The And Exchange Board Of India
INTRODUCTION
The neo–economic liberalization undertaken in India in the 1990s, lead to a new and improved
market structure. It redefined the roles of the various agents in the economy and founded a system
based on the market forces. It was in the backdrop of these changes that there was a marked shift in
the role of the government from an agent that ran businesses to an agent that primarily undertook
regulation and supervision to ensure optimization in the running of the businesses in India. This shift
in the role of the state ushered in an era of regulators . The regulators embodied the expertise,
domain knowledge and the impartiality that the government influenced by the political party in
power could not effectively provide.

The Intermediaries Regulations 2008, were notified in May 2008 and brought about substantial
changes in the treatment and compliance requirements of intermediaries in the Indian securities
market.
This paper seeks to analysis the functioning of the aforesaid regulations in the context of the Indian
securities market. It begins with a brief introduction on the meaning and definition of intermediaries
along with the circumstances in which the Intermediaries Regulations, 2008 were enforced. The next
section delves deeply into the various provisions of the regulations. The concluding section deals
with the success of the regulations and tries to identify lacuna in the implementation to create a
more efficient system for regulating the securities markets that the SEBI is trying to achieve.
DEFINITION OF INTERMEDIARIES AND THE NEED FOR THE INTERMEDIARIES
REGULATIONS, 2008
Before any progress can be made in determining the exact regulatory structure envisaged by the
Intermediaries Regulations of 2008, it is important to discuss the scope of the term intermediaries
and the various agents of the market that it seeks to incorporate within its ambit.
In common parlance, intermediaries can be understood as middlemen. With the expanding markets

Action Against The Government Of Italy
Francovich brought action against the government of Italy for failing to implement the Directive
80/987, that required the protection of employees in the event of their employer's insolvency.
Francovich and other applicants were owed wages by their employers who became bankrupt. Since
they could not sue their employers (because that would involve horizontal effect which is not
possible with a Directive) they sued the Government of Italy which had failed to apply the Directive
that aimed to create institutions for compensating employees. In the first claim the European Court
found that the Directive lacked of direct effect. However, EU Law would be enfeebled if citizens
could not acquire remedy when their rights were breached by a state failing to comply with the EU
Law obligations. Eventually, the Court of Justice in the second claim, decided based on the Article 5
EC that Italy failed to satisfy its Treaty obligations. So, Francovich set the three conditions under
which an individual who suffered a detriment could bring proceedings directly against the member
state. The first condition is that the outcome prescribed by the directive involves the grant of rights
to individuals, the second condition is that it is essential to identify the content of those rights from
the directive and lastly the third condition is that there must be a causal link between the Member
State's negligence and the detriment suffered by the individual.
Nonetheless, the principle of state

A Report On The Taxi Industry
Introduction
The taxi industry is closely linked with people's life and it is seriously regulated in most cities in
Australia. This review examines an article that links cost of regulation to taxi industry in Sydney.
The article, "The High Cost of Taxi Regulation, with Special Reference to Sydney," was written by
Peter Abelson, a part–time economic advisor to the NSW Treasury. As the title of the article
indicates, the author found some papers that show the taxi industry in Sydney is over regulated
under some regulations, which are regulations of industry structure, quantity, services and prices.
The cost of taxi deregulation is lower than taxi regulation. The article shows a conclusion that the
productive forces and services revenue would be greater if other rules which restrict taxi services
were canceled. The NSW government does not make any changes because of insufficient
understanding of the advantages of market regulations. This review will summary the main points of
Peter's paper first, then put forward the personal view about the article and conclude with some
suggestions.
Summary
This section contains a summary of the article "The High Cost of Taxi Regulation, with Special
Reference to Sydney." In the paper, the author indicates the structure of the article in the
introduction. In addition, Peter describes the regulations of taxi industry in Sydney and analyzes the
results. After this part, the author discusses policy objectives and evaluates the net benefits of

How does an understanding of the influences on operations contribute to business success?
Executive Summary:
Qantas is Australia's largest domestic and international airline. Although Qantas is primarily a
passenger airline, air freight is also an integral part of its core business. Other Qantas operations
include catering, tourism and E–commerce devoted to transport and travel. In order to have an
effective business and operations process, a company, like Qantas must be aware of the influences
that can affect it. By being aware of the influences it enables the business to make decision and
choices that can get the most out of each influence, by doing this it can assist the business in its
endeavours for success. ... Show more content on Helpwriting.net ...
Cost minimisation however, cannot be pursued without attention to quality – there must be a balance
between the two
Government Policies –All businesses operating in Australia are subject to policies applied by the
three different levels of government – local, state, and federal. Government policies have a big
impact on Qantas. For example their economic policies (monetary, fiscal policy) have a direct
impact of the level of economic activity and therefore demand for its service. The federal
government's new policy the Fair Work Act is a lot more pro worker which has increased Qantas'
operating costs. All businesses must be aware and understand all government policies in order that
they are abiding by the law.
Legal regulation – The aim of government regulation of business is to promote safety and fair
business conduct. To remain in operation, a business like Qantas must comply with these
regulations. Penalties for non–compliance can be severe. Examples include, Qantas is subject to the
regulatory control of Civil Aviation Authority and is required to hold operating licences, State
government regulations on labour such as OH&S, anti–discrimination, workers compensation
etc. Being in the food industry it is critical that McDonalds meet and go beyond the food safety
laws; that include food being cooked and stored at the right temperatures and the correct food
handling procedures.

This paper will discuss the proposed views on the advantages and disadvantages of government
regulations on businesses.
Government Regulations on Businesses Advantages and Disadvantages There are advantages and
disadvantages that may be associated with the regulations that government imposes on businesses. It
is best to examine the reasoning behind regulations first prior to determining the potential
advantages or disadvantages that are viewed with government regulations. Government ... Show

This report is based on the knowledge about company structure and its types grounded on Australian
standards, the features which different organizations possess while functioning and the obligations
implied on them in light of Australian standards. Secondly the major differences between large and
small companies have also been discussed in this report, that what are those criteria which separate
large companies from small? And the last part discusses the role which the organizations are playing
in the progress of regulation of companies in Australia. The main purpose of these procedures is to

Ferguson term paper
Term Paper
Part A:
In the introduction of Ferguson's book, he talks about these four black boxes. He uses these four
sealed black boxes to "demonstrate that Western institutions have indeed degenerated" (Ferguson
page 11). The first of these "long–sealed" boxes is " labelled 'democracy'. The second is labelled
'capitalism'. The third is 'the rule of law'. And the fourth box labelled 'civil society'" (Ferguson).
Each one of these boxes are an important part of how our civilization works. The purpose for
revealing these black boxes, Ferguson states, is "that inside these political, economic, legal, and
social black boxes are highly complex sets of interlocking institutions. Like the circuit board inside
your computer or your ... Show more content on Helpwriting.net ...
Government is based on the consent of the governed. In a democracy, the people are sovereign–they
are the highest form of political authority." (What Is Democracy?). In his approach to democracy,
Ferguson, relates to the distributional characteristics of this concept with special reference to what
whether or not we are witnessing a fundamental breakdown that of which Edmund Burke called "the
partnership between generations."
Ferguson then moves on to his discussion of capitalism by discussing: "What is the right balance to
be struck between economic freedom and government regulation"? Here his discussion focuses on
whether "excessive regulation has become the disease rather than the cure" for the financial crisis
that began in 2007 (Ferguson page 3). Adam Smith also wrote a book on capitalism and that is
where he coined the term "stationary state." The third black box that Ferguson talks about is the rule
of law. Here he favors the common law as it was practiced in the United Kingdom. He supports his
argument when comparing other systems of law with common law he modifies the concept of the
rule of law to compare different codes of law to "what might be called the 'law of rules': the way that
law itself is made." Ferguson believes that American law is becoming noncompetitive with other
countries and this is true. Neill Ferguson's final black box concept describes why we are in a
stationary state

