This document discusses the Islamic scholarly perspective on organ transplantation. to ascertainthat the benefitsof thisoperationoutweighanyharmthatmay resultfromitand on the
conditionthatthisisdone to replace somethingthathasbeenlost,or to restore itsappearance or
regularfunction,orto correct some faultor disfigurementwhichiscausingphysicalorpsychological
distress.

Care shouldbe takentoensure thatthere isproperagreementtothe transplantof organ inthe
casesdescribedabove,onthe conditionthatnobuyingorsellingof organisinvolved.Itisnot permitted
trade in human organs underanycircumstances.
But the questionof whetherthe beneficiarymayspendmoneytoobtainanorgan he needs,or
to showhisappreciation,isamatterwhichis still underscholarlydebate.

It isHaram [Forbidden] totake anorgan on whichlife depends, like takingaheartor brain from
a livingpersontotransplantintoanother person.
It isHaram [Forbidden] totake anorgan from a livingpersonwhensocouldimpairanessential
vital function,eventhoughhislife itself maynotbe underthreat,suchas removingthe corneasof both
eyes.However,removingorganswhichleadtoonlypartial impairmentisamatter whichisstill under
scholarlydiscussion.
4. Whatdo the scholars of Islam say about transplant organs on which life doesnot depend?
It ispermissible to transplantorgansolongas the donationwill notleadtothe deathof the
donor.It isHaram [Forbidden] totransplantanorgan froma livingpersonwhenitsremoval maycause
an essential functiontochase,eventhoughhislifedoesnotdependonit,suchas takingthe corneas of
the both eyes.Butif he will still have partial functionafterremovingit,thenthe matterissubjectto
furtherdiscussionand remainsunderscholarlydebate.
Eliminatingharm
Eliminatingharmisone amongof the objective of shariah. Inthe contextof organtransplantation,this
procedure fulfilsthe purpose of preservinghumanlife.Allahpromisesgreatrewards.Allahsaysin
Qur’an;Surat-ul-Maeeda:
“And whoever saves one - it is as if he had saved mankind entirely” (Al-Qur'an) 5:32
Giventwosituationswithdifferentdegree of harmfulness.Priorityisgiventoavoidthe more harmful by
choosingthe lessharmful.Inthe contextof organtransplant,the more harmful situationistoallowthe
patientinneedof organtransplantationtopassaway.Therefore, underthissituation,the lesserharmis
givenhigherpriority,whichisdonatingorgansfroma deceaseddonortobe transplantedtothe patient
inneedof that organ. (Mimber,2015)

so,if these three conditionsare fulfilled,the scholarsayunderthese conditionorgantransplantcanbe
done.
