nder a Narendra Modi-
Amit Shah mandate, a
new collective leader-
ship of Shinde and Fad-
navis has taken over the
reins of Maharashtra,
the state that is home to
India’s commercial capital of Mum-
bai, on June 30. In fact, it was a mo-
ment of some sort of a mental humil-
iation for the top Maharashtra man—
Fadnavis--because of an eleventh-
hour U-turn by New Delhi. At face
value, this new team looks to be a
“united front” but insiders are not
confident of smooth sailing in the
long run. One major reason is that
the “remote control” of this gov-
ernment will likely remain in the
hands of Fadnavis, with a discreet
understanding with the central
agencies that Fadnavis’s position
will be unmatchable.
Fadnavis will likely emerge as the
only “gainer” in the long run. Accord-
ing to sources in the larger scheme of
things, Fadnavis may be asked to re-
tain the charge of home portfolio.
Political observers added that the
the higher IAS and IPS echelons will
be also more in tune and comfortable
with an experienced and dignified
Fadnavis because of his earlier stint
as CM. Now, as things stand the
Un-Common Man CM Eknath
Shinde has joined with Maha BJP
Chanakya Devendra Fadnavis for
a Double-Engine Sarkar.

The earlier protests in
several states were sparked
by the BJP spokesperson
Nupur Sharma’s irrespon-
sible remark on Prophet
Mohammed. The outrage
culminated in the brutal
murder of a tailor in
Udaipur. Another murder,
of a chemist in Aurang-
abad, is also being attrib-
uted to the remark on the
Prophet. Both the cases are
being investigated by the
National Investigation
Agency. Nupur Sharma
was chastised by the Su-
preme Court when she ap-
proached it for clubbing
FIRs lodged against her in
different cities. Her re-
quest was declined.
Some people take hurt-
ing religious sentiments
quite casually in the name
of freedom of expression.
That is what has happened
in the case of “Kaali”, “a
performance documenta-
ry” by Leena Manimekalai.
Incidentally
, the entire pro-
duction team comprises
Hindus. Leena, who has
also acted in and directed
the film, posted a tweet say-
ing,“Superthrilledtoshare
the launch of my recent
film---today at @Aga Khan
Museum…Feeling pumped
up with my CREW…” So
far protests are confined to
social media but it may not
be long before they spill on
to streets. There’s a chorus
for Leena’s arrest and a
complaint has been filed
with the Delhi Police and
the Home Ministry for
hurting religious senti-
ments.
Leena is reported to have
said that “this Kaali talks
about choosing love instead
of hate in the midst of so
many racial differences”.

BANKS LOSING THE
FIGHT AGAINST FRAUDS?
years back in a bankers’
summit organized in a
Mumbai 5-star hotel, a vet-
eran banker shared a joke
with a small gathering of
journalists. A reporter
askedhimaboutthemount-
ing corporate defaults to
whichheanswered,“If you
owe the bank Rs. 1 lakh,
that’s your problem but if
you owe the bank Rs. 100
crore, it’s the bank’s prob-
lem.” The joke although
long forgotten still holds. It
pointed toward the lapses
in the Indian banking sys-
tem and a sinkhole of de-
faulted loans that it has
managed to create.
It has been three dec-
ades since the Harshad
Mehta securities scam
was unearthed in 1992 but
serious lapses in banking
operations still exist. The
scam exposed the gaping
loopholes in the country’s
stock markets and the
banking system. Harshad
Mehta manipulated the
stock prices by illegally
obtaining funds from the
banks using fake bank re-
ceipts and diverting them
to the stock market. He
created a vicious cycle of
fraud with some of the
leading banks in those
times like SBI and Nation-
al Housing Bank.
Thankfully, the scam
resulted in sweeping
changes in the securities
market. Stricter laws were
introduced and the pow-
ers of SEBI were widened.
However, amendments in
the banking laws have not
been sufficient and are
still exploited by wealthy
corporates.
Several corporates in
the past few years have
“wilfully” defaulted on
thousands of crores worth
of loans from banks and
have simply fled the coun-
try to never come back. All
attempts at extradition
have failed, leaving very
little hope that the money
will ever be recovered.
Wilful defaulters are
those who can pay back
the borrowed money to
the banks but do not do so
willingly. They have the
money and muscle to fight
arduous legal battles that
carry on for years.
BIGGEST SCAMS IN
LAST DECADE
The latest Dewan Housing
Finance Limited (DHFL)
scam defrauded a consor-
tium of 17 banks worth Rs.
34,000 crore is the biggest
banking fraud India has
ever seen. Only ABG Ship-
yard comes close with a
fraud case of about Rs.
20,000 crore, reported only
afewmonthsback.Thelist
however doesn’t end here.
From diamond trader
Nirav Modi and his uncle
Mehul Choksi’s Rs. 14,000
crore scam, The Sande-
saras of Sterling Biotech’s
Rs. 15,000 cr scam, another
diamantaire Jatin Mehta’s
Rs. 10,000 cr fraud to Vijay
Mallya’s Rs. 9,900 crore
scam,thelistof consseems
endless.
All these and many
more such cases simply
bring forth the systemic
faults and vulnerabilities
in our banking processes.
Lack of regulation, flawed
lending policies, and an
inadequate fraud moni-
toring mechanism are
among the many reasons
for the rise in fraud cases
in the country leading to
mounting non-perform-
ing assets (NPA).
The push toward digiti-
zation and financial inclu-
sion during the pandemic
significantly changed the
way the industry operates.
It has however brought
along with it, its own set
of problems of data theft
and cyber-crimes.
Even though RBI and
the government have tak-
en coherent steps to ad-
dress these pain points
and plug the loopholes,
they are not enough.

