n the latest political
scenario in Rajasthan
Congress, now, every-
one in Jaipur and New
Delhi, including Sonia
Gandhi, Ajay Maken, Sachin Pilot
and even Gehlot’s 102 loyalist leg-
islators, are curiously watching
Ashok Ge- hlot’s ‘next move’
on the upcoming cabinet reshuffle
and political appointments.
A ‘seasoned’ State Congress In-
charge Ajay Maken, after his two
days stay in Jaipur on 7th and 8th
July and after having a three hour
long, one-to-one discussion with a
towering Gehlot, has reportedly
furnished his ‘factual assessment’
to party president Sonia Gandhi.
Now, after having a final round of
brief discussions, she is likely to
take the ultimate call on this long
pending issue in the next couple
of days, just after the announce-
ment of Punjab ‘peace formu-
la’ which is at a very critical
stage at this moment.
According to knowl-
edgeable sources, eve-
rything is being dis-
cussed with all the
stake-holders on a
day-to-day basis,
and any day and
any moment, the
date of oath taking
ceremony and
names of new and
outgoing ministers
may be announced,
where Harish
Choudhary may opt
for organizational
services. However,
after repeated fail-
ure of earlier ‘an-
nounced’ dates, now,
New Delhi is not will-
ing to publicly an-
nounce any specific
date for the oath tak-
ing ceremony but
any date at least be-
fore July 17 is com-
pletely ruled out.
After Ajay Maken’s likely visit
to Jaipur on 17-18 July, the final
compromise formula may be ap-
proved by the Congress high com-
mand. In spite of an ‘extra-hope-
ful’ Maken, there still seems to be
some serious ‘road block’ in the
settlement way. According to
sources, CM Gehlot is slightly up-
set with a growing pressure from
high command on him to ‘suitably’
accommodate Pilot camp and put
his stamp on the names and de-
partments of at least 4 Pilot
camp MLAs to be inducted
as ministers (may be 2
cabinet and 2 MoS).
In this context, it is
heard that Gehlot’s
viewpoint is that
there should be
no ‘camps’
(Gehlot or Pi-
lot) in his cab-
inet and the
final choice to
select 4-5 min-
isters out of 19
Pilot camp rebel
MLAs, should be
entirely left to
him. But Pilot
camp is reportedly
insisting for the in-
duction of their
own selected ‘nomi-
nees’ only with speci-
fied departments.
Similarly, Gehlot camp
also wants that Pilot
should not be allowed
to play any active po-
litical role in Rajasthan
through his frequent
tours and he should main-
ly concentrate only on the
affairs of the state which is going
to be allotted to him, once he takes
over the charge of a powerful gen-
eral secretary at AICC in the next
reshuffle.
All said and done...now every-
one awaits a mastermind strate-
gist Gehlot’s ‘amicable solution’ to
this complex issue, which may not
be easy this time.

taken a new turn. The cricketer-
turned-politician used Twitter
to give a peek into his mind.
Whether he will leave the party
or was using the social media
platform to put pressure on the
Gandhis to take a decision in his
favour is still not clear. His tweet
said, “Our opposition AAP has
always recognized my vision 
work for Punjab…” Recall what
Arvind Kejriwal said last month
about AAP’s CM face being a
Sikh and the logical deduction
is that Sidhu could be that face.
If Sidhu quits the Congress to
join AAP
, it will be a second time
that he will be embracing the
Delhi-based party
. In 2016 he left
the BJP to join hands with Kejri-
wal. But Sidhu as CM of Punjab
is hard to visualize.

behaviour. The soccer-crazy
mob did not stop at gate-
crashing and lawlessness but
also took to social media to
racially abuse the three
Black players in the England
team, especially Saka (19), for
missing their penalty kicks.
Prime Minister Boris
Johnson of Britain castigat-
ed those attacking the play-
ers. England team captain
Harry Kane stood by his
team-mates and said, “If you
abuse anyone on social me-
dia you are not an England
fan and we don’t want you.”
Something similar was stat-
ed by RSS chief Mohan Bhag-
wat, though in a different
context of hate. Bhagwat re-
cently said that those who
lynch Muslims or ask them
to leave India are not true
Hindus. Just as racists in the
UK will look at Kane’s re-
marks as a general homily, it
is doubtful if BJP and VHP
foot soldiers will take Bhag-
wat’s words with the serious-
ness they deserve.
In the US the killing of
George Floyd by a white po-
lice officer Derek Chauvin
early this year and of Jacob
Blake in 2020 sparked out-
rage. These instances are
symptomatic of a deeper ma-
laise. The sooner it is cured
the better it will be.

