WHAT IS SEXUAL HARASSMENT ?
•Unwelcome sexual advances, requests for sexual favors, and
other verbal or physical conduct of a sexual nature.
•SEXUAL HARASSMENT is a behavior.
•It is defined as unwelcome behavior of a sexual nature.
•For example, a man whistles at a woman when she walks by.
SEXUAL HARASSMENT INCLUDES MANY
THINGS...
ACTUAL OR ATTEMPTED RAPE OR SEXUAL ASSAULT.
• UNWANTED PRESSURE FOR SEXUAL FAVOURS.
• UNWANTED DELIBERATE TOUCHING, LEANING OVER, CORNERING, OR PINCHING.
• UNWANTED SEXUAL LOOKS OR GESTURES.
• UNWANTED LETTERS, TELEPHONE CALLS, OR MATERIALS
OF A SEXUAL NATURE.
• UNWANTED SEXUAL TEASING, JOKES, OR QUESTIONS.
• WHISTLING AT SOMEONE.
• Sexually suggestive signals.
• Neck massage.
• Hanging around a person.
• Hugging, kissing, patting, or stroking.
• Touching or rubbing oneself sexually around another person.
• Standing close or brushing up against a person.
• Looking a person up and down (elevator eyes).
• Facial expressions, winking,
• Making sexual gestures with hands.

TYPES OF SEXUAL HARASSMENT
• QUID PRO QUO – LATIN TERM MEANING “THIS FOR THAT”. THE
TERM REFERS TO CONDITIONS PLACED ON A PERSON’S CAREER
OR TERMS OF EMPLOYMENT IN RETURN FOR SEXUAL FAVOURS.
• HOSTILE ENVIRONMENT – OCCURS WHEN SOLDIERS OR
CIVILIANS ARE SUBJECTED TO OFFENSIVE, UNWANTED AND
UNSOLICITED COMMENTS OR BEHAVIOURS OF A SEXUAL NATURE.
CLASSIFIED AS HOSTILE IF BEHAVIOUR UNREASONABLY
INTERFERES WITH THEIR PERFORMANCE.

WHAT SHOULD I DO IF I AM BEING SEXUALLY HARASSED?
1. DO NOT IGNORE IT. IT MIGHT NOT END.
2. SAY “NO” TO THE HARASSER FIRMLYAND CLEARLY.
3. NAME ‘IT’AS UNWANTED SEXUAL HARASSMENT.
4. WRITE A LETTER/EMAIL TO THE HARASSER ASKING THEM TO STOP IF YOU DO NOT FEEL SAFE OR
COMFORTABLE ENOUGH TO SPEAK TO THEM DIRECTLY.
5. KEEPA RECORD OF WHAT HAPPENED AND WHEN IT HAPPENED.
6. SEEK ADVICE FROM A FRIEND, PROFESSOR OR SUPERVISOR.
7. REPORT IT TO WHOEVER IS IN CHARGE: IF THEY DON’T LISTEN OR TAKE ACTION, REPORT IT TO
SOMEONE ELSE.
8. TALK TO SOMEONE AT THE HUMAN RIGHTS OFFICE.
9. FILE A COMPLAINT OR A GRIEVANCE.
INDIAN PENAL CODE
1. SECTION 294
DOES ANY OBSCENE ACT IN ANY PUBLIC PLACE, OR SINGS, RECITES AND UTTERS
ANY OBSCENE SONGS, BALLADS OR WORDS, IN OR NEAR ANY PUBLIC SPACE.
PUNISHMENT - THREE MONTHS, OR WITH FINE, OR WITH BOTH.

• FORCE ON ANY WOMAN, INTENDING TO OUTRAGE HER MODESTY OR KNOWING IT LIKELY THAT
HE WILL THEREBY OUTRAGE HER MODESTY

• PUNISHMENT- SIMPLE IMPRISONMENT FOR A TERM WHICH MAY EXTEND TO ONE YEAR, OR WITH

• GOA CHILDREN'S ACT, 2003, WAS THE ONLY SPECIFIC PIECE OF CHILD ABUSE LEGISLATION BEFORE THE 2012 ACT. CHILD SEXUAL
ABUSE WAS PROSECUTED UNDER THE FOLLOWING SECTIONS OF INDIAN PENAL CODE:
• I.P.C. (1860) 375- RAPE O I.P.C. (1860) 354- OUTRAGING THE MODESTY OF A WOMAN
• I.P.C. (1860) 377- UNNATURAL OFFENCES O
• I.P.C. (1860) 511- ATTEMPT
• HOWEVER, THE IPC COULD NOT EFFECTIVELY PROTECT THE CHILD DUE TO VARIOUS LOOPHOLES
LIKE:
• IPC 375 DOESN'T PROTECT MALE VICTIMS OR ANYONE FROM SEXUALACTS OF PENETRATION
OTHER THAN "TRADITIONAL" PENO-VAGINAL INTERCOURSE.
• IPC 354 LACKS A STATUTORY DEFINITION OF "MODESTY". IT CARRIES A WEAK PENALTY AND IS
A COMPOUNDABLE OFFENCE. FURTHER, IT DOES NOT PROTECT THE "MODESTY" OF A MALE
CHILD.
• IN IPC 377, THE TERM "UNNATURAL OFFENCES" IS NOT DEFINED. IT ONLY APPLIES TO VICTIMS
PENETRATED BY THEIR ATTACKER'S SEX ACT, AND IS NOT DESIGNED TO CRIMINALIZE SEXUAL
ABUSE OF CHILDREN.

