Survey Report on the Implementation of
Directions of Hon’ble High Court in Writ
Petition No. 5663 of 2004
Rationale and Significance of the Study
• State is morally and legally bound to provide rehabilitation
including alternative livelihood to people displaced by
government developmental projects
• Rights of villagers of Akkarpatti and Popharan, Palghar Taluka,
Thane District, Maharashtra, affected due to expansion of Tarapur
Nuclear Power Plant Unit No. 3 & 4
• Writ Petition No. 5663 of 2004 filed by, petitioner, Tarapur
Anushakti Prakalp Pidit Janta Samiti on behalf of Project Affected
Persons before the Hon’ble High Court of Judicature at Bombay.
Scope of the study
• The survey was conducted in the villages of Akkarpatti and
Popharan in the Palghar Taluka, Thane District.
• The main focus of the survey was to gain information regarding
the basic civic amenities in the villages.
Objective of the Study
 To survey and monitor the implementation of directions of this
Hon'ble High Court in Writ Petition No 5663 of 2004
 To understand the reasons behind the emigration of PAPs
 To examine and assess the socio-economic background of the PAPs
and the impact of the rehabilitation project
 To submit the findings of the survey to this Hon'ble High Court
 To present before this Hon'ble High Court suggestions of possible
steps to alleviate the problems and issues faced by the PAPs
Research questions
 Whether the directions issued by this Hon'ble High Court in Writ Petition
No. 5663 of 2004 have been implemented effectively?
 What are the problems encountered by the stakeholders in the process of
rehabilitation?
 What is the socio-economic background of the PAPs before and after
rehabilitation?
 What is the state of supply of electricity, water and other amenities in the
villages?
Research questions
• Whether adequate compensation has been given in the rehabilitation
process?
• Whether alternative employment has been provided in the
rehabilitation process?
• What is the condition of the infrastructure in the allotted houses?
Universe of the Study and Sample Design
Universe of the Study
• Villages Popharan and Akkarpatti, Palghar Taluka, Thane District,
Maharashtra
• Sample design includes 1250 samples collected by interviewing
families of the villages
Sampling Procedure
• Sampling Technique - Purposive/Judgement
• Sample Size -1250 but data of only 872 could be used

• Primary (Survey Method) and Secondary (Statutes, Policy, Report,
Judgment, Order, etc)

• Survey Questionnaire
Time Frame
The study has following three phases:
 First phase: gathering all policies, reports and action plans available
to develop an understating goals and intentions of the policy makers
and administration
 Second phase: identifying the samples, making questionnaires to
proceed with data collection
 Third phase: to analyze the data collected, critically examine and
write a report on all the aspects of rehabilitation of villagers in the
light of the order of the Hon'ble High Court in Writ Petition No 5663
of 2004.
Process of Data Collection
 Survey method through questionnaire used for data collection
 Questionnaire prepared by students under guidance from faculty
 One day survey conducted by students under faculty guidance
covering 1250 surveys
Data Analysis Process
 The data is analyzed through triangulation method.
 Combination of both qualitative and quantitative methodologies in
research to get reliable findings
 For quantitative methodology, survey carried out and data analysed
using SPSS and STATA
 For qualitative research, existing legal literature was analysed.

8. The Distrcit Collector of Palgarh

the Water Supplies Department of
the Zilla Parishad. On the basis of
this inspection, he was required to
submit a report to this Hon’ble
Court before 6th August, 2016.

Limitations
 The respondents themselves were not aware of many of the
required information
 76 houses were not occupied hence could not be interviewed
Ethical considerations
• Informed Consent: The surveyor interviewed the villagers
only after receiving informed consent and permission to fill
the form
• Voluntary participation: The researcher ensured that the
villagers were participative and gave responses on their own
free will

Rationale and Significance of the Study • State is morally and legally bound to provide rehabilitation including alternative livelihood to people displaced by government developmental projects • Rights of villagers of Akkarpatti and Popharan, Palghar Taluka, Thane District, Maharashtra, affected due to expansion of Tarapur Nuclear Power Plant Unit No. 3 & 4 • Writ Petition No. 5663 of 2004 filed by, petitioner, Tarapur Anushakti Prakalp Pidit Janta Samiti on behalf of Project Affected Persons before the Hon’ble High Court of Judicature at Bombay.
  • 3. Scope of the study • The survey was conducted in the villages of Akkarpatti and Popharan in the Palghar Taluka, Thane District. • The main focus of the survey was to gain information regarding the basic civic amenities in the villages.
  • 4. Objective of the Study  To survey and monitor the implementation of directions of this Hon'ble High Court in Writ Petition No 5663 of 2004  To understand the reasons behind the emigration of PAPs  To examine and assess the socio-economic background of the PAPs and the impact of the rehabilitation project  To submit the findings of the survey to this Hon'ble High Court  To present before this Hon'ble High Court suggestions of possible steps to alleviate the problems and issues faced by the PAPs
  • 5. Research questions  Whether the directions issued by this Hon'ble High Court in Writ Petition No. 5663 of 2004 have been implemented effectively?  What are the problems encountered by the stakeholders in the process of rehabilitation?  What is the socio-economic background of the PAPs before and after rehabilitation?  What is the state of supply of electricity, water and other amenities in the villages?
  • 6. Research questions • Whether adequate compensation has been given in the rehabilitation process? • Whether alternative employment has been provided in the rehabilitation process? • What is the condition of the infrastructure in the allotted houses?
  • 7. Universe of the Study and Sample Design Universe of the Study • Villages Popharan and Akkarpatti, Palghar Taluka, Thane District, Maharashtra • Sample design includes 1250 samples collected by interviewing families of the villages Sampling Procedure • Sampling Technique - Purposive/Judgement • Sample Size -1250 but data of only 872 could be used