icroblogging is an online
broadcast medium that “al-
lows users to exchange small
elements of content such as
short sentences, individual
images,orvideolinks.”Major
microblogging sites, such as,
Twitter,Facebook,Instagram,
Telegram, Tumblr, Pinterest,
Scoop.it, LinkedIn, Reddit,
Gab,Plurk,oGoing,etc.,popu-
larly known as social media
platforms / networks / inter-
mediaries, have emerged as
thenewmediumof communi-
cation across the globe. While
these social media platforms
areveryempoweringinmany
ways, yet they are fraught
with immense possibilities of
abuse because of their reach.
Supreme Court opined in
2018 that the Indian Govern-
ment may make law to pre-
vent child pornography
, rape
imageries, videos from being
published on content hosting
platforms and other applica-
tions.Anad-hoccommitteeof
the Rajya Sabha submitted its
report on these issues in 2020,
which recommended tracing
the originator of such con-
tents. Against this backdrop,
the Central Government has
enactedtheInformationTech-
nology (Guidelines for Inter-
mediaries and Digital Media
Ethics Code) Rules, 2021 un-
der Sections 69A (2), 79 (2) (c)
and 87 of the Information
Technology Act, 2000. These
rules stress that social media
intermediariesshouldsubject
themselves to domestic laws.
With this legislation, India
has joined other countries
which regulate digital media
and provide a comprehensive
mechanism for the protection
of digital media consumers.
The rules define social media
intermediaries and signifi-
cant social media intermedi-
aries. There are additional
compliance measures for sig-
nificantsocialmediainterme-
diaries because of the large
number of users and the vol-
ume of content they process.
Generally
, the intermediar-
iesadoptapassiveapproachto
the content they host (unlike
book publishers). Since they
,
generally
,donothaveeditorial
controloverthecontent,coun-
tries are encouraged to enact
safe harbour protections
whichofferimmunitytointer-
mediaries from criminal lia-
bility
. In India, safe harbour
provisions are in Section 79 of
the IT Act. In case due dili-
gence is not followed by the
intermediary
, the safe har-
bourprovisionsmaynotapply
to them. These rules have es-
tablished a three-level manda-
tory grievance redressal
mechanism for all social me-
dia platforms in the form of
appointmentof Chief Compli-
ance Officer, a Nodal Contact
Person and a Grievance Of-
ficer to deal with complaints.
The basic objective of these
rulesistoensureonlinesafety
and dignity of users, to estab-
lish the identity of the origi-
natorof themessage/content
and to not host or publish any
information which is prohib-
ited under any law in relation
to the interest of the sover-
eignty and integrity of India,
public order, friendly rela-
tions with foreign countries,
sexually explicit videos, etc.
Critiques against these rules
are:thattheserulesarepreda-
cious; that tracing originator
of contentious messages
breaks encryption protocol;
that users’ right to privacy
may be violated; that they ad-
versely affect free speech; and
most importantly that these
social media intermediaries
are supranational entities fol-
lowing their own policies
which they treat as being su-
perior to domestic laws.
A tussle is currently going
on between Twitter and the
Government of India about
applicationof theserules.Itis
well known that Twitter is a
“chaotic echo chamber” de-
void of verified information.
Social media platforms gener-
ally do not furnish fact-
checked,reliableandaccount-
able information, although
they are bound to act against
‘catfishing,’ hate speech, fake
news and publishers of ob-
scenecontents(justrecallhow
YouTube nonchalantly pub-
lished video of nude Jarawas
tribes of Andaman Islands).
Undoubtedly
, social media
platforms are hugely influen-
tial, but still wish to function
with rights but without re-
sponsibilities. In western de-
mocracies social media plat-
forms were suspected to have
influenced core democratic
processes. ‘Net freedom’ can-
not be allowed to lead to crim-
inality
.Facebookhasacknowl-
edged before the Hon’ble Su-
preme Court in the Delhi riots
case that it removed 22.5 mil-
lion pieces of hate speech in
2020.Theserulesshouldnotbe
seen in isolation. What is hap-
pening in India is part of a
global trend. Content modera-
tion is the need of the hour.
To say that the social me-
dia policies are more impor-
tant to these platforms than
the domestic laws of India is
to directly breach the sover-
eignty of the country. Our
preamble declares India to be
a sovereign republic.
The social media platforms
are basically technology busi-
nesseswhichthriveonbillions
of dollars they generate from
the host countries through
various modes of advertising.
Theirreluctanceinabidingby
the new rules may jeopardise
their safe harbour status, be-
sides losing huge revenues.
Social media companies can-
not be selective about which
country’s laws they will ad-
here to. The profits they earn
have made them ‘digital dons.’
It will be better to impose tax
on their huge profits, besides,
enforcing the new rules, to put
an end to their bullying.