  • 4. WHAT IS SEXUAL HARASSMENT ? •Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature. •SEXUAL HARASSMENT is a behavior. •It is defined as unwelcome behavior of a sexual nature. •For example, a man whistles at a woman when she walks by.
  • 5. SEXUAL HARASSMENT INCLUDES MANY THINGS... ACTUAL OR ATTEMPTED RAPE OR SEXUAL ASSAULT. • UNWANTED PRESSURE FOR SEXUAL FAVOURS. • UNWANTED DELIBERATE TOUCHING, LEANING OVER, CORNERING, OR PINCHING. • UNWANTED SEXUAL LOOKS OR GESTURES. • UNWANTED LETTERS, TELEPHONE CALLS, OR MATERIALS OF A SEXUAL NATURE. • UNWANTED SEXUAL TEASING, JOKES, OR QUESTIONS. • WHISTLING AT SOMEONE.
  • 6. • Sexually suggestive signals. • Neck massage. • Hanging around a person. • Hugging, kissing, patting, or stroking. • Touching or rubbing oneself sexually around another person. • Standing close or brushing up against a person. • Looking a person up and down (elevator eyes). • Facial expressions, winking, • Making sexual gestures with hands.
  • 7. 1 OUT OF 3 GIRLS AND 1 OUT OF 5 BOYS WILL BE SEXUALLY ABUSED BEFORE THEY REACH AGE 18 SEXUALABUSE STARTS BEFORE 11 FOR 1 VICTIM IN 2 AND BEFORE 6 FOR 1 VICTIM IN 5 IN MORE THAN 90% OF CASES THE PERPETRATOR IS A RELATIVE, 1 CHILD IN 2 IS ABUSED BY A FAMILY MEMBER
  • 8. • CHILD PORNOGRAPHY IS A FORM OF CHILD SEXUAL EXPLOITATION • 1 VICTIM IN 2 ABUSED DURING CHILDHOOD TRIES TO COMMIT SUICIDE • WORLDWIDE, 1 IN 10 GIRLS UNDER THE AGE OF 18 HAS BEEN RAPED, AMOUNTING TO 120 MILLION

  • 10. VERBAL – Referring to an adult as a girl, hunk, doll, babe, or honey – Whistling at someone, cat calls – Making sexual comments about a person's body – Making sexual comments – Turning work discussions to sexual topics – Telling sexual jokes or stories
  • 11. NON-VERBAL • LOOKING A PERSON UP AND DOWN (ELEVATOR EYES) • STARING AT SOMEONE • BLOCKING A PERSON'S PATH • FOLLOWING THE PERSON • GIVING PERSONAL GIFTS • DISPLAYING SEXUALLY SUGGESTIVE VISUALS • MAKING SEXUAL GESTURES WITH HANDS OR THROUGH BODY MOVEMENTS
  • 12. PHYSICAL • GIVING A MASSAGE AROUND THE NECK OR SHOULDERS • TOUCHING THE PERSON'S CLOTHING, HAIR, OR BODY • HUGGING, KISSING, PATTING, OR STROKING • TOUCHING OR RUBBING ONESELF SEXUALLY AROUND ANOTHER PERSON • STANDING CLOSE OR BRUSHING UP AGAINST ANOTHER PERSON

TEXTUAL/ELECTRONIC • ELECTRONICALLY SENDING MESSAGES WITH SEXUAL CONTENT, INCLUDING PICTURES AND VIDEO • THE USE OF SEXUALLY EXPLICIT LANGUAGE, HARASSMENT, CYBER STALKING AND THREATS VIAALL FORMS OF ELECTRONIC COMMUNICATION (E- MAIL, TEXT/PICTURE/VIDEO MESSAGES, INTRANET/ON-LINE POSTINGS, BLOGS, INSTANT MESSAGES AND SOCIAL NETWORK WEBSITES LIKE FACEBOOK AND TWITTER).
  • 14. TYPES OF SEXUAL HARASSMENT
  • 15. • QUID PRO QUO – LATIN TERM MEANING “THIS FOR THAT”. THE TERM REFERS TO CONDITIONS PLACED ON A PERSON’S CAREER OR TERMS OF EMPLOYMENT IN RETURN FOR SEXUAL FAVOURS. • HOSTILE ENVIRONMENT – OCCURS WHEN SOLDIERS OR CIVILIANS ARE SUBJECTED TO OFFENSIVE, UNWANTED AND UNSOLICITED COMMENTS OR BEHAVIOURS OF A SEXUAL NATURE. CLASSIFIED AS HOSTILE IF BEHAVIOUR UNREASONABLY INTERFERES WITH THEIR PERFORMANCE. • INDIAN CONTEXT ITS NAMED AS “EVE-TEASING”