According to the Singapore consumer watchdog, there have been an increasing number of
complaints against tuition agencies in the country. With the given situation, the quality of education
is then compromised. Several agencies remain to be unregulated, making and following their own
rules. Given the standard regulations and procedures, owners still remain to be deviant. Others
owners are informed however, that they still manage to overlook the standards. To serve as a
guideline, the following is a discussion on the standard procedures on how to set up a tuition agency
in Singapore.
Two Methods to Register

registration.
The first method requires ... Show more content on Helpwriting.net ...
CPE Requirement
1. Evidence of Registration by ACRA
All the relevant documents from ACRA must be forwarded to CPE for compliance. Without the
requirements, the applicants cannot move forward to further registration procedures. One of the
requirements checked is the tuition agency for proprietary. The proprietary name is integrated with
academy, school, or education to be labelled as a place of learning.
The CPE makes sure that no two tuition agencies have the same name, otherwise parents and
students will be confused. Association with the government such as the inclusion of Singapore,
nations or government is also discouraged.
2. Details of the Agency Managers
A list of the ruling body for the tuition agency must also be identified. The managers are the same
with the listed directors of the business as registered by ACRA. A full personal detail in the
Declaration Form is required. In case of the issues, this form serves as a proof for accountability of
the managers. It is also used for scrutiny.
3. Suitability of the Agency Premises
The agency premise is more on the infrastructure allotted by the tuition agency. Much like in every
educational institution, there is a minimum space for classrooms and administrative duties. Aside
from the enclosures, CPE also requires all the premises to be danger–free. In fact, CPE ensures that

Government And Large Financial Institutions
Research suggests that government and large financial institutions should not be allowed to regulate
cryptocurrency, because eventually it will change cryptocurrency to mirror our current paper
currency system, and ultimately remove the freedom and anonymity associated with the use of
cryptocurrency.
The use of Cryptocurrency has become more prevalent across the globe. Regulation seems like the
next logical step in evolution and legitimacy, but this will ultimately lead to large financial
institutions and government establishing the standards and determining the value. At that stage
cryptocurrency may still be categorized as a decentralized form of currency, but the behavior will be
that of a centralized system overseen by the same institutions who govern our monetary systems
today. Many people think of cryptocurrency as a new and innovative payment system, yet it's much
like forms of money that the world has seen in the past, before governments and central banks
exerted their control. In many ways, cryptocurrency completes the cycle started when money began
to take hold in the Renaissance, when value and control was not determined by any government but
rather by the issuers of notes and the customers who used those notes. One of the most popular
cryptocurrencies available is Bitcoin. Bitcoin is regulated differently in the People's Republic of
China (PRC), Canada, and the United States, and no country has currently backed Bitcoin.

Public Sector : Is A Government Run Organisation?
Organisational sectors can be seperatred for the most part into 3 camps;
Public sector – Is a government run organisation (HMRC) which takes money from the public in the
form of taxes, and allocates some of the funds to to other public sector organisations, (such as the
Met. Police Service) to finance them the majority of them so they can keep in operation. These sort
of organisations usually aim to serve the publics interest with essential services ( Again, such as the
police and medical services).
From a Legal stand point, as its the public sector and is funded by the public, the government
(parliament, HMRC) is in charge of regulating the sector and insuring the allocated funds are
distributed and used how they should be. Due to its basic structure its fundamentily different to the
other sectors, that are mainly finance by inhouse sources or privatley earned money as opposed to
state tax.
Private Sector – business 's in this sector are owned and run by individuals as opposed to one large
governing body. This can vary from sole traders (such as contractors, or any one trading or running a
business by themselves.), partnerships (a business run by joint owners who share in the profits and
expenses equally, as a joint venture) & companies Both Public ( 'A public company is a company
with securities (equity and debt) owned and traded by the general public through the public capital

Government Regulation And Its Effect On Society Essay
The world is a complex and intricate machine, with many pieces to create a much larger thing.
Government and society are simply pieces of the same machine that depend on each other.
Likewise, government and society have the option to liberate or limit the activities of men and it is a
necessary occurrence of life. Government is dependent on society because social behaviors exists
wherever there are good or bad, proper or improper relationships between human beings. Humans
install government from their own belief that human behavior is "self–centered" therefore society
requires governing. Likewise, government oversight is needed in the economy as well as in society.
The appropriate role of government in the economy is different from a typical liberal stance.
Although the economy is an ever–changing machine that rises and falls due to no fault of its own
some feel that government regulation is needed. Without government regulation in the economy,
free market trade could set the bar for interest rates, trade tax, business monopolies, and currency
value. "...the safety of the republic lay in the autocratic strength of its government..." this quote from
Franklin Roosevelt's Commonwealth Club Address displays how the main objective for a strong
central government is to protect the people. To further protect the people of the United States, the
presences of a strong government in the financial sector is crucial to prohibit the use of banks
raising the interest rates to a level where

The Contradiction Of Opposing Regulation
The Contradiction of Opposing Regulation Under public interest theory, regulations exist to protect
consumers, to protect workers, and to protect the rights of the least advantaged. They exist to hedge
against the greed, corruption, and exploitation that can occur in an unchecked capitalistic society.
They attempt to prevent or ameliorate detrimental consequences to individuals and communities.
Granted, this can be seen as an idealistic view of regulation. Exponents of public interest theory
argue that even well–intentioned regulation can fail to achieve what it set out to do, and politicians
are imperfect and subject to pressure both by corporations and vocal minorities (Koopman et al.,
2014). Nonetheless, in the United States, these democratically elected local and federal
representatives have put regulations in place that, unless given reason for doubt, are presumed to
reflect the will of their constituents. Therefore, rebelling against regulation is not simply renouncing
the government – in some cases, it is renouncing the concerns of the communities that these
companies argue they are improving. Airbnb's $8 million snarky ad campaign against a housing
affordability bill in San Francisco was widely panned as "tone–deaf." One of the many billboard ads
suggested to the public library system to "use some of the $12 million in hotel taxes to keep the
library open later" (Toor, 2015). Tusk Ventures, a corporate consulting firm that serves as a
"regulatory broker," assists

Leisure and Stress Management : A Correlation Study of Social Activities and Stress Levels in
College Students.
Stress is a state of mental tension that is very familiar in present–day society. It is a topic that is
much debated in media coverage, and has been associated with significant impacts on both mental
and physical wellbeing (Iwasaki, 2003). While the repercussions of stress are well–established field
of research in the health and social fields, research in stress management and the different coping
mechanisms is still on debatable grounds (Iwasaki and Mannell, 2000).
Research on leisure–the free time in which non–working activities are enjoyed– is particularly
oriented on the different strategies employed to effectively cope with stress through its many
activities such as physical exercises (Nguyen–Michel, Unger, Hamilton, and Spruijt–Metz, 2006),
social interactions (Patry, Blanchard, and Mask,2007) and other personal relaxation activities
(Iwasaki, 2000). Studies done by researchers Iwasaki and Mannell (2000) have shown that leisure
activities serve as a regulatory system of stress intake This regulatory process involves both coping
beliefs–the actions the persons take in regards to personal characteristics and environments (e.g.
writing for an introvert) – and coping strategies –the actions a person takes in regards to situations
(e.g. socializing with friends after a harsh final) (Iwasaki and Mannell, 2000). For these reasons,

The Problem Of A Free Lunch
"There's no such thing as a free lunch" a very common saying in Economics because it emphasizes
that every decision requires a trade–off, and although one person may be getting a deal there is
always another side to the story. John Komlos, a well respected Economist, felt economics students
left their introductory classes under the impression that in the real world, perfect competition and
efficiency are very common in the market, with few market failures, and government intervention in
the economy is generally bad and leads to losses (2). In theory and for in–class examples this view
of the economy is very straight–forward and makes teaching easier. However, in the real world;
there is another side of the story. Free markets do have downsides and need some government
regulation alongside being guided by morals. Americans pride themselves extensively on being free
and letting the people choose how to live, but should everything in our country be left up to the
public? The free–market has the potential to be an efficient and positive system for all those
involved. Theoretically, consumers make themselves heard through their purchasing power, this
creates competition and ensures companies supply only quality products for fair prices (1).
Unfortunately, creating competition also has a Darwin effect on the producers(1). Suddenly, rivalries
are formed and making the highest profits becomes the sole purpose of the company. The
importance of worker safety, environmental

Free Market Economy
The United States is known to operate in a free market economy. In other words, the economy is
based solely on supply and demand with little to no government control. In reality, however, the
United States has various government regulations on our country's market. The amount of regulation
that is necessary is a continuing debate among politicians and economists to this day. Some would
say that the key to a successful market economy is to remove government restrictions in order to
force businesses to provide superior products and services at affordable prices. Yet, others assert that
government regulations are essential in protecting consumers, stemming from the assumption that
corporations are not always looking out for the public's interest. Of course, there are various
advantages and disadvantages associated with each level of regulation, however it is safe to assume
that there must be a balance between an unregulated free market and a regulated economy in order
to protect people and the environment and allow the economy to flourish. Advantages of a Free
Market Economy A free market is driven by individual innovation and the concept that hard work
and initiative will be rewarded with success. Because of the ingenuity factor, there is plenty of
competition in the market place. Therefore, the rivalry between companies provides the best
possible product to the customer at the best price. In addition, this gives consumers the ability to let

market so that they can sustain their existing customer centric competitive advantage. 3.) FII is
behind innovation due to managerial decision of only allocation 5% of EBIT towards R&D.

