THE TRADE IN SPECIMENS OF ANIMALS AND PLANTS
NOT OF WILD SOURCE”
• It mentions in line 92 & 93, clearly
– “an economic alternative to traditional
agriculture in countries of origin, and could also
increase conservation interest in the areas of
natural distribution….”
Yes, It is true
Ambiguities, Confusion,,
Inconsistencies, Misunderstanding of
objective of IUCN / CBD /CITES,
Procedures etc prevails in many
countries, including India
It affected Indian Dryland Red Sanders
Tree growing farmers, Very Badly.
Red Sanders Tree Growers in India
• Around 3000 small dry land farmers in Tamilnadu &
Andra Pradesh states of India are growing this tree
• More than 10 Million trees are growing
• Taking risk of long term gestation, 20-25 years
• No proper guidance / financial support
• Mostly they grow as no other option.
– No water or bore well crossed 1000 ft depth
– Erratic rain fall & frequent droughts
Many more farmers are interested to Grow it
But, they are not able to sell / export, in trouble
• Traders say “ Nowadays, we don’t deal with
it, due to policy restriction / delays “
• Export policy says only value added products
are allowed to export.
– but no value adders / companies in India
• It helps only smuggling to increase
• Cumbersome procedures
– Refer NBA’s Expert committee report
Can ignorant, remotely located farmers run
around for years?
In the End…
Farmers Life is in Danger by Smugglers
Similar to Sandal tree owners
No incentive for tree growing,
but only hurdles & harassment !!!
Is it the way to facilitate tree growing?
How are we going to combat climate change?
Root Cause of the Problem
• IUCN classified it as an Endangered species in 1998,
without objective survey
• CITES added it in Appendix II, without proper study
• So, Exim policy restricted export of Red sanders wood
in log form etc, as applicable for Appendix II species
Missed out
CITES restrictions are for wild source (forest source)
Exempts for cultivated source, but
Lapse
India did not distinguish Wild and farmers Red
sanders wood specimen, as done by CITES
One Main Root Cause - Resolved
IUCN has classified it as Near Threatened
with objective survey

Appendix II of CITES
CITES on Appendix II says
“Appendix II includes species not necessarily
threatened with extinction, but in which trade
must be controlled in order to avoid
utilization incompatible with their survival”.
(Not restricted)
Note: IUCN’s removal from Endangered
category will facilitate, removal of Red
Sanders from Appendix II of CITES.

• But only confiscated wood is allowed every
year.

thoroughly for 2 years with necessary studies,

• CITES does not restrict export, only FTP
– Foreign Trade Policy, ie EXIM
• Highlighted the cumbersome procedures
• Recommended to remove export
restriction for farmer’s Red Sanders
wood

an Unconditional Separate Export Policy,
for Farmer’s Red sanders Wood
WHY?
Problem with Export conditions
• RTI reply said “As per the existing export
policy, wood of red sanders in any form,
whether raw, processed or unprocessed, is
prohibited from export”
Some places it says
• Only value added products are allowed for
export . What are they? Who is doing it?
– No value adders / companies, RTI confirms
– ..uses of timber not clear- MoEF article says
RTI confirms…
• Wanted to know the value adding Industries
• Replies from AYUSH, Industries, Bio-
technology, Handicrafts etc
• There is no company,
– Few in whole India, very less quantity needed
– That can be given from confiscated wood
• I had provided some copies,

within the country mainly in Ayurvedic
pharmacopoeia and some times for making
toys”
• It also says “The extend of range of end
uses for timber is not fully clear”
Then having a policy, “Export Red Sanders
wood in log form is not allowed” is not fair.
Purpose of value addition?
TO GET BETTER PRICE
• But understand from a retd DFO that Japanese
want it in LOg FORm.
• They make musical instruments with their
perfection and designs.
• So they pay better price only for Log form
• Similarly china furniture.
Then, Why should we value add?
Who recommended only value added
products to export? Struggled to know it.