EFFECTS OF CHILD SEXUALABUSE • LOW SELF-ESTEEM • DEPRESSION • ANXIETY • ISOLATION • REGRESSIVE BEHAVIORS • DISSOCIATION • NIGHTMARES • FLASHBACKS • DIFFICULTY CONCENTRATING • FEELING UNSAFE •Promiscuity •Early pregnancy •Prostitution •Drug and alcohol abuse •Self-harm behaviors (cutting, burning) •Eating disorders •Abstinence of sex •Interpersonal difficulties (trouble at work or home…) •Running Away
  • 17. WHAT SHOULD I DO IF I AM BEING SEXUALLY HARASSED? 1. DO NOT IGNORE IT. IT MIGHT NOT END. 2. SAY “NO” TO THE HARASSER FIRMLYAND CLEARLY. 3. NAME ‘IT’AS UNWANTED SEXUAL HARASSMENT. 4. WRITE A LETTER/EMAIL TO THE HARASSER ASKING THEM TO STOP IF YOU DO NOT FEEL SAFE OR COMFORTABLE ENOUGH TO SPEAK TO THEM DIRECTLY. 5. KEEPA RECORD OF WHAT HAPPENED AND WHEN IT HAPPENED. 6. SEEK ADVICE FROM A FRIEND, PROFESSOR OR SUPERVISOR. 7. REPORT IT TO WHOEVER IS IN CHARGE: IF THEY DON’T LISTEN OR TAKE ACTION, REPORT IT TO SOMEONE ELSE. 8. TALK TO SOMEONE AT THE HUMAN RIGHTS OFFICE. 9. FILE A COMPLAINT OR A GRIEVANCE.

  • 19. INDIAN PENAL CODE 1. SECTION 294 DOES ANY OBSCENE ACT IN ANY PUBLIC PLACE, OR SINGS, RECITES AND UTTERS ANY OBSCENE SONGS, BALLADS OR WORDS, IN OR NEAR ANY PUBLIC SPACE. PUNISHMENT - THREE MONTHS, OR WITH FINE, OR WITH BOTH. 2. SECTION 354 • FORCE ON ANY WOMAN, INTENDING TO OUTRAGE HER MODESTY OR KNOWING IT LIKELY THAT HE WILL THEREBY OUTRAGE HER MODESTY • PUNISHMENT - PUNISHED WITH IMPRISONMENT FOR A TERM WHICH MAY EXTEND TO TWO YEARS, OR WITH FINE, OR WITH BOTH. 3. SECTION 509 • INSULT AND ANNOYANCE • PUNISHMENT- SIMPLE IMPRISONMENT FOR A TERM WHICH MAY EXTEND TO ONE YEAR, OR WITH FINE, OR WITH BOTH..
  • 20. • GOA CHILDREN'S ACT, 2003, WAS THE ONLY SPECIFIC PIECE OF CHILD ABUSE LEGISLATION BEFORE THE 2012 ACT. CHILD SEXUAL ABUSE WAS PROSECUTED UNDER THE FOLLOWING SECTIONS OF INDIAN PENAL CODE: • I.P.C. (1860) 375- RAPE O I.P.C. (1860) 354- OUTRAGING THE MODESTY OF A WOMAN • I.P.C. (1860) 377- UNNATURAL OFFENCES O • I.P.C. (1860) 511- ATTEMPT • HOWEVER, THE IPC COULD NOT EFFECTIVELY PROTECT THE CHILD DUE TO VARIOUS LOOPHOLES LIKE: • IPC 375 DOESN'T PROTECT MALE VICTIMS OR ANYONE FROM SEXUALACTS OF PENETRATION OTHER THAN "TRADITIONAL" PENO-VAGINAL INTERCOURSE. • IPC 354 LACKS A STATUTORY DEFINITION OF "MODESTY". IT CARRIES A WEAK PENALTY AND IS A COMPOUNDABLE OFFENCE. FURTHER, IT DOES NOT PROTECT THE "MODESTY" OF A MALE CHILD. • IN IPC 377, THE TERM "UNNATURAL OFFENCES" IS NOT DEFINED. IT ONLY APPLIES TO VICTIMS PENETRATED BY THEIR ATTACKER'S SEX ACT, AND IS NOT DESIGNED TO CRIMINALIZE SEXUAL ABUSE OF CHILDREN.