IN THE ROOM
Numbers up, value down:
As per RBI’s annual report
for FY 2021-22, total num-
ber of frauds reported in
FY 2022 was up 23% from
last year but the total
amount of fraud cases in
value terms reduced to
half from Rs 1.4 trillion in
FY 2021 to Rs 60,000 crore
in FY 2022. There isn’t
much to cheer about coz
the DHFL case forms more
than half of the total fraud
amount of last year! FYI,
RBI data considers frauds
of Rs1lakhandaboveonly
.
PSUs: The weakest link
– If one were to assess the
frauddataforthelastthree
years, private sector banks
reported the maximum
number of frauds while in
value terms public sector
banks’ contribution was
more,aspertheRBIreport.
Advances to be moni-
tored: The nature of
frauds reported by private
sector banks were mainly
on account of small value
card/internet frauds,
while those for public sec-
tor banks were mainly in
the loan portfolio. Advanc-
esformedthemajorchunk
of all the fraud in value
terms (97% of all frauds)
while cards/ internet con-
tributed to just 0.2% of all
frauds in value terms.
Time Lag: There is a sig-
nificant time lag between
the date of occurrence of
fraud and its detection.
94% of all frauds detected
last year occurred in pre-
vious fiscal years.

Risk is an inherent aspect
of banking and needs to be
dealt with. Frauds are on
the rise and are expected
to rise further especially
in the current adverse
business environment.

a new pandora’s box if not
addressed early

While banks have been making
investments to strengthen their
fraud risk management
framework and monitoring
systems, they have not been
sufficient, it’s a no-brainer.
Every red flag and an early
warning signal is important
and should be identified and
closely monitored. Banks need
an Independent fraud risk
management department that
can avoid delays in decision-
making, especially in large
value frauds. After all, most of
the scams take place with help
from bank staff. All in all, the
current state reminds us of the
line quoted in the Harshad
Mehta web series: “Bohot
Kuch badla, lekin Phir bhi,
Kuch nahi badla”
It has been three decades since the Harshad Mehta

gopal. He is 91 years old

sponsibility for more
than two years. He was
appointed as the coun-
try’s highest legal offic-
er - the Attorney Gen-
eral - by the Central
Government in 2017.
Whenhistermendedin
2020, he had expressed
his desire to retire. On
the insistence of the
central government, he
had said that he could
take a service exten-
sion, that is, in 2021, he
hadtoretireatanycost.
But in 2021 also he got
extension of service
and now in 2022 also he
is to be given extension
for one year. Think, af-
ter coming to power at
the Center, the Naren-
dra Modi government
made Mukul Rohatgi as
Attorney General in
2014, who retired in

jay Pandey, who has
been summoned by the
Enforcement Directo-
rate on Thursday morn-
ing, is likely to face
strong action.
Those familiar with
the issue say iSec Ser-
vices Pvt. Ltd--the IT
firm company Pandey
founded in 2001 when he
had quit the IPS in frus-
tration after being re-
peatedly sidelined by
the political establish-
ment--was one of those
auditing NSE servers
between 2010 and 2015
but failed to point out
the breach.
“iSec officials were
aware of the breach of
the NSE servers, but did
not raise any red flags,”
a person close to the in-
vestigating agencies
told First India. Pandey,
however, has refused to
comment on the allega-
tions.
The 1986-batch IPS of-
ficer suddenly found fa-
vour with the political
class when a series of
sensational cases dent-
ed the image of the
Mumbai police. These
include the TRP scam
that led to anchor Arnab
Goswami’s arrest, the
Antilia case that ex-
posed the role of police
officer Sachin Vaze and
finally the Rs100 crore
corruption allegations

tion: that Niccon bought
66,110 sq.m and paid for

Taking the heckling
in stride, the senior
Bharatiya Janata Party
leader said, “It is true
the new government is
formed by ED, which

Devendra.”
Fadnavis claimed
that Maharashtra wit-
nessed a “deficit of
leadership availabili-
ty” in the last few
years—pointing fingers
at Uddhav Thackeray,
without naming the for-
mer chief minister.
“But, there are two
leaders in the House

available for people,”

Bharatiya Janata Party
(BJP) and the Shiv Sena
had parted ways after
the results of 2019 state
Assembly polls were an-
nounced over the issue

Vikas Aghadi (MVA)

Pune: All electric me-
ter-reading agencies
have come under the
scanner of the Maha-
rashtra State Elec-
tricity Distribution
Company Ltd (MSED-
CL) following com-
plaints of widespread
discrepancies.
MSEDCL has termi-
nated services of five
private agencies tasked
with recording read-
ings of consumer me-
ters.
“Three agencies are
from Solapur district,
while two are from
Pune district,” an
MSEDCL spokesperson
told media on Monday.
Five agencies have been
found negligent in tak-
ing meter readings.
“In the last two
months, it was noticed
that these private agen-
cies have made no im-
provement in meter
readings. Despite me-
ters being in a good
state, they have given
adverse remarks and
recorded wrong aver-
age meter readings,”
the spokesperson said.
In Western Maha-
rashtra, the MSEDCL
has hired as many as
110 private agencies
that have appointed
their own manpower
for recording meter
readings at the resi-
dences of consumers.

