COMPOSITION
288 members are elected.
01 members nominated by the Governor from the Anglo Indian community.
QUALIFICATION
 Must be citizen of India
 Must be 25 years old.
 He/She possesses such other qualification as may be prescribed by the Parliament.
 The candidate must be registered as a voter in a any legislative assembly or parliamentary constituency and must be eligible to vote.
 A person from reserved category only can contest election if the Vidhan Sabha seat is reserved for these categories. (However, an SC/ST
person can contest election on an unreserved seat also).
Disqualification (The constitution of India has provided (in article 102) that a member of legislative council will be disqualified for membership if):
 He holds an office of profit under GOI or any State Government, other than that of a Minister at the center or any state or an office
declared by a law (many States have passed such laws declaring certain offices to be offices the holding of which does not disqualify its holder for being a member of the
Legislature of that States)
 He is of unsound mind and stands so declared by a court.
 He has ceased to be a citizen of India.
 He is an undischarged insolvent.
 He is disqualified due to continuously absent for 60 days in assembly.
 He is disqualified if he posses membership in both the houses (Legislative Assembly and Legislative Council)
 He is disqualified under any other law made by parliament.
 He must not have been found guilty of certain election offences and corrupt practices
 He must not have been convicted for any offence that results in imprisonment for two or more years. However, detention under
preventive detention law is not disqualification.
 He must not have failed to lodge an account of election expenses within stipulated time.
 He must not have any interest in government contracts, works and services.
 He must not be a director or managing personnel in a company / organization in which government has at least 25% share.
 He must not have been dismissed from government service due to corruption or disloyalty to state.
 He must not have been punished for supporting social crimes such as untouchability, sati, dowry etc.
TENURE OF
LEGISLATIVE ASSEMBLY
 5-year terms unless dissolved
 Extend by one year in emergency case single time
 Not extended by more than six months after emergency.
 President rule can be in existence up to three years
 Governor can dissolve before completion of tenure in political issues or on the request of CM

art, co-operative movement and social service
QUALIFICATION

Lecture 13 state legislative - vidhan sabha & vidhan parishad

  • 4. LEGISLATIVE ASSEMBLY (VIDHAN SABHA) • Lower House in the state • Vidhan Sabha (LEGISLATIVE ASSEMBLY) • not more than 500 members and not less than 60 members • For every 75,000 population one MLA • Assemblies Reserved for SC/ST communities • Governor nominates for Anglo-Indian (if required) • 5-year terms unless dissolved • Vidhan Sabha elects its presiding officer • the Speaker Vidhan Bhavan, Mumbai (Summer session) Vidhan Bhavan, Nagpur (Winter session)
  • 5. • 28 states and 8 centrally administered Union Territories
  • 6. COMPOSITION 288 members are elected. 01 members nominated by the Governor from the Anglo Indian community.

  • 8. QUALIFICATION  Must be citizen of India  Must be 25 years old.  He/She possesses such other qualification as may be prescribed by the Parliament.  The candidate must be registered as a voter in a any legislative assembly or parliamentary constituency and must be eligible to vote.  A person from reserved category only can contest election if the Vidhan Sabha seat is reserved for these categories. (However, an SC/ST person can contest election on an unreserved seat also).

Disqualification (The constitution of India has provided (in article 102) that a member of legislative council will be disqualified for membership if):  He holds an office of profit under GOI or any State Government, other than that of a Minister at the center or any state or an office declared by a law (many States have passed such laws declaring certain offices to be offices the holding of which does not disqualify its holder for being a member of the Legislature of that States)  He is of unsound mind and stands so declared by a court.  He has ceased to be a citizen of India.  He is an undischarged insolvent.  He is disqualified due to continuously absent for 60 days in assembly.  He is disqualified if he posses membership in both the houses (Legislative Assembly and Legislative Council)  He is disqualified under any other law made by parliament.  He must not have been found guilty of certain election offences and corrupt practices  He must not have been convicted for any offence that results in imprisonment for two or more years. However, detention under preventive detention law is not disqualification.  He must not have failed to lodge an account of election expenses within stipulated time.  He must not have any interest in government contracts, works and services.  He must not be a director or managing personnel in a company / organization in which government has at least 25% share.  He must not have been dismissed from government service due to corruption or disloyalty to state.  He must not have been punished for supporting social crimes such as untouchability, sati, dowry etc.

TENURE OF LEGISLATIVE ASSEMBLY  5-year terms unless dissolved  Extend by one year in emergency case single time  Not extended by more than six months after emergency.  President rule can be in existence up to three years  Governor can dissolve before completion of tenure in political issues or on the request of CM

LEGISLATIVE COUNCIL (VIDHAN PARISHAD) • Upper house in the state • Vidhan Parishad (LEGISLATIVE COUNCIL) • 78 members • 12 are appointed by the Governor of India • Vidhan Parishad elects its presiding officer • the Speaker • The legislative council can not be dissolved • It is a permanent House • members have terms of 6 years • 1/3 members retire at end of every 2nd year Vidhan Bhavan, Maharashtra Legislative Council, Mumbai

COMPOSITION Total 78 members are chosen in manner given below. 32 members elected by MLA’s of state legislative. 20 members elected by members of Local Authorities’ Constituencies. 07 members elected from amongst graduates. 07 members elected from amongst teachers. 12 members nominated by the President for special knowledge or practical experience in literature, science, art, co-operative movement and social service
