22nd Law
Commission
of India has
set the ball
rolling for soliciting views
and ideas of the public at
large and recognized reli-
gious organizations about
the Uniform Civil Code
(referred to as UCC herein-
after), vide its public notice
of 14th June, 2023. This
conversation that the Com-
mission has begun on the
UCC will focus on family
laws of all religions, such
as, laws of marriage, di-
vorce, succession, inherit-
ance, maintenance, adop-
tion, guardianship, et al.
There is a need to address
social injustice rather than
plurality of laws. Over the
ages India has prided itself
over its diversity of cus-
tomary practices and multi-
culturalism. Secularity will
be meaningful in the words
of 21st Law Commission
(Consultation Paper of
2018) “if it can also assure
that the expression of any
form of difference, not just
religious but also regional,
does not get subsumed un-
der the louder voice of the
majority; and at the same
time no discriminatory
practice hides behind the
cloak of religion to gain le-
gitimacy.”
It is noteworthy that
Apex Court has been urg-
ing the Central Govern-
ment to get over its “frozen
feet” in framing gender and
religion neutral UCC,
which is envisaged under
Article 44 of the Constitu-
tionasanaspirationwithno
legal enforceability. Three
decades after codification
of Hindu personal laws, Su-
preme Court said in the
case of Shah Bano (1985)
that “a common civil code
will help the cause of na-
tional integration by re-
moving disparate loyalties
to law which have conflict-
ing ideologies.” Apex
Court held in this case that
a divorced Muslim woman
is entitled to get mainte-
nance (which was a meagre
amount of Rs 20/- per
month to the petitioner
Shah Bano) from her hus-
band under Section 125 of
Cr.PC after ‘iddat’ period
till she remarries. Criminal
law, being secular in nature,
does not apply differently
to persons of different reli-
gions. However, enactment
of MuslimWomen (Protec-
tion of Rights on Divorce)
Act, 1986, overturned this
verdict. Despite this set-
back, Supreme Court has
continuously held in the
cases of Daniel Latifi
(2001), Iqbal Bano (2007)
and Shabana Bano (2009)
that Muslim women should
get the benefit of Section
125 of Cr.PC. Apex Court
has held in the case of Sarla
Mudgal (1995) that “where
more than 80% of citizens
have already been brought
under codified personal
laws, there is no justifica-
tion whatsoever to keep in
abeyance, any more, the
introduction of UCC for all
citizens in India.” Similar-
ly, it stressed the “the desir-
ability of achieving the goal
set by Article 44 of the
Constitution” in the case of
John Vallamattom (2003).
India has been debating
the implementation of a
UCC for decades now. It
mustbeappreciatedthatthe
demand of UCC transcends
all religions and should be
viewed from a strictly hu-
manitarian perspective sans
communal colours. It is im-
perative for every commu-
nity to usher in changes
according to the way soci-
ety evolves. Even though
petitions were submitted
against UCC in 2017, the
fact remains that Shariat
laws,arenotuniformacross
sects. It may bode well to
see why, despite the Lex
Loci Report 1840, which
emphasized the need for
uniformity in the codifica-
tion of Indian laws, it was
recommended to keep the
Hindu and Muslim person-
allawsoutofsuchcodifica-
tion. This was done with a
clear intent of creating a
permanent wedge between
Indians. So if a particular
community believes that
UCC is targeted against
them, it is important they
see it in the right historical
context before coming to
their conclusions. There
have been some powerful
voices raised within the
Muslim community in sup-
port of framing a common
civil code, though too fee-
ble to reach larger public.
If we glance across the
globe, France was the first
country to adopt a uniform
civil code in 1804 under the
Napoleonic Code. Muslim
majority countries, such as,
TurkeyandTunisiaadopted
UCC in 1926 and 1954, re-
spectively. They abolished
Islamic laws and estab-
lishedasecularlegalsystem
to give women equal rights
in matters of marriage, di-
vorce, and inheritance. Ja-
pan adopted a uniform civil
code in 1947 as part of the
country’spost-WorldWarII
reforms. Mexico adopted a
uniform civil code in 1928
as part of the country’s
modernization efforts. In
Britain, Shariat law is ap-
plicable to the extent it does
not contravene the national
law. China has adopted its
firstcivilcodeinMay2020,
with effect from 1st Janu-
ary, 2021. A report of the
Commission on Marriage
and Family Laws in Paki-
stan concluded that “the
question which is likely to
confront Muslim countries
is whether the law of Islam
is capable of evolution – a
question which will require
great intellectual effort and
is sure to be answered in the
affirmative.”
Law Commission’s win-
dow has presented an op-
portunity to start awareness
as to what exactly UCC
entails. While UCC is cer-
tainly a constitutional de-
sideratum, there is an equal
need to acknowledge and
overcome the hindrances in
thisendeavourthroughcon-
sensus. Let us admit that
there is something power-
fully symbolic about UCC,
as Alladi Krishnaswami
Ayyar said in the Constitu-
ent Assembly that it would
weld “competing commu-
nities into a single nation.”