This is very important to their competitive advantage as ongoing service and support will allow
them to win contracts. FII will need to hire a technology expert that already has experience in MBR
systems and for this they may look to Europe because Europe is more advanced in this technological
aspect. A decrease in net income had an adverse effect to R&D because 5% of EBIT is
allocated towards further research and due to the decline in net income, FII's R&D budget
decreases as well. Therefore, FII is losing their innovative edge within the industry. This is evident
as they are currently behind in the MBR technology. Options A.) Status Quo If FII were to go into
2009 without investing into MBR technology, they will continue to lose revenue due to the new
government regulations making some of their products and services more obsolete. FII will lose
even more clientele because they will not pass future regulations. Based on their decline in profit in
2008¹ and if FII's product line were to remain the same, FII would continue to see a loss in the
coming years. Dragasevich's vision for the company is to be a leader in innovations and the
company's corporate goal is to be socially and environmentally responsible. Neither the vision or

EU legislation. This is aided by the FSA's move to the socalled 'copy–out' approach, transposing
directives word for word, where possible, in order to avoid 'gold–plating'. The FSA grows in size
and cost through greater activity for the Financial Ombudsman Service and increasing calls on the
Financial Services Compensation Scheme, fuelled by a growing number of consumer complaints
especially around bank charges and payment protection insurance. The FSA also increases its
enforcement activity, especially on market issues and in terms of stepping up fine sizes.
Financial crisis and beyond The single regulatory structure is restructured as a response to the crisis.
National supervisors face greater harmonisation of practice at EU level. The need to prop up the
banking system introduces a new actor, the Resolution Authority (in the UK a role of the Bank of
England), as the Tripartite Authorities50 put in place legislation to deal with bank resolution after
the collapse of Northern Rock. Major banks are now required to have recovery and resolution plans
('living wills'). Government announces the planned break–up of the FSA in 2012. It transfers the

The Act Of Texas And The Sunset Advisory Commission ( Sac )
In 2013, a proposal was written by a branch of the Texas state government called the Sunset
Advisory Commission (SAC). This proposal would, if made into law, deregulate 14,568 respiratory
therapists (RTs) currently employed in Texas (Gaebler 6). This would mean that RTs along with 18
other programs would not have to hold a state license to practice their craft (Sunset 52).
Deregulation may sound like a good idea on paper, however in practice, it is anything but. The
potential negative outcomes in the form of patient harm and possible death would far outweigh any
benefit. Deregulation of respiratory therapists in Texas began in the government as a proposal, was
fought against by those who say the potential danger in the idea, then ended back in the government
with a compromise that was written into law. In May of 2014, the SAC released a report. This report
states that the commission felt that RTs along with several other professions should no longer be
regulated by an agency of the government called the Department of State Health Services (DSHS)
(52). One of the many responsibilities of the DSHS is providing state licensure to individuals of
various job disciplines which both can and do have an impact on public health (43). The SAC brings
up a few key points in the report:
First, the SAC argues that, the DSHS is under staffed and underfunded for the amount of tasks it
must manage (4). The Sunset Advisory Commission's goal in the 2014 report is to reduce operation

Mechanisms for the Regulation of Biological Processes
The regulation of essential biological processes such as metabolism, growth and reproduction is a
hallmark of living systems. Cells, the fundamental units of life, employ a variety of mechanisms to
achieve this exquisite control, and regulation of the activity of proteins provides a means to fine–
tune cellular processes. One of the ways of controlling the activity of proteins is to alter the absolute
levels of a protein in a cell. This is achieved either by altering the levels of the mRNA coding for the
protein or by altering the stability of the protein in the cellular environment. Transcriptional
regulation, along with the presence of microRNAs, is a common mechanism employed by cells to
alter the levels of mRNA (1–5). The amount of a protein in the cell is essentially determined by the
balance of its rates of synthesis and degradation (6). The stability of a protein can be regulated by
different mechanisms including degradation (7, 8), molecular crowding (9), disulfide bond
formation, and small molecule binding (10–12).
In addition to controlling the absolute level of a protein, the activity of a protein can also be
regulated by covalent modification, interaction with other proteins, or binding of small molecules.
Covalent modification of a protein involves the attachment of a functional group resulting in
phosphorylation (13, 14), glycosylation (15), or acetylation (16). A protein can also be covalently
modified by attachment of another protein resulting in

on the overall profit of the company. ( REG Debenhams PLC, Interim Results, 2009)
In Debenhams Annual Report it is stated that Debenhams meet the regulation of recycling. Pollution

introduced the regulation which is reducing and planning to set recycling law. Due to minimum

Effects Of Regulation On The Economy
Every economy needs regulations to a certain extent, but how much is too much, and how exactly
do regulations even affect the economy of the country? Those are key questions that many are
asking, and don't truly have answers for. Many people in the country feel that there is way too much
regulation on the economy at this point; however, there's also a great amount of people who are
content with how much regulation is going on, and would keep pushing. Essentially there are two
extremes when it comes to the topic of regulation and what too much of it will do to the economy.
Too much regulation on the economy can have a negative impact in many ways. The biggest reason
as to why many are so terribly against too much regulation is because ... Show more content on

In Texas each person who is a computer repair technician is required to obtain a private
investigator's license, or a PI license. The only way two ways for and individual to receive a PI
license is to either go to school and earn a degree in criminal justice (CJ), or they are required to
take part in a three year apprenticeship with an individual who is already a licensed PI. Considering
that there are individuals who just repair computers on the side or want to just help a friend or
someone else out simply because they possess the skill set is also not an option. Any person who
repairs a computer without possessing a license, and any person who lets someone without the PI
license repairs their computer are both violating laws. Both could receive up to a year of jail time
and both could be fined up to $4,000. Texas isn't the only place that requires individuals to get
license for petty things. In Pennsylvania, any person who is a blogger it is obligatory to purchase a
business privilege license. These licenses cost $300, and it truly wouldn't be a big deal if one is
making a lot of money off of blogging; however, regardless of how much or how little you make off

The Use Of Biologics And Medical Devices Should Be Strict
The level of regulation governed by the FDA over drugs, biologics & medical devices is a widely
debated topic. In my point of view, the level of regulation on drugs, biologics and medical devices
should be strict. The current regulations governed by the FDA are very strict and should remain that
way because the base of these regulations are underlined by various tragedies which we don't want
to be repeated. For instance, the thalidomide incident in which many children were born with
Phocomelia (shortening or absence of limbs). Thalidomide, which started as an OTC drug in 1957 as
a remedy for sleeplessness was later found to have off–label effects such as mitigation of morning
sickness in pregnant women. Hence was then prescribed worldwide to pregnant women. However,
in 1962 Frances Kelsey prevented the approval of this drug in the USA. This resulted in Harris–
Kefauver Amendment in 1962 which tightened the investigation and approval of drugs requiring the
manufacturers to prove their safety and efficacy. Many incidents could be avoided in the past if the
regulations were firm and so there is an utter necessity of governing bodies for oversight of clinical
trials, new drug development and manufacturing of drugs, biologics and medical devices. Many of
these unfortunate events were mishaps, but there are many such incidents which are the result of
greed and corruption leading to adulteration of drugs, cosmetics and food products. Until the 19th