Kabul: As many as 22

were massacred in cold
blood by Taliban fight-
ers in Afghanistan’s
Faryab province. The
soldiers were killed
even after they had
peacefully surrendered.
According to a purport-
ed video retrieved by
CNN, someone can be
heard yelling: “Surren-
der, commandos, sur-
render”. The call is fol-
lowed by nearly two
dozen members of an
Afghan Special Forces
unit coming out of a
building unarmed.
As soon as they are
lined up in the street,
gunfire erupts for barely
5-7 seconds and all the
commandos can be seen

The cold-blooded kill-
ings took place on June
16 in the town of Dawlat
Abad in Faryab prov-
ince, close to Afghani-
stan’s border with

tle to hold the Dawlat
Abad town last month,

New Delhi: The government of Afghanistan
may, at some future point, seek India’s military
assistance if talks with the Taliban fail amid a
withdrawal of US troops from there, the coun-
try’s Ambassador to India has said. He, however,
made it clear that the aid sought would not
involve sending troops but could be in areas like
training and technical support. Representatives
of the Taliban and Afghanistan govt have been
holding talks amid the insurgents’ increasing
control over country even as the US looks to
wind up its 2-decade war there by end of August.
New Delhi: PM Narendra Modi will interact with
Chief Ministers of Tamil Nadu, Andhra Pradesh,
Karnataka, Odisha, Maharashtra and Kerala on
Friday, July 16 at 11 am through video conferenc-
ing on the COVID-19 situation. Meanwhile, the PM
will visit Varanasi on July 15 and inaugurate and

New Delhi: External affairs minister S Jais-
hankar and his Afghan counterpart Haneef
Atmar on Tuesday discussed the latest de-
velopments in Afghanistan against the back-
drop of a violent campaign by the Taliban
to take control of territory. Jaishankar and
Atmar met in Tajikistan capital Dushanbe
on sidelines of a meeting of foreign minis-
ters of Shanghai Cooperation Organisation
(SCO). The two ministers will also partici-
pate in a meeting of the SCO Contact Group
on Afghanistan on Wednesday. Atmar also
held a meeting with his Pakistani counter-

Moscow: The first batch of Sputnik vaccine is expected
to be produced at Serum Institute of India (SII)’s facili-
ties in September, said Russian Direct Investment Fund

New Delhi: India’s 1983 World Cup hero Yashpal
Sharma, who was admired for being a gutsy middle-
order batsman at the peak of his prowess, died on
Tuesday after suffering a massive cardiac arrest. He
was 66 and is survived by his
wife, two daughters and a
son. Sharma collapsed at

railway minister Ash-
wini Vaishnaw to re-
sume the Jaisalmer via
Barmer - Bhabhar (Gu-
jarat) rail link project.
Bishnoi wrote a let-
ter to the newly induct-
ed railway minister
and said it was unfortu-
nate that the Central
government has put on
hold the project, which
is important for people
of the state.

ing of officials of tour-
ism department and
RTDC and discussed
the plan for the leasing
out the RTDC units.
He said that if the
municipality and pan-
chayat samitis want to
operate the RTDC units
under their areas, then
the units can be given
on lease to them.
Some of the unused
properties of the tour-
ism corporation can
also be surrendered to
the state government.
Dotasra said that ef-
forts are being taken to
revive tourism and
leasing out the RTDC
units, which currently
are running in losses,
will give fillip to tour-
ism and will also en-
hance revenue.

