Description: The Foreign Account Tax Compliance Act (FATCA) was signed into law on 18 March
2010 by President Obama as part of the Hiring Incentives to Restore Employment (HIRE) Act. The
purpose of FATCA is to reduce the possibility of US tax evasion by US individuals (through personal
accounts or legal constructs) via financial institutions and investment vehicles outside of the US. The
IRS plans to do this by requiring all financial institutions such as Barclays – banks, asset managers,
global custodians and insurance companies – to identify and report US accounts to the IRS.
FATCA introduces a withholding tax of 30% to be applied on any US source income and gross
proceeds paid to non-participating foreign financial institutions and/or any other person or entity that
does not identify themselves (where they are seen to be US). The new withholding tax can be
avoided if foreign financial institutions enter into an agreement with the IRS to carry out due
diligence on their new and existing accounts and report on specified US persons annually.