• Small countries like Malaysia / FIJI has
export quota for many species and lakhs of
tons for Endangered species.
• And they export ( India had 310 tons for Red
sanders wood but never)

CITES Treaty Objective is Clear
“CITES remains one of the world's most
powerful tools for wildlife conservation through
the regulation of trade. Thousands of species
are internationally traded and used by people in
their daily lives for food, health care, housing,
tourist souvenirs, cosmetics or fashion…. with
benefits for the livelihoods of local people and
the global environment”
Purpose of all Offices / Treaties is to improve
life / environment, not to hamper.
UN CBD also says
It has 3 main objectives:
• The conservation of biological diversity
• The sustainable use of the components of
biological diversity
• The fair and equitable sharing of the
benefits arising out of the utilization of
genetic resources.
– Sharing with… ???
NITI Aayog said,
in it’s Agri 2016 reforms
All tree species grown in Farmer’s field
should be free from Felling, Transportation
regulations.
I would just like to add
Free from…. Selling / Export regulation.
At least trying to make it simple and fast.
Removal of conditions,
separate policy and simple procedures
for Farmers Red Sanders wood would be
A Good Start
Hopefully India will get, min Rs 1000 crores p.a.
If all potential explored then may be 5000 crores
Note it is from a dry wood export so good
And it goes to remote farmers, distributed
Probably
India can regain it’s wood exporter status
Ultimately, what we farmers, want
“Farmer’s Red Sanders wood is allowed for
export in any form without any quota restrictions”
Yearly Quota creates problem with expiry. Getting all
permission in a year is too difficult, starting from gross
root forest official to CITES MA, DGFT ….
When un-replenishable Iron Ore is allowed to
export?
Why not valuable dry land wood, in log form?
Good Income from Wood Encourages ….
• More Red sanders plantation in farmers land
• Global needs will be met
• Smuggling reduces
• Price drop
• India will use it for furniture also
– Solid wood furniture is gaining market
• India’s import may come down
• Tree cover / carbon sink will increase
Healthy environment
Treeculture is the Healthiest Wealth
• Unfortunately it is Harassed / unclear in India.
• Main issue, Treeculture (Agroforesty) is NO-
BODIES BABY. No dept plans, tracks India’s
need, Import / Export of wood
– MoAFW has SMAF
– But Forest dept’s colonial laws meant for protection
of forest is applied on farmer’s trees (harassing)
• Task force under NITI Aayog for “Doubling
farmer’s Income”, has representation from many
ministries but not MoEFCC (Trees ?).

• Shri TSR Subramaniyam High Level

• Agroforestry policy mentions hurdles 2014

• Sandal, Rosewood, Red Sanders meet 2017…
Studies, Meeting and reports are meant for
removing hurdles, not for propagating wrong
images. Regaining confidence is difficult

• India imports wood worth of Rs 50,000 cr p.a
• India’s EPI is 178 /180 countries
• Ground water level, crossing 1000 ft deep
• Indian farmer’s suicide
– Water scarcity for regular crops
• India’s tree cover, remains 23% for decades
• Paris INDC target of 2.5 Billion MT CO2 sink
• India Imports wood for it’s 90% requirement

RPG Representation to DGFT for favorable Export Policy for Farmers Red Sanders wood

