Ct. App. 1991) Cindy Werth was expecting twins. Because she was a Jehovah’s Witness and had a firm belief in the religion’s teaching “that it is a sin to receive blood transfusions”, Cindy signed a “Refusal to Permit Blood Transfusions” form as part of her hospital preregistration. After delivery, Cindy had complications and was experiencing uterine bleeding. She was advised to undergo a dilatation and curettage and agreed. Again, she discussed her refusal to allow a blood transfusion with her obstetrician/gynecologist (OB/Gyn). After being placed under anesthesia and despite the specialist’s efforts during surgery, Cindy continued to bleed and was experiencing, among other things, premature ventricular activity and a significant decrease in blood pressure. The anesthesiologist (Dr. Michael Taylor) determined that Cindy needed a blood transfusion to sustain her life. Cindy’s OB/Gyn expressed Cindy’s refusal of blood transfusions, but the anesthesiologist proceeded anyway stating that it was medically necessary. The Werth’s filed a malpractice suit, alleging that Dr. Taylor committed battery by performing the transfusion without Cindy’s consent. Dr. Taylor moved for a summary disposition “because Cindy’s refusal was not conscious, competent, contemporaneous and fully informed.” The trial court found that Cindy’s refusals of a transfusion were made when she contemplated “merely routine elective surgery” and not life-threatening circumstances, and that, “it could not be said that she made the decision to refuse a blood transfusion while in a competent state and while fully aware that death would result from such refusal.” The record apparently reflected “the unexpected development of a medical emergency requiring blood transfusion to prevent death or serious compromise of the patient’s wellbeing.” ...

: Hello everyone….welcome back to class. Today, we are going to discuss patient rights and responsibilities and acquired immunodeficiency syndrome.
The Patient Self-Determination Act of 1990 (PSDA) made a significant advance in the protection of the rights of patients to make decisions regarding their own health care. Healthcare organizations may no longer passively permit patients to exercise their rights but must protect and promote such rights. The PSDA provides that each individual has a right under state law to make decisions concerning his or her medical care, including the right to accept or refuse medical or surgical treatment and the right to formulate advance directives.
Let’s first discuss the rights of the patient. How are patient rights classified?
Casey:
Patient rights may be classified as either legal (those emanating from law) or human statements of desirable ethical principles (such as the right to healthcare or the right to be treated with human dignity). Both staff and patients should be aware and understand not only their own rights and responsibilities, but also the rights and responsibilities of each other.

: Patients also have a right to receive a clear explanation of tests, diagnoses, treatment options, prescribed medications, and prognosis; participate in healthcare decisions; understand treatment options; and discontinue or refuse treatment options. It is recognized that the relationship between the physician and the patient is essential for the provision of proper care.

: In addition to what has already been noted, I would say that legal precedent has established that not only does the institution have responsibility to the patient, but also the patient has responsibility to the institution.

: Absolutely… What does the federal and state law and the Constitution have to say about discriminatory practices?

: Most federal, state and local programs specifically require, as a condition for receiving funds under such programs, an affirmative statement on the part of the organization that it will not discriminate. For example, Medicare and Medicaid programs specifically require affirmative assurances by healthcare organizations that no discrimination will be practiced. Healthcare organizations who do not comply may lose Medicare and Medicaid certification and reimbursement.

