the Union address “…an
Electronic Health Record for
every American by the year
2014…by computerizing health
records, we can avoid dangerous
medical mistakes, reduce costs,
and improve care” (Bush, 2004). This was the first
time a president formally recognized the value of HIT
and set a deadline to do something about it! President
Bush went on to establish the Office of the National
Coordinator for HIT (ONC), and Dr. David Brailer was
appointed as the first coordinator by Tommy
Thompson, then Secretary of the Department of
Health and Human Services (HHS).
The support continued. In 2005, funding from
HHS was earmarked to establish organizations for
standards harmonization (HIT Standards Panel) and
for certification of electronic health record (EHR) sys-
tems (Certification Commission for HIT). In 2006, the
Agency for Healthcare Research and Quality (AHRQ)
launched its National Resource Center for HIT.
Government attention persisted in 2007 with the
funding of National Health Information Network pro-
totypes. Momentum was building and there was
much attention on HIT from the federal government.
Fast forward to 2009. President-Elect Barack
Obama says he wants the federal government to
invest in EHRs so all medical records are digitized
within 5 years and vows to continue to push for the
2014 deadline established by Bush. “This will cut
waste, eliminate red tape, and reduce the need to
repeat expensive medical tests,” he said, adding that
the switch also will save lives by reducing the num-
ber of errors in medicine (Obama, 2009).
President Obama then does more than talk about
HIT. He works with Congress to pass the American
Recovery and Reinvestment Act (ARRA), providing
unprecedented funding to promote health care reform
through the use of HIT. Incentives totaling $19 billion
are allocated for “meaningful use” of EHRs in hospi-
tals and ambulatory settings beginning in 2011. This
sets the stage for today’s focus on the use of HIT, and
the proliferation of EHR implementation projects in
our clinical settings. Let’s explore the legislative back-
ground and details surrounding the federal incen-
tives.
Legislative Background
On March 23, 2010, President Obama signed into
law the landmark Patient Protection and Affordable
Care Act (PPACA), a federal statute that represents the
most recent legislation in a sweeping health care
reform agenda driven into law by the Democratic
111th Congress and the Obama Administration. The
new law is dedicated to replacing a broken system
with one that ensures all Americans have access to
health care that is both affordable and driven by qual-

While HIPAA was intended for several beneficial purposes like making health insurance affordable and protecting patient data, loopholes in the act were being exploited by several parties and the electronic systems that were suggested to be incorporated into medical services were being ignored (Security, 2019). Thus, the HITECH act was proposed to pinch off the loopholes and to incentivize healthcare services to adopt the electronic health record (EHR) system.
To understand why HIPAA and HITECH acts were developed in the first place, it is first important to acknowledge that the healthcare service industry has both economic and political dimensions. HITECH is a government incentive program encouraging physicians to implement electronic health records (Security, 2019). This industry-wide EHR adoption incentive program costs the congress billions of dollars every year. The act uses financial incentives to not just encourage physicians to adopt EHR, but to adopt EHR certified by the government (Security, 2019). While electronic records have been used since the 1960s (although only sparingly), the widespread use of computers in the 1990s tipped the government to consider implementing a widespread adoption of an EHR that could help in the recording and exchange of clinical information (Security, 2019). Even by the year 2009, only a few doctors had adopted the digital capabilities of the information age to record and share medical information, with most of them still holding on to the use of paper to record and share information (Security, 2019). Thus, one of the main reasons behind the enforcement of EHR was the many-fold increase in efficiency provided by EHR.
In fact, the Obama administration, in 2009, even decided to spend billions of dollars to stimulate EHR adoption, and help guide physicians from the inefficiencies of a paper-based to protect patient privacy and improve health outcomes (EHR Meaningful Use Criteria, n.d.). Qualified professionals are eligible to receive up to $44,000 over five years in Medicare incentives and upto $64,000 in Medicaid incentives (EHR Meaningful Use Criteria, n.d.). However, any physician or healthcare service who waits could not only lose out but also get hit with penalties (Security, 2019). Typically, a physician has to prove that he uses a certified EHR system and demonstrate a “meaningful use” criteria of EHR use (Security, 2019). Each provider has to meet this comprehensive “meaningful use” criteria which break down into five big goals. And if even one aspect of this goal is not met by the physic.

