This past March, Ontario implemented a new law in hopes of deterring
drivers from being distracted by their cell phone devices while behind the
wheel of a car. Under this new legislation, judges in Ontario now have the
ability to charge those distracted driving between $300 and $1,000 and
assign three demerit points.
According to the OPP, distracted driving is a significant reason for accidents
and deaths on the road. As a personal injury lawyer, we see cases of personal
injury due to distracted driving frequently.
It’s important to remember that distracted driving includes more than just
using your cell phone. Under this legislation not only can those caught with
using their cell phone while behind the wheel be fined with distracted driving,
but other forms of distractions can result in hefty charges as well (i.e., using a tablet, eating).
It’s no surprise that increased technology use, especially while driving, has resulted in an increase in the number of
accidents. This is why the provinces across the country have started making efforts to eliminate the use of
technology while behind the wheel.
Though these new legislations are aimed at decreasing the amount accidents happening, it shouldn’t take new laws
to keep you away from being distracted on the road.
While driving, you’re only focus should be on the road. If you’re distracted by any means, you’re not only at risk of
being fined but you’re also putting yourself and those around you at a higher risk of being involved in an accident. If

A recent study examined the risks of distracted driving and determined that a driver who is distracted is 23 times
more likely to get into an accident. Though Ontario and other provinces are cracking down on this risky behaviour
by applying harsher laws and fines, the real deterrent should be the fact that if you’re distracted behind the wheel
you can seriously injure or kill another person or yourself. These dire consequences can affect those who are
completely innocent in your car, in another car, on a motorcycle, walking, or cycling.
