं पनी र स्वीक रि कय ज एग ।
भ रतम आककस्मक मृत्यु/स्थ यीि वकल ंगत होने के म मलेम उत्व स सरं क्षी र ि दय गय म ण प स्
वीक यर्होग ।
च) िीम कं पनीिीम कृ त व्नयक्त की िीम िववध के दौर नआप तक लमदघुटतन से लगी चोट और/ य िीम री/
रूगणत / रोग के आध रपर भ रतम / तीसरे दशे म िथव उसदशेम जह ं वह क यरततहै, म िस्पत ल म भतके
म मलेम 1 ल ख रू. के वल(िस्पत ल म भत होने के ि तम मले म
50,000 रू.) क ि गचकत्स िीम कवरद न करेगी।
छ) िीम कं पनीउपरोक् त 4 (च) कीघटन म होन े व ले व स्नतवक ि गचकत्स व्यय की ि तपूि तर्करेगी,
और नयद ऐस ि गचकत्स उपच रभ रतम ि कय ज त ह ै तो नगदीररहतिस्पत लम भत होन क
वध नभी करेगी।
ज) नयद िीम कृ तव्नयक् त िीम रपड़ ज त ह ै िथव क यर्शुरू करने य क यर्ज री रखनेय क यर्हण करने
के ि लएस्व स्थ कीदिृ ष्ट से िनुपयुक् त घोि षतकर ि दय ज त ह ै और ि वदशीि नयोक् त र े िीम
कवरलेने के आरंि भक 12 महीन के भीतरसेव कर रसम प्त करि दय ज त ह ै तो िीम कं पनी र िीम कृ त
व्नयक् त के ि नव स के ि नकटतमिंतर ष्त ीयहव ई ि े तक के इकोनॉमी ेणी के एक तरफ के हव ई भ ड़े की
ि तपूि तर्की ज एगीिशत ि क त्य वतनत के आध रसंिंि धतभ रतीय
ि मशन/पोस्ट र म ि णति कए ज एंऔर हव ई जह ज के ि टकट मूल रूपम स्तुत ि कए ज एं।
झ) ि वदशेम िपने क यर्स्थल िथव गंतव्य स्थलपर पहुचं ने पर ि नयोक् त र उत्व सीको लेने न आने
िथव िीम कृ तव्नयक् त के ि तकू लम क यर्/रोजग रसंि वद /कर रम कोई मौि लक वपरवतनर्ि कएज ने
िथव उत्व सी कीि िन ि कसीगलती के रोजग रकी िववध के भीतर रोजग रको सम प्त कर ि दयेज ने की
ि स्गथतम िीम कं पनी र िीम कृ तव्नयक् त के ि नव सके ि नकटतमिंतर ष्र् ीय हव ई ि े तक की
इकोनॉमी ेणी के एक तरफ के हव ई भ ड़े कीि तवपू तर्की ज एगी िशति क त्य वतनतके आध रसंिंि धत
भ रतीयि मशन/पोस्ट र म ि णति कए ज एंऔर हव ई जह ज के ि टकट मूलरूप म स्तुत ि कएज एं।
6. ञ) ऐसे म मलम जह ं त्य वतनत क िंध भ रतीयि मशन/पोस्ट र ि कय ज त ह, ै िीम कं पनी व स्नतवक
व्यय की र ि शक भुगत न संिंि धतभ रतीयि मशन/पोस्ट कोकरेगी। इस पॉि लसीके िंतगतत िीम म
लमहल उत्व ि सयको सूतील भ भी द नि कय ज एग जो ि त पॉि लसीिववध के दौर नस म न्य सव के
म मलेम पतीस हज ररू. क न्यूनतम कवरऔर सीजेि रयनऑपरेशनके म मले म 50 हज र रू.तक होग । नयद
इल ज उस दशेम कर य ज त ह ै जह ंवह क यरतत ह ै तो सूि तल भ तभीद न ि कय ज एग जबिक िपेि क्षत
दस्त वेज संिंि धतभ रतीयि मशन/पोस्ट र म ि णतह । ि तवपूतर्के वलव स्नतवक र ि शतक ही
सीि मतह गी।
ट) भ रत म उत्व सी क मग रक वपरव रि जसमवपत/ पत्नी और21 वषर्की आयुतक के पहले दोिआ त िच्
चे श ि मलह, िीम कृ तव्नयक् त की मृत्युिथव स्थ यीि वकल ंगत के म मले म िस्पत ल म भतक प
होग ि जसकीर ि शपॉि लसीिववध के दौर नि त वषर्ििधकतम50हज र रू. ह गी।
ठ) एक िीम कृ तव्नयक् त को उसके रोजग रसे संिंि धति कसीमुकदमेम उसके र ि कएगए ि कसी
ि ववधक खचर्के संिंध म पैत्त लीसहज र रू.की र ि श हतेुश ि मलि कय ज एग िशति क संिंि धत
भ रतीयि मशन/पोस्ट र इस क र के म मल े को दजर्करने कीआवश्यकत म ि णति कय गय हो।
ड) िीम कं पनी रोजग रके म ण स्तुतकरने के आध रपर िपनीसम ि प्त पर उत्व ि सय र आग े की
िववध के ि लए पॉि लसीके ऑनल इननवीकरणकी सुि वध द नकरेगी।
ढ) िीम कं पनीिीम कृ तव्नयक् त के न ि मत व्नयक् त को िीम पॉि लसीकी एक ि त द न करेगी।
ण) िीम कं वपनय ंिउचतएवंतकसंगत ि ि मयमक भ र वसूलगी।सवे करजैस व्यवह यर्होग उसके
िनुस रभ ि रति कय ज एग ।
5. व सीभ रतीयिीम योजन ,2017 इसके ल गू होने की त रीख स े मौजूद व सीभ रतीयिीम योजन क स्
थ नलेगी।

G.S.R. 864(E).—Whereasaninsurance scheme forIndianemigrantsgoingabroadforemployment,viz.,
Pravasi BharatiyaBimaYojana, 2003 andamendmentasper Pravasi BharatiyaBimaYojana,2006 and
7. Pravasi BharatiyaBimaYojana, 2008 , as carriedoutby the Governmentof Indiaon13th November,
2003, 25th January,2006 and1st April,2008 respectively.