ABOUT THE UCC
IN ABROAD
If we glance across the
globe, France was the first
country to adopt a uniform
civil code in 1804 under
the Napoleonic Code.
Muslim majority countries,
such as, Turkey and Tuni-
sia adopted UCC in 1926
and 1954, respectively.
Mexico adopted a uniform
civil code in 1928 as part
of the country’s moderni-
zation efforts. In Britain,
Shariat law is applicable to
the extent it does not con-
travene the national law.
China has adopted its first
civil code in May 2020, with
effect from Jan 1, 2021.
Law Commission’s window

n a 2013 Kedarnath-like deluge, flash floods
and storms caused mayhem in Himachal
Pradesh washing away people and property.
Mandi, Kullu-Manali, Chamba and other parts of the
state were devastated by torrential rains in Himachal.
Life was thrown out of gear. Bad news for Himachal
is the red alert sounded for Tuesday. Lives were also
crippled in Punjab, Jammu & Kashmir and Delhi
where posh areas were inundated. Precious lives have
been lost to Nature’s fury year after year but we are
unable to find a solution to the problem.
Aparliamentary panel had suggested bringing flood
management in the concurrent list. It also recommend-
ed setting up a permanent institutional structure in the
form of the National Integrated Flood Management
Group. Whether these suggestions would solve the
problem is not known but there’s no harm in imple-
menting the suggestion to avoid destruction. The
usual culprit one points a finger at is climate change
as a warm atmosphere leads to extreme rains.

mitted his government’s resignation over “in-
surmountable” differences with his far-right
allies on migrants. The disagreements arose over
Rutte’s proposal to “tighten restrictions on the reunifi-

of migrants to 200 per month after two years. Two of
Rutte’s alliance partners ---D66 and the Christian Un-
ion---rejected the proposal. Members of Rutte’s Peo-
ple’sPartyforFreedomandDemocracy(VVD)favour
measures to bring down the inflow of refugees.
The Netherlands is not alone. Fear of European
countries losing na-
tional identity and tra-
ditional values is
widespread. This has
resulted in the rise of
the far-right political
parties across Europe.
In Italy, Georgia Mel-
oni has become the
far-right politician to
be elected prime min-
ister. Far-right Swe-
den Democrats’ sup-
porttotherulingparty
in Stockholm is cru-
cial for the govern-
ment’s survival. Ger-
many has been ward-
ing off occasional
threats from neo-Na-
zis and the rise of Ma-
rie Le Pen, a radical
right wing leader,
point to the growing
imprint of far-right
political parties in Eu-
rope. Other countries
thatrequirementionhereareHungaryandPoland.Last
monththetwocountriesvetoedEuropeanUnion’srules
“deploring the loss of life of migrants trying to reach
Europe” and “commitment to fight trafficking”.
These far right parties are not only strongly opposed
to any further influx of refugees but they are also
against the European Common Market and pose a
threat to liberal democracy. Prime Minister Viktor
Obran’s popularity has ensured mainstreaming of the
far-right parties and making Hungary move away from
liberal democracy.

drowned in a pond while
taking bath on Monday
evening in Tonk district.
Nagaur: Two teachers of a private school drowned in a
farm pond in Badu village of Nagaur district on Sunday
evening. The incident occurred in Gachhipura police station
area. Ravi (32), a resident of Bikaner, and Manish (25),
hailing from Hanumangarh district, had gone to take bath in
the farm pond on Sunday during which they drowned. They
were the teachers of Sharda Public School in Badu.
Water entered Kendriya Vidyalaya, Bajaj Nagar, prompting

foiled a robbery attempt
and arrested five miscre-
ants who tried to rob a
jewellery shop in Jaipur.
A sword, two knives, a
plastic rope, a bag of
chilli powder, 11 mobile
phones along with five
bikes and illegal weap-
ons have been recovered
from them.
The miscreants intend-
ed to blindfold the jewel-
lers and other people in
the showroom by throw-
ing chlli powder in their
eyes and making them
hostages. If anyone re-
sisted, they had even
planned to kill them.
However, this could not
happen. Assistant Com-

those arrested have been

crops in the country, add-
ing,“CMYogiAdityanath
is committed to conduct-
ing survey of crops under
Centre’s Agristack
scheme”. “This database
will work like a ‘one-stop
solution’ for the farmers,
where they will be able to
get many facilities such as
solutions to crop-related
issues, govt subsidies and
citation management as
well as access to the larg-
er market. The Agristack
scheme will serve as a
convenient and compre-
hensive solution. In line
with CM Yogi Adity-

‘e-Padtal’ survey in the

vide quality study facilities,
a residential school from
class 1st to 12th will start
soon in Jaipur. CM Ashok Gehlot has given financial
approval of Rs 15.15 crore for the construction of
the school building. An amount of Rs 1 crore will be
spent in this financial year. This amount will be spent
from the Minority Inclusive Development Fund. This
residential school will have a capacity of 200 students.
If there are more than 200 students here, they will be
able to study as day-scholars. Through this school,
free residential facility will be provided to the needy
and talented students of the minority community.