Introduction And Background Of Mobile Money Essay
CHAPTER ONE
INTRODUCTION AND BACKGROUND TO THE STUDY
1.1 Background to the Problem
Mobile money is the money stored using the Subscriber Identity Module in a mobile phone as an
identifier as opposed to an account number in conventional banking. Notational equivalent is the
value issued by Money Network Operator and is kept in a value account on the SIM within the
mobile phone that is also used to transmit, transfer or payment instructions, while corresponding
cash value is safely in a bank. The balance on the value account can be accessed via the mobile
phone, which is also used to transmit instant transfer or payment instructions.
M–Pesa is a mobile phone–based money transfer, financing and microfinancing service, launched in
2007 and 2008 by Vodafone for Safaricom and Vodacom, the largest mobile network operators in
Kenya and Tanzania respectively. M–Pesa allows users to deposit, withdraw, transfer money and pay
for goods and services (Lipa na M–Pesa) easily with a mobile device.
Mobile money services in Tanzania and Kenya emerged when there were no laws governing
National Payment Systems for mobile payments and there was no adequate regulation of mobile
payments.
Mobile phone companies in Tanzania are regulated by the Tanzania Communication Regulatory
Authority, which was established by the Tanzania Communication Regulatory Authority Act and the
Electronic Postal Communication( Licencing) Regulations. The main function of these two bodies,

The Constitutionality Of The Affordable Care Act
Every year consumers spend billions of dollars on insurance coverage in the United
States. According to Webster's Dictionary, "insurance is a practice or arrangement by which a
company or government agency provides a guarantee of compensation for specified loss, damage,
illness, or death in return for payment of a premium." The statutory power to regulate the business
of insurance comes from a 1945 ruling by the U.S. Supreme Court that prompts
Congress to enact the McCarron–Ferguson Law giving individual states the power to regulate the
business of insurance. But the lack of uniformity, loop holes, blind spots and deficiencies within the
state–based agencies have become a growing problem. For years Congress has been studying ...

Should Marijuana Be Legalized? Essay
Legalization of Marijuana Marijuana is not a recent discovery, but the mysteries surrounding the
controversial topic in question remains to be disputed since its prohibition. Classified as an illegal
substance, cannabis has been restricted in Canada and around the world. Marijuana is a complex
drug and its contradictory claims of medical purposes, and harmful destruction, fuel the debate on
whether or not the legal constraints of consuming marijuana should be reconsidered. In
consideration of academic journals and news article, citizen welfare, economy benefit, social
progression and legal system implications, will be focused on. Despite opposing beliefs, prohibiting
the recreational usage of marijuana does not counteract the dangers of the practise thus legalizing
marijuana in Canada will allow greater benefit than harm. Ever since the Canadian Liberal
government initiated the legalization of marijuana, many have been appalled by potential
consequences of the adjudication and conjointly, there are strong beliefs that recreation use of the

be intermittent, there will be safer drugs for user, and accretion of monetary funds. The first
advantage is that regulating marijuana will abolish the marijuana black market in Canada, and
consequences affiliated with illegal commerce. Additionally, criminalizing drugs presents ambiguity

Moral Hazard in Banking Essays
Moral Hazard in Banking Moral hazard is an asymmetric information problem that occurs after a
transaction. In essence, a lender runs the risk that a borrower will engage in activities that are
undesirable from the lender's point of view, making it less likely that the loan will be paid back.
Gary H. Stern's article, "Managing Moral Hazard with Market Signals: How Regulation Should
Change with Banking", addresses the moral hazard problem inherent to the financial safety net
provided by the government protection of depositors. Interest rates do not reflect the risk associated
with bank activity, which in turn causes banks to finance higher–risk projects with price tags that are
not parallel to the risk level. A solution ... Show more content on Helpwriting.net ...
After the passage of the FDICIA, two trends have emerged that have further exacerbated efforts in
regulating moral hazards. The first trend is increased asset concentration among larger banks. Over
time, more assets have flowed into fewer banks, and as a result more TBTFs were incubated in the
process. The second trend to emerge is increased complexity of banks. Increase of bank sizes
involved not only structural growth but also geographic reach. Larger banks begin to offer a greater
scope of offerings. With this plethora of change amid increased sizing, new skills needed to be
developed in order to manage the new risk. The complexity and size of banks and their associated
offerings caused a greater level of asymmetry between regulators and bank managers.
Opponents of the safety net provided by the government have offered several alternate options, one
of which is little government intervention, if at all. Such Laissez Faire approach, according to Stern,
is that they do not credibly address the potential for instability in the banking system nor the TBTF
problem. The absence of a federal safety net creates the potential for bank panics which would have
a substantial cost to our economic system. Privatization will not eliminate the expectations in the
material market making risk harder to price. Under the suggested system,

The Constitutional Basis Of Personal Jurisdiction
Jurisdiction Personal jurisdiction refers to the ability of a court to exercise its power over a
particular defendant or item of property. Personal jurisdiction may be categorized as in personam, in
rem, or quasi in rem. The primary restraints on a court's power to exercise personal jurisdiction are
found in the United States Constitution, state statutes, and case law. The Constitutional basis for
personal jurisdiction comes from the due process clause of the 14th Amendment. The statutory basis
comes from most states adopting what is called a long arm statute that states the limits of personal
jurisdiction that a state has over the defendant. Most long arm statutes, including CA, state that their
personal jurisdiction may be exercised up to the limits of the constitution. There are two types of
personal jurisdiction: specific jurisdiction and general jurisdiction. A court will have specific
jurisdiction when the activities that gave rise to the case happened in the forum state and general
jurisdiction occurs when the activities that gave rise were unrelated to the forum state. Specific
jurisdiction is easier to find than general jurisdiction. Pennoyer v. Neff, 95 U.S. 714 (1878)
established four ways to attain general jurisdiction: 1) the defendant's presence in the forum state,
including corporations, 2) if the defendant is a domicile of the forum state, 3) if the defendant
consented to being sued in the forum state, and 4) Quasi in Rem (the suit of the thing), where

Overview: China is the world 's largest power generator in 2011. Net power generation was
estimated 4,476 Terawatt–hours in 2011. Electricity generation increased by more than 89% since
2005. The industrial sector currently accounts for three–quarters of China 's electricity consumption.
Fossil–fired power has historically made up about three–fourths of installed capacity, and coal
continued to dominate the generation for electricity with 66% of total capacity in 2012.

Two grid companies (the State Power Grid (SPG) and the China Southern Power Grid (CSPG)) and
a diverse set of generation companies were established. In this way, the grid and generation in
electricity sector was separated. This provides a potential basis for developing vigorous competition
in the electricity sector. Also, the State Electricity Regulatory Commission (SERC) was established
as an independent regulatory body of the electricity sector in 2003. The goal of forming SERC is to
oversee fair market competition and eliminate monopolistic practices after the dismantling of CSPC.
Therefore, the regulatory framework has become one where the NEA is mainly responsible for
price, planning, investment and construction, and the SERC has become an independent regulator
under the State Council. The establishment of SERC demonstrates the government's commitment to
establish independent regulation in electricity sector. However, SERC lacked the authority to be an
effective regulator because the NDRC still controlled most decision making powers in the electricity
sector and the SERC became redundant. Eventually, in 2013, the SERC was merged into NEA. This
follows Chinese government's goal in creating an integrated regulatory system and enhancing
regulatory power. The NEA has more clearly designated regulatory power. Thus, SERC could be
viewed as a transitional institution. After fulfilling its role during the reform period, it is replaced

