Russian Constitution— After the dissolution of USSR in 1991, Russia framed a new
constitution salient features of Russian Constitution are—
i) The constitution declares Russia as Sovereign Republication State.
ii) It provides for a Federal country
iii) It establishes a liberal democratic Governance and guarantees fundamental
rights citizens. Thus it disregards the earlier totalitarian system (everything is
controlled by Govt.)
iv) It introduces a multiparty system and ensures tree and fare periodic election.
v) It provides for division of power among executive legislature and judiciary and
three organs are in dependent to each other.
vi) It establishes bicameral legislature consisting of Federal Council and State Duma.
vii) Federal Council consists 178 members. The State Duma consists of 450 members
directly elected from a period of 4 years.
viii) It declares President of Russia as the Head of the State. He is elected for a term
of 4 years by Universal Adult Suffrage. He is the Head of the Executive as well as
Commander of Army.
President appoints the Chairman of Govt. as the Prime Minister.
Representationi of People’s Act (1950 & 1951)— Representation of People’s Act, 1950 and
1951 have a no. Of significant provisions which deals with the election process. RPA, 1950
contains 32 sections in 8 parts and 4 schedules.
RPA, 1951 has 171 section in 13 parts. The Parliament framed these acts in order to conduct
elections in free and fare manner in a country.
Following are the important provisions of the Act.
i) Disqualification of the Electoral Representatives of a parliamentary and
Assembly.
The RPA talks about the qualification of a person who can contest the elections.
The qualifications are—
a) He should be citizen of India.
b) As per the 3rd
scheduled, he makes or subscribes oath of Affirmation before
same person authorised by the Election Commission.
c) He should not be less than 25 yrs. Age for Lok Sabha and 30 yrs of age for
Rajya Sabha.
d) He should not be less than 25 yrs of age for Legislative Assembly for State and
30 years for Legislative Council of states.
e) He possesses any other qualification as prescribed by Parliament any Act of
Parliament.

Provisions for Qualification under RPA, 1951—
i) A person is not qualified to be chosen in any state unless he is an elector.
ii) A person shall not be qualified to be chosen to fill a seat in the house of the
people unless—
a) In the case of seat is reserved for SC in any state. He is a member of any SCs
and is an elector of any Parliamentary constituency.
b) If a seat is reserved for STs in a state, he/she should be a member of ST
Community.
This excludes autonomous tribal districts of Assam. In this case, seat is
allotted to Sikkim. He is the elector for a parliamentary election of Sikkim.
A person shall not be qualified to be chosen to fill a seat in the legislative
assembly in the state unless—
i) In case of seat is reserved for SC or ST of that State, he is a member of
SC & ST Community and is an elector of any Assembly Constituency of
that state.
ii) In case the seat is reserved for an autonomous district of Assam, he
should be a member of ST Community of that autonomous district
and is an elector for Assembly Constituency in which such seat or any
other seat is reserved for that seat.
iii) In case of any other seat he should be an elector of any Constituent
Assembly of that State.
A person shall not be qualified to be chosen to fill a seat in the Legislative Council of State
unless—
i) He is an elector for any Assembly Constituency in that State.
ii) He is ordinarily resident of the state.
Disqualification of Elected Representatives from Parliament and Assembly—
Constitutional Provision— A person shall be disqualified for being chosen as member of
Parliament or State Legislature if—
i) He holds any office of profit under Govt. of India or Govt. of any state other than
those offices declared by parliament by law for exemption, e.g., a person shall
not deemed to hold on office of profit under Govt. of India or Govt. of State by
reason only of he is a Minister either of a State or Union.
ii) If he is of unsound mind and declared so by a Competent Court.
iii) If he is an undischarged insolvent loan.
iv) If he is not a citizen of India and has voluntarily acquired citizenship of foreign
state and acknowledged allegiance to foreign state.

v) If he is so disqualified under any law made by the Parliament.