Mumbai: The Bom-
bay High Court on
Monday pulled up the
Brihanmumbai Mu-
nicipal Corporation
(BMC) for not crack-
ing down on illegal
nursing homes in the
city.
A bench comprising
Justice Anil K Menon
and Justice Makarand
S Karnik posed the
question to the civic
body
, after taking cogni-
zance of an inspection
conducted by the civic
body in December last
year. The outcome of
the on-ground review
showed that of 1,574
clinics or private hospi-
tals, only 687 had com-
plied with fire safety
and other norms.
The justices were
hearing a public inter-
est litigation (PIL) filed
by Shakeel Shaik
through his counsel, ad-
vocate Mohammed Zain
Khan.
The plea highlighted
an incident from 2019,
where an unauthorized
health camp organized
in the city had resulted
in the accidental death
of a three-ye ar-old. Ac-
cording to Shaik, the
gathering had been
held without due dili-
gence of meeting requi-
site fire norms.
Senior counsel
Milind Sathe, who ap-
peared on behalf of the
BMC, told the court that
it had taken action
against unlawful nurs-
ing homes, but was of-
ten unable to close them
due to patients admit-
ted there.
“We cannot under-
stand how the BMC is
so powerless that it can-
not stop an illegal nurs-
ing home from func-
tioning, just because of
10 people there? If such
nursing homes do not
have fire safety and yet,
there are people in
them, it is a disaster
waiting to happen,”
said the bench.
The High court asked
the civic body to file an
additional affidavit de-
tailing how many clin-
ics or nursing homes
continued to operate in
the city without requi-
site licenses and, or, fire
safety norms.
The HC further di-
rected BMC and the city
fire department to file
their respective affida-
vits within three weeks.

Latur: Police seized twelve stolen motorcycles
worth Rs7.20 lakh from a man in Udgir town of
Latur district. Netaji Narayan Ghodke (39), a resi-
dent of Nanded, was held by police on Sunday after
receiving a tip off that he was selling motorcycles at
low cost at some spots along the Karnataka border,
said Udgir rural police station Inspector Deepakku-
mar Waghmare. We have initiated further investiga-
tion into Ghodke’s activities, he added.
Thane: Seven people were stuck in an elevator
of a seven-storey building that houses the police
residential quarters in Thane city on Monday. Ac-
cording to a civic official, local firefighters rushed
to the spot and rescued them, after being alerted.
The elevator got stuck on the second floor of the
building, informed Avinash Sawant, Thane Munici-
pal Corporation’s Regional Disaster Management
cell chief.
Mumbai: The youth wing of MNS has asked Navi
Mumbai Municipal Corporation (NMMC) to re-
examine all fitness-related documents of school
buses to prevent any untoward incidents. Sand-

hisarstated: “Dear par-
ent, this is to notify that
chickenpox is on the
rise in children. If your
child develops any
symptoms of chicken-
pox, you should notify
the school. Do not allow
your child to attend
school until all of the
blisters become crusted
or no lesions appear, as
it may spread to other
children.”
“ Last month we had
five students from jun-
ior kindergarten and
Class I with symptoms
and blisters on their
body. Two of them
turned out to be chick-
enpox. We have asked
the parents to closely
watch out for symptoms
and not send kids to
school to prevent fur-
ther spread of the dis-
ease,” said the principal
of a school in Andheri.
Dr Vishal Parmar,
consultant paediatri-
cian, Wockhardt Hospi-
tal, Mira Road, said,
“Nowadays there is
slight rise in chicken-
pox cases. We see 4 to 6
cases in a week. The
reason may be missing

renaming of a metro
station from Pathan-
wadi to Dindoshi,
within two weeks.
Filed by a social or-
ganization, Naee Rosh-
ni, through advocate
Sahood Anwar Naqvi,
the PIL challenged the
Mumbai Metropolitan
Region Development
Authority (MMRDA)’s
July 18, 2019 order to
revise the station
names on lines 2A and
7 of the Mumbai Met-
ro.
According to the or-
ganization, the re-
christening was in
“sheer violation of
policy framed by
MMRDA”.
It also alleged that
the name change was
ordered due to political
pressure from two
MLAs namely Atul
Bhatkhalkar and Sunil
Prabhu. “This was
done despite Right to
Information (RTI) re-
plies stating that Din-
doshi is a revenue vil-
lage and not the near-
est wadi,” stated the
organization. It fur-
ther said that the re-
naming was “arbi-
trary”, had affected the
sentiments of Pathan-
wadi residents and
was against their con-
stitutional rights.
On June 09, the court
had directed Naee
Roshni to deposit Rs1

The HC asked the BMC what it did about the patients who are undergoing treat-
ment in such nursing homes. “We expect that the least you can do is to shift
them to another facility. Can you say so in an affidavit? Also, how difficult is it to
know who is behind it? You have conducted COVID-19 treatment in many of these
unauthorized clinics, so you should know who is behind them,” said the bench.

towards sensitizing the
youth and introduction
of a mandatory course
on caste sensitization.

is yet to be designed and

juniors of the SC/ST
communities and make
sure that there is no
caste-based distinction

CAR ON MUMBAI-A’BAD HIGHWAY
Pune: Three persons, including a six-month-old
child, were killed after being hit by a truck in Piran-
gut area on the outskirts of Pune on Sunday. As per
primary investigation, the brakes of the truck failed,
which led to the accident near Lavale intersection,
said police. “Due to brake failure, the truck first hit
a motorcycle of one Pawan Patel, due to which his
wife and six-month-old child died. It later dashed
another motorcycle of one Tanaji Dhamale, who
was also killed in the accident,” said a cop.
Thane: The body of an unidentified man was found
in a car parked on a roadside on the Mumbai-
Ahmedabad highway near Maharashtra, said police
officials on Monday. A police team patrolling the
area on Sunday evening spotted the car in Sha-
hapur area. On checking the car, they found the
body of a man, aged 35 to 40 years, with a head
injury, lying inside the vehicle, confirmed an official
from Shahapur police station. The body was later
sent for a post-mortem examination.