Alwar: A horrifying
case of forced abor-
tion after raping a
15-year-old minor of a
widow has come to
light at Kishangarh-
bas of Alwar. The po-
lice have arrested six
persons including
rape accused and the
woman who did the
abortion. The major
role of the police has
been that the victim’s
family was afraid to
file a case. The police
counseled them to file
a case so that culprits
can be punished.
After this, the fam-
ily members lodged a
complaint on Monday
night. The accused
had fled towards Del-
hi from where the po-
lice arrested them.
Police said that the
accused Rakesh and
Gurmit raped the mi-
nor nine times in the
months of March and
May.
Police formed 6
teams to nab the ac-
cused out of which
two teams reached
Delhi. The accused
were hiding in a kachi
basti there.

in the state would be
allowed to recover pend-
ing fees for only one
year. Education minister
Govind Singh Dotasra
said that the department
will soon issue an order
under which the private
schools will be able to
recover fees pending
for only one year. The
private schools will not
be allowed to recover
fees pending for more
than one year. It is worth
noting that during the
pandemic, many families
have not yet deposited the
fees in private schools.

MINOR RAPED REPEATEDLY FOR 6 MTH
Jaipur: A shameful incident came to light where a
17-year-old minor girl was threatened and raped
for the past six months in Jaipur. The victim’s fa-
ther registered the case in the Amer police station.
According to the victim’s father, the accused name
is Vikas Saini, who used to blackmail the minor.The
police officials have registered the case and got the
victim’s medical. The accused is still missing.

kar working in Dubai
fell into the net of the
customs officials on
Monday when they
caught him with gold
worth Rs 68.93 lakh.
The gold, about 1.40
kg, was hidden inside
a mixer-grinder mo-
tor. The passenger was
arrested and is being
interrogated, said
Custom Commission-
er Subhash Agarwal.
He landed here in an
Air India flight from
Dubai late Monday
night. The gold was
polished with silver
colour.
The accused said in
Dubai a person named
Sherni Aabad gave
him the machine say-
ing that someone
would pick it up from
outside the Jaipur air-
port. The person pro-
viding the mixer-
grinder is a resident
of Nagaur and works
in Dubai. Earlier on
July 7, a passenger
reached Sharjah and
gold worth Rs 19.90
lakh was recovered
from him.

three days.
The department has
issued alert for light-
ning strike with heavy
rainfall in 31 districts

Kota and Bikaner.
In an incident that
happened under Sankra
police station of Jais-
almer, Shivdan Singh
died on the spot due to
lightning in Sanavada
village.
About 393 people
were hit by lightning
strike in the state from
2016 to 2021. Last year, a
total of 42 people died in
lightning strikes.

A check list has been

on Tuesday accused police of taking selective action
on assembly of people and demanded from chief
minister to dispose of a case lodged against him and
sanitation workers favourably. He said that nearly
400-500 sanitation workers had assembled outside
the JGMC office to press for their demands but police
did not let them enter into the building. However, after
sometime, a delegation led by him went inside and
talked to officers and later the sanitation workers dis-
persed. He said it was discrimination and demanded
from the CM to direct police officials to dispose the
fabricated case against him and others.

Jaipur: Intensifying protests against the Modi
government on the issues of inflation and fuel prices
hike, Congress on Tuesday held a demonstration
in Jaipur on camel carts. The demonstration was
organised by the Seva Dal, a frontal organisation of

of LPG cylinders and a protest march was also taken
out from Bani park to 22 godown circle while beating

who were injured in a
lightning strike on a hill in
front of Amer in Jaipur on
July 11 were discharged
from SMS hospital on
Tuesday. Two others are
still undergoing treatment
and their condition is im-
proving, doctors treating
them said. SMS Hospital
Superintendent Dr. Rajesh
Sharma said that about
40 patients who were
injured in the incident.
It is unfortunate
that the Centre
has pulled out of

1 month-long mines
safety campaign
begins today in state

mines safety campaign
in the state for one
month from Wednesday
to August 14. ACS Mines
and Petroleum Dr Sub-
odh Agrawal said that
the provisions of Con-
sent to Operate and En-
vironment Clearance