Whereasthe Governmentof Indiaconsidersitnecessarytofurtheramendthe scheme withaviewto
strengthenthe coverage tothe emigrantworkers.
Now,therefore,the Governmentof Indiaherebymakesthe followingscheme,namely:-
1. Short title and commencement:
(i. ThisScheme maybe calledthe Pravasi BharatiyaBimaYojana 2017.
(ii. It shall come intoforce from 1st August,2017.
2. Application:-
(i. ThisScheme shall be mandatory for all citizensof Indiawhoapplyforandobtainan emigration
clearance as requiredunderthe EmigrationAct,1983 (31 of 1983) as well asemigrantsgoingfor
overseasemploymentforvariousprofessionsfallingunderworkcategoriescoveredunderSection2 (o)
of EmigrationAct,1983 irrespective of the passportcategory.
(ii. The benefitsunderthisScheme shallnotapplyinthe eventof waror internal conflictinthe
countryto whichthe citizenof Indiaholdingthe saidpolicyhasgone forworkor where Government
travel advisorynotto travel isinplace.
3. Definition:-
In thisScheme,unlessthe contextotherwiserequires,
“Emigrant” meansanycitizenof Indiawhointendstoemigrate,oremigratesorhasemigratedbutdoes
not include:
a. a dependentof anemigrant,whethersuchdependentaccompaniesthatemigrant,or
departssubsequentlyforthe purpose of joiningthatemigrantinthe countrytowhich
that emigranthaslawfullyemigrated;
b. any personwhohasresidedoutside Indiaatany time afterattainingthe age of eighteen
years,fornot lessthanthree yearsor the spouse or childof such person;
“Protectorof Emigrants”meansa Protectorof Emigrantsappointedundersection3and includesa
personauthorizedundersection5of the EmigrationAct,1983.
“Insurance Company”meansaninsurerbeingacompanyformedand registeredunderthe Insurance
Act,1938.
“Insurance RegulatoryandDevelopmentAuthorityof India(IRDAI)”meansthe Insurance Regulatoryand
DevelopmentAuthorityof India(IRDAI)formedasperInsurance RegulatoryandDevelopmentAuthority
Act, 1999.
4. Requirementoftaking insurance policyby certain persons applyingfor emigrationclearance:
8. (i. It shall be mandatoryforall emigrantswhoneedEmigrationClearance foroverseas
employment,tosubscribe toaninsurance policyfromanyInsurance CompanyoperatinginIndiaand
dulyregisteredwiththe InsuranceRegulatoryandDevelopmentAuthorityof India(IRDAI).
(ii. Each citizenof Indiaapplyingforemigrationclearance fromthe concernedProtectorof
Emigrants(POE) shall obtainanInsurance policycoveringthe following:
a. The Insurance policyshall be validfora minimumperiodof two/three yearsand
renewable thereafterduringthe periodof employmentcontract.
b. The Insuredpersonshall be coveredfora sumof tenlakhrupeesinthe eventof
accidental deathorpermanentdisabilityleadingtolossof employmentwhile in
employmentabroad.The insurance shall remainvalidirrespectiveof change of
employerorthe insured’slocationduringthe policyperiod.The insuranceshall also
remainvalidduringvisitof insuredtoIndiaoranythirdcountry duringthe currencyof
insurance policy.
c. Certificationof accidentaldeathorpermanentdisabilityleadingtolossinthe
employmentbyIndianMissionsandPostsabroadshall be acceptedbythe insurance
companies.While inthirdcountry,certificationof accidental death/permanent
disabilityleadingtolossinthe employmentbyIndianMission/Postinthatcountryand
inIndia,certificationbyconcernedProtectorof Emigrantsshall be acceptable.