New Delhi: The Delhi High Court on Monday adjourned the
hearing on the bail plea of Umar Khalid in the larger conspir-
acy of North East Delhi violence due to the non-availability
of his counsel. His counsel senior advocate Trideep Pais has
contracted COVID-19. In April, Khalid challenged the denial
of bail in a larger conspiracy of North East Delhi riots 2020.
The division bench headed by Justice Siddharth Mridul
adjourned the hearing for two weeks. Now the matter will be
heard on July 27. This matter was to be heard at 2.15 pm
today. Karkardooma Court had denied bail to former JNU

GST slab of 28% for
luxury and sin goods,
but is open to discuss
narrowing down the
three slabs of 5, 12 and
18% into two, Revenue
Secretary Tarun Bajaj
said on Monday
.
Addressing the in-
dustry leaders, Bajaj
said the rate rationali-
sation exercise of the
GST Council is a result
of introspection of
GST, five years after its
rollout, and the policy-
makers do not have a
“fetish” to raise the tax
rates to the revenue-
neutral level of 15.5%.
On the industry de-
mand for bringing pe-
troleum products un-
der GST net, he said
since fuel constitutes a
larger part of their rev-
enues, both the Centre
and states have some
apprehension. “We will
have to wait for some
time.”
“Of the 5, 12, 18 and
28%, we would have to
continue with 28% be-
cause in a developing
economy, in an econo-
my with so much of
income disparity, there
would be some luxury
and sin items that
would and should at-
tract a higher rate of
taxation.
“But, whether on 5,
12 and 18 (%), we can
bring down to 2 rates to
start with and then see
how the country grows
and whether there is a
capacity to bring it to
one rate or not is some-
thing to be seen. It is a
very difficult chal-
lenge,” Bajaj said at an
Assocham event.
Under the GST, a
four-rate structure that
exempts or imposes a
low rate of tax of 5 per
cent on essential items
and a top rate of 28%
on cars is levied. The
other slabs of tax are 12
and 18%.
Besides, there is a
special 3% rate for
gold, jewellery and pre-
cious stones and 1.5%
on cut and polished dia-
monds.
Also, a cess is levied
on the highest tax slab
of 28% on luxury, sin
and demerit goods. The
collection from the cess
goes to a separate cor-
pus—Compensation
fund — which is used to
make up for revenue
loss suffered by the
state due to the GST
rollout.
The GST Council has
set up a GoM, under
Karnataka Chief Min-
ister Basavaraj Bom-
mai, to suggest ration-
alisation in tax rates,
merging of slabs, re-
viewing the exempt list
and correcting duty
inversion in cases
where taxes on final
output in lower than
that in inputs. The
GoM has been given
3-month more time to
submit a final report.

been ranked as the best
performers in develop-
ing startup ecosystem
for budding entrepre-
neurs, according to the
ranking of states and
Union territories by the
department for promo-
tion of industry and in-
ternal trade (DPIIT).
Among smaller states
having population of
less than one crore,
Meghalaya has been ad-
judged as the best per-
former.The rankings
are based on the initia-
tives taken to develop
the startup ecosystem
for promoting budding
entrepreneurs.
For the third time in
a row, Gujarat was
ranked as the best per-
former.
The exercise is aimed
at supporting states and
Union territories (UTs)
in developing their
startup ecosystem and
learning from each oth-
er’s best practices.
A total of 24 states
and 7 UTs participated
in the exercise, which
ranked them under five
categories -- best per-
formers, top perform-
ers, leaders, aspiring
leaders and emerging
startup ecosystems.
The states and UTs
were also ranked under
these five categories
based on the population
of less than one crore.
Kerala, Maharashtra,
Odisha, Telangana and
Jammu and Kashmir
were categorised as the
top performers.
Punjab, Tamil Nadu,
Uttarakhand, UP, Anda-
man and Nicobar Is-
lands, Arunachal
Pradesh, and Goa are in
the leaders category
.
States and UTs in the
aspiring leaders’ cate-
gory include Chhattis-

Govt to review oil export,
windfall tax every fortnight
New Delhi (PTI): The
government will re-
view the just intro-
duced windfall tax on
domestically produced
crude oil and fuel ex-
ports every two weeks
based on foreign cur-
rency rates and inter-
national oil prices, but
no levels have been
fixed for its recall, top
officials said on Mon-
day
. Revenue Secretary
Tarun Bajaj said the
$40 per barrel level of
oil prices being talked
about for a rollback of
the levy is unrealistic,
considering the inter-
national oil rates cur-
rently. The review is
based on the premise
that if crude prices
fall, then windfall
gains will cease and
new taxes would be
rollback.
“There is a way we
will monitor it every 2
weeks, depending on
the foreign currency
rates and depending
on where the interna-
tional prices are,” Ba-
jaj said.
“What is the dollar
to rupee, the interna-
tional price of diesel,
crude, what is the do-
mestic cost of crude,
will keep reviewing it.
You can decipher it
yourself once we re-
view it.”
Govt committed to

PACS may be allowed to
sell petroleum products
New Delhi (PTI): The
Centre has proposed to
allow primary agricul-
ture credit societies
(PACS) to undertake ac-
tivities like dealership
of petroleum products,
running PDS shops,
and developing hospital
and educational institu-
tions, in addition to
their regular functions.
In this regard, the
Ministry of Coopera-
tion has floated a draft
‘Model By-laws of
PACS’ on which it has
invited suggestions
from the state govern-
ments and other stake-
holders by July 19.
The draft model by-
laws propose that PACS
should be allowed to
work as Bank Mitras
and common service
centres, provide cold
storage and godown fa-
cilities, set up PDS
shops besides enabling
them to work in dairy,
fishery, irrigation and
green energy sectors.

