Some textualist scholars argue that administrative agencies are unconstitutional, particularly because of the arguably unconstitutional delegation of law-making power. Nonetheless, the current jurisprudence in administrative law deems agencies constitutional, and necessary in the current society in a functional and pragmatic sense.