The California Department Of Justice
The California Department of Justice (DOJ) plans to amend various sections in the California Code
of Regulations pertaining to purchasing firearms. The DOJ's proposal will require future firearm
purchasers to pass a "safe handling demonstration" in addition to the existing written exam.
Customers will have to demonstrate that he or she can safely handle a long gun or handgun, which
include guns with alternative designs. However, the DOJ stated that these regulations are "currently
in effect as emergency regulations."
The DOJ claims that this regulation will increase public health because people who purchase
firearms will have some "basic familiarity with that firearm" and will know how to safely handle
and store the firearm. Yet, the DOJ presents no evidence to support this statement. Additionally, the
DOJ has implemented this regulation before the public hearing scheduled for November 24, 2015.
The DOJ should provide some evidence for implementing a regulation when the regulation does not
follow the normal procedural rules.
Still, the "safe handling" concept is similar to obtaining a driver license. Drivers must pass a written
and practical exam before obtaining his or her license. This ensures that drivers know the rules of
the road and actually know how to drive on the road. Likewise, gun purchases must know the rules
pertaining to firearms and must actually know how to handle a firearm. Therefore, I would
recommend partial adoption of this regulation and suggest some

Government Intervention Vs. Self Regulation
Business Ethics: Government Intervention vs. Self–Regulation Wealth brings power and power can
at times bring corruption. In today's economy where individuals are no longer the concern when it
comes to wealth, the global attention is drawn to corporations who hold the majority of our wealth.
This calls for us to take cetain measures that can ensure the existence of a socially responsible
behavior amongst all corporations, and these measures could be introduced in many forms, quite
possibly the most favorable currently being government intervention. However, government
intervention is not always the best method for ensuring social responsibility and ethical behavior
amongst corporations. A much better alternative is a self–regulatory economy along with a
combination of freedom and transparency in order to ensure responsible behavior in corporations, in
addition to an increase in efficiency and flexibility in regards to resources and innovation. The first
step is to realize exactly how out of control government regulations have become. In his article at
Wall Street Journal, Regulations Run Amok–And How to Fight Back, Charles Murray notes "the
number of federal crimes you could commit as of 2007 (the last year they were tallied) was about
4,450, a %50 increase since just 1980." Furthermore, Murray brings to light the fact that other than a
handful few, these crimes are not acts that are bad or evil in nature, and instead are labeled crimes

The Low Calorie Frozen Microwaveable Food Company
Introduction
This is a follow up to the previous two assignments for the low calorie frozen microwaveable food
company and how the company wants to expand and make long term budgeting decisions. With
facing increases in costs and also the expansion this assignment will answer the basic questions for
review about what the company can do to be able to move ahead with these challenges and come out
profitable.
Pricing strategies for making a change in this microwaveable low calories frozen food would be to
look at the basics of pricing strategies and the market mix. To create a pricing strategy, the company
needs to take into account the target group and the willingness to pay for the product to make sure
that the market segmentation and where the price is going to be set at, should be a key point in
determining the anticipated rate of price since the product in itself is elastic in nature. Being an
elastic company means that the company has flexibility, the ability to meet fluctuations and
unplanned changes to demand the potential to take on more contracts and not forfeit seasonal work,
financial stability, accounting for fluctuations in a far more controlled way, increase work flow
without jeopardizing SLAs or impeding regulatory standards, improved staff efficiencies from well–
organized working conditions (retrieved Logistics & Transport Focus, 16(11), 56–57.) By this the
change in price will not necessarily cause a huge change in the quantity of demand by the
consumers,

such as the taxi industry, legal system, and customer behavior. Certain critiques regarding the safety,

Uber.
According to the TPLA (Taxicab, Limousine & Paratransit Association), in association with Who's

perpetuated by Uber drivers (2015). Despite Uber's added Safe Ride fee feature to reduce cases of
assault on users, problems still emerge. Uber's added Safe Ride fee does not do enough to hinder
many types of assault, primarily cases of sexual assault, which Uber has been charged with on
multiple occasions. CBS News criticizes the lack of accountability from Uber headquarters as the
main reason why passenger safety and security are an issue (Picchi, 2015).
Uber practically hires anyone as a driver. One report on 7 ABC News criticizes the regular

Regulatory Risks And Regulatory Risk Management
What is regulatory risk and regulatory risk management?
There is no one definitive definition of "regulatory risk", but most people have a good understanding
of what this term means. One way of looking at regulatory risk is that it is the risk of getting
negative attention from a regulator or having the "licence to operate" withdrawn by a regulator.
Clearly, this would adversely impact on the economic value of any organisation, regardless of size.
Regulatory risk management involves the identification of the different types of regulatory risk,
assessing the impact of these risks, determining the risk appetite of the organisation, and putting in
place risk management procedures and controls.
Why is regulatory risk management important?
Regulatory risk management brings many benefits to an organisation. It goes without saying that,
put very simply, proper and effective regulatory risk management keeps an organisation out of
trouble. This is because it informs the decision makers on how to operate the business, from
managing day–to–day activities such as processing routine transactions, to attending to atypical
matters such as assisting in a regulator's investigation. With enhanced decision making and greater
operational efficiency, regulatory risk management can derive a genuine competitive advantage for
any organisation. Excellence in regulatory risk management also differentiates – an organisation can
be distinguished from its competitors by the confidence the market has in

Vega–Gordilio and Alvarez–Arce (2003) states economic freedoms exist in the following
conditions; property acquired without the use of force, fraud, or theft is protected from physical
invasions by others. Economic freedoms exist when individuals are free to use, exchange, or give
their property to another as long as their actions do not violate the identical rights of others (Vega–
Gordilio & Alvarez–Arce, 2003). Environmental laws are established by the Environmental

limitations on individuals and organizations in order to protect the environment, endangered species,

Providing society with an increase of economic freedom will likely increase harm to the
environment (Ozler & Obach, 2009). Ozler and Obach (2009), states that the less freedom afforded
for capitalism through government regulations, the better the ecological footprint. Government
penalties and regulations require businesses to dedicate funds and resources to avoid harming the
environment. Endangering the ecology presents the choice of saving lives or spending money.
Almost everyone would vote to save lives but in many cases businesses will vote for legislation that
will increase the organization's bottom line (Smith & Jeffreys, n.d.). Government intervention is
needed for the protection of the environment, which subsequently protects the human race.
Federal air quality regulations, regulatory protection for endangered species, federal programs for
the cleanup of hazardous waste sites, the Clean Water Act, and Federal mandates for automobile fuel
efficiency, are just a few of the laws imposed by the government to protect the environment. Many
of government programs are costly for businesses and some even counter–productive. Government
intervention is called for when market activities impact environmental quality (Frazier, 2003).
Fulton (2010), states that the heavy environmental regulations have actually strengthened the
economy. The regulations imposed by the government put pressures on private business to comply.

The And Exchange Board Of India

  • 1. The And Exchange Board Of India INTRODUCTION The neo–economic liberalization undertaken in India in the 1990s, lead to a new and improved market structure. It redefined the roles of the various agents in the economy and founded a system based on the market forces. It was in the backdrop of these changes that there was a marked shift in the role of the government from an agent that ran businesses to an agent that primarily undertook regulation and supervision to ensure optimization in the running of the businesses in India. This shift in the role of the state ushered in an era of regulators . The regulators embodied the expertise, domain knowledge and the impartiality that the government influenced by the political party in power could not effectively provide. It was ... The Intermediaries Regulations 2008, were notified in May 2008 and brought about substantial changes in the treatment and compliance requirements of intermediaries in the Indian securities market. This paper seeks to analysis the functioning of the aforesaid regulations in the context of the Indian securities market. It begins with a brief introduction on the meaning and definition of intermediaries along with the circumstances in which the Intermediaries Regulations, 2008 were enforced. The next section delves deeply into the various provisions of the regulations. The concluding section deals with the success of the regulations and tries to identify lacuna in the implementation to create a more efficient system for regulating the securities markets that the SEBI is trying to achieve. DEFINITION OF INTERMEDIARIES AND THE NEED FOR THE INTERMEDIARIES REGULATIONS, 2008 Before any progress can be made in determining the exact regulatory structure envisaged by the Intermediaries Regulations of 2008, it is important to discuss the scope of the term intermediaries and the various agents of the market that it seeks to incorporate within its ambit. In common parlance, intermediaries can be understood as middlemen. With the expanding markets and opening ... Get more on HelpWriting.net ...

