Penamaan qiradh mempunyai 2 interpretasi. Menurut ahli Basrah dinamakan itu karena pemilik modal memotong hartanya dan potongan harta tersebut adalah dinamakan qiradh. Interpretasi kedua menurut penduduk baghdad adalah karena kedua belah pihak adalah son’an (pembuat / pengusaha), pemilik modal bertugas mengusahakan modal dan pekerja berusaha memberdayakan modal tersebut.
Dari jaman kenabian Qiradh tersebut berkembang seiring perkembangan jaman yang modern sampai sekarang ini. Para kalangan pengusaha seperti pemberian kredit dan pembiayaan seperti yang ada pada perbankkan syariah dan finance yang berdiri dan berkembang di indonesia.

Adopting specific sources to derive laws is a major subject in Usul al Fiqah. The “QURAN “,
“SUNNAH”, “IJMA”, SAHABAH”, (consensus of the companion), and “QIYAS” are the four
sources in Islamic that are accepted by almost all of the scholars.

In Islam there are 2 types of sources of lawmaking:

1. The Holy Qur’an:
The Holy Qur’an is the scripture of Islam, believed by Muslims to be the direct and unaltered
word of Allah. It is the first and the most authentic source of knowledge about Allah’s
Book i.e. the Holy Qur’an.
Hadith (Sunnah):
Sunnah linguistically means a path or away. Sunnah refers to all that is
narrated from the Holy Prophet (S.A.W) which includes:
1) His Acts
2) His sayings.
3) Whatever he has approved
The Six Book of Reliable Hadith:
1. Sahih Bukhari
2. Sahih Muslim
3. Sunan al- Dawood
4. Sunan al-Tirmidhi
5. Sunan al-Nasa'i.
6. Sunan ibn Majah.
Discussed about the sources of Islamic law such as primary source (Quran, Sunnah, Ijmak & Qiyas) and secondary source (istishab, uruf, istihsan, & marsalih mursalah). also discuss of fiqh methods.
Maqasid as-Shariah is very important subject in understanding the whole picture of Islamic law. Without the knowledge about maqasid as-Shariah, people will not be able to see the beautiful of Islam as it has been described in the Quran as the rahmah or mercy to the universe. Maqasid as-Shariah shows that every single law or regulations in the Islamic teaching are meant for the benefit of the whole universe since Islam was revealed to the universe. Shari'ah aims at the welfare of the people in this life and in the life hereafter, and for this purpose it has advised people to adopt such means and measures that may give advantage benefit/well-being to them and may ward off evil/injury/loss, from them.
Maqasid al-Shari'ah comprises those benefits/welfare/advantages behind the revelation of Islamic Laws.
It aims at the attainment of good, welfare, benefits, and warding off evil, injury, loss, etc. for the creatures. (All this in Arabic terminology can be stated as Masalih al-'Ibad.)
Many jurists have tried to explain the aims and objectives of Shari'ah upon which it is established.
Among the outstanding figures are the Malikite Abu Ishaq al-Shatibi, the Shafite al-'Izz ibn 'Abd aI-Salam, and the Hanbalite Ibn Qayyim al-Jawiziyyah.

ABSTRACT: The formulation of Islamic law is based on a universal-humanity foundation, covering worldly
and hereafter interests, aiming to make people happy protect them from evil and destruction, and Islam is
suitable in various conditions, times and places. There is a greater difficulty if the development of Islamic law
does not want to go through the path of the goals of Islamic law, or at least the general principles of Islamic law.
Therefore, in the development of Islamic legal thought, thinkers are relatively quick to agree on ‗mashlahah‘ as
‗maqashid sharia‘ or what is more popularly known as the goal of Islamic law. More than that, maslahah in its
development is not only a legal goal but also becomes a proposition in the formulation of Islamic law itself. The
importance of research based on Islamic legal philosophy through the maqashid sharia of electronic commerce
(e-commerce), because it is a modern trading model, not discovered by researchers in classical fiqh, and even
contemporary fiqh before the 1990s, in Indonesia e-commerce began in the early 2000s. This qualitative
research paradigm and its type of normative legal research used secondary data traced and obtained from
libraries and internet sites to find new arguments regarding the formulation and purpose of Islamic law on ecommerce.

3. WHAT IS MAQASID AL-SHARI’AH?
The Maqasid (plural of maqsad) refers to
the aims, higher intents, objectives,
purposes, and goals, principles of Shari’ah.
These have been classified into 2 broad
categories.
1. Promotion of the common good and
benefit (maslaha)
2. Avoidance and protection from harm
(mafsada) – dar’ al-mafasid

4. According to Imam al-Qarafi,
“A purpose (maqasid) is not valid unless it
leads to the fulfilment of some good
(maslaha) or avoidance of some mischief
(mafsadah)”.
In other words, the maqasid of Shari’ah are
the fulfillment of maslaha and the
avoidance of mafsada.

5. Objectives of Maqasid Al-Sharia’h
The objectives (maqasid) are classified in
different ways by various scholars for
various purposes.
The traditional classification has been to
divide the maqasid according to 3 “levels of
necessity”:
1. absolute necessities (daruriyyat),
2. needs (hajiyyat) and
3. luxuries (tahsiniyyat)

Protection of Faith (Din)
Protection of Life (Nafs)
Protection of Posterity (Nasl)
Protection of Property (Mal)
Protection of Reason ('Aql)

8. Hajiyyat (Requirement)
All such provisions of Shari'ah which aim
at facilitating life, removing hardship,
etcetera, are said to fulfill the hajiyyah
(requirements).
For example, permission of hunting and
use of halal goods for food, lodging, and
conveyance,

9. Tahsiniyyat (embellishment)
Shari'ah beautifies life and puts comforts
into it. There are several provisions of
Shari'ah which are meant to ensure better
utilization, beautification and simplification
of daruriyyah and hajiyyah.

to have cold drinks and so on

The Meaning of Fiqh
The term Usul al-Fiqh is composed of two
terms:
a.Usul (pl. of asl)
Root (something from which another thing
originates)
b. Fiqh
Fiqh is :The knowledge of the sharia legal
rules, pertaining to conduct,/practical revealed
rulings, that have been derived/extracted from
their specific evidences/detailed evidences.

Accordingly the study of usul al-fiqh is a
study of the principles, the evidences, i.e.
a study of the rule, the sources of the rule,
and the method of extracting the rule from
these sources.

12. Abu Hanifah defined Fiqh as: A person’s
knowledge of his rights and duties.
Al-Shawkani: () It is the knowledge of
principles by means of which one has an
access to the derivation of the commands
of the shariah relating to the conduct of
man on the basis of its detailed evidences.

14. Benefit of Study of Usul alFiqh
The benefits of the study of Usul al Fiqh
are many. From a study of Usul, we come
to know the methods of interpretations of
the Quran and Sunnah, all the secondary
sources of Islamic law, the views on Usul
of major scholars of the past and present,
the rules of Qiyas and other methods of
Ijtihad, the history of development of
Islamic law and legal theory.

A Muslims, we should remain curious to
understand others better, humble in self-

threaten the greater maqasid brotherhood
and unity. These are clear obligations
(Fard /Wajib) and based on the Qur’an
and Sunnah. Difference of opinion is not
equivalent to disunity; and unity does not