CLASS NOTE of 09/04/2019 Refer to previous class notes for better understanding 1 www.vajiraoiasacademy.com ©Vajirao IAS Academy Russian Constitution— After the dissolution of USSR in 1991, Russia framed a new constitution salient features of Russian Constitution are— i) The constitution declares Russia as Sovereign Republication State. ii) It provides for a Federal country iii) It establishes a liberal democratic Governance and guarantees fundamental rights citizens. Thus it disregards the earlier totalitarian system (everything is controlled by Govt.) iv) It introduces a multiparty system and ensures tree and fare periodic election. v) It provides for division of power among executive legislature and judiciary and three organs are in dependent to each other. vi) It establishes bicameral legislature consisting of Federal Council and State Duma. vii) Federal Council consists 178 members. The State Duma consists of 450 members directly elected from a period of 4 years. viii) It declares President of Russia as the Head of the State. He is elected for a term of 4 years by Universal Adult Suffrage. He is the Head of the Executive as well as Commander of Army. President appoints the Chairman of Govt. as the Prime Minister. Representationi of People’s Act (1950 & 1951)— Representation of People’s Act, 1950 and 1951 have a no. Of significant provisions which deals with the election process. RPA, 1950 contains 32 sections in 8 parts and 4 schedules. RPA, 1951 has 171 section in 13 parts. The Parliament framed these acts in order to conduct elections in free and fare manner in a country. Following are the important provisions of the Act. i) Disqualification of the Electoral Representatives of a parliamentary and Assembly. The RPA talks about the qualification of a person who can contest the elections. The qualifications are— a) He should be citizen of India. b) As per the 3rd scheduled, he makes or subscribes oath of Affirmation before same person authorised by the Election Commission. c) He should not be less than 25 yrs. Age for Lok Sabha and 30 yrs of age for Rajya Sabha. d) He should not be less than 25 yrs of age for Legislative Assembly for State and 30 years for Legislative Council of states. e) He possesses any other qualification as prescribed by Parliament any Act of Parliament.

CLASS NOTE of 09/04/2019 Refer to previous class notes for better understanding 2 www.vajiraoiasacademy.com ©Vajirao IAS Academy Provisions for Qualification under RPA, 1951— i) A person is not qualified to be chosen in any state unless he is an elector. ii) A person shall not be qualified to be chosen to fill a seat in the house of the people unless— a) In the case of seat is reserved for SC in any state. He is a member of any SCs and is an elector of any Parliamentary constituency. b) If a seat is reserved for STs in a state, he/she should be a member of ST Community. This excludes autonomous tribal districts of Assam. In this case, seat is allotted to Sikkim. He is the elector for a parliamentary election of Sikkim. A person shall not be qualified to be chosen to fill a seat in the legislative assembly in the state unless— i) In case of seat is reserved for SC or ST of that State, he is a member of SC & ST Community and is an elector of any Assembly Constituency of that state. ii) In case the seat is reserved for an autonomous district of Assam, he should be a member of ST Community of that autonomous district and is an elector for Assembly Constituency in which such seat or any other seat is reserved for that seat. iii) In case of any other seat he should be an elector of any Constituent Assembly of that State. A person shall not be qualified to be chosen to fill a seat in the Legislative Council of State unless— i) He is an elector for any Assembly Constituency in that State. ii) He is ordinarily resident of the state. Disqualification of Elected Representatives from Parliament and Assembly— Constitutional Provision— A person shall be disqualified for being chosen as member of Parliament or State Legislature if— i) He holds any office of profit under Govt. of India or Govt. of any state other than those offices declared by parliament by law for exemption, e.g., a person shall not deemed to hold on office of profit under Govt. of India or Govt. of State by reason only of he is a Minister either of a State or Union. ii) If he is of unsound mind and declared so by a Competent Court. iii) If he is an undischarged insolvent loan. iv) If he is not a citizen of India and has voluntarily acquired citizenship of foreign state and acknowledged allegiance to foreign state.
