Status/Challenge

2012 Inter-agency meetings agreed to study the Presidential Proclamation as
major asset reform program of the PNoy administration
2013 NUPSC identified 13 select priority sites (Pre and Post Proclamation)
2013 PCUP allocated P500,000 as support fund for the CSW in the 13 sites
Background
NUPSC decided to pilot CSW priority sites as basis in crafting the policy reform
The learnings in the 13 sites should provide the basis for amending the implementation
guidelines and procedures of the Pre and Post Proclamations.

2014 PCUP convened a 3-day Joint National Strategizing Workshop on 14-16 March
2014 (fund outside of the P500k support for year 2014).

Challenges
The CSW in the 13 sites should provide the basis for amending the implementation guidelines
and procedures for both the pre and post proclamations.
Crucial need to review the guidelines for policy reform and for identification of bottlenecks for
the effective operationalization of the Presidential proclamation as an asset reform program
of government.

The NUPSC discussed the agenda on violations and effective implementation of law on “forced eviction
and demolition” invoking
Section 28 of RA 7279 (UDHA), RA 7160 (Local Government Code), EO 152 & 708, DILG MCs (2008-143;
2009-05; 2010-134) and the CHR Advisory on Adequate Housing and Humane Eviction

9. Challenges
Need to study and craft the appropriate policy reform for LGU compliance to the
requirements of RA 7279, particularly section 28 on relocation, and of EO 152 and EO 708
prior to issuance of Certificate of Compliance (COC)
Need to review the necessary amendment to RA 7279 that will ensure the effective
Resettlement Action Plan (RAP) and peoples representation in the Local Housing Board (LHBs)
before issuance of COC

DILG and PCUP to facilitate the convening of Justice Sector Coordinating Council (JSCC)

Craft MOA among concerned agencies including DILG and PNP on Pre Demolition Conference
(PDC) under the lead of PCUP
Study/facilitate the creation of policy mechanism to ensure genuine PO representation in LHBs
and ensuring RAP of LHBs as requirements before any demolition
-President Benigno S. Aquino III directed the creation of Informal Settler Families-National Technical Working Group (ISF-NTWG) to study and recommend permanent resettlement as poverty reduction strategy;
-President Benigno S. Aquino III allocated P50B over 5 years (2011-2015) for the permanent resettlement of around 104,219 ISFs living in danger zones in NCR;
-ISF relocation shall be on-site, in-city, and near-city in accordance with the CHR advisory & based on People’s Plans; Off-site (outside NCR) to be allowed only upon request of ISFs; the ISFs who live within the three-meter legal waterways easement shall be prioritized;-People’s plans require social preparation component; access to potable water & sanitation, schools & health facilities & sources of livelihood & employment; Local Project Management Team (LPMT) as local implementer;
- In the July 12, 2013 meeting, the SRs and CabSec agreed to include in beginning 2014 GAA the social preparation fund to assist the ISFs in the production of People’s Plans/Proposals. DILG will fast track implementation of submitted around 37 People’s Plans;
-ISF relocation shall be on-site, in-city, and near-city. Off-site (outside NCR) to be allowed only upon request of ISFs. The ISFs who live within the three-meter legal waterways easement shall be prioritized.
- Relocation Action Plan (RAP) will be crafted through People’s Plan mechanism to provide safe, affordable, and decent permanent housing, and prevent forced eviction of ISFs. Housing solutions to be validated and accepted by beneficiaries.
The implementing agencies are DSWD, NHA, SHFC, and Local Government Units.; Local Project Management Team (LPMT) will be the direct implementer; and the PMO will prepare the implementing guidelines.
- Finalize government policy and implementation on the resettlement of ISFs living in danger areas in NCR as contained in the JMC and facilitate the signature of HUDCC on the JMC
