• MYTH: You do NOT need to incorporate in order to
separate your blog money from your personal money.
• FACT: In most states, you WILL need to be
incorporated to have a checking account with your
business or blog name on it. Even a DBA (Doing
Business As) account usually requires it.

• It’s also used as part of Estate Planning in the case of
Single Adults / Single Parents

How should I proceed?
• Get an attorney and an accountant involved.
• A statewide search for businesses already registered
with a similar name needs to happen.
• Work with people that UNDERSTAND what you do for
a living so you get the proper advice.

professionals.

What is the difference?
• Trademarks protects names, terms and symbols that
are used to identify the source of goods and/or services
on the market. In other words, a trademark lets the
consumer distinguish one company's offerings from
another's.
• Copyright protects original creative works such as
books, movies, songs, paintings, photographs, web
content and choreography. As the owner of a federally
registered copyright, you can control how your work is
reproduced, distributed and presented publicly.

SEARCH prior to your submission to ensure your name
is available.
• Search “Live and Dead”
• Use “Exact Search Phrase”
• Watch ALL of the tutorials before starting the process –
it can be VERY confusing.
• Consult an attorney to file if overwhelmed or have
questions.

Specifics to do it yourself
• The website WILL walk you through the process of
filing for a Trademark and Service mark on your own.
• Most online applications done yourself are called a
TEAS PLUS (Trademark & Service Mark) and cost
$225 – payable at time of application.
• Blogs fall into Class 035: Advertising and marketing
services provided by means of indirect methods of
marketing communications, namely, social media,
search engine marketing, internet marketing . . . .

• Can take 3-6 months to process

(Genesis is easy to learn) • Have a designer who is willing to TEACH you how to make simple changes. • Have a pro readily available if you DO break it. • Know the different between a WP Engineer, a Web Designer and a Graphic Designer.

  • 47. TM 47 #SoFabUOTR Tracking Income & Expenses But how do I really get paid? • Are you making a profit? • Invest back into the business • Talk to your accountant about a draw or salary – depending on your incorporation status.

TM 48 #SoFabUOTR LLC or S-Corp Is it time to incorporate? • MYTH: You do NOT need to incorporate in order to separate your blog money from your personal money. • FACT: In most states, you WILL need to be incorporated to have a checking account with your business or blog name on it. Even a DBA (Doing Business As) account usually requires it.

TM 49 #SoFabUOTR LLC or S-Corp Is it time to incorporate? • Incorporating handles two primary issues: • Personal Liability • Taxes • It’s also used as part of Estate Planning in the case of Single Adults / Single Parents • Both are a pass-through tax entity. Typically, no income taxes are paid at the business level. Business profits or losses pass through to the owners personal returns.

  • 52. TM 52 #SoFabUOTR S-Corporation • Business Tax Returns must be filed • Must draft Bylaws, have Annual Meetings, and file an Annual Report. • Cheaper to set up on the front end, but can cost more over the year in Tax Return / Annual Report filings.

TM 53 #SoFabUOTR LLC or S-Corp How should I proceed? • Get an attorney and an accountant involved. • A statewide search for businesses already registered with a similar name needs to happen. • Work with people that UNDERSTAND what you do for a living so you get the proper advice. • Network in your community – bloggers and social media professionals are GREAT resources for service professionals.

In other words, a trademark lets the consumer distinguish one company's offerings from another's. • Copyright protects original creative works such as books, movies, songs, paintings, photographs, web content and choreography. Some may poo-poo that idea in favor of the paycheck, but I feel strongly in remembering what your brand is. Shifting is fine. But you HAVE to address is or your audience will think you sold out for the paycheck.

Bloggers have carved out their own niche – what makes you different among a world of foodie bloggers or travel bloggers or fashion bloggers? -positioning = the art of sacrifice – it’s difficult to be everything everyone, and if I could go back, I probably would have chosen 1 niche instead of being such a generalist. -narrowing down, focusing -differentiation

It should be slightly witty and not at all braggadocios.  You should feel comfortable speaking it and it should reflect your personality.  The blogosphere is SATURATED right now and injecting your personality will help to set yourself apart from the never ending sea of bloggers. Obviously you can vary this for spontaneity according to what questions your being asked, but don’t be afraid to toot your own horn! "Always lead with your expertise..."