Burnout: Work alone is not life
hen he got the
top job at a new
star hotel, he
was in excellent
spirits but within
one year of this
c h e r i s h e d
achievement his spirit had started
sliding towards an abyss of exhaus-
tion and he began feeling disori-
ented. The pressure of establishing
a fledgling hotel in a highly com-
petitive business environment can
burn out even the most competent
manager. The problem in the mod-
ern work environment is that very
few people understand the phe-
nomenon of burnout hence, it is
never a major consideration in the
hierarchy of the organiza-
tion.
Burnout is
our body's re-
action to in-
tense and usu-
ally chronic stress. Prima facie, is
not a medical condition hence, not
taken seriously but, in many cases,
physical symptoms may start taking
root as secondary consequences
would become dominant. If not de-
tected at an earlier stage, general
health could deteriorate rapidly.
Most researchers focus only on
managerial burnout but other roles
like parenting and caregiving also
burn out people associated with
such tasks.
It is never easy to manage burn-
out as it is not an individual phe-
nomenon but systemic dysfunction.
Toxic, highly ambitious, abusive or
disorganised workplace, singly or
in combination is the commonest
cause that leads to burnout. Igno-
rance or too much bureaucratic ap-
proach of management may also
make the lives of top managers
extremely difficult and exhaustive
as the monotony of the work-
place and people's
struggle to per-
form would al-
ways take its
toll. Sudden,
unexpected
and unprecedented events always
burn out the concerned people. The
most recent example is Covid 19
pandemic where caregivers like
doctors, nurses and all the related
staff underwent excessive stress
and exhaustion. Natural calamities
and major train accidents also burn-
out caregivers and administrators
albeit for a short duration. Simi-
larly, parenting and care of anyone
in the family suffering prolonged
and incurable disease may tire out
the whole family.
The dominant problem in deal-
ing with burnout is a lack of gen-
eral awareness and sensitivity
about its existence. Neither man-
agement nor the sufferer feels the
need for advice. Such behaviour
may lead to resigning from a job or
addiction to drugs or alcohol. Poor
performance may lead to loss of job
and self-esteem which, in turn, may
create financial, emotional and
physical issues and relationship
conflicts. In the absence of profes-
sional support, depression and
anxiety might lead to real bodily
afflictions.This way, many brilliant
people are pushed into miserable
living conditions.
As burnt-out people feel drained,
overwhelmed or powerless, psy-
chotherapy in the form of talk
treatment is, perhaps, the best op-
tion to extricate oneself from this
abysmal situation. Unfortunately,
this form of management is expen-
sive and not easily available. The
modern world is facing a deluge of
information. Information is basi-
cally pollution as it comes not from
within but without. The ma-
jority of information
is sent out to in-
fluence people
for personal
gains to a
l i m i t e d
number of
people. Too much information
blunts the wisdom of society as the
depth of thinking becomes poorly
rooted.
Finally, on a personal level, avoid
conflicting ideological views, hate
and hurry along with argumentative
behaviour patterns. Try to find an
intellectual and philosophical com-
pany in the form of select people or
books. Develop a vibrant hobby
which keeps you close to nature like
outdoor games or gardening. Re-
member, burnout is an individual
phenomenon with individualized
issues, hence, solutions are also per-
sonalized. But being aware and
tackling at an early stage is the best
option for a fruitful outcome.
There are certain indicators
which point out that you are mov-
ing towards the web of burnout so,
beware of these indicators. If you
are a caregiver who has started ex-
periencing compassion fatigue
where sympathy and compassion
for the receiver have gone down
sharply. Similarly, if mental or
physical exhaustion and fa-
tigue have become part of your life
then you are burning yourself out.
The decline in the sense of compe-
tence and achievement is an early
indicator of burnout. Body symp-
toms like headache and muscle
aches, joint pains also indicate
workplace exhaustion. Disturbanc-
es in sleep patterns, sadness and
hopelessness all are to be taken note
of at an early stage. When you start
distrusting your colleagues, it is a
beginning which will ultimately
overburden and exhaust you. Try to
form a team, start trusting people
and train them as per a plan to save
yourself from future burnout. Al-
ways remember that work alone
is not life, it is only a slice, not the
whole pizza.

A free workshop on Kathak was organised for women by Guru Dr

Class 9 students of Jayshree Periwal International School
(JPIS) organised a Cyclothon to raise funds for the SOCH
Educational Society, spreading awareness about autism and
fostering inclusivity recently. The program was coordinated
by school students Ruhbani Singh, Raina Kapoor and Vashisht
Rajgaria. The event was sponsored by Decathlon and Roads
Queen. These sponsors have provided medals, gift hampers,
and bicycles. Speaking on the occasion, Academic Director,
JPIS, Aakriti Periwal, said that the Grade 9 students of JPIS are
deeply committed to making a positive impact on the lives of
individuals with autism.