  • 3. Action Against The Government Of Italy Francovich brought action against the government of Italy for failing to implement the Directive 80/987, that required the protection of employees in the event of their employer's insolvency. Francovich and other applicants were owed wages by their employers who became bankrupt. Since they could not sue their employers (because that would involve horizontal effect which is not possible with a Directive) they sued the Government of Italy which had failed to apply the Directive that aimed to create institutions for compensating employees. In the first claim the European Court found that the Directive lacked of direct effect. However, EU Law would be enfeebled if citizens could not acquire remedy when their rights were breached by a state failing to comply with the EU Law obligations. Eventually, the Court of Justice in the second claim, decided based on the Article 5 EC that Italy failed to satisfy its Treaty obligations. So, Francovich set the three conditions under which an individual who suffered a detriment could bring proceedings directly against the member state. The first condition is that the outcome prescribed by the directive involves the grant of rights to individuals, the second condition is that it is essential to identify the content of those rights from the directive and lastly the third condition is that there must be a causal link between the Member State's negligence and the detriment suffered by the individual. Nonetheless, the principle of state ... Get more on HelpWriting.net ...

  • 5. A Report On The Taxi Industry Introduction The taxi industry is closely linked with people's life and it is seriously regulated in most cities in Australia. This review examines an article that links cost of regulation to taxi industry in Sydney. The article, "The High Cost of Taxi Regulation, with Special Reference to Sydney," was written by Peter Abelson, a part–time economic advisor to the NSW Treasury. As the title of the article indicates, the author found some papers that show the taxi industry in Sydney is over regulated under some regulations, which are regulations of industry structure, quantity, services and prices. The cost of taxi deregulation is lower than taxi regulation. The article shows a conclusion that the productive forces and services revenue would be greater if other rules which restrict taxi services were canceled. The NSW government does not make any changes because of insufficient understanding of the advantages of market regulations. This review will summary the main points of Peter's paper first, then put forward the personal view about the article and conclude with some suggestions. Summary This section contains a summary of the article "The High Cost of Taxi Regulation, with Special Reference to Sydney." In the paper, the author indicates the structure of the article in the introduction. In addition, Peter describes the regulations of taxi industry in Sydney and analyzes the results. After this part, the author discusses policy objectives and evaluates the net benefits of ... Get more on HelpWriting.net ...