The hospital staff was contacted and begged to come and see the old man, and he reluctantly agreed to do
so, despite the interruption to his sleep. Upon examining the patient, the hospital staff concluded that the
man was a having a severe attack of asthma. He then went ahead and administered a drug for asthma
patients to the old man by intravenous injection. A few hours later, the old man died.
My friend the young doctor was informed the following morning on what happened to his grandfather, and
he was utterly shocked. His grandfather had never had any history of asthma-he had never in his life been
treated for asthma. No medical doctor would have prescribed that drug for that patient.
It is at this point that the ethical question arose, and there was need to make an ethical decision on what to
about this person who was not a medical doctor but went ahead to not only prescribe, but administer a
drug to this patient.
In the argument that followed this event, there were two groups with views that varied with each other.
One group argued straight away that the person in question should be prosecuted, because what he did
amounted more or less to pre-meditated murder. He should not have administered any drug to the patient,
since he was not qualified to do so. He should have concentrated on finding ways to get the patient to a
hospital.
The other group argued that this person was just acting as good Samaritan, trying to help out the ailing old
man. They saw it as an act of ingratitude to even consider prosecuting this man.
In the end, the ethical decision made was based on the Duty-based Ethical theory, since it is a universal rule
that only qualified medical personnel are to diagnose and prescribe drugs to patients, as well as administer
those drugs. The medical staff was neither of these-he was merely a te.

Extensive research has been conducted on abortion pro-choice , as it has been a topic of debate since way back. This chapter offers, through selective references to some of the literature, a comprehensible description of abortion and the perspectives on safe abortion. The chapter will also give a thumbnail sketch on previous research findings on abortion and abortion pro-choice, what justifies it and the dangers associated with abortion pro-choice, according to different scholars and researchers.
Ruibal (2014) defines abortion as the termination of a pregnancy by getting rid of an embryo or a fetus so that the fetus does not survive outside the uterus. At times, abortion can occur spontaneously, and when this happens, it is referred to as a miscarriage. Abortion pro-choice is a woman’s right to decide whether to keep a pregnancy or cut it short. Abortion has been carried out for thousands of years. Back in the 1800s, surgical procedures such as abortion were deemed as highly risky. Hospitals and other healthcare facilities were not so popular and antiseptics were not well known. Women were procuring abortions from illegal practitioners which was extremely dangerous and deadly. As time progressed, especially with the advancement and domination of scientific technologies in medical practices, abortion started being advertised openly and abortion became a norm. Thereafter, states started passing laws which illegalized abortion.
Making abortion illegal, however, did not impede women from seeking abortion services. A vast number of women suffered from severe health complications from self-induced abortions. According to Boyle et al (2015), The drive to illegalize abortion was linked to doctors who wanted to create for themselves full rights to practice medicine. They wanted to stop unqualified practitioners from competing with them for customers, in this case, patients. These doctors were also doing so to stop the untrained doctors from competing with them for patients fees and charges. As a result, abortion stopped being criminalized and was successfully changed into a procedure meant for qualified physicians only. A historical survey on abortion pro-choice reveals that it was highly scrutinized because a woman who decided to cut short the life of their unborn baby was said to be no different from a murderer. Moreso, staunch Christians opposed abortion in any circumstance, which meant that a lot of condemnation was thrown at women who felt the need to terminate their pregnancy. Weitz and Weitz (2015) State that an unborn baby is like property and the mother is the prop.

: Hello everyone….welcome back to class. Today, we are going to discuss patient rights and responsibilities and acquired immunodeficiency syndrome.
The Patient Self-Determination Act of 1990 (PSDA) made a significant advance in the protection of the rights of patients to make decisions regarding their own health care. Healthcare organizations may no longer passively permit patients to exercise their rights but must protect and promote such rights. The PSDA provides that each individual has a right under state law to make decisions concerning his or her medical care, including the right to accept or refuse medical or surgical treatment and the right to formulate advance directives.
Let’s first discuss the rights of the patient. How are patient rights classified?
Casey:
Patient rights may be classified as either legal (those emanating from law) or human statements of desirable ethical principles (such as the right to healthcare or the right to be treated with human dignity). Both staff and patients should be aware and understand not only their own rights and responsibilities, but also the rights and responsibilities of each other.

: Patients also have a right to receive a clear explanation of tests, diagnoses, treatment options, prescribed medications, and prognosis; participate in healthcare decisions; understand treatment options; and discontinue or refuse treatment options. It is recognized that the relationship between the physician and the patient is essential for the provision of proper care.

: In addition to what has already been noted, I would say that legal precedent has established that not only does the institution have responsibility to the patient, but also the patient has responsibility to the institution.