Office leasing jumps over
2.5 fold in April-June
New Delhi (PTI):

space jumped over 2.5
fold annually in April-
June across six major

The demand for
housing as well as of-
fice was badly impact-
ed during April-June
quarter of last year
because of the strong

COVID pandemic.
During January-
June 2022, Colliers
said the gross leasing
of office space jumped
more than 2.5 times to
27.5 million square
feet across six cities,
from 10.3 million
square feet in the cor-
responding period of
the previous year.

Plastic (SUP) items that kicked in from Friday. Since
June 30, shares of Seshasayee Paper and Boards

matically or by de-
fault in food bills and
allowed customers to
file complaints in
case of violation.
Amid rising com-
plaints, the CCPA
has issued guidelines
for preventing unfair
trade practices and
violation of consum-
er rights with regard
to levying of service
charge.
As per the guide-
lines, “No hotels or
restaurants shall add
service charge auto-
matically or by de-
fault in the bill.”
There should not
be any collection of
service charge by
any other name, it
added.No hotel or
restaurant can force
a consumer to pay
service charge. They
have to clearly in-
form the consumer
that service charge is
voluntary, optional
and at consumer’s
discretion.
“No restriction on
entry or provision of
services based on col-
lection of service
charge shall be im-
posed on consum-
ers,” the guideline
said.
Further, service
charge cannot be col-
lected by adding it
along with the food
bill and levying GST
on the total amount.
If any consumer
finds that a hotel or
restaurant is levying
service charge in vio-
lation of the guide-
lines, s/he can re-
quest the concerned
establishment to re-
move it from the bill
amount.
The consumers
can also lodge a com-
plaint on the Nation-
al Consumer Hel-
pline (NCH), which
works as an alter-
nate dispute redres-
sal mechanism at
the pre-litigation
level, by calling 1915
or through the NCH
mobile app.

Mumbai: Calling this
a tough time, the Shiv
Sena in an editorial in
its mouthpiece
‘Saamana’, on Mon-
day, said it was not
surprising to see the
BJP winning the As-
sembly Speaker’s elec-
tion as the Sena was
broken and “someone
from the party” was
pitted against it.
It said following the
resignation of Uddhav
Thackeray from the
chief minister’s post,
there was no “state of
law” left in Maharash-
tra.
With the new govern-
ment (led by CM
Eknath Shinde) in the
state, the issue of nom-
ination of 12 MLCs
from the governor’s
quota will be resolved
soon. The old file (sent
by the previous Uddhav
Thackeray-led govern-
ment) will be replaced
with a new one and it
will be cleared by the
governor within 24
hours, it claimed.
If “protectors of the
Constitution” take a
dual stand, these peo-
ple can make any reso-
lution and win any
election, it said, with-
out taking any names.
“Though this is a
tough time, it too shall
pass,” the Marathi dai-
ly said.
“Like the current CM
(Eknath Shinde), (pre-
sent Assembly Speaker)

MLAs of the Shinde
group did not follow
the party’s whip and
action of disqualifica-
tion will start, but to
avoid that, the BJP has
made a person having
legal knowledge as the
Speaker, and now they
will take convenient de-
cisions,” the Sena
mouthpiece claimed.
It said when a peti-
tion seeking disqualifi-
cation of 16 MLAs (of
the Shinde group) is
under consideration
before the Supreme
Court, it is illegal to al-
low them to take part in
the voting process.

Mumbai: A court on
Monday issued a bail-
able warrant against
Shiv Sena MP Sanjay
Raut after he failed to
appear before it in
connection with a
defamation com-
plaint. It was filed by
former Bharatiya Ja-
nata Party (BJP) MP
Kirit Somaiya’s wife
Medha Somaiya.
Last month, the Se-
wri metropolitan mag-
istrate’s court had is-
sued a process (sum-
mons) against Raut,
asking him to appear
before it on July 04.
However, neither
Raut nor his lawyers
were present in the
court on Monday, said
Medha Somaiya’s law-
yer Vivekanand Gupta.
“Hence, we made an
application for the issu-
ance of a warrant
against him, which the
courtallowed,”headded.
The court later ad-
journed the matter and
kept it for hearing on
July 18.
Earlier, while issuing
summons, the magis-
trate had held that doc-
uments and video clips
produced on record
prima facie revealed
that the accused made
defamatory statements
against the complain-
ant (Medha), so that it
will be seen by the pub-
lic at large and read by
people in newspapers.
It was also prima fa-
cie proved by the com-
plainant that the words
spoken by accused San-
jay Raut were such that
it harmed the complain-
ant’s reputation, the
court had said.
In her complaint,
Medha Somaiya, filed
through advocates Gup-
ta and Laxman Kanal,
claimed Raut had made
baseless and defamato-
ry allegations against
her and Kirit Somaiya.