d. In case of accidental death,besidesthe costof transportingthe deadbody,the cost
incurredoneconomyclassreturnairfare of one attendantuptothe International airport
inIndianearestto the addressof the insuredshall alsobe reimbursedbythe Insurance
Company.Incase of permanentdisabilityof the insured,the economyclassreturn
airfare of one attendantuptothe Internationalairportnearesttothe addressof the
insuredshall alsobe reimbursedbythe Insurance Company.The claimfor
reimbursementshall be filedwiththe Insurance Companywithin90daysof completion
of journey.
e. The insurance companyshall paythe sum insuredincase of accidental deathor
permanentdisabilitydue toanyaccident/physical injurysustainedwhile inemployment
abroad occurringwithintwelvemonthsfromthe date of suchaccidentprovidedit
occurs duringthe currencyof insurance policyandsuchdeathor permanentdisability
shall be attributedtothe saidaccident.Insuch cases,intimationaboutthe
accident/physical injurywillbe senttothe Insurance Companywithin30days fromthe
date of suchaccident/physical injury.Further,claimhastobe filedwithin90daysfrom
the date of accidental death/permanentdisability.Incase of non-submissionof claim
documentswithin90days,certificate fromthe IndianMission/Poststatingthatthe
circumstanceswere beyondthe control of the insured,will be acceptedbythe
Insurance Company.Incase of accidental death/permanentdisabilityinIndia,certificate
fromProtectorof Emigrantswill be accepted.
f. The Insurance companyshall provide medical insurance coverof Rupeesone lakhonly
(upto RupeesFiftythousandperhospitalization) incase of hospitalization of the
9. insuredinanemergencyongroundsof accidental injuriesand/or
sickness/ailments/diseasesoccurringduringthe periodof Insurance whetherin
India/thirdcountryorinthe country of hisemployment.
g. The Insurance companyshall reimburse the actual medical expensesinthe eventof 4(f)
above,andin case such medical treatmentistakeninIndia,shall alsoprovide cashless
hospitalization.
h. If the insuredpersonfallssickorisdeclaredmedicallyunfittocommence orcontinue or
resume workandthe service contractisterminatedbythe foreignemployerwithinfirst
twelve monthsof takingthe insurance cover,the actual one wayEconomyClassairfare
up to the International airportnearesttothe addressof the insured shall be
reimbursedbythe Insurance companyprovidedthe groundsforrepatriationare
certifiedbythe concernedIndianMission/PostandAir-ticketsare submittedinoriginal.
i. On arrival at hisworkplace or destinationabroad,if the emigrantworkerisnotreceived
by the employerorif there isanysubstantive change inthe job/Employment
Contract/Agreementtothe disadvantage of the insuredperson,orif the employmentis
prematurelyterminatedwithinthe periodof employmentfornofaultof the emigrant,
one-wayEconomyClassairfare shall alsobe reimbursedbythe Insurance companyupto
the international airportnearesttothe addressof the insuredprovidedthe groundsfor
repatriationare certifiedbythe concernedIndianMission/Postandthe Air-ticketsare
submittedinoriginal.
j. In caseswhere the repatriationisarrangedbythe IndianMission/Post,the Insurance
Companyshall reimburse the actual expensestothe concernedIndianMission/Post.
k. The Insurance underthispolicyshall alsoprovide maternitybenefitstowomen
emigrants,subjecttoa minimumcoverof Thirty five thousandrupeesincase of normal
deliveryandupto Rupeesfiftythousand incase of caesareanoperationperpolicy
period. Incase of medical treatmentinthe countryof employment,the maternity
benefitswouldbe providedonlyif the requisite documentsare certifiedbythe
concernedIndianMission/Post.The reimbursementshall be restrictedtoactuals.
l. The familyof the emigrantworkerinIndiaconsistingof spouse andfirsttwodependent
childrenuptotwentyone yearsof age shall be entitledtohospitalizationcoverinthe
eventof deathor permanentdisabilityof the insuredpersonformaximumfifty
thousandrupeesperannumduringthe policyperiod.
m. An insuredpersonshall be coveredforasum of RupeesFortyfive thousandin
connectionwiththe legal expensesincurredbyhiminanylitigationrelatingtohis/her
employment,providedthe necessityof filingsuchcase iscertifiedbythe concerned
IndianMission/Post.
n. The Insurance Companyshall provide facilityof online renewalof the policyfora further
periodbythe emigrantsonitsexpirysubjecttoproductionof proof of employment.
10. o. The Insurance Companyshall provide acopyof insurance policytothe nominee of the
insuredperson.
p. The Insurance companiesshall charge fairandreasonable premium.Service tax will be
chargedas applicable.
5. The Pravasi BharatiyaBimaYojana,2017 will replace the existingPravasi BharatiyaBimaYojanawith
effectfromthe date of its comingintoforce.