Time Frame The study has following three phases:  First phase: gathering all policies, reports and action plans available to develop an understating goals and intentions of the policy makers and administration  Second phase: identifying the samples, making questionnaires to proceed with data collection  Third phase: to analyze the data collected, critically examine and write a report on all the aspects of rehabilitation of villagers in the light of the order of the Hon'ble High Court in Writ Petition No 5663 of 2004.
  • 10. Process of Data Collection  Survey method through questionnaire used for data collection  Questionnaire prepared by students under guidance from faculty  One day survey conducted by students under faculty guidance covering 1250 surveys
  • 11. Data Analysis Process  The data is analyzed through triangulation method.  Combination of both qualitative and quantitative methodologies in research to get reliable findings  For quantitative methodology, survey carried out and data analysed using SPSS and STATA  For qualitative research, existing legal literature was analysed.
  • 12. Compliance and Non Compliance of the Order SR. NO. REQUIREMENT COMPLIA NCE NON- COMPLIANCE REMARKS OBSERVATIONS 1. Public works department to make water supply available at the site on or before 20th October, 2004. - The scheme was not properly formulated and the villagers were not getting water. This was observed in order dated 11th August 2011. As per the date on which the survey was conducted, 58.6% of people receive water in Akkarpatti and 60.6% people receive water in Popharan. Approximately 40% villagers in each village are not receiving water. (On the day of the survey.)

Employment to PAP to be provided as per rehabilitation package of TAPP Unit no.1 and 2 - Majority of the villagers in either manual labour or other activities as they have not been given job opportunity by TAPP. - - 3. All the villagers in Akkarpatti and Popharan to vacate houses by 31st December, 2004 - Fishermen did not vacate their houses in Popharan village. As per As per order dated 11th February, 2005 -

Houses to be completed and handed over by 30th June, 2006. - The State Government to pay Rs. 2,500/- to the project affected families since houses not completed before 30th June 2006. By order dated 14th July 2006, the State is required to pay - 5. Court officer to send a report to the Registrar general once in week regarding conditions and progress in the allotment of the tenements. Starting from 9th October 2006 Complied - Compliance mentioned in 14th November, 2006 - 6. State government to file response regarding non-availability of water and electricity on 6th October, 2009 - No affidavit sworn in by State Non-compliance as per order dated 1st October, 2009 -
  • 15. Contd. 7. Relief and rehabilitation department of State government required to ensure adequate supply of water as per order dated 2nd September 2015 - 733 families in Popharan are not receiving adequate supply of water. Non-compliance as per order dated 18th July, 2016. Respondent to respond as per order dated 18th July, 2016 As per the date on which the survey was conducted, 40.6% of the allottees of Akkarpatti do not receive water; and 37.5% of the allottees of Popharan do not receive water. (On the day of the survey.) 8. The Distrcit Collector of Palgarh was required to conduct the inspection of water supply accompanied by an expert from the Water Supplies Department of the Zilla Parishad. On the basis of this inspection, he was required to submit a report to this Hon’ble Court before 6th August, 2016. Complied and found the shortfall in complying with the directions of the court with regard to the supply of water - Order dated 8th August, 2016. -
  • 16. Contd. 9. Allottees to have identification proof in the form of AADHAR Card/ Ration Card/ Pan Card. Complied - Majority of the persons have some form of identification proof either in the form of AADHAR card/ Pan Card or Ration Card As per the data collected, 74.92% of the allottees of Akkarpati have ID Proofs; and 73.2% of the allottees of Popharn have ID Proofs. (On the day of the survey.) 1 0. Allottees to have basic amenities such as supply of electricity Complied to an extent - - As per the data collected, 72.45% of the allottees of Akkarpatti, and 56.45% of allottees of Popharan have electricity. However, 27.54% of allottees of Akarpatti and 43.55% of allottees of Popharan do not have supply of electricity. (On the day of the survey.)
  • 17. Limitations  The respondents themselves were not aware of many of the required information  76 houses were not occupied hence could not be interviewed
  • 18. Ethical considerations • Informed Consent: The surveyor interviewed the villagers only after receiving informed consent and permission to fill the form • Voluntary participation: The researcher ensured that the villagers were participative and gave responses on their own free will