next 5 days

al Disaster Response
Force (NDRF) has de-
ployed two teams in
the coastal Konkan
region of Maharash-
tra in view of an or-
ange alert issued by
the India Meteorolog-
ical Department
(IMD) for the next
five days. The order
comes as a precau-
tionary measure after
last year’s massive
floods in two districts
in the region, said an
official on Monday.
Ateamof NDRFissta-
tioned at Chiplun in the
Ratnagiri district and
another team at Mahad
in the Raigad district.
The orange alert, pre-
dicting heavy to very
heavy rains at isolated
places from June 04 to
June 08, has been issued

to scale the summit
of Mount Denali last
week, when she car-
ried the Tricolour to
the top of the highest
mountain peak in
North America, a de-

Karthikeyan, a

Mumbai: The state’s
Covid tally reported
as many as 1515 new
COVID-19 cases,
which were 50% less-
er than the previous
day. The day also saw
three deaths linked to
the disease. The over-
all tally of infected
patients in the state
stood at 79,86,811,
while the total num-
ber of people who lost
their lives to the dis-
ease was 1,47,943.
A drop of 1,447 cases
as compared to Sunday
was registered when
the daily tally reported
2,962 cases. The number
of COVID-19 linked fa-
talities also dipped to
three from six the previ-
ous day
.
The state capital re-
ported 431 COVID-19
cases in the last 24
hours, the health de-
partment informed in a
bulletin.
It further added that
2,062 more patients re-
covered from the infec-
tion on the day, leaving
the state with 21,935 ac-
tive cases.
Of these the highest
7,040—were in Mumbai,
followed by 5,221 in
Pune district and 4,605
in Thane.
Maharashtra’s coro-
navirus recovery rate
stood at 97.87%, while
the fatality rate was
1.85%.
The health depart-
ment revealed that out f
the 1,515 new cases, 810