Department for mining
lease and quarry li-
cence areas, safety pro-
visions issued for pro-
tection of environment
and health of miners
would be ensured.
In case of non-compli-
ance of safety stand-
ards, necessary action
can be taken by shutting

ties. He also said that

Act, it is necessary to
have drinking water
system, toilets, medical
equipment etc keeping

New Delhi: More than
1.91 crore COVID-19
vaccine doses are still
available with the
states, Union Territo-
ries and private hospi-
tals to be administered,
the Union Health Min-
istry said on Tuesday
.
Over 39.46 crore vac-
cine doses have been
provided to states and
Union Territories so far
through all sources and
12,00,000 more doses are
in the pipeline. Of this,
the total consumption,
including the wastage,
is 37,55,38,390 doses, ac-
cording to the sources.
More than 1.91 crore
COVID-19 vaccine doses
are still available with
the states, Union Terri-
tories and private hos-
pitals to be adminis-
tered, the ministry said.

TWO TEENAGERS DROWN WHILE
TAKING BATH IN A WATER-FILLED PIT
Jaisalmer: The heavy rains in the Jaisalmer
district late on Monday night have resulted in
accidents happening in the water-filled areas in
many places. Two teenagers who had gone to
bath in a pit filled with water drowned near Hadda
village, 25 km from the district headquarter. On
getting information about the incident, both the
teenagers were brought to the hospital where they
were declared dead. According to the information,
the potholes were filled with water due to rain on
Monday night in Chahdu village on Kaledungarji
mandir road. In these pits, two teenagers of the
village Chandan Ram, 14, and Umesh, 10, went
to take a bath. They did not know how to swim
and never anticipated that the water would be
so deep. While taking bath, they went into deep
water and drowned.

as the government lift-
ed ban on transfers
from July 14 till August
14. For this, online ap-
plications have been

of the Department of
Administrative Re-
forms.

teachers, are still wait-
ing for the removal of
the ban from the Direc-
torate of Education.
Representatives of
teachers union also met
Education Minister Go-

manding removal of
the ban on transfer of
grade 3 and grade 2
teachers. To this, Do-
tasra said that the
transfers are being
done on policy. Howev-
er, he indicated that
this time only a limited
number of transfers
would be made in the

en only where the posts
are lying vacant. Policy
for grade 3 teachers is

Jaipur: A vaccination
camp was held at the
RHB Headquarters in
Jaipurfortheemployees
of Rajasthan Housing
Board, wherein, about
300 RHB personnel got
vaccinated on Tuesday
.
This was the third vac-
cinationcamporganised
by the Board. RHB Com-
missioner Pawan Arora
said that the vaccine
must be administered to
prevent the corona pan-
demic. The third vacci-
nation camp was organ-
ised by the Board with
an aim to ensure 100%
vaccination of the staff
 their families.
Vaccination camps
have already been or-
ganised at the youth
hostel on April 7 and on
May 17 and 18 at the
Youth Hostel and the
Divisional Headquar-
ters. So far, 1,255 per-
sonnel and their family
members have got
jabbed during the
camps organised by the
RHB. In the first phase
255 personnel got vac-
cinated and in the sec-
ond phase, 700 people
including the person-
nel got the vaccination.
Like last year, this
year also the Board dis-
tributed 1 lakh face
masks free of cost. Aro-
rafurthersaidthatRHB
is the first organisation,
which ensured that all
the employees and their
families from 18 to 60
years of age were vac-
cinated. He said the per-
sonnel were worried
aboutthevaccine,sothe
Board decided to get
them vaccinated
through a special vacci-
nation drive. Refresh-
ments were also served
to all after vaccination.
RHB Commissioner,
Pawan Arora also fe-
licitated the staff of the
medical department,
who administered vac-
cines to all by giving
them gifts. He also sug-
gested the employees to
follow the Corona
guidelines even after
being vaccinated.

ed by sportsmen, who

ia’s husband, Viren-
dra Poonia to the post.
It is alleged that the
State Government
had created the new
post of Chief Sports
Officer (Coaching) in
the Sports Council for
Virendra Poonia,
husband of Krishna
Poonia, who was ear-
lier employed in In-
dian Railways and
remained absent from
duty without infor-
mation.
The Rajasthan Ar-
juna Awardee Asso-
ciation has written
a letter to Chief Min-
ister Ashok Gehlot
demanding a high-
level inquiry into the
matter.
The interview for
this post will be held
on Wednesday.
Although 9 candi-
dates have been called
to depict transparen-
cy in the selection
process, the sport-
spersons allege that
the selection of Viren-
dra Poonia is already
decided.

