17. CRITICAL ISSUES
• BSPC Sub-Vendor M/s ITD Cementation stopped work on site from
23.05.2023 due to payment and other contractual issues. Progress of
Ground Improvement i.e. stone column, BCIS piling and other civil
construction work at site is completely hampered.
• Only one Stone column Rig is deployed at present. UNL asked BSPC to
ensure deployment of two more stone column rigs as committed by them
on 05.04.2023 & 17.05.2023 during VC with Chairman UNL in order to
complete the works before monsoon.
• BSPC was to deploy at least 500 nos. manpower by 30.04.2023 as
committed by them on 05.04.2023 during VC with Chairman UNL.
Presently only 413 nos. manpower is deployed at site. BSPC must adhere
to their commitment and enhance the manpower to 500 nos. immediately
and improve the construction material availability as per site requirement.
• Construction material e.g. OPC Cement and Rebar for Chimney shell
casting work and PPC Cement, Rebar and Liner plate for other civil works
should be made available at site in sufficient required quantity by BSPC.

18. CLAIM NOTICE FILED BY BSPC
BSPC submitted claim notice vide Reference No:
SPC/ANPARA-D/LTR/23-24/277 dated 05.06.2023 received
through email.
Total Claim Value for Contract-1 USD 10.30 Millions
Total Claim Value for Contract-2&3 INR 232.04 Crores
BSPC stated that there was a pressing requirement for UPRVUNL to
proceed for an equitable adjustment of the Contract price, as mandated
and allowed under various clauses of the Contract, including but not limited
to Article 3.1 & 3.2 of the Contract, as well as (among others), Clause 35
(Unforeseen Conditions), Clause 36 (Change in Laws and Regulations),
Clause 37.6 (Force Majeure) and Clause 39 (Change in the Facilities), of
the GCCs
SETTLEMENT OF DISPUTES / NOTICE OF MUTUAL CONSULTATION,
UNDER CLAUSE 6.1 OF THE GCCs.