Cost minimisation however, cannot be pursued without attention to quality – there must be a balance between the two Government Policies –All businesses operating in Australia are subject to policies applied by the three different levels of government – local, state, and federal. Government policies have a big impact on Qantas. For example their economic policies (monetary, fiscal policy) have a direct impact of the level of economic activity and therefore demand for its service. The federal government's new policy the Fair Work Act is a lot more pro worker which has increased Qantas' operating costs. All businesses must be aware and understand all government policies in order that they are abiding by the law. Legal regulation – The aim of government regulation of business is to promote safety and fair business conduct. To remain in operation, a business like Qantas must comply with these regulations. Penalties for non–compliance can be severe. Examples include, Qantas is subject to the regulatory control of Civil Aviation Authority and is required to hold operating licences, State government regulations on labour such as OH&S, anti–discrimination, workers compensation etc. Being in the food industry it is critical that McDonalds meet and go beyond the food safety laws; that include food being cooked and stored at the right temperatures and the correct food handling procedures. He uses these four sealed black boxes to "demonstrate that Western institutions have indeed degenerated" (Ferguson page 11). The first of these "long–sealed" boxes is " labelled 'democracy'. The second is labelled 'capitalism'. The third is 'the rule of law'. And the fourth box labelled 'civil society'" (Ferguson). Each one of these boxes are an important part of how our civilization works. In his approach to democracy, Ferguson, relates to the distributional characteristics of this concept with special reference to what whether or not we are witnessing a fundamental breakdown that of which Edmund Burke called "the partnership between generations." Ferguson then moves on to his discussion of capitalism by discussing: "What is the right balance to be struck between economic freedom and government regulation"? Here his discussion focuses on whether "excessive regulation has become the disease rather than the cure" for the financial crisis that began in 2007 (Ferguson page 3). Adam Smith also wrote a book on capitalism and that is where he coined the term "stationary state." The third black box that Ferguson talks about is the rule of law. Here he favors the common law as it was practiced in the United Kingdom. He supports his argument when comparing other systems of law with common law he modifies the concept of the rule of law to compare different codes of law to "what might be called the 'law of rules': the way that law itself is made." Ferguson believes that American law is becoming noncompetitive with other countries and this is true. Neill Ferguson's final black box concept describes why we are in a stationary state ... According to the Singapore consumer watchdog, there have been an increasing number of complaints against tuition agencies in the country. With the given situation, the quality of education is then compromised. Several agencies remain to be unregulated, making and following their own rules. Given the standard regulations and procedures, owners still remain to be deviant. Others owners are informed however, that they still manage to overlook the standards. To serve as a guideline, the following is a discussion on the standard procedures on how to set up a tuition agency in Singapore. • 26. Government And Large Financial Institutions Research suggests that government and large financial institutions should not be allowed to regulate cryptocurrency, because eventually it will change cryptocurrency to mirror our current paper currency system, and ultimately remove the freedom and anonymity associated with the use of cryptocurrency. The use of Cryptocurrency has become more prevalent across the globe. Regulation seems like the next logical step in evolution and legitimacy, but this will ultimately lead to large financial institutions and government establishing the standards and determining the value. At that stage cryptocurrency may still be categorized as a decentralized form of currency, but the behavior will be that of a centralized system overseen by the same institutions who govern our monetary systems today. Many people think of cryptocurrency as a new and innovative payment system, yet it's much like forms of money that the world has seen in the past, before governments and central banks exerted their control. In many ways, cryptocurrency completes the cycle started when money began to take hold in the Renaissance, when value and control was not determined by any government but rather by the issuers of notes and the customers who used those notes. One of the most popular cryptocurrencies available is Bitcoin. Bitcoin is regulated differently in the People's Republic of China (PRC), Canada, and the United States, and no country has currently backed Bitcoin. Launched in 2009, and founded by Satoshi ... Organisational sectors can be seperatred for the most part into 3 camps; Public sector – Is a government run organisation (HMRC) which takes money from the public in the form of taxes, and allocates some of the funds to to other public sector organisations, (such as the Met. • 30. Government Regulation And Its Effect On Society Essay The world is a complex and intricate machine, with many pieces to create a much larger thing. Government and society are simply pieces of the same machine that depend on each other. Likewise, government and society have the option to liberate or limit the activities of men and it is a necessary occurrence of life. Government is dependent on society because social behaviors exists wherever there are good or bad, proper or improper relationships between human beings. Humans install government from their own belief that human behavior is "self–centered" therefore society requires governing. Likewise, government oversight is needed in the economy as well as in society. The appropriate role of government in the economy is different from a typical liberal stance. Although the economy is an ever–changing machine that rises and falls due to no fault of its own some feel that government regulation is needed. Without government regulation in the economy, free market trade could set the bar for interest rates, trade tax, business monopolies, and currency value. "...the safety of the republic lay in the autocratic strength of its government..." this quote from Franklin Roosevelt's Commonwealth Club Address displays how the main objective for a strong central government is to protect the people. To further protect the people of the United States, the presences of a strong government in the financial sector is crucial to prohibit the use of banks raising the interest rates to a level where ... • 32. The Contradiction Of Opposing Regulation The Contradiction of Opposing Regulation Under public interest theory, regulations exist to protect consumers, to protect workers, and to protect the rights of the least advantaged. They exist to hedge against the greed, corruption, and exploitation that can occur in an unchecked capitalistic society. They attempt to prevent or ameliorate detrimental consequences to individuals and communities. Granted, this can be seen as an idealistic view of regulation. Exponents of public interest theory argue that even well–intentioned regulation can fail to achieve what it set out to do, and politicians are imperfect and subject to pressure both by corporations and vocal minorities (Koopman et al., 2014). Nonetheless, in the United States, these democratically elected local and federal representatives have put regulations in place that, unless given reason for doubt, are presumed to reflect the will of their constituents. Therefore, rebelling against regulation is not simply renouncing the government – in some cases, it is renouncing the concerns of the communities that these companies argue they are improving. Airbnb's $8 million snarky ad campaign against a housing affordability bill in San Francisco was widely panned as "tone–deaf." Stress is a state of mental tension that is very familiar in present–day society. It is a topic that is much debated in media coverage, and has been associated with significant impacts on both mental and physical wellbeing (Iwasaki, 2003). While the repercussions of stress are well–established field of research in the health and social fields, research in stress management and the different coping mechanisms is still on debatable grounds (Iwasaki and Mannell, 2000). Research on leisure–the free time in which non–working activities are enjoyed– is particularly oriented on the different strategies employed to effectively cope with stress through its many activities such as physical exercises (Nguyen–Michel, Unger, Hamilton, and Spruijt–Metz, 2006), social interactions (Patry, Blanchard, and Mask,2007) and other personal relaxation activities (Iwasaki, 2000). Studies done by researchers Iwasaki and Mannell (2000) have shown that leisure activities serve as a regulatory system of stress intake This regulatory process involves both coping beliefs–the actions the persons take in regards to personal characteristics and environments (e.g. writing for an introvert) – and coping strategies –the actions a person takes in regards to situations (e.g. socializing with friends after a harsh final) (Iwasaki and Mannell, 2000). • 36. The Problem Of A Free Lunch "There's no such thing as a free lunch" a very common saying in Economics because it emphasizes that every decision requires a trade–off, and although one person may be getting a deal there is always another side to the story. John Komlos, a well respected Economist, felt economics students left their introductory classes under the impression that in the real world, perfect competition and efficiency are very common in the market, with few market failures, and government intervention in the economy is generally bad and leads to losses (2). In theory and for in–class examples this view of the economy is very straight–forward and makes teaching easier. However, in the real world; there is another side of the story. Free markets do have downsides and need some government regulation alongside being guided by morals. Americans pride themselves extensively on being free and letting the people choose how to live, but should everything in our country be left up to the public? The free–market has the potential to be an efficient and positive system for all those involved. Theoretically, consumers make themselves heard through their purchasing power, this creates competition and ensures companies supply only quality products for fair prices (1). Unfortunately, creating competition also has a Darwin effect on the producers(1). Suddenly, rivalries are formed and making the highest profits becomes the sole purpose of the company. • 38. Free Market Economy The United States is known to operate in a free market economy. In other words, the economy is based solely on supply and demand with little to no government control. In reality, however, the United States has various government regulations on our country's market. The amount of regulation that is necessary is a continuing debate among politicians and economists to this day. Some would say that the key to a successful market economy is to remove government restrictions in order to force businesses to provide superior products and services at affordable prices. Yet, others assert that government regulations are essential in protecting consumers, stemming from the assumption that corporations are not always looking out for the public's interest. Of course, there are various advantages and disadvantages associated with each level of regulation, however it is safe to assume that there must be a balance between an unregulated free market and a regulated economy in order to protect people and the environment and allow the economy to flourish. Advantages of a Free Market Economy A free market is driven by individual innovation and the concept that hard work and initiative will be rewarded with success. Because of the ingenuity factor, there is plenty of competition in the market place. Therefore, the rivalry between companies provides the best possible product to the customer at the best price. The Financial Services Act 1986 (FSA 1986) marks a step change in the nature and extent of UK investment business regulation. April 1988 sees the introduction of a regulatory system that has investor protection as its main aim. The system is based on five selfregulating organisations (SROs);48 membership organisations tasked with the creation, monitoring and enforcement of rules for their respective members. Show more content on Helpwriting.net ... The supervisory culture at the FSA is often characterised by a series of overarching approaches and themes, such as 'more principles–based regulation' and 'Treating Customers Fairly'. The FSA Handbook, a set of rules to which regulated firms are subject, becomes increasingly prescribed by EU legislation. This is aided by the FSA's move to the socalled 'copy–out' approach, transposing directives word for word, where possible, in order to avoid 'gold–plating'. The FSA grows in size and cost through greater activity for the Financial Ombudsman Service and increasing calls on the Financial Services Compensation Scheme, fuelled by a growing number of consumer complaints especially around bank charges and payment protection insurance. The FSA also increases its enforcement activity, especially on market issues and in terms of stepping up fine sizes. Financial crisis and beyond The single regulatory structure is restructured as a response to the crisis. National supervisors face greater harmonisation of practice at EU level. The need to prop up the banking system introduces a new actor, the Resolution Authority (in the UK a role of the Bank of England), as the Tripartite Authorities50 put in place legislation to deal with bank resolution after the collapse of Northern Rock. Major banks are now required to have recovery and resolution plans ('living wills'). Government announces the planned break–up of the FSA in 2012. It transfers the prudential supervision of banks ... • 44. The Act Of Texas And The Sunset Advisory Commission ( Sac ) In 2013, a proposal was written by a branch of the Texas state government called the Sunset Advisory Commission (SAC). This proposal would, if made into law, deregulate 14,568 respiratory therapists (RTs) currently employed in Texas (Gaebler 6). This would mean that RTs along with 18 other programs would not have to hold a state license to practice their craft (Sunset 52). Deregulation may sound like a good idea on paper, however in practice, it is anything but. The potential negative outcomes in the form of patient harm and possible death would far outweigh any benefit. Deregulation of respiratory therapists in Texas began in the government as a proposal, was fought against by those who say the potential danger in the idea, then ended back in the government with a compromise that was written into law. In May of 2014, the SAC released a report. This report states that the commission felt that RTs along with several other professions should no longer be regulated by an agency of the government called the Department of State Health Services (DSHS) (52). One of the many responsibilities of the DSHS is providing state licensure to individuals of various job disciplines which both can and do have an impact on public health (43). The SAC brings up a few key points in the report: First, the SAC argues that, the DSHS is under staffed and underfunded for the amount of tasks it must manage (4). • 46. Mechanisms for the Regulation of Biological Processes The regulation of essential biological processes such as metabolism, growth and reproduction is a hallmark of living systems. Cells, the fundamental units of life, employ a variety of mechanisms to achieve this exquisite control, and regulation of the activity of proteins provides a means to fine– tune cellular processes. One of the ways of controlling the activity of proteins is to alter the absolute levels of a protein in a cell. This is achieved either by altering the levels of the mRNA coding for the protein or by altering the stability of the protein in the cellular environment. Transcriptional regulation, along with the presence of microRNAs, is a common mechanism employed by cells to alter the levels of mRNA (1–5). The amount of a protein in the cell is essentially determined by the balance of its rates of synthesis and degradation (6). The stability of a protein can be regulated by different mechanisms including degradation (7, 8), molecular crowding (9), disulfide bond formation, and small molecule binding (10–12). In addition to controlling the absolute level of a protein, the activity of a protein can also be regulated by covalent modification, interaction with other proteins, or binding of small molecules. Covalent modification of a protein involves the attachment of a functional group resulting in phosphorylation (13, 14), glycosylation (15), or acetylation (16). A protein can also be covalently modified by attachment of another protein resulting in ... Get more on HelpWriting.net ...