A reporter askedhimaboutthemount- ing corporate defaults to whichheanswered,“If you owe the bank Rs. 1 lakh, that’s your problem but if you owe the bank Rs. 100 crore, it’s the bank’s prob- lem.” The joke although long forgotten still holds. It pointed toward the lapses in the Indian banking sys- tem and a sinkhole of de- faulted loans that it has managed to create. It has been three dec- ades since the Harshad Mehta securities scam was unearthed in 1992 but serious lapses in banking operations still exist. The scam exposed the gaping loopholes in the country’s stock markets and the banking system. Harshad Mehta manipulated the stock prices by illegally obtaining funds from the banks using fake bank re- ceipts and diverting them to the stock market. He created a vicious cycle of fraud with some of the leading banks in those times like SBI and Nation- al Housing Bank. Thankfully, the scam resulted in sweeping changes in the securities market. Stricter laws were introduced and the pow- ers of SEBI were widened. However, amendments in the banking laws have not been sufficient and are still exploited by wealthy corporates. Several corporates in the past few years have “wilfully” defaulted on thousands of crores worth of loans from banks and have simply fled the coun- try to never come back. All attempts at extradition have failed, leaving very little hope that the money will ever be recovered. Wilful defaulters are those who can pay back the borrowed money to the banks but do not do so willingly. They have the money and muscle to fight arduous legal battles that carry on for years. BIGGEST SCAMS IN LAST DECADE The latest Dewan Housing Finance Limited (DHFL) scam defrauded a consor- tium of 17 banks worth Rs. 34,000 crore is the biggest banking fraud India has ever seen. Only ABG Ship- yard comes close with a fraud case of about Rs. 20,000 crore, reported only afewmonthsback.Thelist however doesn’t end here. From diamond trader Nirav Modi and his uncle Mehul Choksi’s Rs. 14,000 crore scam, The Sande- saras of Sterling Biotech’s Rs. 15,000 cr scam, another diamantaire Jatin Mehta’s Rs. 10,000 cr fraud to Vijay Mallya’s Rs. 9,900 crore scam,thelistof consseems endless. All these and many more such cases simply bring forth the systemic faults and vulnerabilities in our banking processes. Lack of regulation, flawed lending policies, and an inadequate fraud moni- toring mechanism are among the many reasons for the rise in fraud cases in the country leading to mounting non-perform- ing assets (NPA). The push toward digiti- zation and financial inclu- sion during the pandemic significantly changed the way the industry operates. It has however brought along with it, its own set of problems of data theft and cyber-crimes. Even though RBI and the government have tak- en coherent steps to ad- dress these pain points and plug the loopholes, they are not enough. THE ELEPHANT IN THE ROOM Numbers up, value down: As per RBI’s annual report for FY 2021-22, total num- ber of frauds reported in FY 2022 was up 23% from last year but the total amount of fraud cases in value terms reduced to half from Rs 1.4 trillion in FY 2021 to Rs 60,000 crore in FY 2022. There isn’t much to cheer about coz the DHFL case forms more than half of the total fraud amount of last year! FYI, RBI data considers frauds of Rs1lakhandaboveonly . PSUs: The weakest link – If one were to assess the frauddataforthelastthree years, private sector banks reported the maximum number of frauds while in value terms public sector banks’ contribution was more,aspertheRBIreport. Advances to be moni- tored: The nature of frauds reported by private sector banks were mainly on account of small value card/internet frauds, while those for public sec- tor banks were mainly in the loan portfolio. Advanc- esformedthemajorchunk of all the fraud in value terms (97% of all frauds) while cards/ internet con- tributed to just 0.2% of all frauds in value terms. Time Lag: There is a sig- nificant time lag between the date of occurrence of fraud and its detection. 94% of all frauds detected last year occurred in pre- vious fiscal years. WAKE UP AND SMELL THE COFFEE Risk is an inherent aspect of banking and needs to be dealt with. Frauds are on the rise and are expected to rise further especially in the current adverse business environment. Pandemic-induced loan extensions’, moratoriums, and government support to businesses can open up a new pandora’s box if not addressed early . THE VIEWS EXPRESSED BY THE AUTHOR ARE PERSONAL 3 While banks have been making investments to strengthen their fraud risk management framework and monitoring systems, they have not been sufficient, it’s a no-brainer. Every red flag and an early warning signal is important and should be identified and closely monitored. Banks need an Independent fraud risk management department that can avoid delays in decision- making, especially in large value frauds. After all, most of the scams take place with help from bank staff. MSEDCL has termi- nated services of five private agencies tasked with recording read- ings of consumer me- ters. “Three agencies are from Solapur district, while two are from Pune district,” an MSEDCL spokesperson told media on Monday. Five agencies have been found negligent in tak- ing meter readings. “In the last two months, it was noticed that these private agen- cies have made no im- provement in meter readings. Despite me- ters being in a good state, they have given adverse remarks and recorded wrong aver- age meter readings,” the spokesperson said. In Western Maha- rashtra, the MSEDCL has hired as many as 110 private agencies that have appointed their own manpower for recording meter readings at the resi- dences of consumers. First India Bureau Mumbai: The Bom- bay High Court on Monday pulled up the Brihanmumbai Mu- nicipal Corporation (BMC) for not crack- ing down on illegal nursing homes in the city. A bench comprising Justice Anil K Menon and Justice Makarand S Karnik posed the question to the civic body , after taking cogni- zance of an inspection conducted by the civic body in December last year. The outcome of the on-ground review showed that of 1,574 clinics or private hospi- tals, only 687 had com- plied with fire safety and other norms. The justices were hearing a public inter- est litigation (PIL) filed by Shakeel Shaik through his counsel, ad- vocate Mohammed Zain Khan. The plea highlighted an incident from 2019, where an unauthorized health camp organized in the city had resulted in the accidental death of a three-ye ar-old. Ac- cording to Shaik, the gathering had been held without due dili- gence of meeting requi- site fire norms. Senior counsel Milind Sathe, who ap- peared on behalf of the BMC, told the court that it had taken action against unlawful nurs- ing homes, but was of- ten unable to close them due to patients admit- ted there. “We cannot under- stand how the BMC is so powerless that it can- not stop an illegal nurs- ing home from func- tioning, just because of 10 people there? If such nursing homes do not have fire safety and yet, there are people in them, it is a disaster waiting to happen,” said the bench. The High court asked the civic body to file an additional affidavit de- tailing how many clin- ics or nursing homes continued to operate in the city without requi- site licenses and, or, fire safety norms. The HC further di- rected BMC and the city fire department to file their respective affida- vits within three weeks. Filed by a social or- ganization, Naee Rosh- ni, through advocate Sahood Anwar Naqvi, the PIL challenged the Mumbai Metropolitan Region Development Authority (MMRDA)’s July 18, 2019 order to revise the station names on lines 2A and 7 of the Mumbai Met- ro. According to the or- ganization, the re- christening was in “sheer violation of policy framed by MMRDA”. It also alleged that the name change was ordered due to political pressure from two MLAs namely Atul Bhatkhalkar and Sunil Prabhu. “This was done despite Right to Information (RTI) re- plies stating that Din- doshi is a revenue vil- lage and not the near- est wadi,” stated the organization. It fur- ther said that the re- naming was “arbi- trary”, had affected the sentiments of Pathan- wadi residents and was against their con- stitutional rights. On June 09, the court had directed Naee Roshni to deposit Rs1 lakh as a precondition to hear its petition. On Monday, the organiza- tion informed a bench comprising Justice Anil K Menon and Jus- tice Makarand S Karnik that the depos- it had been made, after which the court grant- ed two weeks for the government to file its reply . Professor Bharat Ad- sul from department of Computer Science and Engineering, and Pro- fessor Madhu N Belur from the department of Electrical Engineering would be the convenor and co-convenor of the course. The initiative to in- troduce the course has been taken on the basis of surveys conducted by the SC/ST cell of the educational body . The surveys further asked the students about the need of hav- ing more events focused towards sensitizing the youth and introduction of a mandatory course on caste sensitization. While the the course is yet to be designed and the SC/ ST cell has de- cided to introduce a mentorship pro- gramme, where seniors will reach out to the juniors of the SC/ST communities and make sure that there is no caste-based distinction in the campus. The SC/ST cell re- cently organised an open house discussion regarding challenges faced by students. It also threw light on steps that can be taken to solve these issues. It later dashed another motorcycle of one Tanaji Dhamale, who was also killed in the accident,” said a cop. Thane: The body of an unidentified man was found in a car parked on a roadside on the Mumbai- Ahmedabad highway near Maharashtra, said police officials on Monday. A police team patrolling the area on Sunday evening spotted the car in Sha- hapur area. On checking the car, they found the body of a man, aged 35 to 40 years, with a head injury, lying inside the vehicle, confirmed an official from Shahapur police station. The body was later sent for a post-mortem examination.

