2. This claim is possible if there is another involved or a pedestrian or cyclist is found to
cause the collision. As long as the body of evidence proves that the driver is not at fault
for the accident, then he or she can make an accident claim.
The Passenger
In many cases, passengers involved in the traffic accident always end up successful in
claiming personal injury claims. There are different personal injury claims for every injury.
According to Alllaw.com, the offender must pay the injured person for medical care and
related expenses, missed work time or other income losses, pain and other physical
suffering, permanent physical disability and disfigurement, loss of social, family and
educational experiences and emotional damages from those aforementioned.
Road traffic collisions have three possible victims: the driver, the passenger and the
pedestrian. Here are the provisions of the law for each of them:
The Driver
The personal injury compensation claim is for those who had the misfortune to be involved
in an accident that was not their fault. That is to say, drivers who did not instigate the road
mishap are just victims themselves and, thus, are entitled to compensation.
3. Everyone must know their rights and their stand under the law. These are just some of the
basic provisions that may change from state to state.
The Pedestrian
If a pedestrian’s injury is proven to have been caused by a third party, he or she may
gain compensation by means of personal injury claim. Even if the pedestrian is involved
in the road accident and is found to have contributed to it, there is still some form of
compensation involved it.
All three victims may claim compensations as mentioned above. If the offender ends up
denying his or her liability, the claimant may escalate the case to the court.
