SEARCH WARRANT
 Philippine Constitution
 Article III, (KATIPUNAN NG MGA KARAPATAN (Bill of Rights))
Section 2 – Right Against Unreasonable Arrest, Search and
Seizure
sasamsamin.”
“A man’s home is his castle. Not even the king would dare
desecrate it.”
unreasonable searches and seizures, idineklara ng ating Saligang
Definition: Search
Warrant is an order in
writing issued in the
name of the People of
the Philippines, signed
by a judge and directed
to a peace officer,
commanding him to
search for personal
property described
therein and bring it
before the court.
 PERSONAL PROPERTY TO BE SEIZED
 (1) Bagay na kasama sa krimen (subject of the offense)
 (2) Nakaw na bagay o bagay na bunga ng isang krimen ( fruit of the
offense)
be used as the means of committing an offense)
 IN THE PRESENCE OF WITNESSES
 TIME OF MAKING SEARCH
 VALIDITY OF SEARCH WARRANT
WELL RECOGNIZED EXCEPTIONS TO WARRANTLESS SEARCH
 1. Warrantless search incidental to a lawful arrest
basta’t may hawak siyang warrant of arrest.
kanya.
 Ngunit ang warrantless search ay dapat “within the area of his immediate control”
 2. Seizure of evidence in plain view
 Ito ang tinatawag na “plain view doctrine”.
 Mga kailangan sa plain view doctrine:
 i.) Legal ang initial intrusion ng mga pulis;
pakalat-kalat;
krimen.
 3. Search of a moving vehicle
6. Stop and Frisk
 7. Inspection of buildings and other premises for the enforcement of
fire, sanitary and building regulations
