Custody statistics show that in the majority of custody cases, mothers are awarded sole or primary physical custody of children. When fathers actively seek custody through the family court process, the statistics show they gain either sole or joint physical custody over 40% of the time. Uncontested custody awards strongly favor mothers; however, contested awards are more evenly balanced between mothers and fathers.