  • 1. Red SandeRS WOOd (Pterocarpus Santalinus) IUCN categorized it as Near Threatened …..removed from Endangered category Request, DGFT to remove all conditions for Dry Land Farmer’s Red Sanders Wood Export
  • 2. IUCN has classified Red Sanders Tree as Near Threatened, NT Published on 5th July, 2018 Based on objective survey in Feb 2018 We Farmers Thank IUCN
  • 3. We also thank IUCN for recommending “It is recommended that the process of Exporting and harvesting propagated and cultivated trees is streamlined to encourage the establishment and use of these trees” Refer conservation actions in http://www.iucnredlist.org/details/32104/0 Fundamental, India yet to understand
  • 4. We Thank CITES HO, Geneva • For trying to resolve Ambiguities and Inconsistencies for cultivated source specimens wide notification 2018 / 048 “ DRAFT REVIEW OF CITES PROVISIONS RELATING TO THE TRADE IN SPECIMENS OF ANIMALS AND PLANTS NOT OF WILD SOURCE” • It mentions in line 92 & 93, clearly – “an economic alternative to traditional agriculture in countries of origin, and could also increase conservation interest in the areas of natural distribution….”
  • 5. Yes, It is true Ambiguities, Confusion,, Inconsistencies, Misunderstanding of objective of IUCN / CBD /CITES, Procedures etc prevails in many countries, including India It affected Indian Dryland Red Sanders Tree growing farmers, Very Badly.
  • 6. Red Sanders Tree Growers in India • Around 3000 small dry land farmers in Tamilnadu & Andra Pradesh states of India are growing this tree • More than 10 Million trees are growing • Taking risk of long term gestation, 20-25 years • No proper guidance / financial support • Mostly they grow as no other option. – No water or bore well crossed 1000 ft depth – Erratic rain fall & frequent droughts Many more farmers are interested to Grow it
  • 7. But, they are not able to sell / export, in trouble • Traders say “ Nowadays, we don’t deal with it, due to policy restriction / delays “ • Export policy says only value added products are allowed to export. – but no value adders / companies in India • It helps only smuggling to increase • Cumbersome procedures – Refer NBA’s Expert committee report
  • 8. Can ignorant, remotely located farmers run around for years? In the End… Farmers Life is in Danger by Smugglers Similar to Sandal tree owners No incentive for tree growing, but only hurdles & harassment !!! Is it the way to facilitate tree growing? How are we going to combat climate change?
  • 9. Root Cause of the Problem • IUCN classified it as an Endangered species in 1998, without objective survey • CITES added it in Appendix II, without proper study • So, Exim policy restricted export of Red sanders wood in log form etc, as applicable for Appendix II species Missed out CITES restrictions are for wild source (forest source) Exempts for cultivated source, but Lapse India did not distinguish Wild and farmers Red sanders wood specimen, as done by CITES

Appendix II of CITES CITES on Appendix II says “Appendix II includes species not necessarily threatened with extinction, but in which trade must be controlled in order to avoid utilization incompatible with their survival”. (Not restricted) Note: IUCN’s removal from Endangered category will facilitate, removal of Red Sanders from Appendix II of CITES.
  • 12. IFGTB, NDF Report (2011 – 12) We thank IFGTB • Recommended “ export should be from cultivated sources”. – Refer 4th recommendation Fact • Farmers wood is not allowed for decades • But only confiscated wood is allowed every year.
  • 13. We thank NBA’s Expert Committee (2014 – 16) 28 Member Expert committee, after deliberating thoroughly for 2 years with necessary studies, mentioned / recommended • CITES does not restrict export, only FTP – Foreign Trade Policy, ie EXIM • Highlighted the cumbersome procedures • Recommended to remove export restriction for farmer’s Red Sanders wood
  • 14. We also thank DGFT For very quick reply for email reminder that “ The policy is under examination and hope for positive development shortly” This representation only to insist for an Unconditional Separate Export Policy, for Farmer’s Red sanders Wood WHY?
  • 15. Problem with Export conditions • RTI reply said “As per the existing export policy, wood of red sanders in any form, whether raw, processed or unprocessed, is prohibited from export” Some places it says • Only value added products are allowed for export . What are they? Who is doing it? – No value adders / companies, RTI confirms – ..uses of timber not clear- MoEF article says
  • 16. RTI confirms… • Wanted to know the value adding Industries • Replies from AYUSH, Industries, Bio- technology, Handicrafts etc • There is no company, – Few in whole India, very less quantity needed – That can be given from confiscated wood • I had provided some copies, – Will upload in my slideshare Understood, Handicrafts comes under Ministry of Textiles !!!
  • 17. MoEF website article says www.moef.nic.in/downloads/public- information/Chap-8-new.pdf Page 7, National Utilization • “ The species has negligible utilization within the country mainly in Ayurvedic pharmacopoeia and some times for making toys” • It also says “The extend of range of end uses for timber is not fully clear” Then having a policy, “Export Red Sanders wood in log form is not allowed” is not fair.
  • 18. Purpose of value addition? TO GET BETTER PRICE • But understand from a retd DFO that Japanese want it in LOg FORm. • They make musical instruments with their perfection and designs. • So they pay better price only for Log form • Similarly china furniture. Then, Why should we value add? Who recommended only value added products to export? Struggled to know it.
  • 19. Eureka !!! • Exim policy could had been derived from CITES regulation – https://www.cites.org/eng/app/appendices.php#ftnt 22 • “It restricts Logs, wood chips, powder and extracts” FACTS It applies to wild source not cultivated source. Wild (confiscated) source itself allowed in log form. Why not cultivated source?
  • 20. CITES Geneva, Clearly distinguishes cultivated source • In Exemptions and Special procedures – https://www.cites.org/eng/disc/how.php • CITES Geneva on Artificially (Cultivated) Propagated Source – https://www.cites.org/sites/default/files/documen t/E-Res-11-11-R17.pdf Note: Red Sanders may be removed from appendix II of CITES, as it has been removed from Endangered category by IUCN