  • 52. The Use Of Biologics And Medical Devices Should Be Strict The level of regulation governed by the FDA over drugs, biologics & medical devices is a widely debated topic. In my point of view, the level of regulation on drugs, biologics and medical devices should be strict. The current regulations governed by the FDA are very strict and should remain that way because the base of these regulations are underlined by various tragedies which we don't want to be repeated. For instance, the thalidomide incident in which many children were born with Phocomelia (shortening or absence of limbs). Thalidomide, which started as an OTC drug in 1957 as a remedy for sleeplessness was later found to have off–label effects such as mitigation of morning sickness in pregnant women. Hence was then prescribed worldwide to pregnant women. However, in 1962 Frances Kelsey prevented the approval of this drug in the USA. This resulted in Harris– Kefauver Amendment in 1962 which tightened the investigation and approval of drugs requiring the manufacturers to prove their safety and efficacy. Many incidents could be avoided in the past if the regulations were firm and so there is an utter necessity of governing bodies for oversight of clinical trials, new drug development and manufacturing of drugs, biologics and medical devices. Many of these unfortunate events were mishaps, but there are many such incidents which are the result of greed and corruption leading to adulteration of drugs, cosmetics and food products. In essence, a lender runs the risk that a borrower will engage in activities that are undesirable from the lender's point of view, making it less likely that the loan will be paid back. Gary H. Stern's article, "Managing Moral Hazard with Market Signals: How Regulation Should Change with Banking", addresses the moral hazard problem inherent to the financial safety net provided by the government protection of depositors. Interest rates do not reflect the risk associated with bank activity, which in turn causes banks to finance higher–risk projects with price tags that are not parallel to the risk level. The first trend is increased asset concentration among larger banks. Over time, more assets have flowed into fewer banks, and as a result more TBTFs were incubated in the process. The second trend to emerge is increased complexity of banks. Increase of bank sizes involved not only structural growth but also geographic reach. Larger banks begin to offer a greater scope of offerings. With this plethora of change amid increased sizing, new skills needed to be developed in order to manage the new risk. The complexity and size of banks and their associated offerings caused a greater level of asymmetry between regulators and bank managers. Opponents of the safety net provided by the government have offered several alternate options, one of which is little government intervention, if at all. Such Laissez Faire approach, according to Stern, is that they do not credibly address the potential for instability in the banking system nor the TBTF problem. • 62. The Constitutional Basis Of Personal Jurisdiction Jurisdiction Personal jurisdiction refers to the ability of a court to exercise its power over a particular defendant or item of property. Personal jurisdiction may be categorized as in personam, in rem, or quasi in rem. The primary restraints on a court's power to exercise personal jurisdiction are found in the United States Constitution, state statutes, and case law. The Constitutional basis for personal jurisdiction comes from the due process clause of the 14th Amendment. The statutory basis comes from most states adopting what is called a long arm statute that states the limits of personal jurisdiction that a state has over the defendant. Most long arm statutes, including CA, state that their personal jurisdiction may be exercised up to the limits of the constitution. There are two types of personal jurisdiction: specific jurisdiction and general jurisdiction. A court will have specific jurisdiction when the activities that gave rise to the case happened in the forum state and general jurisdiction occurs when the activities that gave rise were unrelated to the forum state. Specific jurisdiction is easier to find than general jurisdiction. Pennoyer v. Neff, 95 U.S. 714 (1878) established four ways to attain general jurisdiction: 1) the defendant's presence in the forum state, including corporations, 2) if the defendant is a domicile of the forum state, 3) if the defendant consented to being sued in the forum state, and 4) Quasi in Rem (the suit of the thing), where ... However, SERC lacked the authority to be an effective regulator because the NDRC still controlled most decision making powers in the electricity sector and the SERC became redundant. Eventually, in 2013, the SERC was merged into NEA. This follows Chinese government's goal in creating an integrated regulatory system and enhancing regulatory power. The NEA has more clearly designated regulatory power. Thus, SERC could be viewed as a transitional institution. After fulfilling its role during the reform period, it is replaced with better practice ... Get more on HelpWriting.net ...

  • 66. The California Department Of Justice The California Department of Justice (DOJ) plans to amend various sections in the California Code of Regulations pertaining to purchasing firearms. The DOJ's proposal will require future firearm purchasers to pass a "safe handling demonstration" in addition to the existing written exam. Customers will have to demonstrate that he or she can safely handle a long gun or handgun, which include guns with alternative designs. However, the DOJ stated that these regulations are "currently in effect as emergency regulations." The DOJ claims that this regulation will increase public health because people who purchase firearms will have some "basic familiarity with that firearm" and will know how to safely handle and store the firearm. Yet, the DOJ presents no evidence to support this statement. Additionally, the DOJ has implemented this regulation before the public hearing scheduled for November 24, 2015. The DOJ should provide some evidence for implementing a regulation when the regulation does not follow the normal procedural rules. Still, the "safe handling" concept is similar to obtaining a driver license. Drivers must pass a written and practical exam before obtaining his or her license. This ensures that drivers know the rules of the road and actually know how to drive on the road. Likewise, gun purchases must know the rules pertaining to firearms and must actually know how to handle a firearm. Therefore, I would recommend partial adoption of this regulation and suggest some ... Get more on HelpWriting.net ...

  • 70. Government Intervention Vs. Self Regulation Business Ethics: Government Intervention vs. Self–Regulation Wealth brings power and power can at times bring corruption. In today's economy where individuals are no longer the concern when it comes to wealth, the global attention is drawn to corporations who hold the majority of our wealth. This calls for us to take cetain measures that can ensure the existence of a socially responsible behavior amongst all corporations, and these measures could be introduced in many forms, quite possibly the most favorable currently being government intervention. However, government intervention is not always the best method for ensuring social responsibility and ethical behavior amongst corporations. A much better alternative is a self–regulatory economy along with a combination of freedom and transparency in order to ensure responsible behavior in corporations, in addition to an increase in efficiency and flexibility in regards to resources and innovation. The first step is to realize exactly how out of control government regulations have become. In his article at Wall Street Journal, Regulations Run Amok–And How to Fight Back, Charles Murray notes "the number of federal crimes you could commit as of 2007 (the last year they were tallied) was about 4,450, a %50 increase since just 1980." Furthermore, Murray brings to light the fact that other than a handful few, these crimes are not acts that are bad or evil in nature, and instead are labeled crimes simply because the government ... According to the TPLA (Taxicab, Limousine & Paratransit Association), in association with Who's Driving You? – a public awareness campaign – there have been increasing incidents of assault perpetuated by Uber drivers (2015). Uber's added Safe Ride fee does not do enough to hinder many types of assault, primarily cases of sexual assault, which Uber has been charged with on multiple occasions. CBS News criticizes the lack of accountability from Uber headquarters as the main reason why passenger safety and security are an issue (Picchi, 2015). Uber practically hires anyone as a driver. • 76. Regulatory Risks And Regulatory Risk Management What is regulatory risk and regulatory risk management? There is no one definitive definition of "regulatory risk", but most people have a good understanding of what this term means. One way of looking at regulatory risk is that it is the risk of getting negative attention from a regulator or having the "licence to operate" withdrawn by a regulator. Clearly, this would adversely impact on the economic value of any organisation, regardless of size. Regulatory risk management involves the identification of the different types of regulatory risk, assessing the impact of these risks, determining the risk appetite of the organisation, and putting in place risk management procedures and controls. Why is regulatory risk management important? Regulatory risk management brings many benefits to an organisation. It goes without saying that, put very simply, proper and effective regulatory risk management keeps an organisation out of trouble. This is because it informs the decision makers on how to operate the business, from managing day–to–day activities such as processing routine transactions, to attending to atypical matters such as assisting in a regulator's investigation. With enhanced decision making and greater operational efficiency, regulatory risk management can derive a genuine competitive advantage for any organisation. Excellence in regulatory risk management also differentiates – an organisation can be distinguished from its competitors by the confidence the market has in ... Get more on HelpWriting.net ...

Economic freedoms exist when individuals are free to use, exchange, or give their property to another as long as their actions do not violate the identical rights of others (Vega– Gordilio & Alvarez–Arce, 2003). Ozler and Obach (2009), states that the less freedom afforded for capitalism through government regulations, the better the ecological footprint. Government penalties and regulations require businesses to dedicate funds and resources to avoid harming the environment. Endangering the ecology presents the choice of saving lives or spending money. Almost everyone would vote to save lives but in many cases businesses will vote for legislation that will increase the organization's bottom line (Smith & Jeffreys, n.d.). Government intervention is needed for the protection of the environment, which subsequently protects the human race. Federal air quality regulations, regulatory protection for endangered species, federal programs for the cleanup of hazardous waste sites, the Clean Water Act, and Federal mandates for automobile fuel efficiency, are just a few of the laws imposed by the government to protect the environment. Many of government programs are costly for businesses and some even counter–productive. Government intervention is called for when market activities impact environmental quality (Frazier, 2003). Fulton (2010), states that the heavy environmental regulations have actually strengthened the economy. The regulations imposed by the government put pressures on private business to comply. As ...