: Most federal, state and local programs specifically require, as a condition for receiving funds under such programs, an affirmative statement on the part of the organization that it will not discriminate. For example, Medicare and Medicaid programs specifically require affirmative assurances by healthcare organizations that no discrimination will be practiced. Healthcare organizations who do not comply may lose Medicare and Medicaid certification and reimbursement.

Literature review
Extensive research has been conducted on abortion pro-choice , as it has been a topic of debate since way back. This chapter offers, through selective references to some of the literature, a comprehensible description of abortion and the perspectives on safe abortion. The chapter will also give a thumbnail sketch on previous research findings on abortion and abortion pro-choice, what justifies it and the dangers associated with abortion pro-choice, according to different scholars and researchers.
Ruibal (2014) defines abortion as the termination of a pregnancy by getting rid of an embryo or a fetus so that the fetus does not survive outside the uterus. At times, abortion can occur spontaneously, and when this happens, it is referred to as a miscarriage. Abortion pro-choice is a woman’s right to decide whether to keep a pregnancy or cut it short. Abortion has been carried out for thousands of years. Back in the 1800s, surgical procedures such as abortion were deemed as highly risky. Hospitals and other healthcare facilities were not so popular and antiseptics were not well known. Women were procuring abortions from illegal practitioners which was extremely dangerous and deadly. As time progressed, especially with the advancement and domination of scientific technologies in medical practices, abortion started being advertised openly and abortion became a norm. Thereafter, states started passing laws which illegalized abortion.
Making abortion illegal, however, did not impede women from seeking abortion services. A vast number of women suffered from severe health complications from self-induced abortions. According to Boyle et al (2015), The drive to illegalize abortion was linked to doctors who wanted to create for themselves full rights to practice medicine. They wanted to stop unqualified practitioners from competing with them for customers, in this case, patients. These doctors were also doing so to stop the untrained doctors from competing with them for patients fees and charges. As a result, abortion stopped being criminalized and was successfully changed into a procedure meant for qualified physicians only. A historical survey on abortion pro-choice reveals that it was highly scrutinized because a woman who decided to cut short the life of their unborn baby was said to be no different from a murderer. Moreso, staunch Christians opposed abortion in any circumstance, which meant that a lot of condemnation was thrown at women who felt the need to terminate their pregnancy. Weitz and Weitz (2015) State that an unborn baby is like property and the mother is the prop.

Ct. App. 1991) Cindy Werth was expecting twins. Because she was a Jehovah’s Witness and had a firm belief in the religion’s teaching “that it is a sin to receive blood transfusions”, Cindy signed a “Refusal to Permit Blood Transfusions” form as part of her hospital preregistration. After delivery, Cindy had complications and was experiencing uterine bleeding. She was advised to undergo a dilatation and curettage and agreed. Again, she discussed her refusal to allow a blood transfusion with her obstetrician/gynecologist (OB/Gyn). After being placed under anesthesia and despite the specialist’s efforts during surgery, Cindy continued to bleed and was experiencing, among other things, premature ventricular activity and a significant decrease in blood pressure. The anesthesiologist (Dr. Michael Taylor) determined that Cindy needed a blood transfusion to sustain her life. Cindy’s OB/Gyn expressed Cindy’s refusal of blood transfusions, but the anesthesiologist proceeded anyway stating that it was medically necessary. The Werth’s filed a malpractice suit, alleging that Dr. Taylor committed battery by performing the transfusion without Cindy’s consent. Dr. Taylor moved for a summary disposition “because Cindy’s refusal was not conscious, competent, contemporaneous and fully informed.” The trial court found that Cindy’s refusals of a transfusion were made when she contemplated “merely routine elective surgery” and not life-threatening circumstances, and that, “it could not be said that she made the decision to refuse a blood transfusion while in a competent state and while fully aware that death
- 3. would result from such refusal.” The record apparently reflected “the unexpected development of a medical emergency requiring blood transfusion to prevent death or serious compromise of the patient’s wellbeing.”