in Kota.
Birla, while congrat-
ulating Scindia for his
new responsibility, said
that many small cities
of the country have
now been connected by
air service under the
'UDAN' scheme. He fur-
ther expressed hope
that under the leader-
ship of Scindia, the fa-
cility of air service will
be expanded rapidly

During the meeting,
the two leaders also dis-
cussed about the new
Greenfield Airport in
Kota. Scindia assured
Birla that the construc-
tion of the airport in
Kota would be his prior-
ity. He will soon hold a
special meeting with
the officials of the min-
istry for this. The Ra-
jasthan government
will also be asked to un-
conditionally transfer
the land earmarked for
the new airport to the
Airports Authority of
India.
Scindia said that it
will be his endeavour to
build the best airport
with modern facilities
in Kota that will accel-
erate the progress of
the education city. He
also thanked Lok Sabha
Speaker Birla for his
guidance.

Nagar said, “150 seats
of Congress were
claimed against the
BJP government, but
were reduced merely to
99. Now, those who are
claiming to form the
government by working
hard, should tell why
the seats were reduced?
Who gave tickets to
those, who lost their de-
posits by denying the
tickets to those who
won. Such leaders
should apologise to the
High Command who
left the Congress by
bringing the number of
seats to 99 instead of
150,” he took a jibe with-
out naming any leader.

cided to join Congress
after witnessing his
zeal towards the party.
There is no leader
equivalent to Gehlot in

BANSWARA
Known as ‘the City of Hundred
Islands’, Banswara is a mystical
paradise during the monsoons.

ocks make it so breathtakingly
beautiful that you’ll forget you
are in the desert state of Ra-
jasthan. The popular lakes of
Banswara consist of the lotus-
covered Diablab lake and the
Anand Sagar. The lake’s vicinity
is dotted with cenotaphs that are
a good place to unwind and relax