Addressing the in- dustry leaders, Bajaj said the rate rationali- sation exercise of the GST Council is a result of introspection of GST, five years after its rollout, and the policy- makers do not have a “fetish” to raise the tax rates to the revenue- neutral level of 15.5%. On the industry de- mand for bringing pe- troleum products un- der GST net, he said since fuel constitutes a larger part of their rev- enues, both the Centre and states have some apprehension. “We will have to wait for some time.” “Of the 5, 12, 18 and 28%, we would have to continue with 28% be- cause in a developing economy, in an econo- my with so much of income disparity, there would be some luxury and sin items that would and should at- tract a higher rate of taxation. “But, whether on 5, 12 and 18 (%), we can bring down to 2 rates to start with and then see how the country grows and whether there is a capacity to bring it to one rate or not is some- thing to be seen. It is a very difficult chal- lenge,” Bajaj said at an Assocham event. Under the GST, a four-rate structure that exempts or imposes a low rate of tax of 5 per cent on essential items and a top rate of 28% on cars is levied. The other slabs of tax are 12 and 18%. Besides, there is a special 3% rate for gold, jewellery and pre- cious stones and 1.5% on cut and polished dia- monds. Also, a cess is levied on the highest tax slab of 28% on luxury, sin and demerit goods. The collection from the cess goes to a separate cor- pus—Compensation fund — which is used to make up for revenue loss suffered by the state due to the GST rollout. The GST Council has set up a GoM, under Karnataka Chief Min- ister Basavaraj Bom- mai, to suggest ration- alisation in tax rates, merging of slabs, re- viewing the exempt list and correcting duty inversion in cases where taxes on final output in lower than that in inputs. The GoM has been given 3-month more time to submit a final report. New Delhi (PTI): Guja- rat and Karnataka have been ranked as the best performers in develop- ing startup ecosystem for budding entrepre- neurs, according to the ranking of states and Union territories by the department for promo- tion of industry and in- ternal trade (DPIIT). Among smaller states having population of less than one crore, Meghalaya has been ad- judged as the best per- former.The rankings are based on the initia- tives taken to develop the startup ecosystem for promoting budding entrepreneurs. For the third time in a row, Gujarat was ranked as the best per- former. The exercise is aimed at supporting states and Union territories (UTs) in developing their startup ecosystem and learning from each oth- er’s best practices. A total of 24 states and 7 UTs participated in the exercise, which ranked them under five categories -- best per- formers, top perform- ers, leaders, aspiring leaders and emerging startup ecosystems. Revenue Secretary Tarun Bajaj said the $40 per barrel level of oil prices being talked about for a rollback of the levy is unrealistic, considering the inter- national oil rates cur- rently. The review is based on the premise that if crude prices fall, then windfall gains will cease and new taxes would be rollback. “There is a way we will monitor it every 2 weeks, depending on the foreign currency rates and depending on where the interna- tional prices are,” Ba- jaj said. “What is the dollar to rupee, the interna- tional price of diesel, crude, what is the do- mestic cost of crude, will keep reviewing it. PACS may be allowed to sell petroleum products New Delhi (PTI): The Centre has proposed to allow primary agricul- ture credit societies (PACS) to undertake ac- tivities like dealership of petroleum products, running PDS shops, and developing hospital and educational institu- tions, in addition to their regular functions. In this regard, the Ministry of Coopera- tion has floated a draft ‘Model By-laws of PACS’ on which it has invited suggestions from the state govern- ments and other stake- holders by July 19. The draft model by- laws propose that PACS should be allowed to work as Bank Mitras and common service centres, provide cold storage and godown fa- cilities, set up PDS shops besides enabling them to work in dairy, fishery, irrigation and green energy sectors. The gross leas- ing of office space stood at 5.6 million square feet in the year- ago period, Colliers India said on Monday . The demand for housing as well as of- fice was badly impact- ed during April-June quarter of last year because of the strong second wave of the COVID pandemic. PAPER STOCKS IN DEMAND Hotels, restaurants barred from levying service charge New Delhi (PTI): The Central Consum- er Protection Author- ityonMondaybarred hotels and restau- rants from levying service charge auto- matically or by de- fault in food bills and allowed customers to file complaints in case of violation. Amid rising com- plaints, the CCPA has issued guidelines for preventing unfair trade practices and violation of consum- er rights with regard to levying of service charge. As per the guide- lines, “No hotels or restaurants shall add service charge auto- matically or by de- fault in the bill.” There should not be any collection of service charge by any other name, it added.No hotel or restaurant can force a consumer to pay service charge. They have to clearly in- form the consumer that service charge is voluntary, optional and at consumer’s discretion. “No restriction on entry or provision of services based on col- lection of service charge shall be im- posed on consum- ers,” the guideline said. Further, service charge cannot be col- lected by adding it along with the food bill and levying GST on the total amount. If any consumer finds that a hotel or restaurant is levying service charge in vio- lation of the guide- lines, s/he can re- quest the concerned establishment to re- move it from the bill amount. At 1,515, COVID-19 cases register 50% drop in Maha First India Bureau Mumbai: The state’s Covid tally reported as many as 1515 new COVID-19 cases, which were 50% less- er than the previous day. The day also saw three deaths linked to the disease. The over- all tally of infected patients in the state stood at 79,86,811, while the total num- ber of people who lost their lives to the dis- ease was 1,47,943. A drop of 1,447 cases as compared to Sunday was registered when the daily tally reported 2,962 cases. The number of COVID-19 linked fa- talities also dipped to three from six the previ- ous day . The state capital re- ported 431 COVID-19 cases in the last 24 hours, the health de- partment informed in a bulletin. It further added that 2,062 more patients re- covered from the infec- tion on the day, leaving the state with 21,935 ac- tive cases. Of these the highest 7,040—were in Mumbai, followed by 5,221 in Pune district and 4,605 in Thane. Maharashtra’s coro- navirus recovery rate stood at 97.87%, while the fatality rate was 1.85%.
