A search warrant is a court order issued by a magistrate, judge or Supreme Court official that authorizes law enforcement officers to conduct a search of a person, location, or vehicle for evidence of a crime and to confiscate evidence if it is found. A search warrant cannot be issued in aid of civil process.
Jurisdictions that respect the rule of law and a right to privacy put constraints on the powers of police investigators, and typically require search warrants, or an equivalent procedure, for searches conducted as part of a criminal investigation. An exception is usually made for hot pursuit: if a criminal flees the scene of a crime and a police officer follows him, the officer has the right to enter a property in which the criminal has sought shelter. Conversely, in authoritarian regimes, the police typically have the right to search property and people without having to provide justification, or without having to secure the permission of a court.
The formal appearance of an accused person to hear, and to receive a copy of, the charge against him or her, in the presence of a judge, and to then enter a plea of guilty or not guilty.
It was so important and prudent to include a right to reasonable bail in the Bill of Rights because bail is inherently intertwined with a defendant's right to innocence until proven guilty. A person should have the right to be released on bail while preparing for their trial.

Section 2 – Right Against Unreasonable Arrest, Search and
Seizure
“Ang karapatan ng mga taong-bayan na magkaroon ng
kapanatagan sa kanilang sarili, pamamahay, papeles, at mga
bagay-bagay laban sa hindi makatwirang paghahalughog at
pagsamsam sa ano mang layunin ay hindi dapat labagin, at
hindi dapat maglagda ng warrant sa paghalughog o warrant
sa pagdakip maliban kung may malinaw na dahilan na
personal na pagpapasyahan ng hukom matapos masiyasat
ang mayhabla at ang mga testigong maihaharap niya sa ilalim
ng panunumpa o patotoo, at tiyakang tinutukoy ang lugar na
hahalughugin, at mga taong darakpin o mga bagay na
sasamsamin.”

6. PROSESO NG PAG-ISYU NG SEARCH WARRANT
Ang proseso sa pagkuha ng search warrant ay halos katulad din ng
proseso sa pagkuha ng warrant of arrest.
1) Una, ang search warrant ay iniisyu lang ng hukom, period. Walang
kapangyarihan ang sinumang kernel, major, heneral na magpalabas
ng search warrant.
2) Pangalawa, dapat may probable cause sa isang konektadong
krimen ang pag-isyu ng search warrant na personal na denitermina ng
hukom matapos niyang suriin ang testigo na nanumpa sa kanyang
harapan.
7. 3) Pangatlo, ang nasabing testigo ay dapat higit pa sa inyong
tsismosang kapitbahay na puro sabi-sabi lang ang nalalaman.
Nararapat na meron siyang personal knowledge at kayang ilarawan
ang partikular na bagay na kukunin at saang lugar matatagpuan.
Kapag nakumbinse ang hukom na may probable cause ay maaring
mag-isyu siya ng search warrant ayon sa tamang form.
8. PERSONAL PROPERTY TO BE SEIZED
(1) Bagay na kasama sa krimen (subject of the offense)
(2) Nakaw na bagay o bagay na bunga ng isang krimen ( fruit of the
offense)
(3) Bagay na ginamit o gagamitin sa isang krimen (use or intended to
be used as the means of committing an offense)
9. IN THE PRESENCE OF WITNESSES
Hindi pwedeng maghalughog ang mga pulis o law enforcer na may
search warrant sa inyong tahanan ng hindi ginagawa sa inyong
harapan o sa harapan ng myembro ng inyong pamilya.
Kung walang tao sa bahay ay dapat gawin ang paghahanap sa
harapan ng dalawang testigo na nasa tamang edad at pag-iisip na
nakatira malapit sa inyo.
10. TIME OF MAKING SEARCH
Ang search warrant ay pinapatupad dapat sa araw. Pwera na lang
kung ang salaysay ng testigo na ang bagay na hinahanap ay nasa
tao at nasa sa lugar at may direksiyon siyang maaring mahanap ito
sa araw o gabi lamang.
11. VALIDITY OF SEARCH WARRANT
Ang search warrant ay may buhay lamang ng 10 araw. Di’ tulad ng
warrant of arrest na nakalutang lang sa ere hangga’t hindi nahuhuli
ang akusado, ang search warrant ay napapanis.
13. 1. Warrantless search incidental to a lawful arrest
Kapag ang isang tao ay hinuli dahil may warrant of arrest siya, SOP ng mga pulis
ang kapkapan ang akusado.
Mahirap na kasi baka may baril o pasabog na dala ang nahuli at maaring
masaktan ang mga kapulisan. Kung may nakitang droga o ‘di lisensiyadong baril
habang kinakapkapan, maaring itong gamit laban sa kanya.
Kasama rin sa warantless seach ang mga bagay na nasa paligid ng nahuling tao.
Maari kasing pumasok ang pulis sa isang bahay upang tugusin ang isang akusado
basta’t may hawak siyang warrant of arrest. At kung nahuli siya sa loob ng bahay at
sa tabi niya ay may nakitang illegal substance, maaring rin itong gamitin laban sa
kanya.
Ngunit ang warrantless search ay dapat “within the area of his immediate control”
14. 2. Seizure of evidence in plain view
Ito ang tinatawag na “plain view doctrine”.
Mga kailangan sa plain view doctrine:
i.) Legal ang initial intrusion ng mga pulis;
ii.) ang pagdiskubre ng kontrabando ay hindi sinasadya dahil
pakalat-kalat;
iii.) at ang bagay na yun ay nagamit o maaring magamit sa isang
krimen.
15. 3. Search of a moving vehicle
Di tulad ng bahay, ang sasakyan ay tumakbo at humaharurot, kaya
hindi praktikal na kumuha pa ng search warrant para dito. Kaso,
hindi rin ito lisensiya para sa kapulisan na halughugin ang sasakyan
ng walang dahilan. Dapat may probable cause ang pulis para
siyasatin ang kotse.
Pero kung isa lang itong regular na check point na kaliwa’t-kanang
ginagawa dahil sa nalalapit na eleksiyon, at wala namang kahina-
hinala sa mga kilos ninyo na maaring gawin “probable cause“,
walang karapatan ang pulis na pababain kayo at kapkapan o
siyasatin ang inyong sasakyan.
16. 4. Consented warrantless search
May permiso ng tao o may ari ng isang bahay para isagawa ang
search.
17. 5. Customs search
Ang mga naatasang magpatupad ng ating mga Custom and Tarriff
Laws ay authorized na mag-conduct ng search kahit walang warrant
kahit na anong uri ng artikulo o bagahe, basta may suspetsa sila na
ang mga bagay na ito ay nakapasok sa Pilipinas na hindi nagbayad
ng tamang buwis.
18. 6. Stop and Frisk
Kung kahinahinala ang kilos ng isang tao ay pwede itong
pahintuin ng pulis at siyasatin.