nial Mahi river that flows
through the town starts to gush

RAJENG/2019/77764 l Vol 3 l Issue No. 38 CABINET RESHUFFLE & POLITICAL APPOINTMENTS NOW, EVERYONE LOOKS UP TO GEHLOT Aditi Nagar n the latest political scenario in Rajasthan Congress, now, every- one in Jaipur and New Delhi, including Sonia Gandhi, Ajay Maken, Sachin Pilot and even Gehlot’s 102 loyalist leg- islators, are curiously watching Ashok Ge- hlot’s ‘next move’ on the upcoming cabinet reshuffle and political appointments. A ‘seasoned’ State Congress In- charge Ajay Maken, after his two days stay in Jaipur on 7th and 8th July and after having a three hour long, one-to-one discussion with a towering Gehlot, has reportedly furnished his ‘factual assessment’ to party president Sonia Gandhi. Now, after having a final round of brief discussions, she is likely to take the ultimate call on this long pending issue in the next couple of days, just after the announce- ment of Punjab ‘peace formu- la’ which is at a very critical stage at this moment. According to knowl- edgeable sources, eve- rything is being dis- cussed with all the stake-holders on a day-to-day basis, and any day and any moment, the date of oath taking ceremony and names of new and outgoing ministers may be announced, where Harish Choudhary may opt for organizational services. However, after repeated fail- ure of earlier ‘an- nounced’ dates, now, New Delhi is not will- ing to publicly an- nounce any specific date for the oath tak- ing ceremony but any date at least be- fore July 17 is com- pletely ruled out. After Ajay Maken’s likely visit to Jaipur on 17-18 July, the final compromise formula may be ap- proved by the Congress high com- mand. In spite of an ‘extra-hope- ful’ Maken, there still seems to be some serious ‘road block’ in the settlement way. According to sources, CM Gehlot is slightly up- set with a growing pressure from high command on him to ‘suitably’ accommodate Pilot camp and put his stamp on the names and de- partments of at least 4 Pilot camp MLAs to be inducted as ministers (may be 2 cabinet and 2 MoS). In this context, it is heard that Gehlot’s viewpoint is that there should be no ‘camps’ (Gehlot or Pi- lot) in his cab- inet and the final choice to select 4-5 min- isters out of 19 Pilot camp rebel MLAs, should be entirely left to him. But Pilot camp is reportedly insisting for the in- duction of their own selected ‘nomi- nees’ only with speci- fied departments. Similarly, Gehlot camp also wants that Pilot should not be allowed to play any active po- litical role in Rajasthan through his frequent tours and he should main- ly concentrate only on the affairs of the state which is going to be allotted to him, once he takes over the charge of a powerful gen- eral secretary at AICC in the next reshuffle. All said and done...now every- one awaits a mastermind strate- gist Gehlot’s ‘amicable solution’ to this complex issue, which may not be easy this time. While these social media platforms areveryempoweringinmany ways, yet they are fraught with immense possibilities of abuse because of their reach. Supreme Court opined in 2018 that the Indian Govern- ment may make law to pre- vent child pornography , rape imageries, videos from being published on content hosting platforms and other applica- tions.Anad-hoccommitteeof the Rajya Sabha submitted its report on these issues in 2020, which recommended tracing the originator of such con- tents. Against this backdrop, the Central Government has enactedtheInformationTech- nology (Guidelines for Inter- mediaries and Digital Media Ethics Code) Rules, 2021 un- der Sections 69A (2), 79 (2) (c) and 87 of the Information Technology Act, 2000. These rules stress that social media intermediariesshouldsubject themselves to domestic laws. With this legislation, India has joined other countries which regulate digital media and provide a comprehensive mechanism for the protection of digital media consumers. The rules define social media intermediaries and signifi- cant social media intermedi- aries. There are additional compliance measures for sig- nificantsocialmediainterme- diaries because of the large number of users and the vol- ume of content they process. Generally , the intermediar- iesadoptapassiveapproachto the content they host (unlike book publishers). Since they , generally ,donothaveeditorial controloverthecontent,coun- tries are encouraged to enact safe harbour protections whichofferimmunitytointer- mediaries from criminal lia- bility . In India, safe harbour provisions are in Section 79 of the IT Act. In case due dili- gence is not followed by the intermediary , the safe har- bourprovisionsmaynotapply to them. These rules have es- tablished a three-level manda- tory grievance redressal mechanism for all social me- dia platforms in the form of appointmentof Chief Compli- ance Officer, a Nodal Contact Person and a Grievance Of- ficer to deal with complaints. The basic objective of these rulesistoensureonlinesafety and dignity of users, to estab- lish the identity of the origi- natorof themessage/content and to not host or publish any information which is prohib- ited under any law in relation to the interest of the sover- eignty and integrity of India, public order, friendly rela- tions with foreign countries, sexually explicit videos, etc. Critiques against these rules are:thattheserulesarepreda- cious; that tracing originator of contentious messages breaks encryption protocol; that users’ right to privacy may be violated; that they ad- versely affect free speech; and most importantly that these social media intermediaries are supranational entities fol- lowing their own policies which they treat as being su- perior to domestic laws. A tussle is currently going on between Twitter and the Government of India about applicationof theserules.Itis well known that Twitter is a “chaotic echo chamber” de- void of verified information. Social media platforms gener- ally do not furnish fact- checked,reliableandaccount- able information, although they are bound to act against ‘catfishing,’ hate speech, fake news and publishers of ob- scenecontents(justrecallhow YouTube nonchalantly pub- lished video of nude Jarawas tribes of Andaman Islands). Undoubtedly , social media platforms are hugely influen- tial, but still wish to function with rights but without re- sponsibilities. In western de- mocracies social media plat- forms were suspected to have influenced core democratic processes. ‘Net freedom’ can- not be allowed to lead to crim- inality .Facebookhasacknowl- edged before the Hon’ble Su- preme Court in the Delhi riots case that it removed 22.5 mil- lion pieces of hate speech in 2020.Theserulesshouldnotbe seen in isolation. What is hap- pening in India is part of a global trend. Content modera- tion is the need of the hour. In Churu, two bikers Ashok Singh, 26, and Rohitash, 25, were killed on mega highway near Bhanipura village after a collision with a roadways bus. They were driving from village Jaitsisar to Sardarshahar. The accident happened due to bus driver’s reckless driving, in which the victims were injured seriously and died.