EDI is used in health care to standardize electronic transactions so that electronic information being sent from one computer system to another will be the same. Thus, the HITECH act was proposed to pinch off the loopholes and to incentivize healthcare services to adopt the electronic health record (EHR) system.
To understand why HIPAA and HITECH acts were developed in the first place, it is first important to acknowledge that the healthcare service industry has both economic and political dimensions. HITECH is a government incentive program encouraging physicians to implement electronic health records (Security, 2019). This industry-wide EHR adoption incentive program costs the congress billions of dollars every year. The act uses financial incentives to not just encourage physicians to adopt EHR, but to adopt EHR certified by the government (Security, 2019). While electronic records have been used since the 1960s (although only sparingly), the widespread use of computers in the 1990s tipped the government to consider implementing a widespread adoption of an EHR that could help in the recording and exchange of clinical information (Security, 2019). Even by the year 2009, only a few doctors had adopted the digital capabilities of the information age to record and share medical information, with most of them still holding on to the use of paper to record and share information (Security, 2019). Thus, one of the main reasons behind the enforcement of EHR was the many-fold increase in efficiency provided by EHR.
In fact, the Obama administration, in 2009, even decided to spend billions of dollars to stimulate EHR adoption, and help guide physicians from the inefficiencies of a paper-based to protect patient privacy and improve health outcomes (EHR Meaningful Use Criteria, n.d.). Qualified professionals are eligible to receive up to $44,000 over five years in Medicare incentives and upto $64,000 in Medicaid incentives (EHR Meaningful Use Criteria, n.d.). However, any physician or healthcare service who waits could not only lose out but also get hit with penalties (Security, 2019). Typically, a physician has to prove that he uses a certified EHR system and demonstrate a “meaningful use” criteria of EHR use (Security, 2019). Week Five will introduce you to Electronic Data Interchange (EDI) and the Health Insurance Portability and Accountability Act of 1996 (HIPAA). EDI is used in health care to standardize electronic transactions so that electronic information being sent from one computer system to another will be the same. EDI is comprised of eight transactions, each of which are mandated by HIPAA.
HIPAA was enacted by Congress in 1996 to address the security and privacy of patient health information. HIPAA protects a patient’s health information from unauthorized use while allowing patients to still receive the care that they need. Regardless of what area of health care you work in, you will use HIPAA. Almost every intellectual claims to have the welfare of humanity, and particularly the
welfare of the poor, at heart: but since no mass murder takes place without its
perpetrators alleging that they are acting for the good of mankind, philanthropic
sentiment can plainly take a multiplicity of forms.
Two great European writers of the nineteenth century, Ivan Turgenev and Karl Marx,
illustrate this diversity with vivid clarity. Both were born in 1818 and died in 1883, and
their lives paralleled each other almost preternaturally in many other respects as well.
They nevertheless came to view human life and suffering in very different, indeed
irreconcilable, ways—through different ends of the telescope, as it were. Turgenev saw
human beings as individuals always endowed with consciousness, character, feelings,
and moral strengths and weaknesses; Marx saw them always as snowflakes in an
avalanche, as instances of general forces, as not yet fully human because utterly
conditioned by their circumstances. Where Turgenev saw men, Marx saw classes of men;
where Turgenev saw people, Marx saw the People. These two ways of looking at the
world persist into our own time and profoundly affect, for better or for worse, the
solutions we propose to our social problems.
The resemblances between the careers of these men begin with their attendance at Berlin
University at overlapping times, where both were deeply affected—even intoxicated—by
the prevailing Hegelianism. As a result, both considered careers as university teachers of
philosophy, but neither ever held a university post. They had many acquaintances in

common in Berlin, including Mikhail Bakunin, the Russian aristocrat who later became a
revolutionary anarchist, the philosopher Bruno Bauer, and the radical poet Georg
Herwegh. They shared a carelessness with money, perhaps because they were both born
into easy circumstances and therefore assumed that money would never be a problem.
Both started their writing careers as romantic poets, though more of Turgenev’s poetry
than Marx’s was published.
Their literary influences and tastes were similar. Each read widely in the Greek and Latin
classics; each could quote Shakespeare in the original. Both learned Spanish in order to
read Calderón. (Turgenev, of course, also learned it to speak the native language of the
great, but unsatisfactory, love of his life, the famous prima donna Pauline Viardot.) The
two men were in Brussels at the outbreak of the 1848 revolution against the July
monarch.