Surprising & SAD, India : ZERO Refer CITES Export Quota • Small countries like Malaysia / FIJI has export quota for many species and lakhs of tons for Endangered species. • And they export ( India had 310 tons for Red sanders wood but never) Refer, Year wise, country wise is available https://www.cites.org/eng/resources/quotas/index.php
  • 22. CITES Treaty Objective is Clear “CITES remains one of the world's most powerful tools for wildlife conservation through the regulation of trade. Thousands of species are internationally traded and used by people in their daily lives for food, health care, housing, tourist souvenirs, cosmetics or fashion…. with benefits for the livelihoods of local people and the global environment” Purpose of all Offices / Treaties is to improve life / environment, not to hamper.
  • 23. UN CBD also says It has 3 main objectives: • The conservation of biological diversity • The sustainable use of the components of biological diversity • The fair and equitable sharing of the benefits arising out of the utilization of genetic resources. – Sharing with… ???
  • 24. NITI Aayog said, in it’s Agri 2016 reforms All tree species grown in Farmer’s field should be free from Felling, Transportation regulations. I would just like to add Free from…. Selling / Export regulation. At least trying to make it simple and fast.
  • 25. Removal of conditions, separate policy and simple procedures for Farmers Red Sanders wood would be A Good Start Hopefully India will get, min Rs 1000 crores p.a. If all potential explored then may be 5000 crores Note it is from a dry wood export so good And it goes to remote farmers, distributed Probably India can regain it’s wood exporter status
  • 26. Ultimately, what we farmers, want “Farmer’s Red Sanders wood is allowed for export in any form without any quota restrictions” Yearly Quota creates problem with expiry. Getting all permission in a year is too difficult, starting from gross root forest official to CITES MA, DGFT …. When un-replenishable Iron Ore is allowed to export? Why not valuable dry land wood, in log form?
  • 27. Good Income from Wood Encourages …. • More Red sanders plantation in farmers land • Global needs will be met • Smuggling reduces • Price drop • India will use it for furniture also – Solid wood furniture is gaining market • India’s import may come down • Tree cover / carbon sink will increase Healthy environment
  • 28. Treeculture is the Healthiest Wealth • Unfortunately it is Harassed / unclear in India. • Main issue, Treeculture (Agroforesty) is NO- BODIES BABY. No dept plans, tracks India’s need, Import / Export of wood – MoAFW has SMAF – But Forest dept’s colonial laws meant for protection of forest is applied on farmer’s trees (harassing) • Task force under NITI Aayog for “Doubling farmer’s Income”, has representation from many ministries but not MoEFCC (Trees ?).

Many Reports / Meets.. • Shri AK Bansal Committee Report (2011-12) • IFGTB stakeholders meet –Red sanders 2011 • Shri TSR Subramaniyam High Level Committee report, 2014 • Agroforestry policy mentions hurdles 2014 • NITI Aayog’s Agri reform 2016 • Sandal, Rosewood, Red Sanders meet 2017… Studies, Meeting and reports are meant for removing hurdles, not for propagating wrong images. Regaining confidence is difficult
  • 30. aLaRming • India imports wood worth of Rs 50,000 cr p.a • India’s EPI is 178 /180 countries • Ground water level, crossing 1000 ft deep • Indian farmer’s suicide – Water scarcity for regular crops • India’s tree cover, remains 23% for decades • Paris INDC target of 2.5 Billion MT CO2 sink • India Imports wood for it’s 90% requirement Request DGFT to do their Best
